TheFinanceDepartmentoftheGovernmentofMaharashtrahad

imposedabanonrecruitmentinallthedepartmentssince1998.Inviewofthe
ban, the appointments were not made in Government and nongovernment
aided educational institutions which adversely affected the education of the
students. In20012002permissionwasgrantedtofill50%to2/3rd teaching
postsbutthepostscouldnotbefilledandintheacademicyear20022003,

education of the students, the Government of Maharashtra issued resolution
dated25thJuly,2002bywhichpermissionisgrantedtofill2/3rdteachingpostsin

employees by the Government by resolution dated 18th February, 2006. The

monthlysalaryofthesecontractualemployeeswasincreasedfromRs.8,000/to

the further period of two years. It is to be noted that the Government of

tocontinuetheservicesofthecontractualemployeesaftergivingfourtofive

days'breakuntilthecandidatesselectedthroughMPSCareavailableandthat
theGovernmentofMaharashtrahaddecidedtogrant30days'leavetothese

employeesandhadincreasedmonthlypackageoftheseemployees. These
factors show that the posts, in which these employees are appointed on

contractualbasis,arepermanentandfulltimepostsandtheservicesofthese
employeeswererequiredbytheGovernmentofMaharashtratodischargeits

constitutionalobligationofimpartingeducation.

ThecontentionoftheStateGovernmentastowhethertheposts

shouldbefilled onaregularbasisorcontractualbasisisapolicymatterand
cannot be within the domain of the judicial review of this Court is without

exploitation.TheState,asamodelemployerinawelfareState,is
notexpectedtotakeadvantageofitspositionandimposewholly

caseinconsonancewith rightandreason,intendedtosecure
socialandeconomicjusticeandconformstothemandateofthe
great equality clause in Article 14. This principle is that the
Courtswillnotenforceandwill,whencalledupontodoso,strike
down an unfair and unreasonable contract, or an unfair and

principlelaiddowninthecaseofCentralInlandWaterTransportCorporation

policyandfallswithinthedomainoftheGovernmentofMaharashtra(employer),

undisputedthatthepetitionersareselectedaftertheprocedureforselectionis

followedandthroughthedulyconstitutedSelectionCommitteeasconstitutedby

petitionerswereselectedandallinterestedcandidateshadappliedfortheposts
forwhichthepetitionersareselected.Thus,itcannotbesaidthatthepetitioners

fortheselectionforthepostsinwhichthepetitionersareworking.

appointmenttoanyofficeundertheState.Themainobjectof
Article 16 is to create a constitutional right to equality of
opportunity and employment in public offices. The words
"employment" or "appointment" cover not merely the initial
appointmentbutalso otherattributesofservice likepromotion
and age of superannuation etc. The appointment to any post
undertheStatecanonlybemadeafteraproperadvertisement
hasbeenmadeinvitingapplicationsfromeligiblecandidatesand
holding of selection by a body of experts or a specially
constituted committee whose members are fair and impartial
throughawrittenexaminationorintervieworsomeotherrational
criteria for judging the inter se merit of candidates who have
applied in response to the advertisement made. A regular
appointmenttoapostundertheStateorUnioncannotbemade
without issuing advertisement in the prescribed manner which
may in some cases include inviting applications from the
employmentexchangewhereeligiblecandidatesgettheirnames
registered.Anyregularappointmentmadeonapostunderthe
StateorUnionwithoutissuingadvertisementinvitingapplications
fromeligiblecandidatesandwithoutholdingaproperselection
wherealleligiblecandidatesgetafairchancetocompetewould
violate the guarantee enshrined under Article 16 of the

women,representativehavingtechnicalknowledge,amemberwhobelongsto

backwardclassesandthePrincipalofthePolytechnicInstitutionconcerned.
The Lecturers who are appointed in the Private Polytechnic

Institutions after selection through the School Committee are appointed on


contractualbasisasShikshanSevakfortheperiodofthreeyearsasperthe
policyoftheGovernmentofMaharashtraincorporatedintheresolutiondated
27thApril,2000.Itisnotindisputethattheselectionprocessthroughwhichthe
petitionersareselectedismuchlessstringentthantheselectionprocessofthe

andfollowingregularprocedureofselectionshouldnotbetreatedatparwith
theircounterpartsinthePrivatePolytechnicInstitutions.Weareoftheviewthat

thepetitionerscannotbediscriminatedvizaviztheircounterpartsworkinginthe
PrivatePolytechnicInstitutions.WeareconsciousthattheLecturersworkingin

theGovernmentInstitutionsformadifferentclassthantheLecturersworkingin
thePrivateInstitutions.However,whenallotherserviceconditionsaresimilar,

weareoftheviewthatthepetitionersarealsoentitledforthesamebenefitsas
theircounterpartsworkinginthePrivatePolytechnicInstitutionsareentitledas

farastheconfermentofregularizationandpermanencyareconcerned.

One morefactthatneedstobetakenintoconsiderationisthat

evenaccordingtotherespondentStatetherearemorethan5000teaching
postswhicharestillvacantandtheadvertisementissuedbytheMPSCisonly

for400posts.Itcan,thus,beclearlyseenthatevenafterthecandidateswho
wouldbeselectedthroughtheselectionprocessconductedbytheMPSCare
available,morethan4500postswillbevacant. Itis,therefore,clearthatthe
petitioners'absorptionwouldinnowayaffectthecandidateswhowouldnowbe

selectedthroughtheMPSC.Itis,thus,clearthatthepetitioners'continuationin
service would not adversely affect the fundamental right guaranteed under

Article16tothecitizens.Weareoftheconsideredviewthattherespondent
State having extracted the work from the petitioners for years together, the
