Introduction

Social and economic well-being of the people is one of the principal objective
of present people government. Labor policy like policies in other field should
also aims in attaining the objectives in best manners. There is an urgent
need to revitalize the economy. The economy require sustained effort to
increase the level of productivity, promotion of investment and maximization
of employment. There is an equality genuine requirements to create among
workers and employer a better awareness of their obligations to the national
objectives. At the same time government recognizes that workers and
employers must enjoy reasonable benefits as can be sustained by the
economy without suffering set-backs. Keeping these priorities in view the
government consider that a balanced labor policy should be based on
objectives

Labor Legislation in Pakistan


The legislative framework governing organizations and employees can
considered to be the foundation of human resource management practiced
by the organization of a country. The quality of this legal framework
contributes to the competitiveness of a country on the labor front. The post
liberalization economic growth of Pakistan and the increased efforts to
attract international investments have invited attention to the existing labor
legislation framework in Pakistan. The general perception is that Pakistan
labor laws are inflexible and out of date with requirements of economic
growth. It is argued by the employers that if the rigidities of labor legislation
are taken away Pakistan can experience high economic growth.

Labor law in Pakistan


The constitution of Pakistan contains a range of provisions with regard to
labor rights found in part2 Fundamental rights and principles of policy.
Article 11 of the constitution prohibits all form of slavery, forced labor and
child labor.
Article 7 provides for a fundamental right to exercise the freedom of
association and the right t forms unions.
Article 18 provide the right of its citizens to enter upon any lawful
profession or occupation and to conduct any lawful trade or business.

Article 25 lays down the right to equality before the law and prohibition on
any discrimination.
Article 37 (e) makes provision for securing just and human condition of
work, ensuring that children and women are not employed in vocations
unsuited to their age or gender and for maternity benefits for women in
employment.
The labor policy has accordingly been divided into four parts

Legal Framework
The government is of considered view that an atmosphere of industrial peace
and understanding is the need of hour. It will protect right and interests of
worker and employers and minimizes the area of friction which compel either
of them
The government repealed the Industrial Relation Ordinance 2002 through the
Industrial Relation Act 2008. Now a new law in conformity with the
international labor standard will be promulgated. Section 27B of the
Banking Company Ordinance shall be repeated.

Wages
The government is committed to implement the system of minimum wage as
a fundamental element of labor protection and proposes to continue with the
existing minimum wage determination arrangements. An independent
National wage commission will be set up and government will establish a
working Group to make detailed recommendations for the purpose of specific
functions and operational arrangements for such a Commission including
technical and secretarial support requirements and its relations with
provincial wage fixing authorities.

Women worker

Women worker will benefit from the application of ILO convention on equal
remuneration, 1951(No.100), ratified by Pakistan in 2001. Minimum and
above minimum wages will be ensured on basis of equal pay for equal work,
and value, as between men and women, in accordance with Pakistans
obligation under ILO Conventions 100 and 111 concerned with equality and
non- discrimination respectively.

Child Labor
The government shall take legal as well as other measure to regulate and
control the employment of children in certain occupation and processes
consider dangerous for their health.

Health and safety


A Tripartite Council on Health and Safety be set up to identity health and
safety hazards for worker of all economic sector and to make
recommendations for safety measures on continuous basis.
