OF

3.1

GENERAL DESCRIPTION OF CONTRACT


STAR TRADING COMPANY LTD. intends to establish a new VHP raw sugar refinery on
their concession area at Apapa in the Port of Lagos. Part of this project involves the
supply and installation of a dosing device for flocculant.

3.2

SCOPE OF WORK
Supply and installation of the dosing device at the new sugar refinery in Lagos, Nigeria
according to the design data mentioned in 3.3.
For the details concerning a possible installation next to the tank / on the tank please
see the attached tank drawing:

The dosing device must accompany following items
All internal and external components for complete operation
Industrial Ethernet Interface for communication with the factory DCS
Engineering for detailed design and detail dimension drawing
Painting of carbon steel items (colour according to RAL)
Documentation in English Language

The bid should include information to the following items:

Installed electrical power
Material properties
Delivery period
Detailed equipment drawings incl. dimensions and spacing
Brochures, reference lists etc.

All connections to be provided corresponding with ASME standards.


The equipment has to be supplied incl. CE-Certificate.
3.2.2

Exclusions:
The following are excluded from this contract:
a) Civil and Building works
b) Installation of foundation bolts
c) Grouting to underside base plates
d) Concrete plinths / bases for towers and trestles

3.2.3

Extras to the Contract


The Tenderer may be asked to quote on additional work should it be required by the
Employer. This work will be made known after award of tender.

Any works not specifically mentioned in the detailed scope of works, but deemed by the
supplier as essential to the successful completion of the works, should be included by
the supplier under this heading and brought to the attention of the employer.

3.3

DESIGN DATA AND SPECIFICATION


The dosing system / device has to be designed for a maximum dosing rate of 12 ppm
of flocculant powder on sugar solids.

The assembly of the equipment on site should be offered optional with a separate
price.
Spare part should be offered (optional) considering an operation time of two years.

3.4

GUARANTEES
The material guarantee period is 24 months after commissioning and latest 30 months
after delivery.

3.5

MATERIAL AND TERMINAL POINTS


A) Material: Stainless steel (AISI304L) for all parts in contact with medium.
B) Terminal point: Flanges on equipment connections.

3.6

GENERAL TECHNICAL COMMENTS ON EQUIPMENT TO BE SUPPLIED


The equipment offered is to be generally as indicated within the specifications.
The Contractor may submit alternative designs to that specified. Motivation for such a
proposal must be submitted with the tender.
The manufacturer will be made responsible for making the equipment work. If the
manufacturer detects design areas that can be improved on or that will make equipment
more functional, better quality or easier to manufacture, then these alterations must be
discussed with the design engineer first before the contract is signed and/or the
alteration is made.
It must also be noted that the equipment is to be of an extremely robust, sturdy design
capable of working in adverse conditions and based on a modular concept, enabling the
plant and equipment to be either modified and/or relocated at minimal expense in the
future.

Quality, product reliability and performance will not be substituted for price, although the
system design must be cost effective.
3.7

STANDARD SPECIFICATION AND OTHER RELATED DOCUMENTS


The latest revision of any specification, code of practice or standard referred to in this
technical specification shall apply.
Equipment, materials and operational methods shall in order of preference, comply with
the relevant SABS, ISO, BSS, DIN or equivalent American Standard whether prescribed
or not.
The scope of work as outlined above shall comply with the requirements of:
National Building Regulations and Building Standards Act of Nigeria.
Factories Act of Nigeria.
In support of these regulations but not replacing them, the following standards shall
apply.
Internationally accepted standards for machine guarding and conveyor guard rails, e.g.
N.O.S.A. in South Africa and the H.S.E. in the United Kingdom. (plus other from Europe
or Germany)
IPRO standard specifications related to steelwork, electrical and erection as well as any
other standard company specification that could have relevance to this enquiry will be
involved. These standard specifications are available from the offices of IPRO.

3.8

ENQUIRY DOCUMENT DRAWINGS

3.8.1

The Contractors Responsibility


Before manufacture of any part commences, the Contractor shall at his own expense
submit to the Engineer, for approval, two prints of any detailed drawings required. It is
important that these drawings are checked by the Contractor prior to submission for
approval. Further, they shall be marked Certified for Approval, signed and dated.
Further, these drawings are to be CAD drawn using AutoCAD 2007 and or microfilm
standard.

3.8.2

The Employers Responsibility


The Employer will review detailed drawings with respect to arrangement and general
conformance to the specification and related design details. Approval by the Employer
will not relieve the Contractor of the responsibility of completeness, accuracy of
dimensions, accuracy of structural sections to the design drawings, quantities and
details. Approved by the Engineer means approval in principle with respect to the
technical specs. One copy will be returned to the Contractor approved or with notations
requiring change within ten days of receipt.
In the latter case the Contractor shall make the required corrections at his own expense
and re-submit the drawings for final approval within five working days. Detailed drawings
must bear the stamp of approval of the Employer before fabrication commences.

3.8.3 Drawing Approval


The Employer will review detailed drawings with respect to arrangement and general
conformance to the specification and related design details.

One copy of the drawing will be returned to the contractor marked

In the case the drawing is marked A Approved, the Contractor shall re-issue the
drawing marked Certified for Manufacture, signed and dated.
In the case the drawing is marked B Approved with Comments, the Contractor shall
make the corrections noted on the drawing and re-issue the drawing marked Certified for
Manufacture, signed and dated.
In the case the drawing is marked C Not Approved the Contractor shall make the
required corrections at his own expense and re-submit the drawings for final approval
within five working days.
3.8.4

Final Drawings and As Builts


After approval by the Employer, the Contractor shall at his own expense, provide the
Employer with:

One C.D. disk of all the drawings on AutoCad 2007 programme.

They shall be marked As Built and be revised to show all changes during construction.
Final payment will only be made when these drawings have been received.

3.9

PAINTING COLOURS AND PAINT

3.9.1

Paint Colours (if applicable)


STAR TRADING COMPANY LTD. reserves the right to select the colour of the final paint
coat if this colour is material to the pricing of the tender then this will be furnished upon
request at the time of the tender.

3.9.2

Protection of new carbon steel (if applicable)


All steel shall be abrasive blast cleaned to Sa 2.5 of the Swedish International standard
150 8501-1:1998 with a blast profile of 40-60 microns.
Apply one coat zinc rich self etch primer.
Apply one coat universal undercoat.
Apply 2 finish coats enamel to client colour specifications of 60-80 microns, each.

3.9.3

Site Work and Touch Up


Touch Up:
All damaged areas shall be degreased and wire brushed.
Apply one coat universal primer.
Apply finish coat enamel to client colour specification.
Galvanised steelwork to be repaired with 1 coat of cold galvanising paint to
manufacturers specifications.

3.9.4

Shop test of equipment


The Contractor is to allow where possible for a shop test of the equipment in his works
before the equipment leaves for site.

A minimum of 2 weeks notice must be given that a test is to be conducted. Some of the
following personnel or their representatives are to be present at the test:

This test will be recorded on STAR TRADING COMPANY LTD. "Inspection Report"
forms and copies of the results will be given to all concerned.
Any defect observed during the test will result in the test being failed. These defects are
to be made good and the equipment re-tested.
NB: The complete system will still have to be inspected and passed before it is
accepted.
3.9.5

Access to contractors or subcontractors


The Engineer and any person authorised by him shall have access to the Contractors
workshop during manufacture, in order to assess progress and inspect all components
prior to dispatch to site. It will be the Contractors responsibility to notify the Engineer of
the intended date of dispatch so that inspection can be made prior to this. This will be
part of the Q.C.P. process which is detailed.

3.10

INFORMATION CONCERNING REGULATIONS & CONTROL OF SITE ACTIVITIES


Tenderers are to take note of the following information concerning the control of work at
site. All site works will be under the jurisdiction of the project manager. The Tenderer is
only to allow for supervision of the works as local labour will be installing the equipment
under this supervision.
The following is to be noted. The Tenderer must ensure that the local Contractor
complies with these regulations.

3.10.1 Safety of works


The whole of the works from commencement to completion are to be in the Contractors
charge, and he must provide the requisite watchman, properly reinstate all work, things
lost, damaged or stolen, and bear any expense that may be incurred.
The Contractor shall submit a register with all safety equipment. All lifting equipment to
be clearly marked and a separate register per item is to be filed. The Contractor must
ensure that he adheres to the Factorys Act at all times.
Periodic inspection of all equipment will be carried out by the Engineer or the designated
Safety Officer of the Employer.
Site Rules and Regulations
Issued separately by the Employer but forming part of this document are the Employers
site rules and regulations. If these rules and regulations conflict with or contradict any
other specification or regulation then these site rules will prevail.
3.10.2 Access to works on site
The Engineer reserves the right to open for inspection any concealed work which has
not been passed by him and the cost of such opening to be borne by the Contractor

except where proof of the notification by the Contractor to the Engineer to inspect can be
produced.
3.10.3 Setting out
The Contractor shall check and set out the works in accordance with the drawings
and/or as agreed to by the Engineer before foundation operations commence.
The Contractor shall amend, at his own cost, any errors arising from inaccurate setting
out from the drawings and/or instructions from the Employer prior to building operations
commencing.
The Contractor shall be responsible for checking all dimensions and detailing of the
existing structures on site. No claim for any extras resulting from his failing to do this will
be allowed. Dimensions given on general arrangement drawings should be taken as a
guide only and no drawings are to be scaled.
3.10.4 Protection of works
The Contractor will protect the works from inclement weather and rectify all damages
which may occur if the works are damaged.
3.10.5 Normal factory operations
Normal factory operations will continue during the construction of the proposed new
works. The Contractor shall therefore take all reasonable measures to minimise the
interruptions caused to the normal operations of the plant.
Every care shall be taken to ensure that:
1. As little as possible inconvenience is caused to STAR TRADING COMPANY LTD. Nigeria Management and Staff.
2. All STAR TRADING COMPANY LTD. -Nigeria regulations relating to the personnel
control & behaviour on site are adhered to.
3. No equipment is damaged in any way; and
4. New construction works, including movement corridors, are contained within well
defined areas.
3.10.6 Supervision of work
The Contractor shall provide a fully competent Foreman (in terms of the Occupational
Health and Safety Act of Nigeria) who shall be present at the works for the complete
duration of the period of the contract. The aforementioned Foreman shall act as agent
for the Contractor and any instruction given to him shall be considered to have been
given directly to the Contractor.
3.10.7 Existing services
Particular care must be taken to avoid damaging the existing services on the site.
Should the Contractor come across any services which are not shown on the drawings,
he must immediately notify the Engineer who will issue the necessary instructions
concerning what action is to be taken.
3.10.8 Allowance for all works
The Contractor must ensure that he is familiar with all the relevant details of this contract
document and the existing works on site.
The contract is to be a lump sum contract and the drawings and specifications have
been issued to enable the Contractor to calculate for himself the quantities, which he
considers, will be required to complete the work.

It will be assumed that the Contractor, from his own knowledge and experience, will
make provisions for any work or materials not fully specified. The tender for the works
shall be submitted together with complete specifications for any items which have been
included in the tender, but which have not been specified in the contract agreement.
3.10.9 Site facilities
Site Facilities Available
i) The Contractor will arrange with the Engineer and pay for all costs involved in the
provision of temporary services, site huts and other equipment. Power and water are
available on the site.
ii)The Contractor will locate his laydown area within the site in a position approved by the
Engineer.
iii) The Contractor is to make provision for, at his own cost and in locations approved by
the Engineer, adequate site toilets and washing facilities for the use of all persons
engaged on the works. Such portable conveniences shall comply with local authority
regulations and the Employers requirements and shall be maintained in a clean and
hygienic condition. The site shall be left in a clean, sanitary and tidy condition on
removal of these conveniences from site.
iv)

No persons will be allowed to sleep or erect living accommodation in the site area.
Arrangements for living accommodation must be approved in advance with the
Employers representative and all costs in respect of site accommodation are deemed to
have been included in the Contractors rates.
v)The Contractor shall take down and clear away all plant and temporary works
(including sheds etc) and make good. Remove all rubbish, debris and surplus materials
that have accumulated and at completion, clean all grass, scrub down, clean all floors
and/or paving and leave the work and site clean at completion and ready for immediate
occupation.
Site Security
All security matters relating to the site and the equipment and persons employed thereon
shall remain the responsibility of the Contractor during the contract.

3.10.10 Plant and equipment


The Contractors plant shall be in sound condition, fit for the purpose required and ample
in capacity for carrying out the work expeditiously.
Should the Engineer be of the opinion that the plant in use is unsuitable for carrying out
the works in a manner or at a rate commensurate with the requirements of the contract,
he shall have the right to call on the Contractor at any time during the progress of the
works to provide additional or improved plant as may be deemed necessary. All costs
incurred in this regard shall be to the Contractors
account.
3.10.11 Keeping of records
The Contractor shall keep on hand, protected from the elements, the following records:-

Engineers Site Instruction Books


This will record in triplicate instructions given by the Engineer or his representative. No
site instructions are to be accepted by the Contractor unless they are in writing and
signed by the Site Engineer.
Site Records
This will record weather conditions and delays for any reason.
Copies of Drawings
Must be kept on the site, properly protected, displayed and accessible at all times to the
Engineers.
3.10.12 Site Meetings
A minimum of one site meeting per fortnight will take place throughout the duration of the
contract period with times to be arranged at handing over of site. The Contractor will
attend these meetings in person. All other meetings or inspections by the Engineer and
Contractor, will require 24 hours notice.
3.11

FURTHER SITE CONTROL REGULATIONS


Notwithstanding the site control measures mentioned in paragraph 3.10, these regulations
add to but dont replace para 3.10
The Supplier undertakes to be represented by an authorized member of staff at any of
the site meetings convened.
Access to the sites and storage areas and the workshops shall at any time be granted to
the STAR TRADING COMPANY LTD. representative and/or the Site Management for
inspection of work.

3.11.1 The Supplier is obliged to designate a responsible resident engineer or chief erector.
Any changes in this function during the construction period require the prior approval of
the Contractor.
During the period of his work the Supplier must be represented at the site by at least one
person with the authority to make legally effective statements or to take same from the
Site Management. For all Labors/workers which are on site the evidence of qualification
and knowledge about the safety regulation is necessary. STAR TRADING COMPANY
LTD. requires to see and approve or reject the documents before permitting the Supplier
to start his work.
3.11.2 Preparation of the construction / erection site shall be arranged with the Site
Management. Should the Supplier not comply with any of these arrangements made, the
Site Management has the right to relocate the Supplier's equipment at the latter's cost
and without any prior warning. On Site there are no adequate storage areas available for
the Supplier. The Supplier shall provide the equipment/material just in time to the place
of installation. Any transport to the place of installation remains the Supplier's
responsibility.
Accommodations (including day rooms and sanitary facilities) for the supplier supervision
and personnel shall be provided by the Supplier. The location of such accommodations
and facilities shall be coordinated with the Site Management. Sketches showing the

proposed location of sheds or containers, including details on the required service


connections (electric power, water, telephone) shall be submitted to the Site
Management not later than 7 days before commencement of work.
Due observation of the fire fighting regulations prevailing at and around work places is
within the Supplier's responsibility and he shall himself take care of the required
measures and the provision of suitable means.
3.11.3 Should any of the official and legal regulations of STAR TRADING COMPANY LTD.'s
house and Site Safety Regulations to be observed by the Supplier be violated, the Site
Management may require that the infringing party/parties be instantaneously removed
and replaced. The same applies by analogy should the Site Management have justifiable
reservations as to the qualification of any of the Supplier's experts or supervisors.
3.11.4 The Supplier shall prepare a daily site / erection report which is to include the following
details:
3.11.4.1 The work performed by the Supplier; notes on measurements.
3.11.4.2 Number of the Supplier's resident engineers or chief erectors and/or supervisors and/or
workers present at the site on that particular day.
3.11.4.3 Any incidents at site and/or interruptions of work and/or delay.
3.11.4.4 Particulars of the weather situation on each workday (max. and min. temperatures,
periods and duration of precipitation, wind conditions etc.)
The site report shall carry consecutive numbers and be submitted to the Site
Management before the end of their working hours on each Thursday of the current
week.
3.11.5 Any accidents shall be reported to the Site Management without delay.
3.11.6 Company signboards must not be installed at site unless when agreed with the Site
Management. Should a common signboard be installed showing the companies involved
in the project the costs will be shared among the companies concerned on a
proportionate basis.
3.11.7 The Supplier shall protect his own facilities and/or equipment and/or tools and/or
materials etc. at his own expense. Any STAR TRADING COMPANY LTD. liability shall
be excluded.
3.11.8 Electric power, telephone lines and water can be made available up to STAR TRADING
COMPANY LTD. 's main distribution point.
The provision of any other power sources and agents (e.g. compressed air, welding gas
etc.) are within the Supplier's responsibility.
3.11.9 Waste produced by the Supplier's staff, e.g. debris, packaging material, containers,
residues that cannot be put to further use, shall be disposed of immediately and not later
however than once weekly, at the Supplier's expense and in compliance with the
governing official regulations. STAR TRADING COMPANY LTD. requires to see the
documents for a correct deposit. Should the Supplier not comply with his obligations
despite a reminder the Site Management has the right to have the material disposed of

at the Supplier's expense. Should the material to be disposed of originate from different
companies the costs incurred will be allocated at the discretion of the Site Management.
STAR TRADING COMPANY LTD. 's waste containers must not be used unless with the
express agreement of the Site Management. The original condition of any of the
premises or areas made available to the Supplier by the Site Management shall be
restored and turned over after complete performance of work.
3.11.10 Adequate lighting for his work areas are within the Supplier's responsibility.
3.11.11 STAR TRADING COMPANY LTD. is not obliged to take delivery of any goods that
should arrive at the site for the Supplier or his Subsuppliers during their absence from
the site. Should STAR TRADING COMPANY LTD. give his permission for the goods to
be unloaded, the Supplier will be informed at the earliest possible time. Acceptance of
goods shall be entirely non-binding in character. STAR TRADING COMPANY LTD. or
Site Management will neither check the delivery for correctness, nor will they be liable
for correct unloading and correct storage. The supplier shall reimburse any costs
incurred by STAR TRADING COMPANY LTD. as a result of taking delivery.
3.11.12 Any photographs taken at site require STAR TRADING COMPANY LTD. express
approval.
3.11.13 While performing work and while present at the site the Supplier shall recognize, and
duly follows the Site Regulations as a constituent part of the Contract.
3.12

QUALITY ASSURANCE, TESTING AND INSPECTION CERTIFICATES


Materials and Equipment
All materials and equipment used in the construction of the Contract Works and its
accessories are to be tested or inspected as has been specified in the standard general
specifications listed in Paragraph 3.5 above. The tests and inspections are to be
witnessed by the Engineer or his authorised representative.
Programme
A programme of tests and inspections to be conducted on all materials and equipment
within the scope of this contract is to be submitted to the Engineer for review at least 7
days prior to the commencement of the first test or inspection. The Engineer is to be
notified a minimum of 48 hours prior to the commencement, of any test or inspection.
These tests or inspections are to be covered by the appropriate certificates that have
been signed by all those present at the test or inspection. A representative of the
Employer may be present to witness all tests and inspections.
Quality Assurance Certificates
Quality Assurance certificates for materials of construction are to be lodged with the
Engineer before they are used.

3.13

QUALITY CONTROL AND Q.C.P

The purpose of an effective quality control system is to ensure that a systematic process
is carried out safely and in a co-ordinated manner. The procedure is applicable to all
contractors and shall be read in conjunction with the requirements of the contract.
The Contractor shall be responsible for the following or as stipulated elsewhere in the
contract: Organising and carrying out all equipment test and trials. These trials and tests shall
cover the requirements of the contractor, employer and engineer, as agreed in the
final contract document.
All applicable statutory tests and design code requirements and that the necessary
representatives of these agencies are present to witness these tests where
applicable.
Prior to contract commencing, the Contractor shall:Prepare an overall Quality Control Plan which is to be submitted for approval 14
days after awarding of contract.
On approval, the Contractor shall submit detailed quality control plans on each
aspect of work that is being performed. The control of these plans is the
responsibility of the Contractor.
Not proceed until the procedure has been reviewed and approved by the Engineer.

Note:

3.14

The Contractor shall:Designate sufficient representative of his staff to assume responsibility for the
complete control and supervision of all work within the scope of his contract.
Be responsible for and co-ordinate all obligations of his nominated sub-contractors.
Submit an organogram highlighting each individuals responsibility and department,
the inclusion of the Contractors Sub-Contractors is to be included.
Submit a register with all safety equipment. All lifting equipment to be clearly marked
and a separate register per item are to be filed. The Contractor must ensure that he
adheres to the Occupational Health and Safety Act of the Federal Republic of
Nigeria.
Periodic inspection of all equipment will be carried out by the Engineer or the
designated Safety Officer of the Client.

HANDOVER CERTIFICATES
All structural steel fabrication and erection works are to be handed over using the
appropriate handover certificate. The Engineer is to be notified a minimum of 48 hours
prior to commencement of any handover.
The purpose of handover is to demonstrate that all aspects of the structural steel
fabrication and erection function reliably in accordance with agreed plans and
specifications. The handover does not relieve the Contractor of his warrantee. This can
be a step by step handover. An exception list will be generated during handover that
must be attended to before handover is accepted.
Each handover will be organised by the Engineer and attended by some or all of the
following:

Every handover certificate will be signed by those present and it will be marked as to
whether handover was accepted or not.
A copy of every handover certificate is to be lodged with the Engineer.
Any handover certificate, with an exception list attached, has to be re-inspected before
handover is accepted.
3.15

MATERIALS AND WORKMANSHIP


All materials shall be new, undamaged, free of rust or other defects and shall be of the
best quality. Materials shall comply with the relevant specifications where applicable.
The contractor shall upon the request of the Engineer, furnish him with documentary
proof to his satisfaction that the materials are of the quality specified. Samples of
materials for testing, if required, shall be supplied by the contractor, free of charge.
The installation as a whole shall be installed in a professional manner, to the satisfaction
of the Engineer.

3.16

HOT COMMISSIONING
The Contractor is to include in his price for the hot commissioning of the equipment. The
Contractor is to rectify any faults that occur anywhere in the system so that it allows
product to dried and cooled in a smooth and proper fashion.
The Contractor will be guided by the Design Engineer as to where adjustments are
required. The Contractor is to make these adjustments as part of his scope.

3.17

OPERATING AND MAINTENANCE MANUALS


The Contractor shall prepare and supply manuals for the operation and maintenance of
the installation. A draft of the manual shall be submitted after commissioning for
approval. The draft shall then be corrected, if required, and two sets of the manual shall
be submitted before first acceptance of the plant will be taken.
These manuals shall contain the following information.
System Description
A comprehensive description of the system including schematic diagrams where
required for clarification, shall be included in this section.

Operating Instructions
a)
Pre-start checklist for each individual plant.
b)
Starting and stopping instructions.
c)
Plant running checklist.
d)
Safety precautions to be taken
e)
Manual operation
f)
Operators details

3.18

PROGRAMME AND KEYDATE SCHEDULE


A Programme detailing procurement, delivery, construction and handover key dates is to
be submitted by the Contractor.
On appointment, the Contractor shall forthwith prepare a detailed programme for the
contract representing units of work in sufficient detail to enable the Engineer to assess
the progress of the work at all times and to compare it with the programme.
The Contractor shall implement the programme and should any significant deviations
take place re-programme the works.
Copies of the programme, its supporting documents, together with all updates, shall be
provided for the use of the Employer.

3.19

RE-ROUTING OF SERVICES
Where services have to be temporarily disconnected, deviated or re-routed, such work
shall only be carried out with the approval of the clients representative and the Engineer
and in a manner approved by those persons.

3.20

CO-OPERATION WITH OTHER CONTRACTORS


Other Contractors will be appointed for implementation of other works. The Contractor
to this contract must undertake to work in close liaison with these Contractors under the
direction of the Engineer. This co-operation will be required to optimise time and avoid
delays.

3.21

NOTICE BOARD
No notice board is required.
