havebeenlawfullyadmittedtoCanadaforpermanentresidenceand
(c)apersonagainstwhomaremovalorderhasbeenmaderemainsunderthatorder

5.(1)TheMinistershallgrantcitizenshiptoanypersonwho
(a)makesapplicationforcitizenship
(b)iseighteenyearsofageorover
(c)isapermanentresidentwithinthemeaningofsubsection2(1)oftheImmigrationand
RefugeeProtectionAct,andhas,withinthefouryearsimmediatelyprecedingthedateofhisor
herapplication,accumulatedatleastthreeyearsofresidenceinCanadacalculatedinthe
followingmanner:
(i)foreverydayduringwhichthepersonwasresidentinCanadabeforehislawfuladmission
toCanadaforpermanentresidencethepersonshallbedeemedtohaveaccumulatedone
halfofadayofresidence,and
(ii)foreverydayduringwhichthepersonwasresidentinCanadaafterhislawfuladmission
toCanadaforpermanentresidencethepersonshallbedeemedtohaveaccumulatedone
dayofresidence

(1.1)Anydayduringwhichanapplicantforcitizenshipresidedwiththeapplicantsspousewho
atthetimewasaCanadiancitizenandwasemployedoutsideofCanadainorwiththeCanadian
armedforcesorthefederalpublicadministrationorthepublicserviceofaprovince,otherwise
thanasalocallyengagedperson,shallbetreatedasequivalenttoonedayofresidenceinCanada
forthepurposesofparagraph(1)(c)andsubsection11(1).

(2)TheMinistershallgrantcitizenshiptoanypersonwhoisapermanentresidentwithinthe
meaningofsubsection2(1)oftheImmigrationandRefugeeProtectionAct,andistheminorchild
ofacitizenifanapplicationforcitizenshipismadetotheMinisterbyapersonauthorizedby
regulationtomaketheapplicationonbehalfoftheminorchild.
WaiverbyMinisteroncompassionategrounds

(3)TheMinistermay,inhisdiscretion,waiveoncompassionategrounds,
(a)inthecaseofanyperson,therequirementsofparagraph(1)(d)or(e)
(b)inthecaseofaminor,therequirementrespectingagesetoutinparagraph(1)(b),the
requirementrespectinglengthofresidenceinCanadasetoutinparagraph(1)(c)orthe
requirementtotaketheoathofcitizenshipand
(c)inthecaseofanypersonwhoispreventedfromunderstandingthesignificanceoftaking
theoathofcitizenshipbyreasonofamentaldisability,therequirementtotaketheoath.
Specialcases

(4)DespiteanyotherprovisionofthisAct,theMinistermay,inhisorherdiscretion,grant
citizenshiptoanypersontoalleviatecasesofspecialandunusualhardshiportorewardservices
ofanexceptionalvaluetoCanada.

(5)TheMinistershall,onapplication,grantcitizenshiptoapersonwho
(a)isbornoutsideCanadaafterthecomingintoforceofthissubsection
(b)hasabirthparentwhowasacitizenatthetimeofthebirth
(c)islessthan23yearsofage
(d)hasresidedinCanadaforatleastthreeyearsduringthefouryearsimmediatelybeforethe
dateofhisorherapplication
(e)hasalwaysbeenstatelessand
(f)hasnotbeenconvictedofanyofthefollowingoffences:
(i)aterrorismoffence,asdefinedinsection2oftheCriminalCode,
(ii)anoffenceundersection47,51or52oftheCriminalCode,
(iii)anoffenceundersubsection5(1)oranyofsections6and16to22oftheSecurityof
InformationAct,or
(iv)aconspiracyoranattempttocommit,beinganaccessoryafterthefactinrelationto,or
anycounsellinginrelationto,anoffencereferredtoinsubparagraph(ii)or(iii).
Nooathrequired

(6)Apersonwhoisgrantedcitizenshipundersubsection(5)isnotrequiredtotaketheoathof
citizenship.
