ORDER:
The respondent has filed a motion to reconsider and reopen. The record before us does not
contain a response from the Department of Homeland Security.
Immigration Review CASE records reveal that the respondent appeared at the window of the

Immigration Court at 2:30 p.m. on April 10, 2012, the hearing date. Given that this information
has not been previously considered by the Immigration Judge or the Board, we reopen
proceedings sua sponte.
FURTHER ORDER: The record is remanded to the Immigration Judge for further
proceedings consistent with this opinion and for the entry of a new decision.
