TERMS & CONDITIONS AS AN APPRENTICE OF THE JABATAN PERKHIDMATAN AWAMMANAGEMENT APPRENTICESHIP PROGRAM (JPA-MAP)

In reference to the Apprentice attachment dated 9 March 2015 issued on Jabatan


Perkhidmatan Awam-Management Apprenticeship Programme (JPA-MAP) launch by
Jabatan Perkhidmatan Awam (JPA) to you, we, Talent Corporation Malaysia Berhad
(TalentCorp) as the Secretariat JPA-MAP, are pleased to inform that you (Apprentice)
have been selected to participate in the JPA-MAP.
As an Apprentice in the JPA-MAP, you have been assigned a Host Organisation, as specified
in the Apprentice Placement Letter for a period of 3 months commencing from 1 April 2015
to 30 June 2015 (Apprenticeship Period).
The terms and conditions of your participation in the JPA-MAP are as follows:
1.

Roles and Responsibilities


1.1

You are required to report for duty as an Apprentice at the assigned Host
Organisation on 1 April 2015.

1.2

As an Apprentice at the Host Organisation, you are required to:


(a) fulfill all roles and responsibilities assigned to you by the Host Organisation
throughout the Apprenticeship Period to the best of your ability under the
supervision of the Host Organisation;
(b) complete all tasks and activities assigned and perform all functions as may
be reasonably required of you diligently and responsibly during
Apprenticeship Period;
(c) comply with all applicable rules, regulations or directives of the Host
Organisation; and
(d) observe any directives issued by TalentCorp in accordance with the terms
and conditions contained herein, the Apprentice Placement Letter, and any
variations and/or amendments thereto.

Allowance
2.1.

As an Apprentice under the JPA-MAP, you will be given a monthly allowance


of RM1,500 per month (Allowance) throughout the Apprenticeship Period.

2.2.

The Allowance will be credited into your CIMB Bank account at the end of each
month of the Apprenticeship Period or on any other date as may be deemed
necessary by TalentCorp. For this purpose, you are required to provide your
CIMB Bank account number to TalentCorp together with copies of myKad and
the first page of your CIMB savings account bank book or CIMB Internet
Banking statement (for verification of your account number). If you do not have
an existing account with CIMB Bank, you are required to open one. Please take
note that the Allowance will be paid through an ACTIVE CIMB BANK account
held under your name only.

2.3.

Notwithstanding anything herein, the payment of the Allowance is subject to


your compliance with the terms and conditions of your participation in the JPAMAP, including but not limited to, any variations and/or amendments thereto
and any directives issued by TalentCorp or the Host Organisation.

2.4.

TalentCorp reserves the right to stop payment on the entire amount or any
part of the Allowance and/or request for a refund of the Allowances paid to
you, in the event that you withdraw your participation before the completion
of the JPA-MAP and/or the Apprenticeship Period, without TalentCorps prior
written consent, or should you breach any of the directives issued by
TalentCorp, terms and conditions, contained herein also and any variations
and/or amendments thereto, which may lead to your termination from the
JPA-MAP.

Medical
3.1. You are required to declare to inform TalentCorp in the substance prescribed by
TalentCorp, together with the acceptance of the terms & conditions contained
herein:
3.1.1. regarding all illness and any form of allergies from which you suffer;
and
3.1.2. that you do not use any form of drugs and are not under the influence
of any drugs (save for any medication prescribed to you as part of your
treatment in respect of an illness and any form of allergies which you
suffer from).

3.2. You are eligible for paid medical leave during the period only with certification
from a registered medical practitioner. For the avoidance of doubt, you are only
entitled to a maximum of three (3) days medical leave throughout
Apprenticeship Period. Your entitlement to medical leave will be in accordance
to the Host Organisations rules and regulations. In the event you are unable
and/or fail to produce a certified medical leave to your Host Organisation, you
shall refund the Allowance received by you in advance based on the total
number of days of non-attendance of the JPA-MAP within 14 days from the date
of TalentCorps demand notice.
4.

Employment
4.1. At all times, TalentCorp does not guarantee you any employment with any
company including, but not limited to, the Host Organisations, its related
corporations or any organisations.
4.2. Your overall performance will be evaluated based on apprentice mid-term
review assessment and end-term assessment by your supervisor and TalentCorp.
You are required to fulfill all
4.3. In the event you are offered employment from any organisation other than the
Host Organisation during the Apprenticeship Period, you must immediately
inform and declare such offer to the Host Organisation and TalentCorp. The
organisation offering employment shall be a Malaysia-registered entity as
approved by TalentCorp. You are to discuss the job offer with your Host
Organisation.
4.4. If you decide to accept the offer, you are required to obtain a written consent
from TalentCorp by giving a two-weeks written notice of withdrawal together
with the relevant documents to both TalentCorp and your Host Organisation.
4.5. Upon receipt of written consent by TalentCorp, you shall withdraw from the JPAMAP and you shall no longer be entitled to participate in the JPA-MAP and
receive any allowances under paragraph 2 above. Upon the withdrawal, any
Allowance made in advance to you shall be refunded to TalentCorp on pro-rated
basis within fourteen (14) days from the date of withdrawal.

5.

Absenteeism
5.1

Where you have been absent from the JPA-MAP for more than two (2)
consecutive working days, without informing or attempting to inform the Host
Organisation of the reasons for your absence by any means approved by the
Host Organisation, you will be deemed to have breached the terms and
conditions contained herein and/or amendments thereto, and TalentCorp

reserves the right to terminate your participation from the JPA-MAP under subparagraph 8.3 below.

6.

Covenants
6.1

You hereby agree and covenant that you shall during the JPA-MAP abide by
the following :
6.1.1 You shall comply with all of the terms and conditions contained herein,
the Apprentice Placement Letter and any variations and/or
amendments thereto and directives issued by TalentCorp. For the
avoidance of doubt, TalentCorp has the absolute discretion to vary
and/or amend any terms and conditions contained herein, the
Apprentice Placement Letter and in such manner as it deem fit and such
variation and/or amendments shall be communicated to you.
6.1.2 You shall not be involved in any criminal activities (excluding minor
traffic offences).
6.1.3 You shall not commit any act or do anything which may directly or
indirectly bring you, the JPA-MAP or TalentCorp into disrepute.
6.1.4 You shall not engage in or undertake any employment whether full or
part-time and whether paid or unpaid without the prior written
consent of TalentCorp.
6.1.5 You shall devote your entire time, performance, ability and attention to
the JPA-MAP and be subjected to performance review throughout the
Apprenticeship Period.
6.1.6 You shall not withdraw from the JPA-MAP without the prior written
consent of TalentCorp.

6.2

In the event that TalentCorp has reasonable suspicion that you have breached
any of the covenants under sub-paragraph 6.1 above, TalentCorp has the
right to take disciplinary action, including but not limited to suspending your
participation in the JPA-MAP, pending investigation by TalentCorp and
withholding payment of any part of your Allowance. Upon the conclusion of
the investigation by or on behalf of TalentCorp or JPA, if it is found that:
6.2.1 You have not breached any of the covenants under sub-paragraph 6.1
above, TalentCorp shall inform you that you may resume your
participation in the JPA-MAP. For the avoidance of doubt, you shall only

be entitled to receive any Allowance from the date you resume your
participation in the JPA-MAP and you shall not receive any Allowance
for the period of your suspension; or
6.2.2 You have breached any of the covenants under sub-paragraph 6.1
above, sub-paragraph 8.3 below shall apply.
7.

Major Misconduct
7.1. In the event that during the Apprenticeship Period you are found to have
committed a major misconduct as determined by TalentCorp, TalentCorp
reserves the right to terminate your participation with the JPA-MAP forthwith in
accordance with sub-paragraph 8.3 below.
7.2. Major misconduct includes but is not limited to the following:

8.

Committing a criminal offence, resulting in a conviction by a recognised


court of law;
Persistent absenteeism or late attendance;
Theft;
Fighting or violence resulting in bodily injury;
Sabotage;
Sexual harassment;
Close proximity;
Embezzlement;
Revealing confidential information of the JPA-MAP and/or TalentCorp
to external parties;
Drug or alcohol consumption;
Insubordination or lack of discipline (e.g. not observing the dress code
or curfew, refusing to participate in activities/scheduled programmes);
Disruption to programme operations;
Damage to property; and
Others, as may be deemed appropriate.

Termination
8.1. Your selection as a participant of the JPA-MAP is based on the selection made by
the TalentCorp and/or the medical declaration form under sub-paragraph 3.1
above. TalentCorp reserves the right to terminate your participation from the
JPA-MAP in the event that any information provided by you is found to be
incorrect, false and/or misleading.
8.2. TalentCorp may also terminate you from the JPA-MAP, should you be found to
be a non-performing participant or display lack of discipline or commitment.

8.3. By accepting this Apprentice Placement Letter to participate in the JPA-MAP, you
hereby agree and declare that if you breach any of the terms, conditions and/or
covenants as stipulated under herein, the Apprenticeship Placement Letter and
any variations and/or amendments thereto and/or, notwithstanding anything
else contained herein:
i)

failure to report for duty as the Apprentice at the assigned Host


Organisation on 1 April 2015 at 9.00 am without any valid reason;

ii)

abandon the JPA-MAP before the completion of the Apprenticeship


Period without complying to the relevant requirements; or

iii)

refuse or by your misconduct, render yourself unsuitable to participate


in the JPA-MAP;

TalentCorp reserves the right to take any action against you including but not
limited to terminate your participation in the JPA-MAP forthwith and you shall
be liable to refund the Allowance received by you in advance (if any) on a prorated basis within 14 days from the date of termination.
8.4. TalentCorp will notify JPA on any breach of the terms and conditions of the JPAMAP and/or termination from the JPA-MAP. JPA shall have the right to take any
further actions against such Apprentice, as deemed fit under any agreement
executed between the Apprentice and the government.

below.
