DEVELOPMENTS AFTER THE 2013 UNGA RESOLUTION
The Burmese authorities have failed to implement most of
the recommendations from previous United Nations General
Assembly (UNGA) resolutions, in particular Resolution
6!"#", adopted in "$%&' (n some areas, the situation has
deteriorated as a result of deliberate actions by the
authorities' This briefer summari)es developments on the
*round +ith direct reference to ,ey para*raphs of the
resolution'
The authorities have either failed or refused to protect
vulnerable populations from serious human ri*hts violations,
or pursued essential le*islative and institutional reforms,
effectively bloc,in* Burma-s pro*ress to+ards *enuine
democracy and national reconciliation' This has been partly
due to an assumption that the UNGA resolution +ill either be
canceled or severely +atered do+n as a trade.off for smaller
concessions'
/o far, "$%# has been marred by an overall climate of
impunity that has seen a resur*ence of media repression, the
on*oin* sentencin* of human ri*hts defenders, an increase in
the number of land o+nership disputes, and on*oin* attac,s
on civilians by the Tatmada+ in 0achin and /han /tates amid
nation+ide ceasefire ne*otiations' The human ri*hts and
humanitarian situation in Ara,an 1Ra,hine2 /tate has
deteriorated to the e3tent that a*encies are privately
describin* the situation as 4pre.*enocidal'5
FREE AND FAIR ELECTIONS IN 2015 IN DOUBT

Appendix II
Contradictory ceasefire talks between the regime and ethnic armed groups
Peace talks for a nationwide ceasefire agreement have encountered several stumbling blocks since talks began in
November 2013, following the formation of a 16-member coalition of ethnic armed groups:
1. Federalism is not on the table: The regime and the Tatmadaw have continuously resisted the demand for a
federal union and federal army, which would allow some autonomy and fair representation in the military.

2. The Tatmadaws unreasonable demands: The Tatmadaw has put forward their own prerequisites for
coming to the negotiation table. These demands, first voiced in April 2014, include:
To abide by existing laws: This requires the ethnic armed groups to disarm, putting them in a vulnerable
position, as there is no guarantee to stop attacks by the regime and the Tatmadaw. The Tatmadaw has
violated nearly all prior ceasefire agreements, including those signed during under President Thein Sein.

In
Mon and Chin States where there is no active conflict, troops have attacked civilians, including children.

To abide by the 2008 constitution: Reforming the 2008 constitution is essential to allow for the ethnic
armed groups central demand for a federal union, as the charter gives the central government full decision-
making power over all states and divisions. Other crucial issues are the provision that grants 25% of
parliamentary seats to the military (effective veto over constitutional amendments), and the provision that
allows the regime to claim and make decisions over natural resources and power-sharing in Burma.

3. Exclusion of ethnic groups: In August 2014, the regime indicated that it would only sign the ceasefire
agreement with 15 out of 16 members of the ethnic armed groups peacemaking team, and with two non-
member ethnic groups. Ethnic groups have compared this decision to the 1947 Panglong Agreement, which
also excluded several ethnic groups, and preceded the civil war that has continued until today.

4. Contradictions with the Tatmadaw: When the Tatmadaw put forward their six demands [See below, table]
in April, many of the ethnic armed groups said it would be impossible to negotiate further. Talks resumed at the
end of May after assurances that disarmament and acceptance of the 2008 constitution would not be necessary.
Yet, in August, Tatmadaw Commander-in-Chief Sr Gen Min Aung Hlaing reiterated the six demands to ethnic
leaders from Shan State, and declared the Tatmadaw would defend the 2008 constitution at all costs.

Children suffer most from the humanitarian crisis in Arakan State

30 March: A five-year-old boy in Thaechaung IDP camp in Akyab [Sittwe], Arakan State, died without
medical care after suffering post-appendix operation complications.

31 March: A one-year-old in Thaechaung IDP camp in Akyab, Arakan State, died without medical care after
contracting an infection and developing a fever.

1 April: A father of four in Thaechaung IDP camp in Akyab, Arakan State, died without medical care from
symptoms related to diabetes.

2 April: UN Office for the Coordination of Humanitarian Affairs (OCHA) said 15,000 children in IDP camps
in Arakan State had no access to psycho-social support, 300 acutely malnourished children in Akyab, had no
therapeutic treatment.

2 April: A joint World Health Organization (WHO)-UN statement announced that life-saving therapeutic
treatment for more than 300 children suffering from acute malnutrition had been suspended in Akyab, Arakan
State.

8 April: UNOCHA revealed that emergency medical cases were not being referred to hospitals in Arakan
State because NGOs could not obtain travel authorizations or hospital spaces for patients.

20 May: UNOCHA reported that in April, over 23,000 people in Arakan State lacked access to safe drinking
water and needed daily help from aid agencies.

17 June: It was reported that a two-year-old boy had died from diarrhea complications in a Rohingya IDP
camp in Arakan State, after his family was unable to find medical assistance.

1 August: The regime Health Ministry reported that out of 26 cases of Japanese encephalitis in Arakan State
in July, eight children had died: Four in Akyab Township, three in Ponnagyun Township, and one in
Taunggoat Township. A ministry official said it would not be possible this year to administer the vaccine that
prevents the disease.

13 August: An Akyab general hospital medical superintendent reported that two more people in Arakan State
had died from encephalitis in August, and that there were now 41 reported cases.

13 August: It was reported that in the last two months, nine children had died from meningitis at Akyab
general hospital.

20 August: UNOCHA stated that combined state and INGO efforts in July provided just 50% of the health
services provided in February 2014, before the expulsion of aid agencies in March.
