Subject: Audio/Visual Record-Capture Digital Camcorders

A. Purpose

The purpose of this order is to establish policy and guidelines for electronic data
collection resulting from the use of body worn audio/visual camcorders (BWC).

B. Scope

This policy shall apply to all Florence Police personnel until such time it is
superseded, revoked, or rescinded.

C. Procedure

1. The purpose of the BWC is to provide an accurate unbiased audio/visual record of
enforcement related and non-criminal incidents that will enhance criminal
prosecutions and limit civil liabilities.

2. Department personnel may record activities when, in a Department members
judgment, it would be beneficial to do so. This includes probable cause for stops
and detentions, or any situation, condition, or event having a potential for loss of
life, injury, or damage to property.

D. Prohibitions

1. Department personnel shall not use the BWC to covertly record other police
personnel or a conversation that the officer is not party to.

2. Department personnel shall not use the BWC to record a particular person
based solely on the persons race, color, age, sex, marital status, sexual
orientation, gender identify, creed religion, ancestry, national origin or physical
disability. This prohibition is not intended to limit any of the following:

a. Incidental live monitoring of any person or object in view of the cameras when
the camera is operational on a permitted subject.

b. The camera is activated for the recording of a possible suspect, witness,
victim, or other person based upon reported information of a subjects actions,
description or characteristics.

3. BWC recordings shall only be downloaded to computers operated and maintained
by the City of Florence.

E. Data Management

1. Department personnel will download all recordings to a designated secure server
except for recordings of routine citizen contacts, routine traffic stops, and non-
criminal matters.

2. The designated secure server will be accessed and operated by authorized
personnel only.

3. BWC audio/digital recordings will be maintained on the secure sever until the case
has been adjudicated or otherwise disposed of in accordance with department
policy or section L5229 of the City Model Record Retention Schedule.

4. BWC recordings of DUI arrest will be maintained on the secure server in
accordance with KRS.189A 100, sections 2 and 3.

5. Digital copies for purposes not associated with the investigation or
prosecution of a violation of law will only be made and or created
subject to one of the following:

a. Permission from the Chief of Police or his designee;

b. Request by a Division Commander;

c. Required by court order;
