TENANCY AGREEMENT

BETWEEN

(LANDLORD)
AND

(TENANT)

THIS TENANCY AGREEMENT made the. day of..2012 BETWEEN

MR. of No 4, Lagos State (hereinafter referred to as the Landlord which expression shall
where the context so admits include his successors-in-title, personal representatives and
assigns) of the one part;
AND
a company registered under the Companies and Allied Matters Act, Laws of the
Federation of Nigeria with registered address at. (hereinafter referred to as the
Tenant which expression shall where the context so admits shall include its successor-intitle, personal representatives and assigns) of the other part.
THIS AGREEMENT WITNESSES AS FOLLOWS:
In consideration of the rent hereinafter reserved and the Landlords covenants
hereinafter contained on the part of the Tenant to be observed and performed, the
Landlord as Beneficial Owner HEREBY LETS UNTO the Tenant ALL THAT shop
space known as Shop No. AO75, Bauchi Lagos together with all its appurtenances
(hereinafter referred to as the premises) paying the sum of N100,000 (One
Hundred Thousand Naira Only) per annum TO HOLD the same unto the use of the
tenant for a term of 1 (one) year certain, , paying therefore the total sum of
N100,000.00 (One Hundred Thousand Naira Only) as the rent payable for the said
term of one year.
THE TENANT HEREBY COVENANTS with the Landlord as follows:
i.

To pay the Landlord or his appointed agent the rent in the manner hereinbefore
mentioned.

ii.

To use the premises for commercial purposes.

iii.

To comply and obey Rules and Regulations of all authorizes concern for maintenance
of peace and order in the community.

iv.

To bear, pay and discharge utility bills consumed on the premises from the time of
execution of this agreement.

v.

To keep the interior of the shop space including the decorations and doors thereof and
all the fixtures therein in good and substantial repair and condition and deliver up the
same to the Landlord (fair, wear and tear excepted) upon giving up possession of the
shop space.

vi.

To comply with any notice that may be given by the Landlord or his Agent requiring any
breach of any of the obligations on the part of the Tenant under the last preceding
clause to be made good

vii.

Not to do, permit, or suffer to be done anything in the shop space or building which
may be or known to be a nuisance or annoyance to the Landlord or any neighbour
thereof or affect the building as a block of commercial complex.

viii.

To adhere to the regulations provided by the Landlord.

ix.

To pay the solicitors fees for preparing the Tenancy Agreement and any other fees that
will be required in perfecting the agreement and expenses incurred by the Landlord for
preparing and serving notice on the tenants of any breach of any of the covenants on
the part of the tenant herein contained.

x.

To pay all such sums as may be reasonably agreed on along with other occupants of
the premises for the maintenance of the hygiene and security of the premises.

xi.

At the expiration or determination of the term hereby created or any extension thereof
to peaceably yield up and surrender to the Landlord the premises in such state of
repair, condition, order and preservation shall be in accordance with these presents.

THE LANDLORD HEREBY COVENANTS with the tenant as follows:


i.

That the tenant performing and observing all the covenants herein contained shall
quietly hold and enjoy the premises during the said term without interruption by the
Landlord or any person claiming through or in trust for him.

ii.

To indemnify the Tenant against all manner of losses, actions or claims which may
arise out of any defect in title or ownership on the premises from any person or
group of persons.

iii.

To be responsible for the external redecoration and repair any structural part of the
premises and to ensure the availability of power source and water on the premises.

PROVIDED ALWAYS and it is hereby expressly agreed and declared as follows:


i.

That the Landlord reserved the right to upward review of the rent and inform the
tenant in writing before the expiration date.

ii.

That a party who is not interested in renewing the tenancy shall inform the other
party in writing at least two (2) months before the expiration date.

iii.

That the Tenant, where Landlord in the event he intends not to renew the tenancy,
is entitled to one month notice to quit.

IN WITHNESS OF WHICH the parties have executed this agreement in the manner below the
day and year first above written.
