PRIVATE COMMUNICATIONS BETWEEN
JAMES LEUENBERGER, PLAINITFF EDWARD SNOOK, AND
JUDGE THOMAS T HULL

Defendant moves this court to place into the official record this Judicial Notice.
A. Jan, 28, 2015, after hours Defendant Swan received an email from James
Leuenberger.
B. This email was sent from James Leuenberger with his client Edward Snook
copied.
C. This is self evident that James Leuenberger and Judge Hull, have this type of
communication on a regular basis.
D. This email shows no sign of any apprehensive position from Leuenberger to
email the Judge.
E. There is no concern by Leuenberger that he could possibly upset the Judge
Hull or be reprimanded by Judge Hull for breaking the rules.

F. The fact that the Plaintiff Ed Snook is included in this email, proves there is
no concern from Leuenberger about getting in any sort of trouble by Judge
Hull for this misconduct.

G. It is self evidence that Leuenberger made a serious mistake and copied

Defendant Swan in this email too.

H. January 29, 2015, The email on the previous page is the response that was sent
from Judge Hill to James Leuenberger.
I.

Leuenberger made a mistake by sending this email to the wrong email

address .

J. This email was sent to Judge Hill out of Linn County Court House.
K. Judge Hill addresses this mistake in the email, corrects Leuenberger and
reminds him that this type of communication is not allowed.
L. Leuenberger responded to Judge Hill out of Linn County by saying, sorry.

I, Deborah Swan, certify that the certifications are true and correct based on my
reasonable knowledge, information, after making of such inquiry as is reasonable
under the circumstances. I certify that this document is not being presented for any
improper purpose. I certify that all allegations or other factual assertions so
identified are supported by evidence.

I Hereby certify that on 24th day of February, 2015, service was made by sending
by email , James Leuenberger a true copy of the Judicial Notice .

M. The FACT is that Leuenberger sends private emails to Judge Hull.

N. The Fact is that Leuenberger made a mistake and sent the message to the
wrong judge.
O. Judge Hill is not Judge Hull.
P. Therefore Judge Hill responded and reminded Leuenberger that this type of
communication is not allowed.
Q. Jim Leuenberger attempted to send this private email to Judge T. Hull, with his
client Ed Snook attached.
R. These emails were sent back to Leuenberger with both the Defednant Swan
Plaintiff Ed Snook copied.
S. Leuenberger has not copied Defendant Swan on any further communications.

T. Defendant Swan does not feel like she will receive a fair hearing due to all
these actions by the court , and the opposing side.
