03/2011-12-Supply of Cutter Suction Dredger


SPECIAL CONDITIONS
1. Price should be quoted for the design, construction, supply and successful
commissioning of one number Cutter Suction Dredger as per Departmental
specification attached separately, including free service and trouble free
operational support during the warranty period. The rate should be inclusive
of all the taxes, duties, freight etc. The Departmental specification attached
is only the minimum requirement for the Cutter Suction Dredger. The
equipments, machineries, generator set, LSA, FFA etc whatever required to
meet MMD/IRS/any other classification society under Kerala Inland Vessel
Rules requirements at the time of delivery of the Cutter Suction Dredger
should be provided by the contractor at no extra cost than the accepted rate
in the supply order. The Dredger shall be constructed as per classification
society requirement.
2. The Cutter Suction Dredger should be guaranteed for a minimum period of
12 months /2000 working Hrs from the date of acceptance by department
officers which will be within 7 days of successful testing and commissioning
at site.
3. Operation, maintenance manuals, spare parts manual, trouble shooting
charts of equipments duplicate should be supplied along with a toolkit
required for normal routine operations of the Cutter Suction Dredger. The
details of the spares which will be issued at free of cost along with Cutter
Suction Dredger should be mentioned in your offer. The Contractor should
impart necessary training to the Department officials for the smooth
operation of the Dredger.
4. Approved test certificates and quality assurance certificates for all
equipments placed on vessels, along with warranty cards used in the Cutter
Suction Dredger may be produced along with the supply of Cutter Suction
Dredger.
5. Availability of all spares required for the engine and other equipments
indigenously should be guaranteed and that the product is not refurbished,
reconditioned or remanufactured is to be guaranteed.
6. If advance payment is insisted, the supplier should produce Bank
Guarantee for the equal amount. Final payment will be made only after
commissioning, acceptance of the Cutter Suction Dredger and handing over
to the department.
7. Security deposit (5% of total cost) and an Agreement will have to be
executed by the successful tenderer and the same should be valid till the
expiry of the guarantee period.
8. The firm should make free service at the site as per requirement during
warranty period.

9. The list of customers in India especially in Kerala should be mentioned in


the offer.
10. Cutter Suction Dredger should be insured by the supplier for its full value till
the date of taking over of the Cutter Suction Dredger by the Department,
against total loss/partial loss and other damages and accidents.
11. Trials should be witnessed by departments representative at the place of
delivery. The trial run should be arranged by the suppliers at their own
cost and then only acceptance letter will be issued.
12. Details of the supply of the Cutter Suction Dredger three numbers to be
provided for which the firm claims eligibility for supply to be provided.
13. Letter of reference on the performance of the Cutter Suction Dredger
previously supplied to be provided.
14. Whether the firm has made supply of Cutter Suction Dredger to any of the
Ports in India.
15. The firm should undertake a five-year maintenance contract with the
department after expiry of the warranty period and agreement executed in
this regard. The firm should quote separately for the AMC for the first five
years after the expiry of the warranty period.
16. The Dredger on completion should be delivered at Beypore port.
17. The construction of the Dredger should be completed in all respects as per
Departmental specification and as per the requirements of MMD/IRS/other
classification society before it is brought to the Ports.
18. The final trial runs are to be conducted only after getting necessary
certificate from the Departmental Officers, IRS/MMD/any other classification
societies that the Dredger has been constructed as per Departmental
specification.
19. The final trials are to be conducted at ports of delivery at the builder cost.
Any defects noticed during final trials are to be rectified at contractors cost.
20. The tenderer should include an EMD for Rs.8 lakhs in the form of Demand
Draft drawn from a nationalized bank in favour of Director of Ports,
Thiruvananthapuram payable at Thiruvananthapuram.
21. Following drawings should be submitted along with the tender.

ii) Mid-ship Section
22. Approval of Drawings:
The successful tenderer should submit within 6 months from the date
of work order. 3 copies of approved drawings (IRS/Classification societies)
as detailed in Section 18 of Technical Specification (T.18).
Details Refer in Section 18 of Technical Specification.

Changes/additions, if any will be suggested by the approving


authorities(IRS/MMD/any other classification societies) and this
Department. The tenderer has to carryout the same at no extra cost. The
fabrication of the Cutter Suction Dredger shall be executed based on the
approved drawings and specifications only.

23. Fee for scrutiny and approval of drawings by IRS/MMD and supervision of
the fabrication/inspection of the Cutter Suction Dredger will be borne by the
contractor.
24. Supply of Materials: the tenderer has to make their own arrangements for
procurement of required construction material, structural, machineries and
other equipments required for the fabrication of Cutter Suction Dredger. The
fittings and accessories procured by the tenderer and brought to the site will be
inspected by the inspecting authority authorized by the Department and only
after obtaining the approval, the fittings and accessories should be provided to
the Cutter Suction Dredger.
25. Materials Test: Materials used for construction shall be tested as per
marine practice and authenticated certificates should be produced to the
inspecting authority and the Department, by the builder.
26. Payment: the payments for the work will be made at different stages as
mentioned below:
1st stage payment: 20% Advance against Bank Guarantee along with work
order
2nd stage payment: 15% Hull Completion stage
3rd stage payment: 30% Completion of the Dredger

stage payment: 10% On delivery of the vessel at site

5th Stage Payment: 25% After successful, Commissioning, trial run and training
of staff for the vessel
27. Stage payment: The first stage payment shall be released only against
bank guarantee for the amount and shall be valid till the date of delivery and
acceptance of the Cutter Suction Dredger by the Department. In the event of
an extension of the delivery date, the validity of the guarantee shall be updated
fifteen days before the expiry date of validity. The Department will have the
option to en-cash the guarantee whose validity is not updated as mentioned
above.

28. Taxes and Duties: Rate quoted shall be inclusive of all taxes and duties
(Rate for tax shall be indicated).
29. Delivery: Cutter Suction Dredger shall be delivered to the Department
within sixteen months from the date of receipt of the supply order. The port of
delivery will be specified in this Work Order.
30. If there is any delay in delivery of the vessel, after the specified date,
penalty at the rate of Rs.1,000/- per day will be levied up to a maximum of 10%
of the contract value of the Cutter Suction Dredger and the amount will be
deducted from the stage payment made to the Contractor or from the deposit
available with the Department.
31. Insurance of Materials: The tenderer shall immediately upon granting of
inspection certificate to the effect that the tenderer is entitled to the stage
payments and before payment by the purchaser of the stage payments of the
contract at his own cost and expenses insure with an approved insurance
company against damage by fire and accidents in the name of the purchaser
(Director of Ports) the Cutter Suction Dredger and fittings thereof for the full
term of the contract or until date of delivery whichever is later and when the
work shall be so advance as entitled the tenderer to payment the subsequent
stage payment then and before receiving such stage payments, the tenderer
shall insure in like manner the work and materials for the full term of the
contract and additional amount of each such installment.
32. Ownership: The portions of the work, which have been completed and in
respect of which the payments have been made shall forthwith become the
property of the Government. But the Government shall not be liable for any
loss or damage by theft, fire, storm or weather otherwise as long as the
materials remain in the custody of the tenderer. In the event of such portions
of the work being found subsequently to be not in proper condition for any
reasons, the tenderer shall be bound to make good deficiencies and rectify the
defects found without any extra charge. The decision of the inspecting
authority on such matter shall be final and conclusive and shall be binding
upon the tenderer.
33. Inspection: The Cutter Suction Dredger will be inspected by the Director of
Ports or the Departmental officers authorized by the Director of Ports, Kerala
and the representative of the inspecting authority MMD/IRS/any Government
approved classification society/Registering Authority.
The Cutter Suction Dredger shall be fabricated strictly as per the
approved drawings under the supervision of inspecting authorities.
(a) No portion of the work shall be considered completed in accordance
with the terms of the tender until the inspecting authority shall have
certified in writing that it has been inspected and approved by him.
(b) If the inspecting authority found any work is not in accordance with
the tender, he is empowered to give the notice thereof and the
tenderer shall forthwith make defective work good, rectify or alter
the same at their own cost. Intimation of readiness of the Cutter
Suction Dredger for inspecting shall be given to the Director of Ports
and inspecting authority (IRS/MMD) at least 10 days in advance.

The arrangement for the inspection of the Cutter Suction Dredger at


any stage of the construction by the inspecting authorities will be
the contractors responsibility.
(c) All trials as in Technical Specification under Section 27 will be taken
by the inspecting authority IRS/MMD/any other classification
societies, Surveyor along with Department Officers authorized by
Director of Ports and issue note of inspection before acceptance of
the Cutter Suction Dredger.
34. Guarantee: The tenderer should give a written guarantee for a period of
one year against any defects in workmanship or design, defects to the engines,
machineries, equipments etc from the date of delivery. If any of the above said
defects found during the guarantee period, the tenderer has to make good at
his own cost at the place of operation of the Cutter Suction Dredger. If the
tenderer fails to do so, the work shall be executed by other agencies at the risk
and cost of the tenderer and the entire cost of the same will be realized from
the tenderer. The S.D(5%) will be released only after expiry of guarantee
period.
35. Escalation in cost of materials and wages: The variation if any, in the price
of materials at the time of actual purchase for the execution of the contract
including of sales tax and duties have to be borne by the tenderer. The
Department will not take any responsibility towards any increase in cost of
materials or labour. If there is any increase in cost of materials and cost of
labour the same has to be borne by the tenderer.
36. Validity of Tenders: The rates quoted by the tenderer shall be valid for six
months from the date of opening of the tenders.
37. Earnest Money Deposit: The E.M.D should be deposited in the form of
demand draft, drawn on any scheduled bank, in favour of Director of Ports and
payable at Thiruvananthapuram and should be submitted as stated in para 9 of
instruction to tenderers. SSI & NSIC Registered firm should produce the
attested copy of registration certificate for exception from EMD.
38. Agreement: An agreement in Kerala stamp paper (Rs.100/-) is to be
executed for the due fulfillment of contract along with the tender.
Tenders without Cost of Tender, E.M.D & Agreement will not be accepted
and the Director of Ports can reject any or all the tenders without assigning any
reasons.
