For many years now, cases of students getting involved in brawls have been reported
nationwide. Reports of these brawls have increased in number and causing many problems like
disturbances to society, decreased morality, and the main point is young generation as nations
hope are completely shattered. Quoted in palembang.tribunnews.com dated 23/07/2012, the
chairman of the National Commission of Children Protection, Arist Merdeka Sirait, said that
during the first six months of 2012 noted 139 brawl cases, its more than the last year which is
128 cases.
Children havent fully been able to take responsibility for their actions, thats why the
process of law and punishment is apart from adults. In the Act of Children Protection, child is
someone who hasnt 18 years old yet, including fetus in the womb. Until now, theres no set of
the act in the whole ranging of legal process and justice for under aged criminal, starting from
arrest, detention, investigation, and examination at the trial. The law proceedings only refer to
The Act No. 3 of 1997 about Juvenile Court Act and the Rights of Children Convention which
has been ratified into Presidential Decree No 36 of 1990. Juvenile Court Act is determined based
on the age of underaged criminal, returned to parents for 8 to 12 years old and dropped criminal
for 12 to 18 years old, but it isnt effective anymore to decrease the number of brawls case.
On 24th of September, one student in Jakarta passed away and two others got
injured in a brawl between two neighboring senior high schools, SMA 70 and SMA 6. This is
just one example of what has been happening to teens all over Indonesia. As one of teenaged, I
believe that underaged criminals have their own reasons, like broken home, being set aside from
society, low educated, and everything else which make them want to prove their existence. I am
quite certain that most of the students who were involved in brawls were only involved due to
peer pressure. Deep down, they probably wouldnt have wanted to get involved in such violent
actions. If arrested or rehabiliated, punishment still gives no effect, its better for educated people
to help children fight for their rights like us.
Teenaged community services as one of the way, it means as a group of teenage who
help under criminal aged to be a better person, because the communication among peers is more
communicative in psychological point of view.
This way will be better if the government also makes the act in the whole ranging of
legal process and justice for under aged criminal.
If Densus 88 is able capture terrorists throughout the country, it is possible for the

school authorities to be able to find the culprits among their student.


Society and law must be taken along together to stop or at least to decrease brawl case.
It is hoped that fighting and brawling student will no longer occur.
