CONTRACT OF LEASE
KNOW ALL MEN BY THESE PRESENTS:
This Contract of Sublease made and executed this ______ day of December
2014 at Quezon City, Metro Manila Phillipines, by between:
DOMINGO M. ONG, of legal age, Filipino citizen and residing at 963 Del
Monte Avenue, SFDM, Quezon City, hereinafter known and referred to as the
SUBLESSOR;
-andVICTOR CRUZ FELICIANO, Jr., of legal age, Filipino citizen and residing at
#26 Molave Street, South Green Park Village, Tandang Sora Avenue, Quezon City,
hereinafter known and referred to as the SUBLESEE;

WITNESSETH:
WHEREAS, the SUBLESSOR is the LESSOR of the whole Real Estate property
with improvements located at Lot 13, Blk. 1, Congressional Avenue corner Clarion
Lily Street, Brgy. Bahay-Toro, Pugad Lawin, Quezon City;
WHEREAS, the SUBLESSEE is interested to Lease the 2 nd floor of the
mentioned property and the SUBLESSOR is willing to lease the same to the
SUBLESSEE.
Now, therefore, for and in consideration of all the foregoing premises,
covenants and agreements herein provided, the SUBLESSOR hereby leased the
subject premises unto the SUBLESEE under the following stipulations, Terms and
Conditions:
1. TERM the term of this contract of lease is One (1) year starting January
01. 2015 up to December 01, 2015.
(1.1) That the Monthly Rental shall be Thirty Five Thousand Pesos (Php
35,000.00) net of withholding tax as required by the BIR. That upon
signing hereof the SUBLESSEE shall pay the monthly rentals in TWELVE
(12) post dated checks of Php 35,000.00 each check to complete his
rental.
2. That the SUBLESEE hereby expressly acknowledges that the leased
premises are in good tenantable condition and agrees to keep the same in
such good condition. The SUBLESEE shall have the right to introduce
improvements on the leased premises at his own expense with prior
written consent of the SUBLESSOR and the same shall pertain to the
SUBLESSOR after the lease shall expire.
3. Electric bills, telephone, water and other utility services in the leased
premises shall be at the expense of the SUBLESSEE; all repairs in the
utility services shall be at the expense of the SUBLESSEE.
4. The SUBLESSEE has the right to assign, transfer, convey or in any way
encumber his contract of lease over the leased premises or any portion
thereof under any circumstances whatsoever.
5. After his lease has been terminated for any reason whatsoever, if the
SUBLESSEE continue the occupation of the premises with the consent of
the SUBLESSOR, said extension of lease shall be understood as running
from month-to-month only, under the same terms and

conditions herein stipulated, and maybe terminated by either party by
means of a written demand or notice served upon termination;
6. If the leased premises is not surrendered at the end of the term/period or
upon termination thereof, the SUBLESSEE shall be responsible to the
SUBLESSOR against all claims made by succeeding tenants against the
SUBLESSOR resulting from the delay of the SUBLESSOR in delivering the
possession of the premises to such succeeding tenant in so far as such
delay is occasioned by the failure of the SUBLESSEE to surrender the
premises.
7. Any violation of the terms and condition of this lease shall automatically
terminated the contract and the premises shall be vacated by the
SUBLESSEE for the SUBLESSOR to hold and enjoy as if no agreement had
been entered into and shall be lawful for the SUBLESSOR or any person
duly authorized in his behalf without any formal notice or demand to enter
into the premises or any party hereof without prejudice on the part of the
SUBLESSOR to exercise any or all right from this contract of lease and
those given by law;
8. There shall be a penalty on overdue accounts at the rate of 5% per month
until the rentals are updated. The parties herein agree that at any given
time, the rental payments shall not be delayed for more than two months,
or equivalent to the deposit. Thereafter, notwithstanding any subsequent
payment of the SUBLESSEE, the SUBLESSOR shall have the option to
terminate this lease contract for cause.
9. The SUBLESSEE shall maintain the leased premises in a sanitary and
habitable condition at all times. All ordinary repairs shall be for the
account of SUBLESSEE.
10.All movable furniture and equipment, including fixtures that may be
removed without necessarily causing damage to the building or structure
may also be removed by the SUBLESSEE at the termination of this
contract. The building, fixed structures and improvements made by the
SUBLESSEE on the leased premises shall be turned over to the
SUBLESSOR without any obligation on the part of the SUBLESSOR to pay
or reimburse the cost thereof.
11.The SUBLESSEE shall not engage in any illegal and unlawful activity such
as prohibited drugs and illegal gambling.
12.That the SUBLESSEE has the right to assign, transfer or encumber his right
under this Contract of Lease.
13.If the SUBLESSEE shall at any time during validity of this contract, lock or
otherwise, abandon the premises for more than THIRTY (30) DAYS without
leaving any person therein and without notifying the SUBLESSOR in
writing that he is coming back, the SUBLESSOR may automatically declare
the lease contract terminated and take immediate possession of the
leased premises without any responsibility on the part of the SUBLESSOR
for anything the SUBLESSEE may claim to have lost in the premises which
shall be considered gratuitously abandoned and left by the said
SUBLESSEE for the exclusive benefits of the SUBLESSOR.
14.OTHER PROVISIONS In case of the failure on the part of the SUBLESSEE
to comply with any of the foregoing terms and conditions of this Contract
of Lease, the SUBLESSEE hereby gives and authority to the SUBLESSOR or

to any of his authorized representative to take possession of the leased


premises including all its improvements thereon without compensation to
the SUBLESSEE in the presence of any Barangay Official or Peace Officer
and without necessity of resulting to any court decision. In which case, the
SUBLESSEE shall be duty advised in writing of its failure to comply with
the terms and conditions of the Contract of Lease by way of reminder
before takeover.
