1.0

Safety Specifications

1.1

General

1.2

Responsibility for Safety


The Contractor shall be responsible for the safety of all operations in
connection with the Contract and shall take all necessary actions to
ensure the safety of all persons who may be in, on or adjacent to the
Site.

1.3

Compliance with Acts And Regulations


The Contractor shall comply with the Workplace Safety and Health Act
(hereafter referred to as "the Act" for the purposes of this clause
including all sub clauses under it) and its Subsidiary Legislations
including the Workplace Safety and Health (Construction) Regulations
referred to as "the Regulations" for the purposes of this clause
including all sub clauses under it) and any amendment or re-enactment
thereto and including but not limited to:
1.3.1 Any other rules and regulations, Malaysian Standards and
Codes of Practices related and relevant to the promotion of safe
practices and conduct at the worksite.
Prior to the commencement of the Works, the Contractor shall
first obtain all relevant Certificate or Registration, under
Malaysian Regulatory Authorities.

It shall be the duty of the Contractor to comply with all such
requirements of the regulatory Safety acts and all its Subsidiary
Legislations, as affects him or any person or persons employed
by him, and as related to any work, act or operation performed or
about to be performed by him. The Contractor shall not permit
any person to do anything not in accordance with the generally
accepted principles of safe and sound practices.
The Contractor shall ensure a safe environment on the site at all
times. All safety provisions shall be properly maintained and shall
not be removed. The Contractor shall ensure that necessary and
sufficient precautions are taken by his workmen when safety
provisions are used. The Contractor shall not allow any of the
safety provisions to be used unless he has satisfied himself that
the provisions are safe.
The Contractor shall prepare drawings; details and calculations
for all temporary structures as required, certified by his
Professional Engineer and submit for approval at least one week
before the commencement of the Works unless otherwise
specified. The Contractor and his Professional Engineer shall
ensure the adequacy and sufficiency of the safety provisions.
Where any person appoints a professional engineer to carry out any
work under the Workplace Safety & Health (Construction Regulations
for any temporary works specified below, the professional engineer
shall comply with any duties imposed on him under those regulations:
a) Cantilevered platforms erected more than 3m above ground;
b) Formwork structure that
i) exceeds 9 meters in height;
ii) consists of any form work which is supported by shores
constructed in 2 or more tiers; or
iii) consists of any formwork where the thickness of the slab or
beam to be cast in the formwork exceeds 300 millimeters,
c) Chutes exceeding 12m in height
d) Runway and ramp for use of motor trucks or heavy vehicles;
e) Removal of any column, beam, floor or other load bearing structure;
f) Stability of structure adjacent to excavation;
g) Piling, shoring and bracing for trench excavation > 4m; and
h) Stability of structures adjacent to piling.
Duties on professional engineers undertaking temporary works
regulated under all current Malaysian Health and Safety Regulations:
a) Design it to acceptable codes and standards and in accordance
with good engineering practices;

b) Provide design documentation to the person constructing the
temporary work to facilitate the construction of it according to the
design drawings, including all relevant calculations, drawings and
construction or erection procedures;
c) Ensure that it is constructed accordance with his design;
d) When it is constructed, satisfy him that it is safe for its intended use
and if so, issue a certificate stating that it is safe for its intended
use;
e) The professional engineer shall exercise due diligence when
carrying out his duties; and
f) No temporary work shall be used unless a certificate has been
issued in respect of it.
The Contractor is deemed to have allowed in the Contract Sum for all
cost and expenses for the safety provisions and for all additional cost
that may arise from amendments to the Act and its Subsidiary
Legislations or changes in the requirements of Malaysia regulations
and regulatory bodies and other relevant authorities.
The Contractor shall ensure that the requirements of the Regulations
and the requirements specified hereunder are strictly complied with at
all times. Any amendment or re-enactment to current safety acts, shall
take precedence over the contract.
1.4

Undertaking by Occupier*/ Contractor


The Contractor shall undertake to ensure that the provisions of the
Workplace Safety and Health Act and the Workplace Safety and
Health (Construction) Regulations and any amendments or reenactments thereto are complied with. The attached safety provisions
undertaking form for the Occupier/Contractor in Appendix A shall be
complied by a Managing Director of the company/firm awarded the
Contract.

1.5

Site Safety Programme


The Contractor shall submit a safety programme to the CA within 14
days from the date of the Letter of Acceptance prior to the
commencement of the Works. The relevant safety equipment and safe
method of work employed at each stage of construction shall be
described in detail. Special risks involving specialised equipment shall
also be highlighted. The programme shall also include company safety
policy, risk assessment, safety rules and regulations, small group

activities, safety cycle activities, safety promotion programme (safety
slogans, safety campaign, slide shows etc), safety training, emergency
procedures and other such activities. The safety programme must be
displayed outside the site office. The Contractor shall display safety
posters at the site office, site canteen, exit/entry points of buildings and
passenger cum material hoist area.
1.6

Monthly Safety Review


The Contractor shall carry out a monthly safety review of the measures
contained within the safety programme to demonstrate that the
required level of safety are being achieved and maintained and make a
full report to the Contract Administrator (CA) on each such review. The
CA will review the safety programme from time to time and will advise
the Contractor of any matter with which he is not satisfied and the
Contractor shall take such steps as are necessary to satisfy the CA.
The CA will carry out such safety studies or audits, as he considers
necessary. The Contractor shall make available, specialist personnel
as the CA may consider necessary for the performance of such safety
studies or audits.

1.7

Permit To-Work System


Contractor shall implement a Permit-to-Work System for types of work
as stated in the Construction Regulation which comprises the
followings;
Excavation and trenching work exceeding 1.5m in depth;
Tunneling work;
Lifting operations involving mobile or crawler crane;
Work on a scaffold where person is liable to fall a distance of more
than 2m;
Demolition work;
Work in any confined space; and Piling work.
No work shall be carried out except under a permit-to-work issued by
the person who has overall control of the project on-site (The
Contractors Project Manager).

1.8

Lock-out & Tag-out System


Contractor shall implement lock out and tag out system in accordance
with the requirement as stipulated under the Code of Practice 91: 2001
lock out Procedure. The purpose of the lock out / tag out procedure is
to prevent personal injury and property damage due to the start-up of
electrically driven machinery and equipment that is under repair or
upon which maintenance is being performed. This procedure also
applies to energy sources that are mechanical, air, hydraulic and
thermal, or to spring-loaded devices.

1.9

Risk Management
1.9.1 The contractor shall conduct a risk assessment in relation to the
safety and health risks posed to any person who may be
affected by his undertaking prior to the commencement of work
in accordance to the Workplace Safety & Health (Risk
Management) Regulations.
1.9.2 The contractor shall take all reasonably practicable steps to
eliminate any foreseeable risk to any person who may be
affected by his undertaking.
1.9.3 The contractor shall maintain a record of risk assessments
conducted, including any control measures taken or to be taken
and any safe work procedures.
1.9.4 The contractor shall ensure that his employees are informed of
the nature of the risk involved, the measures implemented to
control the risk and applicable safe work procedures. Whenever
the assessment of a risk is revised, or where control measures
or safe work procedures are changed, employer shall inform
employees of such changes.
1.9.5 The contractor shall incorporate the time frame required for risk
assessment to be developed into the master/monthly work
program and shall ensure that his employees are informed of
the nature of the risk involved, the measures implemented to
control the risk and applicable safe work procedures prior to
commencement of work.
1.9.5 The contractor shall review and if necessary revise the risk
assessment at least once every year and forthwith if, there is an
occurrence of any injury or illness as a result of exposure to a
hazard, or there has been a significant change in work practices
or procedures.

2.1

Site Safety Measures


Physical Measures
2.1.1 Metal Access Scaffold And Working Platforms
The Contractor shall provide, erect and maintain metal access
scaffold for all building blocks. This requirement may be waived,
where industrialized or semi-industrialized method of
construction together with peripheral safety nets is employed.
Under such case, there shall be no adjustment to the Contract
Sum. The Contractor shall allow free use of the scaffold by all
contractors, sub-contractors, specialists, artisans and other
tradesmen employed by the Employer or the Contractor.
An approved scaffold contractor registered with approval
authorities shall be contracted to erect, alter or dismantle
any metal scaffold above 4 meters in height (including the
handrails, mid rails, guard rails and their supports at the
uppermost of the scaffold). All scaffolds and any
component shall be erected, altered or dismantled by
qualified scaffold erectors, under the immediate
supervision of a qualified scaffold supervisor. The scaffold
and its components shall only be dismantled and removed
after the CA has given his permission.
The metal access scaffold shall be of the type approved by the
MOM. It shall comply with the Factories (Scaffolds)
Regulations and the CP 14: Code of Practice for Scaffolds.
The metal access scaffold shall be pre zinc galvanized or other
approved by the CA.
The metal access scaffold and any components therein shall be
designed according to the Factories (Scaffolds) Regulations
and the CP 14: Code of Practice for Scaffolds by a PE
employed by the Contractor. The Professional Engineer's
drawings and calculations shall be submitted for approval by the
CA before the erection of the scaffold.
The scaffold shall be erected ahead of the structural work
(including the construction of water tank rooms) from the second
storey and supported by cantilevered platforms erected
according to the Drawings of the PE. The cantilevered platforms
shall project about 1.1 m from the edge of the building or any
other distance. The scaffold shall be erected within 300 mm

from the building edge. Where the structure does not allow the
scaffold to be erected from the second storey or where the
building is less than 12.0m in height, the Contractor may erect
the scaffold from the first storey subject to review by CA.
The Contractor and his PE shall ensure that the building
structure can resist the load imposed by the scaffold. The
scaffold shall be designed to carry metal working platforms and
two working levels in use concurrently. The maximum average
loading per working level per bay is 220 kgf per m2. Signboards
showing the maximum loading allowed on the scaffold shall be
displayed on the scaffold.
The Contractor shall provide, erect and maintain continuous
galvanized metal work platforms or other types of work platforms
as approved by the CA at every alternate lift starting from the
2nd lift of the scaffold, the immediate level below the top most
level and the roof level of the building block under construction.
Where the height between the work platform at the roof level
and the platform directly below is two lifts or less, the latter work
platform may not be necessary subject to the approval of the
CA. No omission from the Contract Sum shall be made in the
event that such a work platform is not necessary.
The material used for the metal work platform shall be
galvanized steel and comply with local regulations. Work
platforms shall be adequately secured to scaffolding frames at
the required levels. The connections between work platform and
scaffolding frame and between the work platforms shall be
subject to the approval of the CA. For any portion of the work
platform where the use of metal is not suitable, the Contractor
may use timber platform subject to the approval of the CA. The
platform shall be complete with at least 90 mm high coloured toe
boards and metal guardrails at least 1.1 m above the work
platform.
The work platform shall be at least 500mm in width. The
platform shall be used for:
a) Erecting and dismantling of formwork of structural elements;
b) Transferring of formwork or other materials from one working
level to another; and
c) External finishing works.

The Contractor shall provide, erect and maintain an overlying
screening net to cover the entire external face of the scaffold.
The installation of the net shall follow the erection of the scaffold
closely. A 90mm high coloured toe board shall be provided at
the base of the net. After installation, there shall be no opening
between separate sets of the net and any torn net shall be
replaced or repaired immediately. The net shall comply with the
following requirements:
a) Maximum mesh size (square): 15mm
b) Twine No. : Minimum 350D
c) Knot type: single or English knot
d) Minimum 12 ply
The scaffold shall be effectively tied to the building structure by
means of tie- backs. All tie-backs shall be painted with bright
colour for easy identification.
For buildings next to built-up areas having a height of more than
16 storey and less than 30m away from the Site boundary, the
Contractor shall provide special mid-height platform supporting
metal access scaffold at the building elevation directly facing
public areas, walkways, children playgrounds, schools and other
locations with public traffic.
The special mid-height work platform shall be installed from the
floor level at the mid height of the building and shall project 6m
from the edge of the floor. They shall be supported at the floor
level below by diagonal members. Tension tie backs to upper
floors shall not be used.
Around the edges of the 6m platform, guardrails and toe boards
shall be provided. Guardrail shall have sufficient strength and
rigidity to withstand, without permanent deformation or failure, a
50 kg loads applied in any direction at right angles to the
guardrail.
The work platform and its supports shall be designed by a PE to
a uniformly distributed live load of 1.5 KN per m2 and the
loading from the scaffold. Supports for platform shall be spaced
at not more than 1.8m centre to centre unless approved by the
CA. The PE shall satisfy himself that his proposal shall not
unduly overload the RC structure.

2.1.2 Personal Protective Equipment
The Contractor shall provide and maintain suitable personal
protective equipment for all workmen employed on the Site. The
Contractor shall ensure that such personal protective equipment
comply with the requirements of the Regulations on Personal
Protective Equipment. The Contractor shall also ensure that all
equipment is properly used by his workmen during the course of
their work. The Contractor shall record the issuance of all
equipment to his workmen in the prescribed forms and such
forms shall be kept in the site office and made available for
inspection at all times. The colour code of safety helmets
provided by the Contractor shall comply with the Workplace
Safety & Health (Construction) Regulations.
2.1.3 Safety (Anti-Fall) Net

The Contractor shall provide and maintain a safety net system to


catch person(s) falling whilst working at any location where he
would be liable to fall.
The safety net system used should be the approved type. The
Contractor may propose an alternative system, to be certified by
his PE and submitted for review by the CA.
The safety net shall comply with MS requirements or other
approved standards. The net shall be of sufficient size and
strength to catch any person for whom the protection is to be
used and the net shall be so located to cover the area of the
possible fall.
The Contractor shall conduct a sample test on the safety net
system, comprising the net and its supporting structures, before
it is installed. Subsequent tests shall be carried out when
directed for the CA.
For all building blocks of four storeys and above, a peripheral
safety net system shall be provided. Initially the net shall be
installed at the second storey. As construction progresses, it
shall be repositioned to follow the topmost working level but
shall be kept at not more than 6.0m below it.
Where access scaffolding is used or any others alternative
safety measure used, a peripheral safety net system is not
required.

The colour of the safety netting shall be the approved type.
Safety netting of orange colour shall not be used unless such
colour is specifically decided by the CA at the Contractors cost
and expense.
2.1.4 Working Platforms For Lift Shafts, Central Refuse Chute And
Voids
The Contractor shall provide working platforms, according to the
design of his Professional Engineer, for the erection of lift shafts
and void walls except for central refuse chute. The lift shaft and
central refuse chute platforms shall effectively cover the voids at
alternate storey.
The lift shaft, central refuse chute and void wall platforms shall
be left in place.
2.1.5 Overhead Shelters
The Contractor shall provide, erect and maintain overhead
shelters at every point of entry/exit of buildings two or more
storey in height. The overhead shelters shall be constructed
immediately below the second storey. The overhead shelters
shall project at least 3.0m from the building edge and shall be at
least 1.5m wide. The overhead shelters shall be made of curved
metal roofing with a diameter of at least 1.5m or pitched metal
roofing with a slope greater than one in two, with timber
boarding below supported by steel pipes resting on rigid bases.
The overhead shelter shall be designed by a PE in accordance
to the relevant statutory requirements. The Professional
Engineer's drawings, detailing and calculation shall be submitted
to the CA.
The access to, along and egress from the entry/exit points shall
be kept free from obstructions and accumulation of oil, grease,
water and other substances that may cause slipping and
tripping.
Overhead shelters shall also be provided for person(s) exposed
to falling objects.
2.1.6 Peripheral Overhead Shelters
The Contractor shall provide peripheral overhead shelters for
buildings of 15.0m or more in height. It shall be erected in place
when the construction reaches the fourth storey slab. The

overhead shelter shall be at least 2.0m wide, and inclined so
that the outer edge is at least 150mm higher than the inner
edge. The overhead shelter shall be sufficiently strong to
support a weight of at least 75 kg point load.
2.1.7 Barricades to Lift Openings, Voids, Open Sides Of Buildings
And Excavations
The Contractor shall barricade all lift openings, internal voids,
open sides of buildings and excavations where a person is liable
to fall. The barricade shall be at least 1.1m high with mid rail &
guard rail and shall have sufficient strength and rigidity to
withstand a lateral point load of 50 kg.
2.1.8 Suspended Scaffolds
An approved scaffold contractor registered with the
appropriate authorities and shall be contracted to install,
reposition or dismantle any suspended scaffold. All
suspended scaffolds and any component shall be installed,
repositioned or dismantled by qualified suspended scaffold
riggers, under the immediate supervision of a qualified
suspended scaffold supervisor.
A suspended scaffold system shall only be used for touching up,
repair and redecoration and minor work. Where suspended
scaffold system is to be used, the Contractor shall first obtain a
Certificate of Registration under the Workplace Safety & Health
(Registration of Factories) Regulations from MOM and a written
approval from the CA prior to its installation and usage. The safe
working load will be prominently displayed. All users of
suspended scaffold shall be trained by the supplier before use
with training records kept on site. The suspended scaffold
system shall comply with the Factories (Scaffolds) Regulations
and the CP 20: Code of Practice for Suspended Scaffolds. The
Contractor shall ensure that there are weekly checks and
additional check after inclement weather by the suspended
scaffold supervisor, monthly check by PE (Civil) and 6-monthly
testing and inspection by a MOMs approved authorized
examiner. Test certificate, maintenance certificate, inspection
records by suspended scaffold supervisor, authorized examiner
and the authorized operators shall be properly documented,
kept on the Site and produced for inspection by the CA. Where
the use of access scaffolding is not stipulated, suspended
scaffold may be used for finishing works. Independent lifelines
shall be provided for suspended scaffold riggers and users to

anchor their safety harness attached with shock absorbing
device.
2.1.9 Enhanced Hoarding
Where the buildings under construction are more than 6 storey
and less than 30m away from the Site contract boundary within
or next to build-up areas, the Contractor shall provide a 6m
hoarding with an overhead shelter. The design and position of
the enhanced hoarding shall be submitted to the CA. The
hoarding shall be cleared away upon the instruction of the CA.
2.1.10 Tower Cranes And Other Tall Construction Equipment
No person shall install, repair, alter or dismantle a tower crane
unless he is an approved crane contractor. An approved crane
contractor shall obtain a manufacturers manual which contains
instructions on the safe procedures for the installation, repair,
alteration and dismantling before he installs, repairs, alters or
dismantles any tower crane. An approved crane contractor shall
ensure that the crane is installed, repaired, altered or dismantled
in accordance with the instructions contained in such manual.
Where the manual is not available, an approved crane
contractor shall install, repair, alter or dismantle any tower crane
under the immediate supervision of an Authorized Examiner.
Approved crane contractor shall ensure, so far as is reasonably
practicable, that the tower crane is erected, installed or modified
in such a manner that it is safe, and without risk to health, when
properly used.
The Contractor shall comply with all height restrictions on the
use of tower crane or other tall construction equipment, as
imposed by the Civil Aviation Authority of Malaysia and Ministry
of Defense. In addition, the height clearance of tower crane or
other tall construction equipment shall be submitted to the CA
for approval before they are brought to the Site. Force limiting
device, speed limiters and moment limit switches shall be
installed for all cranes.
The Contractor shall submit detailed layout drawings and safety
requirements of the tower cranes to governing authorities and
the CA for approval at least one month prior to their installation.
The slewing radii of the tower cranes shall not overlap, unless
the tower cranes are equipped with slewing limit switches and
their jibs are at different levels. The slewing limit switch shall be
activated to stop the slewing action before the jib slews into the
overlap zone.

The jib of a tower crane shall not be allowed to slew outside the
contract boundary lines without the written approval of the CA.
The free standing mast of the tower crane must be certified by
the Contractor's PE prior to its use on the Site.
The Contractor shall submit detailed drawings and calculations
on the type of foundation support and the tie-back for the tower
crane that are duly endorsed by the PE, together with technical
information to the CA for approval. The Contractor's PE shall
certify that the free standing height of the mast is structurally
adequate and sound before the tie-back is installed. No tower
crane shall be installed and supported on the constructed RC
structure of a building without prior approval by the CA.
The contractor shall ensure daily checks are carried out by
operator. The maintenance shall be carried out in accordance
with the manufacturers instructions, and the requirement as
stated in the CP 62 : Code of Practice for Safe Use of Tower
shall be followed. Testing and inspection by Authorized
Examiner must be carried out every 6 months. Test certificate,
maintenance certificate, inspection records by operators,
Authorized Examiner shall be properly documented, kept on the
Site and produced for inspection by the CA.
2.1.11 Mobile Cranes
No person shall install, repair, alter or dismantle a mobile crane
unless he is an approved crane contractor. An approved crane
contractor shall obtain a manufacturers manual which contains
instructions on the safe procedures for the installation, repair,
alteration and dismantling before he installs, repairs, alters or
dismantles any mobile crane. An approved crane contractor
shall ensure that the crane is installed, repaired, altered or
dismantled in accordance with the instructions contained in such
manual. Where the manual is not available, an approved crane
contractor shall install, repair, alter or dismantle any mobile
crane under the immediate supervision of an Authorized
Examiner. Approved crane contractor shall ensure, so far as is
reasonably practicable, that the mobile crane is erected,
installed or modified in such a manner that it is safe, and without
risk to health, when properly used.
The Contractor shall submit layout and details of the crane
access to the CA prior to the use of the crane on the access.

The Contractor shall ensure that the crane access is properly
constructed and weekly crane access check carried out by site
engineer or project manager.
The Contractor shall keep all records of inspections of the crane
access at the Site and produce them for examination when
requested by the CA. The boom of the mobile crane with hoisted
load shall not be allowed to swing outside the contract boundary
without the review by the CA. All hoisting areas must be
effectively barricaded.
The Contractor shall ensure there is installation of barriers to
warn the crane operator of depressions, excavated areas and
other obstructions.
Moment limiters shall be installed for all cranes. The Contractor
shall station a lifting supervisor on the Site to oversee and guide
the crane operator during positioning, hoisting and slewing. The
cranes shall be tested by an "Authorized Examiner" before being
use on the Site irrespective of any valid test certificates. The
Contractor shall ensure daily checks are carried out by the crane
operator. The maintenance shall be carried out in accordance
with the manufacturers instructions, and the requirement as
stated in the CP 37: Code of Practice for the Safe Use of Mobile
Cranes shall be followed. The cranes must have overhaul
checks before being used on the Site. Testing and inspection by
Authorized Examiner must be carried out every 6 months. Test
certificates, overhaul certificates, maintenance certificates,
inspection records by the crane operators, Authorized Examiner
and the Contractor's site engineers shall be properly
documented, kept on the Site and produced for inspection by
the CA.
2.1.12 Access for the Use Of Mobile Crane And Piling Machines
Next to Built-Up Area
Where the Contractor uses mobile cranes and piling machines
on the Site the access. The access shall be constructed
according to the approved Drawings and maintained in a good
condition at all times until the substantial Completion date or
TOP whichever is later. The access shall be inspected by the
Contractor's PE prior to its use and weekly check shall be
carried out by supervisor.

2.1.13 Lifting Gear
The Contractor shall ensure that every item of lifting gear that is
brought onto site, including that accompanying hired in cranes,
lorry loaders, excavators, cement buckets, air receivers, skips,
welding sets etc. has a currently valid certificate of test and
examination by an authorized examiner, as required under the
Workplace Safety and Health (General Provisions) Regulations,
and is plainly marked with its SWL. The contractor shall make
arrangements for all items of lifting gear to undergo a visual
inspection by a competent person at least once a month with
record update in register and any item found to be no longer of
good construction and free from patent defect is to be discarded
and removed from site. A monthly colour coding system is to be
adopted. When not in use the contractor shall ensure that all
items of lifting gear are stored in a rack sheltered from weather.
All lifting gears are to be inspected by Lifting Supervisor before
issued from the store.
2.1.14 Temporary Chute for the Removal Of Construction Debris
The Contractor shall provide adequate number of temporary
chutes to dispose construction debris from the upper storey of
all building blocks. It shall be erected to follow the structural
work. A large bin at the lower end of each chute shall be
provided and emptied regularly. "DANGER - KEEP OUT" in the
four official languages shall be posted at the bin area. The chute
can be a proprietary system or fabricated on Site. The
Contractor shall submit detailed drawings and calculations duly
endorsed by the PE to the CA.

2.1.15 Warning Signs and Lights


The Contractor shall display warning signs of sizes 900 mm x
600 mm at strategic points around the periphery of the Site
where trespassing is likely to occur. Such signs shall have the
words "DANGER - KEEP OUT" in the four official languages
painted in red on a white background in gloss finishing paint.
Warning lights shall be placed at similar positions at night to
serve as warnings.
If work is carried out near public roads, all signage shall comply
with the recommendations of the Temporary Road Signage
Manual issued by the Land Transport Authority.

2.1.16 Housekeeping
The Contractor shall maintain and ensure a safe working
environment by keeping the Site neat and tidy, and free from
hazards and debris. Materials shall be stacked up safely. All
workstations and access thereto shall be kept free from hazards
and debris.
Housekeeping shall be carried out in such a manner and at such
times so as not to cause any inconvenience to either the
adjoining owners, occupiers or the public. Debris shall be wetted
to minimize the risk of dust. Containers for debris and rubbish are
to be provided at the designated places.
2.1.17 Temporary Staircases
The Contractor shall provide and maintain a minimum 0.8m wide
temporary metal staircase from one working floor to another. The
staircase shall be placed against the adjacent staircase wall or
formwork of the staircase walls that are under construction. The
outer sides of the staircases shall be provided with metal
handrails and mid rails 1.1m above the outer staircase strings.
The bottom of the staircase shall be covered fully with metal
plate.
The Contractor shall engage a PE to design the staircase. The
Professional Engineer's drawings, detailing and calculations shall
be submitted to the CA before the construction of the staircases.

2.1.18 Safety Information Signboard and Assembly Stage


The Contractor shall erect and maintain a Safety Information
Signboard and Assembly Stage. The signboard shall be 6.0m x
3.0m, made of timber plywood and fixed at a steel frame. The
signboard shall consist of safety posters, safety theme and
pictures, safety news, photos of good safety measures, names of
site safety equipment and machinery suppliers. The safety
posters, news and photos shall be protected from weather.
The arrangement and size of display of all items referred herein
shall be submitted to the CA. The stage shall be constructed in
front of the signboard and made of concrete. The stage shall
consist of a raised platform of 4.5m x 1.0m with at least one step.

The signboard and stage shall be designed in accordance to the
relevant statutory requirements by a PE. The Professional
Engineer's drawings, detailing and calculations shall be
submitted to the CA.
The location of the signboard and stage shall be review by the
CA. As and when instructed by the CA, the Contractor shall
remove or relocate and reconstruct the signboard and stage, and
reinstate all the affected ground to the satisfaction of the CA, all
at the cost and expense of the Contractor. On Substantial
Completion of the Works, the signboard and stage shall be
cleared away upon the review of the CA.
2.1.19 Gas Cylinders and Related Equipment
The requirement of the Malaysian standard or British Standard :
Code of Practice for Safety in Welding and Cutting (and Other
Operations Involving the Use of Heat) shall be followed for
welding, cutting and other operations involving the use of heat.
The Contractor shall use gas cylinders, each fitted with a low
pressure gauge, a high pressure gauge, a reducing valve with
pressure regulator, and a safety relief device. The gas cylinders
shall not be kept in the same room where welding, cutting or
heating is being carried out or placed within five meters of any
source of heat. The gas cylinders must always be kept upright in
a wheeled-trolley. When lifted by crane, hoist or derrick, cylinders
must be placed in cradles or skip box design approved by the
PE. Protective valve caps shall also be in place.
The hose connecting a gas cylinder to an apparatus for cutting,
welding, heating or other related works shall be of good
construction and sound material, free from defect, properly
maintained, and not entangled or kinked. Valves and fittings shall
be tested for leak with soap water every day before use.
A flashback arrester or any other similar device of the type
acceptable to the Chief Inspector must be fitted at every outlet of
a gas cylinder and every inlet of an apparatus.
The gas cylinders and hoses shall be colour-coded to conform to
SS 152: Identification of Contents of Industrial Gas Containers or
any amendments thereof.
The Contractor shall engage a competent person to check the
safety devices referred herein once in every 6 months. The
competent person is any person who is competent by education,

training and experience on the safety and operational aspects of
the use of gas cylinders and related equipment.
2.1.20 Safety Reflective Apparel

All workmen engaged in any type of work on public roads shall


wear approved type of reflective apparel during all hours of the
day and night when so engaged. The approved types of apparel
shall be:
a) short-sleeved vests covering the top half of the body with or
without perforations for wear comfort; and
b) a one-piece shoulder and waist strap (also called the wrap).
The apparel shall cover at least 25% of the trunk of the body
and it shall be fastened together by press-buttons, tying,
burdock fastener or by any other approved means.
The material to be used shall be fabric with poly vinyl chloride
coating and shall be retro-reflective. It shall be reinforced at the
edges and shall offer resistance against tearing. It shall be free
of ragged edges, surface blemishes, loose stitches or seams.
The apparel shall be coated or covered with retro-reflective
material in two colors, namely bright orange and white or bright
orange and yellow. The two colors shall alternate with each
other to provide contrast.
The material shall either have (i) self-cleaning surface so that
there will not be a heavy accumulation of dirt on the reflective
surface; or (ii) a surface that permits ready removal of
accumulated dirt and contaminants by wiping with soft rags and
mild detergent solution.
The reflective intensity of the material when tested in
accordance with the US Federal Specifications shall have the
following minimum value in candelas per lux per square meter:
The brightness of the reflective vests, totally wet by rain shall not
be less than 90% of the above values.
2.1.21 Health Measures

The contractor shall establish and implement a programme to
manage the receipt, movement, storage and use of hazardous
chemicals in the Site. The programme shall include:Written procedures for the acquisition, transportation,
storage, usage and disposal of hazardous chemicals;
ii) The appointment of a competent person to receive
hazardous chemicals and manage their storage, distribution
and handling;
iii) Maintaining a register of hazardous chemicals together with
their Material Safety Data Sheets (MSDS). The MSDS shall
give details of the hazardous chemicals compositions,
physical and chemical properties, toxicity, flammability,
personal protective equipment required during their
handling, and measures to be taken during an emergency;
iv) Labeling of all containers of hazardous chemicals. The
labels shall indicate the hazards involved and the
precautions to be taken;
v) Designation of suitable storage areas. All unused hazardous
chemicals shall be returned to the designated storage
areas. Storage areas shall be secured against unauthorized
access and storage & chemical hazard notice clearly
displayed;
vi) Regular hygiene monitoring where there is exposure to
airborne hazardous chemicals. Workers shall not be
exposed to toxic airborne chemicals exceeding the
permissible exposure level (PEL) specified in the First
Schedule of the Workplace Safety and Health (General
Provisions) Regulations.
vii) Training and education of workers on the hazards
associated with the hazardous chemicals, and the
precautions to be taken during the storage, handling and
use of these chemicals;
viii) The provision, maintenance, and use of personal protective
equipment (PPE) such as respirators. Workers shall be
trained in the use of PPE. The site Safety Supervisor shall
regularly inspect for the provision and use of PPE by
workers;
ix) Arrangement of workers to undergo pre-employment and
regular medical examinations if they are exposed to any of
the chemicals (e.g. silica, asbestos, lead) listed in the
Factories (Medical Examinations) Regulations.

b) Noise Management
The contractor shall as far as practicable, ensure that all
processes, machines and equipment used, do not cause workers

to be exposed to excessive noise, i.e. above an equivalent sound
level of 85 dBA for 8 hour workday, as stipulated in the Factories
(Noise) Regulations. This can be done by implementing one or
more of the following measures:
Engineering noise control, e.g., modifying noisy processes,
machines and equipment, relocating noisy processes or
isolating them within enclosures, erecting sound barriers,
reducing kinetic or potential energy and regularly
maintaining machines and equipment;
ii) Administrative noise control, e.g., rotating noisy jobs among
workers so that they are not exposed to noise above the
permissible exposure limit;
iii) Using quiet machines and equipment when such machines
and equipment are available in the market. Examples are
generators, compressors and concrete breakers. The
contractor shall provide hearing protectors for workers who
are exposed to excessive noise and ensure that they are
worn at all times. Warning signs to remind workers that
hearing protectors must be worn shall be put up at areas
with excessive noise.
iv) Contract workers should be trained and educated on the
hazards of noise, noise control and the prevention. Workers
who are exposed to excessive noise shall be sent for preemployment and annual audiometric examinations (hearing
tests) to detect any sign of hearing loss.
i)

c) First-Aid
All workplaces as specified within the class or description in the
first schedule of the Workplace Safety & Health Act shall establish
and implement a first-aid programme to provide emergency
treatment to victims of accidents, chemical poisoning or excessive
exposure to toxic substances.

The occupier of a workplace in which more than 25 persons are
customarily employed shall appoint such number of persons
specified in the Second Schedule as first aiders who shall be
readily available during working hours.
All first-aid provisions shall comply with the Workplace Safety &
Health (First-Aid) Regulations.
2.1.22 Temporary Electrical installation
The Contractor shall ensure, when using electrical power on
site, whether from Power Grid mains, site utility system or from
their own generators, a license to use or operate an electrical
installation is obtained for the Site. The license must be issued
by Public Utilities Board. All temporary electrical installations in
the Site are required to satisfy the requirements stipulated under
CP 88: Code of Practice for Temporary Electrical Installations.
2.1.23 Work in Confined Space
Where work is to be carried out in any confined space as
defined in the Workplace
Safety and Health Act or its subsidiary legislations, the
requirement of CP 84
Code of Practice for Entry into and Safe Working in Confined
Spaces shall be followed. The Contractor shall appoint a
competent person, Confine Space Assessor or Safety Assessor,
to carry out gas checking, testing, monitoring and to certify that
the confined space is safe for men to work. A copy of the
Permit-to- Work Certificate shall be submitted to the CA.

2.1.24 Others
The Contractor shall provide and maintain guards, fences or
barriers around excavations lift pits or other similar potential
places of danger to prevent accidents. The guards, fences and
barriers shall be of sound material, good construction and
possess adequate strength. All floor openings to within building
that are big enough to step right through and small enough to
cause trip and fall hazards need to be to be fully covered or
guarded with mid rail, guard rail and toe board.
The Contractor shall provide and maintain storey number
indicator of size 400mm x 400mm at every staircase area and
Storey number indicator of size 900mm x 900mm at the metal
scaffold enclosing passenger cum material hoist. The indicators
shall be displayed at alternate storey starting from the second
storey.
2.2

Registered Workplace Safety & Health Officer


The Contractor shall appoint a Registered Workplace Safety & Health
Officer who possesses Safety Officer Training Certificate or equivalent
qualification approved by Malaysian Regulative Authority and who has
minimum of 2 years practical experience relevant to the work to be
performed by the Workplace Safety & Health Officer in building
construction and works of engineering construction.
The appointment of Registered Workplace Safety & Health Officer shall
be based on the following requirements:
The appointment of the Registered Workplace Safety & Health Officer
shall be subjected to the approval of the CA. The appointed Registered
Workplace Safety & Health Officer shall not be removed or replaced
without the CAs permission.
The Registered Workplace Safety & Health Officer shall be a person
who is competent in carrying out his duty of ensuring the safety and
health of the persons employed on the Contract. The Workplace Safety
& Health Officer shall carry out his duty as stipulated in Regulations 9
of Workplace Safety & Health (Workplace Safety & Health Officer)
Regulations.
The Registered Workplace Safety & Health Officer shall prepare and
submit to the CA a monthly Safety Report in such a form as the CA
may require. The Report shall be submitted to the CA at the same time
as the specified in the Monthly Contract Progress Report.

2.3

Site Safety Coordinators by

The Contractor shall employ Site Safety Coordinator with recognized


and approved certification by Malaysian Regulative Authority to take
charge of all matters related to safety. The said Site Safety Coordinator
shall spend his time fully on the Site and perform the following:
2.3.1 Supervise safety and promote safety conduct; (Ii) Inspect and
rectify any unsafe place of work;
2.3.2 Correct any unsafe practice; and
2.3.3 To ensure that the provisions of the Workplace Safety and
Health Act and Its Subsidiary Legislations made there under are
complied with.
The Contractor shall submit the names, documentary evidence of the
qualifications of the Site Safety Coordinator within one month from the
date of the Letter of Acceptance for approval by the CA.
The Site Safety Coordinator shall put on suitable uniforms provided by
the Contractor. The type of uniform shall be subjected to the approval
of the CA.
The CA may consider the request by the Contractor in writing to
release his Site Safety Coordinator from the obligations under this subclause if the contract has been certified to be more than 95% complete.
Nevertheless, one Site Safety Coordinator shall be stationed on the
Site on a full-time basis until the substantial completion date or TOP
whichever is later.
All differences and/or disputes arising under this sub-clause (including
questions relating to the interpretation) shall be reviewed by the CA
whose decision made shall be final and binding on and conclusive
against the Contractor.
The Contractor shall ensure that their respective sub-contractors
engaged a full time site safety supervisor to oversee the safety
and health issues representing their respective trade / scope of
work.
2.4

Environmental Control Officers / Health Officer


Under the Environmental Public Health Regulations, the Contractor
shall appoint a full-time or part-time Environmental Control Officer who
possesses Environmental Control Training Certificate approved by
ENV and who has minimum of 2 years practical experience relevant to

the work to be performed by the Environmental Control Officer in
building construction and works of engineering construction.
The appointment of the Environmental Control Officer / Health Officer
shall be subjected to the review of the CA. The appointed
Environmental Control Officer / Health Officer shall not be removed or
replaced without the CAs review.
The Registered Environmental Control Officer / Health Officer shall be
a person who is competent in carrying out his duty in controlling the
environmental health hazards on the Site. The Environmental Control
Officer / Health Officer shall carry out his duty as stipulated in
Environmental Public Health Regulations.
The Contractor is required to submit a Site Environmental Control
Programme to ENV. This programme shall be prepared and jointly
endorsed by the Environmental Control Officer and the contractor. The
Environmental Control Officer shall prepare and submit to the CA a Site
Environmental Control Report every fortnight.
Health Officer shall be a person who possesses Industrial Hygiene
Training Certificate issued by MOM and has minimum of 2 years
practical experience relevant to the work to be performed by the Health
Officer in building construction and works of engineering construction.
2.5

Crane Operator, Lifting Supervisor, Rigger and Signalman


The Contractor shall comply with the UK Factories (Operation of
Cranes) Regulations. He shall appoint at least one full time lifting
supervisor to supervise all operations of any crane on the Site.
However, where more than one crane is used on the Site, more lifting
supervisors shall be engaged by the Contractor. No lifting activity shall
be allowed without the supervision of the lifting supervisor.
The lifting supervisor shall have a minimum of three year[s experience
in construction work and lifting operations. He must be a site foreman
or site engineer and possesses a certificate on Safety Instruction
Course for Lifting Supervisor. He shall spend his time on all lifting
activities and ensure that unsafe conditions are rectified.
For lifting operations within the Site, which is next to existing buildings,
public roads or MRT lines, the crane operator shall have a minimum of
5 years experience.
Riggers and signalmen shall also be appointed for all lifting operations
and they must have completed an approved training course.

The crane operator, lifting supervisor, rigger and signalman shall carry
out their duties strictly in accordance to the above mentioned
Regulations and other duties as the CA deems necessary from time to
time.
The Contractor shall submit a list of crane operators, lifting supervisors,
riggers and signalmen with their names, identification card or passport
numbers, qualifications and years of experience to the CA for review
one week before the lifting operations commences. The list shall be
updated and kept on the Site at all times. The CA reserves the right to
examine the list as and when required.
2.6

Authorized Operators for Machinery And Vehicles


The Contractor shall employ only qualified operators for the machinery
to be used on Site. The operators for machinery shall possess a Skill
Evaluation Certificate (SEC) from the Construction Industry Training
Institute (hereinafter referred to as "CITI" for the purposes of this subclause) or other approved training centre. For those machinery
whereby CITI or other approved training center does not conduct
courses or practical tests for the machinery operators, the Contractor
shall only authorize operators with minimum of 2 years practical
experience to in operate the machinery.
In the case of vehicles, which are to be operated within the contract
boundary, the authorized operators shall possess the minimum valid
Class 3 driving licenses from the Registrar of Vehicles or the equivalent
from their originating countries. The equivalent of the minimum Class 3
driving license shall first be verified by the respective embassy in
Singapore and thereafter submitted to the CA.
The Contractor shall record the particulars of the operators for the
machinery and vehicles in the prescribed form and submit to the CA
one week before the commencement of the Works. The prescribed
form shall be updated, kept on the Site and made available for
inspection at all times.

2.7

Safety Training
2.7.1 Safety Orientation Course
The Contractor shall employ workmen who possess valid Safety
Orientation Course Certificates to work on the site. The
Contractor shall ensure that his workmen attend a prescribed
safety refresher course at regular interval.

The safety training shall be applicable to all levels of employees
stipulated in this sub-clause including top management at the work site.
Particular attention shall be given to the needs of young employees.
Further training shall be required where:
(i) Employees are transferred or where employees take on new
responsibilities or where there is a change in the work activity or work
environment; and
(ii) There is a change in the work equipment or systems of work.
Training shall be repeated periodically to ensure continued
competence.
2.8

Safety Audit
The Contractor shall appoint an independent Malaysian regulative body
approved external safety auditor where the contract sum awarded is
equal or exceed $10 mil to audit the Safety Management System of the
Site at least once every six (6) months using Construction Safety Audit
Scoring System (ConSASS), with the first audit conducted within one
(1) month from the date of the Letter of Acceptance. In addition, the
Contractor shall carry out internal safety audits to verify whether safety
activities comply with the Safety Management System requirements.
If deemed necessary, the CA shall be entitled to engage an
independent external auditor to audit the Contractors Safety
Management System and the Contractor shall provide all necessary
attendance and information to the auditor. The contractor shall bear the
cost of engaging the external auditor.
The Contractor shall periodically review and evaluate the efficiency of
the Safety Management System in place.
The audit and possible corrective actions shall be carried out in
accordance with the documented procedures.

The results of audit and corrective actions shall be submitted to the CA
and brought to the attention of all sub-contractors.
2.9

Reporting Of Accidents and Dangerous Occurrences


Under the Workplace Safety and Health (Incident Reporting)
Regulations, where any workplace accident leads to a death of any
employee, the employer of that person shall forthwith notify the
Commissioner of the occurrence of the accident. The employer shall
thereafter, but not later than 10 days following the day of the accident,
submit a report to the Commissioner.
In an event of any dangerous occurrence (Second Schedule) at a
workplace, the occupier of the workplace shall forthwith notify the
Commissioner of the occurrence. The occupier shall thereafter, but not
later than 10 days following the day of the occurrence, submit a report
to the Commissioner.
Where any workplace accident occurs which leads to the injury of any
employee at work and is granted more than three consecutive days of
sick leave by a registered medical practitioner for that injury or is
admitted in a hospital for at least 24 hours for observation or treatment,
the employer of that person shall within 10 days of the occurrence of
the accident, submit a report to the Commissioner.
Where any person suffers an occupational disease (Third Schedule),
and the employer of that person has received a written statement
prepared by a registered medical practitioner diagnosing the
occupational disease, the employer shall, within 10 days of receipt of
the written diagnosis, submit a report to the Commissioner.
In the case of an accident or a dangerous occurrence, as classified
under Workplace Safety and Health (Incident Reporting) Regulations
including any amendment or re-enactment thereto, the Contractor shall
notify the CA by telephone or by facsimile transmission within one hour
of such accident or dangerous occurrence.
Upon receipt of information of an accident or dangerous occurrence,
the CA shall at its discretion make a preliminary investigation of the
circumstances and record its finding upon such investigation.
Notwithstanding the aforementioned requirements, the Contractor shall
in addition, make a written notice and submit it to the CA within 10
working days of the accident or dangerous occurrence.
Upon submitting the above report to the CA, the Contractor shall
arrange for the injured workman, witnesses and an interpreter, if

necessary, to report to the CA to furnish evidence relating to the
accident or dangerous occurrence.
If the Contractor fails to give any required notice or fails to furnish
evidence of the accident or dangerous occurrence as required under
this sub clause, the CA may at his absolute discretion exercise his
rights to impose charges against the Contractor.
3.0

Inspection
The Client may appoint in writing one or more Safety Inspectors who
shall be authorized without prior notice to the Contractor, to enter the
Site at all reasonable times to conduct inspections and examinations
for the purpose of ensuring compliance with the safety requirements
described in the Safety Specifications. However, the Contractor shall
be notified of the arrival of Safety Inspector at the Site and any
inspection carried out by the Safety Inspector shall be witnessed by the
Contractors Project Manager and Workplace Safety & Health Officer/
Safety Coordinator.
The frequency of safety inspection shall depend on the nature of the
construction activities, the hazards present, internal and external
feedback received and the performance of the Contractor.

4.0

Non-Compliance with Contract Safety Specifications


In the event of contravention or non-compliance with the safety
specifications, the CA shall:
4.0.1 Impose Demerit Point on the Contractor in accordance with
Clause 6.0;
and
4.0.2 Impose Administrative Charges on the Contractor in accordance
with Clause 9.0; and where necessary

4.1

Suspend Work
The CA may suspend the progress of works or any part of them if
necessary for the safety of the works or if he is of the opinion that the
working environment or procedure is unsafe for the works to continue.
In such event, the Contractor shall not be entitled to any claims for
compensation or extension of time for Completion.

5.0

Demerit Points for Safety Infringements


Demerit points shall be imposed upon the Contractor for the following
safety infringements:

5.1

Demerit Points for Accident


The CA shall, without prior notice to the Contractor, impose the
following demerit points on the Contractor whenever one of the
following types of Accidents occurs at the Site:
5.1.1 Reported Accident that does not cause permanent incapacity - 2
5.1.2 Reported Accident causing partial incapacity - 5
5.1.3 Reported Accident causing permanent incapacity except
paralysis - 8
5.1.4 Death or Paralysis - 10

5.2

Demerit Points for Dangerous Occurrence


The CA shall, without prior notice to the Contractor, impose three (3)
demerit points on the Contractor for each Dangerous Occurrence,
which does not result in death or injury to person(s).

5.3

Demerit Points for Non-Compliance with Safety Requirements


In the event the Contractor fails to comply with the safety requirements
as described in the checklist (attachment I), demerit points shall be
imposed by the CA as follows:5.3.1 For Project $10 million and less:.
First Inspection
a) No demerit points shall be imposed if there is no
contravention or non-compliance with the safety specifications.
b) Should six (6) or less demerit points be imposed during the
safety inspection, the Contractor shall carry out rectification
works within two (2) days from date of inspection and submit the
required photographic evidence in the next site meeting for
verification.

c) Should more than six (6) demerit points be imposed during
the site inspection, re-inspection shall be carried out.
5.3.2 Re-Inspection
a) The re-inspection shall be carried out three (3) days from the
date of the first inspection. The Contractor shall carry out this
rectification works prior to the re-inspection. The rectification
works shall be subjected to the CAs verification. Photographic
evidence of rectification works is to be submitted by the
Contractor after the CAs verification.
b) Please refer to Clause 6.0 (i) (b) for six (6) or less demerit
points imposed.
c) Should more than six (6) demerit points be imposed, the CA
shall engage an external safety auditor to audit the site using
Construction Safety Audit Scoring System (ConSASS) within 3
days from the day of the re-inspection.
The Contractor shall bear the full cost of engaging the external
auditor and submit corrective action plan to rectify any safety
irregularities put forward by the external auditor within three (3)
days from the date of issue of external audit report.
5.3.3 For Project above $10 million:
a) First Inspection
i)

No demerit points shall be imposed if there is no


contravention or non-compliance with the safety
specifications.

ii) Should ten (10) or less demerit points be imposed during


the safety inspection, the Contractor shall carry out
rectification works within two (2) days from date of
inspection and submit the required photographic
evidence in the next site meeting for verification.
iii) Should more than ten (10) demerit points be imposed
during the site inspection, re-inspection shall be carried
out.
b) Re-Inspection
i) The re-inspection shall be carried out three (3) days from
the date of the first inspection. The Contractor shall carry

out this rectification works prior to the re-inspection. The
rectification works shall be subjected to the CAs
verification. Photographic evidence of rectification works
is to be submitted by the Contractor after the CAs
verification.
ii) Please refer to Clause 6.3.2 (i) (b) for ten (10) or less
demerit points imposed.
c) Should more than ten (10) demerit points be imposed, the
Employer may engage an external auditor to audit the site
using Construction Safety Audit Scoring System (ConSASS)
within 3 days from the day of the re-inspection.
The Contractor shall bear the full cost of engaging the external
auditor and submit corrective action plan to rectify any safety
irregularities put forward by the external auditor within three (3)
days from the date of issue of external audit report.
6.0

Tolerable Cumulative Demerit Points over 6 months Period


Any demerit point imposed on the Contractor shall remain exclusively
with the Contract and shall not be added to any demerit point imposed
on other contracts involving the same contractor. For any 6-month
rolling period of the Contract, the demerit points accumulated shall not
exceed the following:

7.0

Suspension from Tendering


If the cumulative demerit points at any time during the 6-month period
of the Contract exceed the tolerable limit described in Clause 7.0, the
Contractor shall be barred from tendering for THE EMPLOYERS
projects for a period ranging from 3 to 12 months commencing from the
date of Notice of Suspension. The CA shall recommend the period of
suspension to the Employer whose decision shall be final and
conclusive.
After the end of the suspension period, the CA may recommend
continuing with the suspension if the rolling demerit points at the end of
suspension exceed half of the tolerable limit described in Clause 7.0.

8.0

Administrative Charges for Safety Infringements


Without prejudice to other rights and remedies available under the
Contract, the CA shall impose administrative charges against the
Contractor for the following types of infringements arising from or in the
course of the Work where the CA is satisfied that: 8.0.1 There has been non-compliances with the safety requirements
as stipulated in the Checklist (Attachment 1); or
8.0.2 A dangerous occurrence which does not result in injury to
person(s) is directly or indirectly caused by the default, act,
omission, or negligence, in part or in whole of the Contractor; or
8.0.3 A non-fatal accident resulting in injury to person(s), is directly or
indirectly caused by the default, act, omission, or negligence, in
part or in whole of the Contractor; or
8.0.4 A fatal accident resulting in death is directly or indirectly caused
by the default, act, omission, or negligence in part or in whole of
the Contractor.
Where the CA is satisfied that any of the above event has occurred, the
CA shall be entitled to recover the following administrative charges
incurred and may deduct, without prior notice to the Contractor, the
said administrative charges from any monies that are or may become
due to the Contractor.

Emergency And Injuries


1.0 Fire Safety, Emergency And Rescue
The Contractor shall establish a Fire Safety, Emergency and Rescue Plan to ensure
that the work on Site is undertaken to the highest standard of fire and other aspects
of safety. As a basic guide, the Contractor shall submit the plan to CA for review.
The plan to be implemented shall include detail for the following:

The role and responsibility of every individual in the work area on fire safety,
emergency and rescue;
General work area precautions, fire prevention, detection, protection and
warning alarm systems;
Fire-fighting & rescue equipment including types of fire extinguishers;
Fire safety measures for site accommodation;
Escape and communication;
Fire brigade access, facilities and coordination;
Fire drills and training including the use of fire-fighting apparatus;
Material storage including flammable liquids, gases and waste control regime;
The Contractor shall ensure that all procedures, precautionary measures and
safety standards stipulated in the Plan are communicated, implemented and
complied with by all workers including sub-contractors and other interfacing
contractors on Site.
The Contractor shall review and ensure the adequacy of the Plan as the work
progress.
The Contractor shall conduct weekly checks on fire-fighting equipment and
test all alarms and detection devices installed on the site.

brigade access, fire-fighting facilities and working areas to ensure that the
requirements stipulated in the Fire Safety, Emergency and Rescue Plan are
complied with.
All inspection records shall be documented and submitted to CA for reference.

Upon submitting the above report to the CA, the Contractor shall arrange for
the injured workman, witnesses and an interpreter, if necessary, to report to
the CA to furnish evidence relating to the accident or dangerous occurrence.
If the Contractor fails to give any required notice or fails to furnish evidence of
the accident or dangerous occurrence as required under this sub clause, the
CA may at his absolute discretion exercise his rights to impose charges
against the Contractor.
3.0

Environmental Control Measures

3.1

Environmental Control
Under the Sewerage And Drainage Act, Cap. 294 pertaining to the control of
erosion and sediment, the Contractor shall be responsible for preventing silt
from being washed into public drains by implementing effective Earth Control
Measures (ECM) for the construction site to meet the requirements under the
latest Sewerage and Drainage Act Cap 294. (Information on ECM
requirements can be found in the Code of Practice on Surface Water
Drainage and the website.
The Contractor shall note that the ECM are for the containment and treatment
of silty discharges due to the impact of rainwater. ECM are not meant for the
treatment of wastewater due to construction activities (such as slurry from
tunnelling, pipe-jacking and bore-piling works) which shall be treated to
comply with the requirements under Environmental Pollution Control Act
(Chapter 94A).
Before construction works commence on site, the Contractor shall engage a
QECP to plan and design the ECM, and he shall install the ECM according to
the QECP's design. The ECM plan and design shall be submitted 1 week
after the award of the contract. During the course of the construction works,
the Contractor together with his QECP shall review the ECM proposal
regularly to meet the changing needs of the construction activities. The
Contractor shall improve the ECM as advised by his QECP. The planning and
design of the ECM shall meet the minimum requirements stipulated and in
accordance to the Code of Practice on Surface Water Drainage.
The Contractor shall maintain the ECM for the whole duration of the Contract
period to ensure that it is effective at all times. Proper records detailing the
maintenance works, supported by dated photographs, shall be kept by the
Contractor and submitted to CA for verification.
The Contractor shall submit the ECM proposal duly endorsed by his QECP,
for review by the CA prior to submission to Director, Drainage (Public Utilities
Board) for records.

During construction, the Contractor shall minimize the formation of bare
surfaces under the ECM's Erosion Control Plan. The Plan shall depict
graphically the activities, including sequence of work, type and duration for
each phase of construction activities to include the following measures to:
1. Sequence and schedule of the earthworks / demolition works in stages
and progressively with the subsequent construction activities and building
works.
2. Minimize site disturbance by keeping site clearance works to a minimum
by retaining as much of the existing vegetation as possible.
3. pave up the bare surfaces and all construction access by concrete or
milled waste or other suitable materials.
4. Protect the bare slopes with close-turfing, concrete grouting, canvas or
erosion control blanket.
5. Protect the earth stock piles with canvas or erosion control blanket.
6. restore ground cover over disturbed areas, which are or have become
bare, as soon as possible.
The Contractor shall put in place the ECM's Sediment Control Plan, which
aims to capture the sediments washed down from the construction sites.
Some of these sediment control measures and facilities, which must be in
place before the works start, shall include but not limited to the following:
1. concrete-lined cut-off drains (minimum C7 precast channel) along the
perimeter of the construction sites.
2. Silt fence properly installed and embedded on to the ground along the
perimeter cut-off drains (between the construction site and the cut-off
drain).
3. sedimentation basins or any other sediment filtering or settling system of
adequate size and sufficient numbers along the perimeter cut-off drain and
before the discharge points into public drain.
4. A treatment system to be provided before the discharge points into public
drain. A storage basin / tank may be required to capture the runoff before
treatment.
5. Turbidity curtains shall be installed along all the exposed slopes for works
in or adjacent to water bodies, such as canals, rivers, sea or in a
reclamation work. The silty discharge trapped within the turbidity curtain
shall be allowed to be settled or treated.
The QECP shall submit full basis of design back up with design calculations to
show clearly how the perimeter cut-off drains, silt fence, sedimentation basins
and storage basin / tank are designed and sized as well as how such design
will effectively filter off silt and allow only clean water to discharge into public
drains. The QECP shall also submit the design specifications on the treatment
system which can effectively treat the silty discharge from the construction
site. The intensity of a one-in-two year storm should be adopted for the
proposed design.

House Rules and Contractors Responsibilities
All contractors carrying out works in the site are to note and comply strictly
with the House Rules and Contractors Responsibilities.
The Employer reserves the right to stop work or to impose such penalties as
described in the House Rules and Contractors Responsibilities on contractors
found in breach of the said rules and conditions.
The term Contractor shall mean the person or firm whose offer for work has
been accepted by the Employer and include the contractors workmen, subcontractors, suppliers and agents.

1. SITE ADMINISTRATION
1.1

Official working hours for the Employers Site Office:


Monday ~ Friday 8:30 am ~ 5:30 pm (inclusive of 1 hour lunch)
Saturday 8:30 am ~ 12:30 pm
Sunday & Public Holiday Off

1.2

The Contractor shall conduct a pre-condition site survey i.e. take


photos and record the existing site condition prior to commencement of
works. Three sets of pre-condition reports are to be submitted (i.e. one
set each to Employer, Consultant, Resident Engineer and Resident
Technical Officer respectively) for record. Also see related item under
Site Utilisation.

1.3

The Contractor shall provide its own power supply from portable low
noise genset (less than 2 years of service and 30dBA at 5m away from
genset). The contractor shall not tap power from the existing source
unless otherwise approved by the employer. The installation must be

licensed by a Licensed Electrical Worker (according to the local Public
Utilities Act and CP88 whatever is revevant), and a copy of LEW
licence must be displayed at the generator site.
1.4

The Contractor shall provide and maintain own temporary water supply
and distribution system. The temporary water supply shall be tapped
from the PUB mains and installation shall comply with the requirements
of Public Utilities Board.

1.5

The Contractor shall submit a Site Organization Chart and Emergency


Action Plan with full information e.g. names, designations, contact
numbers, etc. to the employer and Consultant within 2 weeks upon
award of Contract.

1.6

The Contractor shall submit a site layout clearly indicating the facilities,
site office, emergency assembly area, workers resting, storage area,
free P.P.E zone, designated chemical storage area, etc. to the
Employer and Consultant for approval within 2 weeks upon award of
Contract.

1.7

The Contractor shall submit the worker and sub-contractor's worker


name lists (together with worker's permit) to Consultant for verification.

1.8

The Contractor shall submit a detailed breakdown of Preliminary Items


to the Employer and Consultant.

1.9

The Contractor shall ensure the Employers site possession procedure


is followed and conduct a handover meeting with Faculty Coordinator
and Consultant's Representative.

1.10

The Contractor shall mark out all new works (eg. drywall, door, fitment,
etc) on site and seek Consultant / site staff's confirmation before
commencement of work.

1.11

The Contractor shall highlight all existing damaged pipes, cables and
structures to Consultant and CA for follow up action.

1.12

The Contractor should use a set of standard forms issued by the


Consultants for the administration of the construction and renovation
works.

1.13

The Consultant will issue a set of standard forms for the administration
of the contractors works.

1.14

The Contractor shall submit construction progress schedule to the


Consultant.

1.15

The
Contractor
shall
submit
copies of shop
drawing,
materials/equipment and samples to Consultant for comments when
required to do so.

1.16

The Contractor shall submit insurance policies and performance bond


before commencing work.

1.17

The Contractor shall submit Maintenance Schedule, relevant keys to


the system, list of contractors on call and warranties within one week
after the successful handover inspection.

1.18 The Contractor shall ensure all workers, site staff, sub-contractors,
suppliers engaged by the him shall not behave unruly to local people.
For non-compliance the persons involved would be barred from
entering the site.
2. SITE HOARDING
2.1

The Contractor shall provide an aluminum sheet hoarding to a height of


approximately 2m surrounding the site, with a smooth clean colourbond
surface suitable for painting and applying information/decorative
decals, and sufficient safety barricades to cordon off the site.

Adequate signage should also provide information of the project,
duration and person-in-charge with contact number. Minimum
dimension: 1.8m Length and 1m Width.

3. PROJECT SIGNAGE AND WARNING SIGNS
3.1 Proper Malaysia Authory approved signboard on construction site shall be
erected with location approved by CA before commencement of work and to
inform Hospital community of the particular improvement work.
3.2 The Contractor shall provide LTA standard traffic and directional signs,
barriers, warning lamps, rubber cones etc to guide and inform the public that
the working area is closed or partially closed to all traffic (vehicular as well as
pedestrians).
3.3 The Contractor shall provide proper and clear demarcation for pedestrian
movement.
3.4 The Contractor shall provide safety signs in accordance to Malaysian
standards for latest specification for Industrial Safety Signs at the work site.
4. APPROVALS REQUIRED FROM THE EMPLOYERS
4.1 The Contractor shall note that no agreement for works shall be made
directly between themselves and end-users without the employers /
Consultant's agreement. Consultant will not entertain any counter proposed
materials submitted by Contractor without Consultant / THE EMPLOYERS
approval.
4.2 The Contractor shall seek THE EMPLOYERS approval through the
Consultant for proposed locations of contractor's site office, temporary toilets,
electrical generator and bulk bin. Company signage (of BCA standard) to
include Company name, Person-in-Charge and Hand phone No., Company
Address and Tel. No., Person-in-Charge (THE EMPLOYERS), Person-inCharge (Consultant), Contract Period and Contract Specification (please refer
to 2.1 above) should be installed at the site office. Proposal shall be submitted
within 2 weeks upon award of contract.
4.3 Mobile toilet(s) and washing bay(s) shall be provided by the Contractor at
designated area(s) at his own expense. Also see related item under Site
Utilisation.
4.4 Contractor is to ensure that the toilet is maintained at maximum
cleanliness at all times. Contractor should remind Male workers not to enter
Female toilets
4.5 The Contractor shall seek CAs approval for isolation of existing services.
The Contractor is to submit Request to Isolate Power Supply/Fire
Alarm/Water Supply with method statements and drawings through the CA,
giving 7 days' advance notice before work begins. No immediate termination

of cables and services will be allowed. Work is to be carried out only after
receiving approval.
4.6 The Contractor shall seek CAs permission to use THE EMPLOYERSs
water supply. The Contractor shall provide and install a water meter (for billing
purposes) in the presence of THE EMPLOYERS staff.
4.7 The Contractor shall seek CAs approval to use existing lifts for
transporting of materials. Contractor is to submit Application to Use Lift
together with photographs of lift condition, giving 7 days' advance notice
before work begins. Contractor should liaise with Zone TSO/Project Officer for
a site inspection of the lift before commencement of work.
4.8 The Contractor shall seek CAs approval before dismantling existing
works together with method statements and drawings, giving 7 days' advance
notice before work begins. Work to be carried out only after receiving approval
from Zone TSO/Project Officers.
5. SECURITY AND CONTROL
5.1 No worker is permitted to stay overnight on site other than the security
staff unless agreed with THE EMPLOYERS authority. Also see related item
under Site Utilisation.
5.2 Workers to have separate food and beverage vendors at the contractors
cost:
5.3 Opening hours for canteen at CA agreement.
5.4 Proper designated resting and eating area are to be allocated by the
Contractor outside the building under construction and submit to the CA for
approval. Workers are not allowed to eat, drink or sleep in the building under
construction.
5.5 Spot checks would be conducted and an administration charge TBA per
violation shall be imposed on the Contractor.
5.6 The Contractor shall provide sufficient artificial lighting at the work area.
Contractor should display warning signs of sizes 900mm x 600mm at strategic
points around the periphery of the Site where trespassing is likely to occur.
Warning lights should be placed at similar positions at night to serve as a
warning to the public that the works is in progress.
5.7 Provision of security guards on site if contract is called for. The Contractor
is to submit the number of security guards required with names, work permit
numbers, contact numbers, person-in-charge to contact in case of emergency
to security office. Also see related item under Site Utilisation.

5.8 All workers shall wear security passes and uniforms bearing Contractors
name for easy identification at all times.
5.9 A Letter of indemnity shall be signed upon award of contract. It is the
Contractors responsibility to ensure the workers and sub- contractors are
valid work permit holders before application of the security passes. Issuing
records shall be kept and filed properly for periodic checks.
5.10 Illegal/unauthorized workers shall be handed over to police/security
immediately. If workers are caught without security passes or/and company Tshirts, an administration charge of S$200/- per instance shall be imposed on
the Contractor. If workers are caught without work permits and security
passes, an administration charge of S$5,000/- per instance shall be imposed
on the Contractor.
5.11 Prominent road signboards approved by LTA are to be provided along
roads to caution the public of the heavy vehicle movement and provide
direction for the Contractors vehicles.
5.12 A minimum of 2 traffic wardens in approved type of reflective apparel is
required to be provided and stationed at each gate use by the Contractor to
guide and control the vehicle movement in/out of the site.
5.13 A Holding area for workers pickup point within the site is to be provided
by the Contractor, workers are strictly not allowed to loiter/wait outside the
gate/hoarding.
6. SITE SAFETY
6.1 The Contractor shall maintain an effective site safety management system
(SMS) in compliance with CP 79 Safety Management System for Construction
Sites (contract sum more than $5 million) or relevant MALAYSIAN
LEGISLATION by certification body. The contractor shall ensure tight safety
and security to user's site during the entire construction period.
6.2 The Contractor shall inform CA of the appointed site safety supervisors
who must enforce site safety and conduct regular site safety checks with
proper documentation. The Contractor shall ensure all works to be carried out
in compliance with all relevant legislation and subsidiary requirements. The
Contractor to ensure all relevant permits such as Factory Permit are obtained
before work commencement. Factory Permit shall be obtained for all piling
and demolition works and all construction works more than 2 months duration.
6.3 The Contractor shall inform CA / Client with regard to the site safety
management systems meetings.

6.4 The Contractor shall provide adequate safety gear/measures to all
workers and visitors when in the vicinity of construction works or other danger
areas in accordance with Malaysian legislative safety rules and regulations.
6.5 The Contractor shall ensure barricades, protection and coverings to all
holes and openings. Contractor should provide barriers, handrails and boards
to all excavated openings and shafts.
6.6 No loading in excess of the design load shall be placed on any portion of
the structure of the buildings
6.7 All temporary lightings and wiring should be properly secured and not be
left dangling in the middle of passageways.
6.8 All materials, particularly timber and other combustible materials shall be
properly stored.
6.9 The Contractor shall ensure that fire extinguishers are provided at
strategic points on site. Fire extinguisher should be on standby whenever hot
work is being carried out.
6.10 In event of any outbreak of epidemic in Malaysia e.g. SARS outbreak,
The Contractor shall record the temperature of all workers as per advised by
local authorities, e.g twice daily (9am and 2pm) and maintain a temperature
log book.
The Contractor shall submit the following reports in soft copy to the respective
personnel handling the collation:
a) Two Daily Situational Reports (of morning and afternoon
temperature checks)
b) Health Declaration Form
c) Daily Temperature Record
The contractor shall ensure they meet the required standards of control
required by LA and Government authorities and will be held responsible for
non-confirmation.

7. PROTECTION OF LOCAL PROPERTY AND MINIMAL INCONVENIENCE
TO COMMUNITY
7.1 No delivery of materials to site shall be made during off peak hours:
7.2 The Contractor shall inform THE EMPLOYERS / CA and Security Office
of the heavy and long vehicles that will be passing through any car park
barrier. The Contractor shall work with THE EMPLOYERS/CA to take
necessary action for the vehicles access. If the Contractors vehicle causes
any damage or loss of property, the Contractor shall pay for all damages and
reinstatement works.
7.3 The Contractor shall thoroughly check the access route and pay attention
to height clearance of building (if applicable) and overhead bridges when
transporting heavy crane equipment.
7.4 The Contractor shall take measures to prevent damage to existing roads,
footpaths, lamp posts, overhead bridges, kerbs etc by vehicles of the
Contractor.
7.5 Safety measures and proper barricade shall be taken when hoisting up
equipment and material to the rooftop. A copy of the 'Hoisting Up of
Equipment & Material to Rooftop by Crane' schedule is to be given to the
THE EMPLOYERS / CA representatives.
7.6 The Contractor shall take proper care and protection of all existing
properties, floor finishes and existing lifts (protection before usage). Reinstatement of damaged properties shall be fully borne by Contractor.
7.7 The Contractor shall detect and protect existing services and carry out
cable detection before any excavation works. Standing supervision is
necessary for all the excavation works.
7.8 The Contractor shall inform all of any lifting work and ensure that
registered Lifting Supervisor, Riggers, Signalman and Resident Technical
Officer are present at all times.
7.9 After handing over, the Contractor shall inform all end-users prior to any
hacking works at least two (2) days in advance for minor works and one week
(7 days) in advance for major works.
7.10 Precautionary measures shall be taken when carrying out major hacking
work which could cause vibrations, and thus affecting end-user and/or their
equipment.

7.11 Fire engine access, hard standing areas and escape staircases shall be
clear of obstruction at all times. Only removable barricades are allowed for
closure of the road and this is subject to THE EMPLOYERSs approval.
7.12 Workers shall be confined to their work area(s). Loitering/sleeping is
strictly prohibited.
8. HOUSEKEEPING
8.1 Good housekeeping in compliance with the Workplace Safety and Health
(General Provisions) Regulations 2006 and Workplace Safety and Health
(Construction) Regulations 2007 shall be maintained on site and surrounding
bulk bin area at all times.
8.2 Proper pest control shall be implemented regularly to prevent site from
breeding or harboring of vectors especially at/and around the site
office/temporary buildings.
8.3 No empty container or receptacle capable of collecting water and forming
breeding places for mosquitoes shall be left in the open. Contractor shall take
all necessary steps to prevent the breeding of mosquitoes in the areas
handed over to him during the construction period.
8.4 The Contractor shall tidy work site e.g. to straighten netting, line-up
barricade properly, maintain site safety equipment and proper storage of
construction materials.
8.5 All workers shall wear tags and uniform bearing Contractor's name for
easy identification. Contractor shall submit to CA, a photograph of a worker
(typical) with uniform and tag i.e. stationed on site.
9. DECORUM
9.1 The Contractor shall ensure that workers do not smoke in the Building site
areas except where agreed upon with THE EMPLOYERS.
9.2 The Contractor shall ensure that workers do not sleep or lie on the
benches or corridors at common areas.
9.3 Workers who conduct or behave towards staff in a disrespectful manner
will be removed from the worksite immediately.
10. POLLUTION CONTROL
10.1 Noisy works shall not be carried out during evening or night-time.

10.2 If non-noisy works has to be carried out during the evening or night time,
the Contractor shall provide and install an calibrated noise level, NEA
approved Type 1 noise meter measuring instrument/metering to monitor and
record the noise level. The noise level shall be of an acceptable level for the
Hospital.
10.3 Contractor is to ensure the pollution control of the
construction/renovation works meet the requirements stipulated in the Code of
Practice on Pollution Control for MALAYSIA.

10.6 The noise shall be measured at 1 m from outside the affected premises
or at the boundary of the construction site if the affected premises are 50m
away from the boundary of the construction site.
10.7 Contractor is to report any Asbestos or hazardous materials found on
THE EMPLOYERS site to Consultant immediately. The Contractor is to
apply permit from the relevant Authority (if applicable) for handling of
Asbestos or hazardous materials. All toxic industrial waste disposals to be
carried out by NEA approved toxic waste contractor.
10.8 Contractor are not allowed to discharge any trade effluent, silt into any
sewerage or drainage. For those Contractors engaging in earthworks, ECM
shall be designed by PUB approved QECP and submitted to CA / PUB
drainage dept for silt discharge control on site.
10.9 Contractor to seek THE EMPLOYERS approval for the proposed
location(s) to house diesel generator on site.

11. DEFECTS LIABILITY
11.1 All identified defects recorded at the pre-handing inspection with
Consultant must be rectified before the actual hand-over date. Consultant will
arrange for an actual hand-over with the user and THE EMPLOYERS. On
the actual hand-over date, Consultant / site staff will note all comments by
users and THE EMPLOYERS. Consultant will compile a defect list for all
trades which will be copy to users and THE EMPLOYERS for confirmation.
11.2 All defects shall be rectified according to the defect list as soon as
possible. Contractor must attend all monthly Defect Liability Progress
Meetings and report the defects that have been rectified. The defects list must
be endorsed by Consultant and THE EMPLOYERS after rectification of
defects.
12 AS-BUILT DRAWINGS / WARRANTIES SUBMISSION
12.1 The following items shall be submitted through Consultant within 3
months after issuance of the Substantial Completion Certificate:

As-built drawings with Qualified Person endorsement

12.1.2

List of all materials/equipment used in the project

12.1.3

Relevant warranty of works

12.1.4

Relevant original certificates/plans from building authorities

12.1.5

Six (6) sets of Comprehensive Operation and Maintenance


Manual

12.1.6

Manual and Data Sheets for all Mechanical and Electrical


services incorporated in the works

12.2

The above items in 12.1.1 to be submitted in the following format:

12.2.1

Soft copy (1 set) in CD ROM prepared in an acceptable


AutoCAD format.

12.2.2

Hard copy (2 sets) of all drawings (paper size in AO series) to


be folded and filed in a ring file using clear refills.

12.3 All as-built drawings shall be accompanied with a detailed drawing list,
indicating the project title/reference, type of service, drawing title and drawing
number.
