MOTION TO CONFIRM EXTENSION OF VALIDITY

OF CERTIFICATE OF PUBLIC CONVENIENCE
COMES NOW the undersigned applicant, to the Honorable Board,
most respectfully states that:
1. Applicant is a Filipino corporation duly organized and existing under the
laws of the Philippines;
2. It is a grantee of Certificate of Public Convenience to operate a TH
freight truck service under the trade name ALITAGTAG FREIGHT
SERVICE, INC., within CABUYAO LAGUNA and from said place to any
point of LUZON accessible to motor vehicle traffic and vice versa with
the use of four (4) units which Certificate expired on JANUARY 9, 2013;
3. Subsequently, it filed application for extension of validity of a Certificate
of Public Convenience to operate a TH Freight Truck Service which was
granted by the Honorable Board in a Decision dated October 3, 2013.
The dispositive portion of which reads as follows:
WHEREFORE,

by

virtue

of

Section

16(a)

of

Commonwealth Act No. 146, as amended, and Executive

Order No. 202, dated June 19, 1987, this Board hereby
APPROVES the aforesaid application. Let a Certificate of
Public Convenience previously issued to herein applicant is
hereby EXTENDED to operate a TH freight service within
CABUYAO LAGUNA and from said place to any point in

LUZON accessible to motor vehicle traffic and vice versa

with the use of four (4) units,

The Certificate of Public Convenience issued by virtue

of this decision shall be valid and subsisting only for a period
of up to January 9, 2018. (emphasis supplied)
4. Herein Applicant as a grantee was given relative restrictions of
confirmation due to the fact that the existing units should be substituted
by newer ones;
5. However, it is undeniable that such restrictions to confirmation would
readily hamper catering of public service given the swelling population
and

tremendous

expansion

of

business

establishments

within

CABUYAO LAGUNA that demand the hauling of greater volume of

products and goods, not only in the said territory but all other areas of
Luzon accessible to motor vehicle traffic and vice versa with the use of
the aforementioned units;
6. There is no other better alternative to meet the extreme need for haulers
than to utilize the said units which the Applicant undertakes to be in
good condition and roadworthy during its operation;
7. Applicant shall meet the finances and all other responsibilities incident to
the operation of TH freight truck Service and to comply with all the legal
requirements necessary to cope with the demand for a common carrier.

PRAYER

WHEREFORE, premises considered, it is most respectfully prayed

of this Honorable Board TO CONFIRM extension of validity of Certificate
of Public Convenience dispensing the relative restrictions of the four (4)
truck units until January 9, 2018.
Other forms of relief just and equitable in the premises are
respectfully prayed for.
