Chemical Waste Management, Inc. ("CWM"), through undersigned counsel, and upon
suggestingtotheCourtthat:

On October 13, 2014, the State filed a Petition for Temporary Restraining Order,
Preliminary Injunction, and Permanent Injunction against VESNA, Veolia ES, and CWM to
preventthetransporttoanddisposal inLouisianaofcertainincineratorashfromtheincineration
on October 10, 17, and 18, 2014, ofdecontaminatedmaterials associated withthe recentEbola
virusdiagnosesinDallas,Texas(the"IncineratorAsh").

OnOctober13,2014,aTemporaryRestrainingOrder("TRO")wasissued,directingthe
partiesasfollows:
a. "VESNAandVeoliaES beandare commandedto ceaseand desist any transportofthe
incinerator ash from the treated Ebola contaminated waste in Texas to the State of
Louisiana;
b. VESNAandVeoliaES beand are commandedtoapply for any applicablepermitsfrom
theStateofLouisianaandprovidetheStateofLouisianawithcopiesofall informationit

has regarding the material and the transport and treatment ofsame, including but not
limitedto,transportmanifest, treatmentprotocol, anytestingperformedonthematerials
includingtheresultsthereof, anypaperworksufficientto provethatthematerialsdonot
constituteorcontaininfectiouswaste, andanyandallcommunicationsorcorrespondence
fromotherfederalandstateregulatoryagenciesregardingthematerials,includingbutnot
limitedtoUSDOT,CDC,TexasDepartmentof Health;
c. VESNAand VeoliaES be and are commanded to provide a Ust ofTexas licensed and
permitted hazardous waste landfills authorized to dispose ofthe materials with whom
VESNA and Veolia ES may also beunder contract and to which the materials can be
transported andcontainedinthe StateofTexaswheretheEbolacontaminatedmaterials
originated.
d. CWMbeand is commandednottoacceptfor disposal ordispose ofanyincineratedash
orothermedicalwasteoriginatingfromEbolacontaminatedmaterials."

On October 21, 2014, through a Joint Motion, the parties agreed that a temporary
extension ofthe TRO would provide an opportunity to further discuss stipulations, consent
judgments, orotherterms and conditions thatwould ensure theprotectionofthe health, safety
and welfare ofLouisiana citizens and eliminate the need for a hearing onthe preliminary or
permanentinjunction.

Followingtheissuanceof theTROandthetemporaryextension,thepartieshavebeenin
discussionsregardingtheIncineratorAshandthetransportandtreatmentof sameandhavecome
tothemutual agreementthatthemosteffectiveandefficientresolutiontothismatteristhrough
theConsentjudgmentattachedhereto.

Therefore, the parties consent to and jointly move for the entry ofJudgment herein,
whichprovidesthattheIncineratorAshwillnotbetransportedtoordisposedofinLouisiana.
WHEREFORE,inaccordancewiththeforegoing, thepartiespraythatthisCourtgrant
thisJointMotionforConsentJudgment.

Thismatterhaving come before the Court by agreementbetween the Plaintiff, the State

claimsanddisputesinvolvedinthissuit,andstipulateandagreetotherenderingofthefollowing
judgment:
IT ISHEREBYORDERED,ADJUDGED,ANDDECREEDTHAT:
1. On October 1 0, 17, and 18, 2014, decontaminated materials associated with the recent
Ebola virus diagnoses in Dallas, Texas were incinerated at facilities owned and/or
operatedbyVeoliaES TechnicalSolutions, L.L.c. Incineratorashwas generatedbythe
incinerator(the"IncineratorAsh"),andtheIncineratorAshneedstobedisposed.
2. OnOctober 13, 2014, the State commenced this action seeking temporary, preliminary,
andpermanentinjunctivereliefto, inter alia, preventthetransportto anddisposalofthe
IncineratorAsh from Texas into Louisiana. This Courtissued the requestedTemporary
RestrainingOrder(<<TRO") onthesameday.
3. OnOctober21,2014,thepartiesagreedto atemporaryextensionoftheTROto provide
the parties anopportunity to discuss stipulations,consentjudgments,orotherterms and
,-
conditions thatwould eliminatethe need for ahearing onthe preliminary orpennanent
injunction.
4. The parties agree that the Incinerator Ash will not be transported to ordisposed ofin
Louisiana,andtheTROisdissolvedinallotherrespects.
