Peoples Vigilance Committee on Human Rights (PVCHR), a program unit of


Jan Mitra Nyas works to ensure basic rights for marginalized groups in the
Indian society, e.g. children, women, Dalits and tribes and to create a
human rights culture based on democratic values. PVCHR ideology is
inspired by the father of the Dalit movement, Dr. B. R. Ambedkar, who
struggled against Brahmanism and the caste hierarchical system prevailing
in India.
Three comprehensive programs always integrate the combination of service
delivery and advocacy in its program components: (Comprehensive program
for survivors of torture and Organized Violence, Comprehensive program for
model villages and model blocks, Comprehensive program for women and
children sectors)
In 2004 PVCHR created first "people Friendly Village" to enable and amplify
the voice of the marginalized. Since then organization had implemented
projects on child rights issues with support from CRY (Child Right and You),
Sir Dorabji Tata Trust (India) and Global Fund for Children (USA). Dr. Lenin
founder of the organization was founding member of Bachapan Bachao
Andolan (Save the Child hood Movement) along with Mr. Kailash Satyarthi
and others. He organized, coordinated, and participated as Core Marcher in
Global March against Child Labour. Initiated the Fair Play Campaign
against use of child labour in Indian Sporting Goods Industry and The
campaign influenced FIFA, ICC (International Cricket Council), World
Federation of Sporting Goods Industry and Reebok to prohibit use of child
labour in producing their goods. JMN/PVCHR is a vibrant partner of
alliance working on child issues at state, regional, national and
international level.
Now PVCHR is working in 21 villages and 1 slum of Varanasi to ensure
the civil, political, social, economic and cultural rights of every child as
mentioned in four categories of UNCRC i.e. Right to survival, Right to
Development, and Right to Protection of children through (1) Direct activity
with children (2) Action with community (3) Direct action with local self
governance (4) Networking and policy advocacy, which is creating child right
grid model. (5) Facilitate effective implementation of other legislations for
child protection in the Model village.
Organization believes that Education will break the cycle of poverty, improve
equity, empower women, and create health awareness and moreover
improved democracy and accountability. So, in 2006 with the support of Sir
Dorabji Tata Trust runs Pre-Primary Center in Ayer and Bhaithauli for the
first learners. In 2007 Ms. Helma Ritscher, Chairperson, Indo- German
Society of Remscheid visited Ayer village and together with the community

and PVCHR core group and core team decided to build room in musahar
ghetto with economic assistance from Inwent, Germany through DIG.
Understanding the importance of education Mr. Sijjan and Somaru Musahar
donated the land to build the pre- primary centre with the kitchen. On 6th
September, 2007 Ms. Veena, District Magistrate of Varanasi and Mr. Kim,
Director-Trustee of May 18 Foundation and participants of 4th May 18
Academy of South Korea inaugurate this Eklavya centre.
Child for Peace and Peace for Child
Now 10 children parliament are functioning in 22 villages child rights centric
village with the participation of 195 children (127 female 94 male). The name
of the bal panchayat are on the name of eminent personalities and social
reformer such as Munshi Prem Chandra BalPanchayat, Savitri Bai Phule
Mahila Panchayat.
Vision
To establish a society which focuses upon children. A society where children
get citizenship, respect and happy childhood and opportunity to decide and
discuss.
Mission
To eradicate discrimination and strengthen society and administration to
establish a child focused society where each child gets equal opportunity.
Objective
To ensure each child gets citizenship, basic amenities (clean drinking
water, nutritious food, safe housing etc), quality health services and
care. If the family of the child is unable to provide these then it is the
responsibility of the government
All children get education without discrimination and punishment in a
fear free environment which focuses upon child rights. Children get
opportunity to develop personal abilities. Challenged children get more
attention and care.
Children should not be abused mentally or physically neither be
humiliated in any form.
They get adequate information, opportunity of expression and
thoughtfulness, freedom of religion, their thoughts should be
respected, and their opinion should be considered while taking a
decision that effects them.
Girls should get equal rights and opportunity in a safe environment so
that they live a secured life.

Key achievement
1. Nearly 1517 children between age group 6 14 got enrolled in
Government primary school.
2. Advocacy for the infrastructure development for providing quality
education in Government Primary and Middle school. the outcome of the
advocacy as follows:
Renovation of 2 toilet in school
Painting in 8 Primary school
Surfacing of playground
Appointment of teachers
Health check up
3. 633 children between age group 1 5 years received birth registration
certificate.
4. Health checkup of nearly 590 children between age group 0 5 year in
which 105 children were identified as extreme malnourished. 22 children
benefited with emergency assistance of 1000/- as direction given by
Government of Uttar Pradesh.
5. Activation of the PDS shop Ke
6. Distribution of 600 bags including the copies, crayon, pencil box to the
marginalized children to ensure the dignity of children.
7. Organized 120 Baal Sabha (meeting of children parliament)
8. Celebrated two children festival on the thematic issues i.e. Right to
Education and Right to Protection. In the program 350 children, parents,
social worker and musicians participated.
9. The organization is running one full time center in Baghwanla and
bridge course in Raup Ghasia Basti, Sonbhadra.
10. 250 children are receiving cooked food in Raup, Barhikalan and
Baghwanala.
11. Providing education to 2129 children in 20 madaras and 5 remedial
center Rampur and Jalapur blocks of Jaunpur and Kashi Vidyapith
blocks of Varanasi districts of Uttar Pradesh.
12. Capacity building of 45 members under School Management Committee
of targeted 15 schools.
13. 24 children got benefited under Integrated Child Protection Scheme.
14. The organization with support from Parul Shamra and 200 Swedish
donors launched SHAMA BICYCLE for freedom on 31st Decmeber, 2014.
The motive of this initiative is protection of girl from sexual abuse. The
bi-cycle will be distributed to girls in 2015
15. Launched campaign against culture of Rape on the auspicious occasion
of Bharti Mahila Mukti Diwas (death anniversary of Savitri Bai
Phule)i on 10 March, 2014. In the program various human rights
activist and academia shared the finding on the various issues related to

women and role of its stakeholder. In the interface two Survivors who
fought for women rights and dignity were honored. It is honour of
courage against culture of impunity and victim hood with a certificate
and financial support of 5000 Rs. The fund for honour provided by
Danish organization Dignity and German journalist.ii
16. The organization pay tribute to Nirbhaya on her death anniversary
Respect our Dignity to brave heart lady Nirbhaya. The children of
Munshi Prem Chandra Bal Panchayat paid tribute by singing song
(Now we have wings to fly) and further proceed with
musical tribute by Pandit Vikas Maharaj, Prabhash Maharaj and
Abhishek Maharaj. The panel discussed on the role of different
stakeholders and linked it with Masculinity.

Organized

PVCHR since its inception is working to establish rule of law through


participatory activism. In 2010 the organization adopted 60 model villages
for creating torture free model village. The role of village life in the Indian
culture and history is almost sacred. Hence, the construct of the model
village strategy is a key to public discourse on mechanisms of state
sponsored violence and suppression and keeping poor neighborhoods
excluded from the development process taking place elsewhere in India.
Model Village is pursuing progress in 60-70 villages as part of the
preventive campaign torture free villages.
Musician Against Torture: organized on 28th November, 2014 in Hotel
Kamesh Hut, Varanasi in memory of Justice Shri Rangnath Mishra(former
Chairperson of NHRC, Former Chief Justice of India and member of advisory
committee at
PVCHR:http://www.scribd.com/doc/59035158/Justice-Shri-RangnathMishra-meber-of-Advisory-Committe-PVCHR). The famous Maharaj Trio
Pandit Vikash Maharaj, Sarod Maestro and awarded with highest civilian
award of Uttar Pradesh, his son Pandit Prabhash Maharaj, Tabla Player and
Pandit Abhishek Maharaj sitar player performed in this concert. The
brochure of Musician Against Torture launched. Pandit Vikash Maharaj
Ambassador of PVCHR and founder of Musicians Against Torture appeals to
the Musician around the globe to join this campaign for creating torture free
globe.
Since 2010 PVCHR with the support of Dignity is creating 70 torture free
model villages in Uttar Pradesh and Jharkhand state of India. Since its
inception PVCHR is voicing against the torture and organized violence.

Key achievement
The organization observed international day against torture on 26 June in

(http://www.un.org/en/events/torturevictimsday/) as discussion on Neo
Dalit movement in context of preamble of Indian Constitution" and peoples'
agenda in the election manifesto of different political parties. The various
multi stakeholders Mr. C.P Rai, (Minister Samajwadi Party), Mr. Daddu
Prasad (Ex- Cabinet, Minister, BSP), Mr. Hemant Sharma, (National
President, Indian Federation of working journalist), Mr. Utkarsh Sinha
(Independent Journalist and Social Worker), Siddhartha Kalhans (President,
Lucknow Working Journalist Union), Mr. Hasseb Siddiqui, (State President,
UP Working Journalist Union) and Ms. Shruti Nagvanshi, (Convenor, VOP)
shared their experience and survivors shared their experience of being
tortured. Dr. Lenin Raghuvanshi gave welcome speech and key note
address by Lenin Raghuvanshi, Secretary General of PVCHR. In the second
session survivors of torture Akkar, Munni, Kupan Devi, Khanjati Mushar
shared their experience. Mr. Yogesh Bandhu, an independent consultant
shared the brief of all political parties election manifesto in the context of
torture.
The multi stakeholders Mr. C.P Rai, (Minister Samajwadi Party), Mr. Daddu
Prasad (Ex- Cabinet, Minister, BSP), Mr. Hemant Sharma, (National
President, Indian Federation of working journalist), Mr. Utkarsh Sinha
(Independent Journalist and Social Worker), Siddhartha Kalhans (President,
Lucknow Working Journalist Union), Mr. Hasseb Siddiqui, (State President,
UP Working Journalist Union) and Ms. Shruti Nagvanshi, (Convenor, VOP).
The program was published in the newsletter of the press club.
On 10th December, 2014 Department of Political Science, Jamia Millia
Islamia University in collaboration with The Origin, an NGO working for the
underprivileged section of society, observed Human Rights Day organized
program "Promotion and Protection of Human Rights: Contemporary
Issues and challenges" with an essay writing and poster making
competition held at the Department of Political Science. In this program Dr.
Lenin was the Chief Guest.iii
PVCHR trained 400 human rights defenders in two training program on
human rights with the support from NHRC In the first training Shri Indrajit
Kumar, Assistant Registrar, National Human Rights Commission (NHRC),
New Delhi was the chief guest in the workshop.
67 bonded labours rescued from brick kiln and received 20,000 of
rehabilitation package each.
84 human rights activists (who converted from survivors to activist) from
torture free model villages shared their local problem, non compliance of
NHRC and public hearing to Shri Anil Parashar, Focal person for human

26 Human Rights Defenders from Caritas trained on ToT Workshop on
Testimonial Therapy from 14th-20th May, 2014. The workshop was formally
inaugurated by Sri Anil Parashar, Joint registrar and Focal Point for Human
Rights Defenders (HRD), National Human Rights Commission, Rev. Lumen
Monterio, Chairman, Caritas India, Rev. Cerald John Mathias, Bisop,
Lucknow and Dr. Lenin Raghuvanshi at Prabhat Tara, Lucknow. Others
who graced the programmes were Father Melwin, Mr P.M. Philip, HoD,
Partner Support. The training from Caritas
PVCHR with Justice Venture International created State action plan. PVCHR
intervened to Prime Minister and Chief Minister of Uttar Pradesh for creating
model labour free village.
Detention Watch:
In April, 2011 PVCHR[i] in consultation with member organization of
NATT[ii] officially launched detention watch to monitor any type of detention
happening with the adult and children in Judicial Custody, Police Custody,
Custody in Remand Home and Administrative Custody to strengthen and
expansion of its previous work of PVCHR for focusing on rights of prisoners
and rights during the times of detention.
The strategy of the detention watch based on 1.Policy to practice and 2.
Practice to Policy. Article 21 of the Constitution guarantees the right of
personal liberty and thereby prohibits any inhuman, cruel or degrading
treatment to any person whether (s) he is a national or foreigner. Already
many guidelines and direction from time to time were given by Honble
Supreme Court and High Court of various state courts for the well being of
prisoners and rights during detentions.[iii]
The strategic actions are as follows which is based on previous
experience:
1. Court Intervention: Public Interest Litigation (PIL)[iv] and writ petition
2. Meta- Legal Intervention: With various concerned authorities and
National Human Rights Commission, New Delhi.
3. Rehabilitation of the acquitted prisoners.
4. Policy level intervention for prison reform, advocating for the
implementation of various recommendations by the committee and
intervention on the trial procedures.
5. Monitoring the prison and homes through using of Right to
Information Act to know actual knowledge condition of the prisons.
6. Visit to juvenile home and visit to correction home for women in
collaboration with QIC-AC network.

7. Tracking the cases of custodial death, torture in police custody,


administrative custody and homes through various site alerts.
Key Achivement
NHRC ordered for CBCID enquiry (case no. 43832/24/24/2013) against the
police officials in the case of Ram Laut, due to uprooting the ear of an old
man.iv
The Honble Supreme Court commuted the death sentences into life
imprisonment of Suresh and Ramji Chauhanv.
The NHRC ordered for 10 lakhs Rupees compensation in the case of
Sahil, a small boy of 10 years was tortured and kept under detention all
night by the Police. It is alleged that the victim is a beggar and on
21.05.2013, he ran after a woman seeking alms and received Rs. 2 from
her. She later complained to the police that the boy stole her cheque of
large amount. The next morning, she informed the Police, that she had
found her missing cheque. One person gave Rs.600/- to his mother who
took her to hospital and got medical treatment to him. The allegations of
unlawful detention of and torture to victim boy, and violation of Juvenile
Justice (Care & Protection) Act 2000 as well as Schedule Caste and
Schedule Tribe (Prevention of Atrocities) Act, 1989 required further
enquiry into the matter. The Commission vide its Letter dated
08.07.2014 directed the Director General of Police, Uttar Pradesh to get a
fresh enquiry conducted in the matter from a Superior Police Officer of
any District other than District Varanasi. The Commission vide its Show
Cause Notice dated 11.07.2014 called upon Chief Secretary, Govt. of
Uttar Pradesh to show cause, why compensation of Rs. 1,00,000/- shall
not be granted to the victim as per Section 18 of the Protection of Human
Rights Act, 1993.
Intervention for releasing of inmates who spent more than 14 years in
Varanasi central prison. The Ministry of home affair wrote letter to Chief
Secretary, Government of Uttar Pradesh in letter no. 15011/253/3013HR-II to take appropriate action in this regards.vi

died in police custody.

After intervention with NHRC regard with the status of overcrowding in


prisons in Uttar Pradesh.
The districts where there are no prisons - Kasganj, Chitrakoot,
Gautam Buddha Nagar, Ambedkernagar, Shrawasti, bagpat,
Sonbhadra, bareilly, Azamgarh prisons are being constructed which
shall increase capacity for 11326 prisoners. Apart from this increase
in number of barracks is underway in different prisons, which shall
increase the capacity by 1120.
Under the CRPc Section 436 (A) and 436 (1) legal assistance is being
provides to identified prisoners and their case is being presented
before the court. In the year 2013 the total number of such identified
prisoners under section 436 (A) and 436 (1) was 2609 and out of
these 200 were set free after legal process. Those identified under
bailable section 436 (1) 22937 and out of these 19281 could get free.
In case no. 10700/24/4/2013-AD NHRC summon to DM Allahabad
on the issue of custodial death.ix
NHRC on the about the discrimination main reason behind high
number of Muslims in prisons (given below petition) on the complaint
NHRC gave direction to Ministry of Home Affair to take appropriate
action. Ministry of Home Affairs wrote Chief Secretary for taking
further appropriate action.
In 2001 PVCHR started using information technology for torture prevention
advocacy with a news title Women paraded naked in Karnataka
According to the news reporting she belongs to the scheduled caste and
resides in Onenur village in Bellary district of Andra Pradesh. The men were
angry of their community, who had eloped with a dalit boy last month,
returned to the village and blamed the woman for instigating her. On the

complaint NHRC took cognizance and called for the report from concerned
authorities.
In 2005 PVCHR started it blogger www.pvchr.blogspot.com when hardly
organization in India was using new technology for torture prevention and
advocacy. PVCHR is using communication tools and media to reach out to
the widest coverage of public and stakeholders in a cost effective manner for torture prevention and advocacy.
The motive behind using IT for torture prevention advocacy as follows:
Web as the infrastructure for storing and dissemination of
institutional memories and custom references and used with the
objective to transform private pain into political voice.
To create a closer, more intimate network of individuals &
organizations. To provide an opportunity to participate in debates on
various activities & raise key issues.
To share information with intention to enrich each other on activities
and also on testimonial therapy.
To reach out with the survivors suffering to the UN, allied human
rights organizations, policy makers, academicians and Civil Society at
large
PVCHR used online social media as a cost effective medium for the
monitoring the cases of human rights violation across India through google
alert on various thematic issues and following daily newspaper on many
sources i.e. facebook, twitter and etc.
The complaint to the concerned authorities is done through email. Within 24
hours organization received email confirmation from office of Director
General of Police and comment from various concerned authorities on the
investigation report. Even the office of Chief Minister of Uttar Pradesh sent
the message of the action taken in concerned cases.

In the case no. 497/22/36/2012-CL NHRC issued summon
for the personal appearance of District Magistrate, Trichy,
Tamil Nadu before the Commission on 17.06.2014 along
with the report.
In the case no. 454/22/15/2012-AD NHRC issued summon
for the personal appearance of District Magistrate, Madurai,
Tamil Nadu before the Commission on 30.9.2014 at 11.00
AM along with the requisite report.
In the case no. 28226/24/31/2013-AD NHRC issued
notice to DG (I) to collect the requisite reports from
concerned authorities within eight weeks along with an
explanation as to why the said custodial death has not yet
been intimated to the commission.
In the case no. 345/6/1/2012-AD District Judge,
Ahmedabad (rural) to get the magisterial enquiry report
prepared by the Metropolitan Magistrate-21 expedited and
submit the same before the Commission within six weeks.
Despite that no response has been received. The
Commission takes note of the non - submission of
required Magisterial enquiry report. The Registrar (Law),
NHRC may send a reminder to the concerned District
Judge to expedite the Magisterial enquiry report
In the case no. 952/12/22/2012-AD Issue a notice to the
State Government of M.P. at Bhopal through its Chief
Secretary to show cause within six weeks as to why
suitable monetary relief/compensation be not directed to be
paid by the State Government to the next of kin/legal heirs
of deceased prisoner Pappu @ Prakash for violation of
human rights to life.
21 May, 2014 NHRC directed for the compensation of 21
hundred thousand Rupees only to the family survivors of
communal violence in Meerut.xiii

Neo dalit movement for creating comprehensive, medley, plural and
inclusive culture

Banaras Sammelan (Banaras Convention) observed on August 09, 2014


i.e. on the occasion of August Kranti Day at the Moolgadi Kabir Math, Kabir
Chaura, Varanasi, India from 11 onwards. The programme started with the
classical music by Varanasi famous Maharaj trio Pt. Vikash Maharaj
(renowned Sarod player) and Pt Prabhash Maharaj (Tabla player).
Representative of various religious leaders Swami Avimukteshwaranand
(representative of Shankaracharya of Dwarka peeth), Maulana Abdul Batin
Nomani, Sahar e Mufti, Maulana Haarun Rasheed Nakshbandi, Bhante
Kirti Narayan and Father Gabriel (Director of Diocese, Varanasi) enlightened
on the role of religion and spirituality in pluralism. The religious leaders
jointly released report of Kashi Kumbh to save river Ganga ji. On the
occasion, Ms. Teesta Setalvad, a veteran social activist, Dr. Tir Vijay Singh, a
veteran journalist and Senior Editor of Hindustan and Mr. Nageshwar
Patnaik, a veteran journalist were honoured with Jan Mitra Awards for their
incredible contributions and commitment. Similarly PVCHR Ambassador
award was given to Pandit Vikash Maharaj, Sarod Maestro and Mr.
Prabhash Maharaj, Tabla Maestro as legendary musicians for protecting and
asserting pluralism and inclusiveness around the world.xv
The convention also came out with Banaras Declaration which was sent to
all stakeholders. Convention broke the fear of sectarian thinking against
minority
Fr Bernardo Cervellera, Director of Asia News and 31 other people from Italy
visited Musahar ghetto Sarai village of Pindara, Varanasi as tribute honour
to heroic nonviolence fight of Musahar people. Mahveer and Ram Dayal
provided insights of their fight and success of right based movement and its
positive impact. Fr Bernardo Cervelleraxvi, Director of Asia Newsxvii says," We
are your brothers and sisters. We, Christian and Catholic support all of you
as a human being: love of god."xviii
On 2nd October, 2014 i.e. Birthday of Mahatma Gandhi the Sadbhawana
March (communal harmony March) conducted in three model village
(mubarakpur bodhipur piyarepur chintaura) against the communal fascism,
sectarian thinking and police torture march focused on plural and inclusive
culture.
Candle March on the International Women Day i.e. 8 March, 2014 for
making awareness on D.K Basu guideline related to women.
On 14th February, 2014 organized focus discussion on witch hunting and
role of police in registering case related to the women at Behradih,
Koderma district of Domchach
On 21st October, 2014 in Kudi Mushar Basti organized fest and invited
people from different caste in this model village. The program started with
for discussion on the education. The people from different communities
such as Upper caste and Other Backward Caste (OBC) contributed money

and items for this program. First time the people from different caste sit
together and eat fest.xix
On 21st October, 2014 march for the women rights organized in
Kharagpur model village. In the starting of March discussion on the new
laws and amendment in IPC and Cr.Pc.xx
