PETITIONER BAKKET N. BACNANG
I, BAKKET N. BACNANG, of legal age, married, Filipino, a resident of
#1 Siruc Iti Manga, Turtle Islands, Tawi-Tawi, under oath, hereby
depose and state:
PRELIMINARY STATEMENT
The person examining me is Atty. Carra Pangabac with address at #1
Siruc Iti Manga, Turtle Islands, Tawi-Tawi. The examination is being
held at the same address. I am answering his questions fully
conscious that I do so under oath and may face criminal liability for
false testimony and/or perjury.
Q1: Are you the same BAKKET N. BACNANG the petitioner in this
case?
A1: Yes sir.
Q2: Do you know the respondent LAKAY A. BACNANG?
A2: Yes sir, he is my husband.
Q3: Do you have proof of your marriage?
A3: Yes sir, I have marriage contract (Exh."A").
Q4: How and when did you meet the respondent?
A4: I met him sometime in 1976 when he was working as a waiter
in Green Turtle Soup Restaurant.
Q5: When did you marry him?
A5: After three (3) months of courtship, we got married in
December 28, 1976 in Blue Beach, Turtle Islands, Tawi-Tawi.
Q6: Do you have children?
A6: Yes sir, we have two (2) children, namely NAPINTAS N.
BACNANG, who was born on July 28, 1977 and NALAENG N.
BACNANG who was born on March 25, 1979.
Q7: Do you have proof of birth of your children?
A7: Yes sir, I have the certificate of live birth (Exh."B") of namely
NAPINTAS N. BACNANG and the certificate of live birth of
(EXh. "C") of NALAENG N. BACNANG.
Q8: Where did you stay after your wedding day?
A8: We lived in my parents' house in Green, Turtle Islands, TawiTawi.

Q9: What was the respondent's occupation while you were living
together as husband and wife?
A9: My husband worked as part time waiter. He has no stable job to
support our needs. We rely largely on my parents for our daily
sustenance.
Q10: How would you describe the respondent as a husband?
A10: He was irresponsible as husband. He gambles, drinks, smokes
marijuana and had an affair with another woman despite his
unstable and small income.
Q11: What did you do, knowing these weaknesses of your husband?
A11: I tried to confront him but he even got angry and he attacked
me physically. I just tried to endure the situation to save our
marriage for the sake of our children.
Q12: When you gave birth to your children, was he around?
A12: No sir, he was not present then. In fact, it was even my parents
who paid for my hospital bills and other expenses at Turtle
Islands General Hospital where I gave birth.
Q13: After you gave birth to your second child in March 1979, what
happen to your relationship?
A13: My husband did not come home until I heard that he was living
with another woman who works as a waitress in Green Turtle
Soup Restaurant.
Q14: Then what happened?
A14: After a month, he showed up and when I confronted him about
his concubine, he readily admitted their affair.
Q15: What was your reaction upon his admission of guilt?
A15: I find it unacceptable an unbearable and I finally decided to end
our relationship and lived with my two (2) children through the
support of my parents.
Q16: How long have you been living separately?
A16: Thirty seven (37) years, sir.
Q17: Did he support you and your children after your separation?
A17: No sir.
Q18: Did he ever visit you and your children after your separation?
A18: No sir.
Q19: Do you have pre-nuptial agreement regarding your properties?
A19: No sir.

Q23: Why did you execute this Judicial Affidavit?
A23: I am executing this Judicial Affidavit to attest to the truth of all
the foregoing facts, to serve as my direct testimony, and for all
other intents and purposes.
