ORDER ASSESSING CIVIL PENALTY


On January 28,2013,you were advised through aNotice of Proposed Civil Penalty that the FAA
proposed to assess a civil penalty in the amount of $2,200.

After consideration of all of the avaiiable information, including the information you presented
the March 8,2013, informal conference, it has been determined that:

1)

On November 14,2072, you were a ticketed passenger, aboard GoJet Airlines


Flight 3662 dlblaUnited Express, operated under the provisions of 14 C.F.R.
Chapter I, Part 121 from Denver, Colorado (DEN) to St. Louis, Missouri (STL).

2)

During Flight 3662's above noted operation, after the cabin doors had closed and
prior to departure:

a.

A flight attendant (FA) began the safety demonstration;

b.

You became disruptive and verbally abusive;

c.

A FA repeatedly arurounced that all:

d.

i.

Portable electronics must be shut down; and

ii.

Carryon bags must be stowed away)

Despite the FA's above noted instructions, you:

i.

Failed to shut down and stow away yorr cell phone;

at

3)

ii.

Failed to stow away your carryon bag;

iii.

Continued to play games on your cell phone; and

iv.

Became more belligerent and verbally abusive during the FA's


continued efforts to get you to turn off your cell phone and stow
away your baggage.

Due to your continued disruptive and abusive behavior as specifically noted in


paragraphs 2(b) and 2(d) above:

a.

Flight 3662 aborted its scheduled take-off to STL;

b.

Flight 3662 rctumed to the gate;

b.

The Captain requested you be removed from Flight 3662;

4)

Your above-described actions constituted an unwarranted interference with the


duties and responsibilities of cabin crewmembers aboard an airc;aft..

5)

By reason of the foregoing facts and circumstances you violated the following
sections of the Federal Aviation Regulations:

a.

121.306(a), which states in relevant partthat no person aboard anafucraft.


being operated under Part I2l may operate any portable electronic device.

b.

121.580, which states in relevant part that no person may assault, threaten,

intimidate, or interfere with a crewmember in the performance of the


crewmember's duties aboard an aircraft being operated under Part l2l.

NOW, THEREFORE, IT IS ORDERED, pursuant to Title 49 U.S.C. 46301(a), and pursuant to


the settlement agreement between the parties, that you be and hereby are assessed a civil penalty
in the amount of $800.
We hereby acknowledge receipt of your check in the amount of $800, which we accept in full
settlement of this matter. You may consider this matter closed.
