The Cri!e Against Persons" The cri!e of rape shall hereafter be classified as a
Cri!e Against Persons under Title #ight of Act $o" %&1'( as a!ended( otherise
)non as the Re*ised Penal Code" Accordingl+( there shall be incorporated into
Title #ight of the sa!e Code a ne chapter to be )non as Chapter Three on
Rape( to read as follos,
Chapter Three
RAPE:
Article 266-A. Rape: When And How Coitted.
Rape is Co!!itted -
1" -+ a !an ho shall ha*e carnal )noledge of a o!an under an+ of the
folloing,
a" Through force( threat( or inti!idation.
b" /hen the offended part+ is depri*ed of reason or otherise unconscious.
c" -+ !eans of fraudulent !achination or gra*e abuse of authorit+. and
d" /hen the offended part+ is under tel*e (10) +ears of age or is de!ented(
e*en though none of the circu!stances !entioned abo*e be present"
0" -+ an+ person ho( under an+ of the circu!stances !entioned in
paragraph 1 hereof( shall co!!it an act of se1ual assault b+ inserting his
penis into another person2s !outh or anal orifice( or an+ instru!ent or
ob3ect( into the genital or anal orifice of another person"
Article 266-!. Penaltie". Rape under paragraph 1 of the ne1t preceding article

shall be punished b+ reclusion perpetua to death"
/hene*er the rape is co!!itted ith the use of a deadl+ eapon or b+ to or
!ore persons( the penalt+ shall be reclusion perpetua to death"
/hen the rape is atte!pted and a ho!icide is co!!itted b+ reason or on the
occasion thereof( the penalt+ shall be reclusion perpetua to death"
/hen b+ reason or on the occasion of the rape( ho!icide is co!!itted( the
penalt+ shall be death"
The death penalt+ shall also be i!posed if the cri!e of rape is co!!itted ith an+
of the folloing aggra*ating45ualif+ing circu!stances,
1" /hen the *icti! is under eighteen (1&) +ears of age and the offender is a
parent( ascendant( step-parent( guardian( relati*e b+ consanguinit+ or
affinit+ ithin the third ci*il degree( or the co!!on-la spouse of the
parent of the *icti!.
0" /hen the *icti! is under the custod+ of the police or !ilitar+ authorities or
an+ la enforce!ent or penal institution.
%" /hen the rape is co!!itted in full *ie of the spouse( parent( an+ of the
children or relati*es ithin the third ci*il degree of consanguinit+.
6" /hen the *icti! is a religious engaged in legiti!ate religious *ocation or
calling and is personall+ )non to be such b+ the offender before or at the
ti!e of the co!!ission of the cri!e.
'" /hen the *icti! is a child belo se*en (7) +ears old.
7" /hen the offender )nos that he is afflicted ith 8u!an 9!!uno-
:eficienc+ ;irus (89;) Ac5uired 9!!une :eficienc+ S+ndro!e (A9:S) or
an+ other se1uall+ trans!issible disease and the *irus or disease is
trans!itted to the *icti!.
7" /hen co!!itted b+ an+ !e!ber of the Ar!ed <orces of the Philippines of
para-!ilitar+ units thereof or the Philippine $ational Police or an+ la
enforce!ent agenc+ or penal institution( hen the offender too) ad*antage
of his position to facilitate the co!!ission of the cri!e.
&" /hen the offender )ne of the pregnanc+ of the offended part+ at the ti!e
of the co!!ission of the cri!e. and
9" /hen the offender )ne of the !ental disabilit+( e!otional disorder and4or
ph+sical handicap of the offended part+ at the ti!e of the co!!ission of
cri!e"
Rape under paragraph 0 of the ne1t preceding article shall be punished b+ prison
mayor.
/hene*er the rape is co!!itted ith the use of a deadl+ eapon or b+ to or
!ore persons( the penalt+ shall be prision mayor to reclusion temporal"
/hen b+ reason or on the occasion of the rape( the *icti! has beco!e insane( the
penalt+ shall be reclusion temporal to reclusion perpetua.
/hen b+ reason or on the occasion of the rape( ho!icide is co!!itted ( the
penalt+ shall be reclusion perpetua.
Reclusion temporal shall also be i!posed if the rape is co!!itted ith an+ of the
ten aggra*ating45ualif+ing circu!stances !entioned in this article"
Article 266-C. Effect of Pardon. The subse5uent *alid !arriage beteen the
offender and the offended part+ shall e1tinguish the cri!inal action or the penalt+
i!posed"
9n case it is the legal husband ho is the offender( the subse5uent forgi*eness b+
the ife as the offended part+ shall e1tinguish the cri!inal action or the penalt+,
Provided, That the cri!e shall not be e1tinguished or the penalt+ shall not be
abated if the !arriage is void ab initio.
Article 266-#. Presumptions. An+ ph+sical o*ert act !anifesting resistance
against the act of rape in an+ degree fro! the offended part+( or here the
offended part+ is so situated as to render her4hi! incapable of gi*ing *alid
consent( !a+ be accepted as e*idence in the prosecution of the acts punished
under Article 077-A"
