APD solutions s~earheaded the nsp program by going to different


counties in ga such as clayton, fulton, and dekalb etc. by
offering the cou~ty a way to use the nsp funds without giving the
money out to pGtential homeowner prospects. The are using the
abandoned buil8er subdivisions and stating they have to finish
the units when they are alreaay finished. They will use maybe 1
or 2 low income homeowner prospects and provide a free home. Upon
being stuck with the program funds. Dekalb county will list the
abandoned units ona tax sale under spa sonmons.nowever apd
solutions never purchased the property from the builder or paid
the tax sales, but dekalb county will change the name on the tax
record. Then they will remove the property from the tax sale
without verification that apd solutions paid the taxes, therefore
the tax lien still exist however it buys time for apd solutions
to pay tax sales or transfer deeds without the proper release
from the lender. One such community that the builder desisted on
is Panola Slope if you go to apd solutions website you will see

this. Dekalb County also changed the street names on the


properties to confuse anyone from trying to obtain the properties
from a tax salel One such property is 4902 johnnye way decature
ga 30035 parc41 id# 1600710006. This property was on the tax
sale for 04/01/~4 then it was removed upon apd solutions stating
that they own the property however on the tax sale a company
called dcd own~d the unit. The property was removed from the tax
sale upon apd folutions alerting the dekalb county that an
outsider wanted to purchase the unit. Dekalb county records the
taxes were pai~ by apd solutions without a receipt date on file.
Suddenly apd solutions paid all of the taxes due upon this unit
and the others. However, nsp funds expired for Dekalb county so
how are they still using the funds? How is it possible that
Dekalb county.have used a company like apd solutions to claim
these propertirs without this company getting any release from
the builders o~ lenders from the construction loans and then use
Dekalb county1to transfer tax records and claim these units
without mortgages. Then a~d solutions have family and friends
living in the units to spy an~ deter future residents from living
in the units. Dekalb county are allowing investors to register
these abandoned builder urlits in the county by changing tax
records because they themselves are adverse possessing the homes
in the county rithout utilizing the nsp funds to properly
administer th1 possession of these properties via purchase under
the stimulis funds provided to each county for the nsp program.
The question remains whatl happened to the millions of dollars
that were suppose to be used for the program, Also the former
commissioner is under indictment. One such county that used the
funds to purchase the properties from the builder/lender is
Newton county

a response and specific documentation on the situation that seems to be desc bed in the co plaint. Before I
respond I would like to assert that this property is one that is in the. company rtfollo and p rchased with
private funds. It is not a part of any government programs, including HUD,the tate of Gear a, or DeKalb
County. As such, I am responding as a courtesy.

required rehab. For Del<albCounty i\lSP,APDSdid purchase 6 homes at the Pirdmont Point ubdivislon,
Those 6 homes received nearly $200,000 of rehab. They were all sold to income eligible bu rs per NSP
guidelines and each buyer has received buying assistance with their purchase This is aneth r series of
misstatements from the complainant clearly designed to support their case, tit agaon, yet ore falsehoods.

As previously stated the Panola Slope project was acquired and rehabilitated using private apital not NSP
funds. Nor is it subsidized by any funding from DeKalb county, or any govern ent entity. It s correct that we
did not purchase Panola Slope from a builder because we purchased it from banks that h foreclosed on
the previous developer. It is well documented that we purchased this prope from Ameri Bank, State Bank
& Trust, and Decatur First Bank. It is also well documented that tis property s t for 5 years s an eyesore. It
was stripped of all major systems, vandalized, and home to homeless men. It is also well d umented that
the property has never received a certificate of occupancy, and APDShas sp t $4 million the property in

This complaint is directly tied to a squatter situation and the assertions in th complaint ar

I arrived at Panola Slope about 2pm and saw the blinds in the front, rear

I called 11 (see attached call sheet) and asked them to come to the comm

place. Street names and Subdivisions sometimes are changed and in this nstance bo h were changed, (see

from a tax ale. One such property is 4902 johnnye way decature
ga 30035 p reel id# 16 007 10 006. This property was on the tax
sale for 04~01/14 then it was removed uponapd solutions stating
that they o~n the property however on the tax sale a company
called d.cd~wned the unit. The property was removed from the tax
sale upon pd solutions alerting the dekalh county that an
outsider w nted to purchase the unit. Dekalb count'{ records the
taxes were paid by apd solutions without a receipt date on file.
Sudden IV apdsolutions paid aU of the taxes due upon this unit
and the ot~ers. However, nsp funds expired for Dekalb county so
how are thrY still using the funds? How is it pOSsiblethat
Dekalb COUey have used a company like apd solutions to clalm
these proPFrties without this company getting any release from
the buildeT or lenders from the construction loans and then use
Dekalb county to transfer tax records and claim these units
without m~rtgages. Then apd solutions have r.lmily and friends
IMng in th, units to spy and deter future restdents from living
in the un~. Dekalb county are allowing i!,!vestllrsto regi$ter
these abandoned builder units in the county by changing tax
records because they themselves are adverse possessing the homes
in the county without utilizing the nsp fullds to properly
administer the possession of these properties via purchase under
the stimulis funds provided to each county for the nsp program.
The question remains what happened to the millions of dollars
that were suppose to be used for the program. Aiso the former
commissioner is under indictment. One such county that used the
fundsto purchase the properties from the builder/lender is
Newton county
