Peter,
while I do not practice a religion I am well aware that the Bible as like the Koran includes
parts which do not fit in todays society. I reproduce below also some emails I received, showing
it is not just my make up, and as one Muslim writes there are basically 2 types of Muslims, those
being the Mecca Muslims (so to say the peaceful once) and the Medina Muslims (those
who have violent tendencies).
How would the Greater City of Bendigo take it is the Medina Muslims were to pursue that
their Islamic laws is above any council by-laws?
As referred to in the quotations in France alone there are about 750 Muslims no go zones and
surely not something one would desire for Bendigo or for that any other place!
What is needed to be understood is that what was written numerous centuries ago needs to be
understood to be in a different kind of environment. and while it may be argued that for example
a constitution (Commonwealth of Australia Constitution Act 1900 (UK) is to be understood as
was the meaning of words at the time but then again you cannot so to say cherry pick the best of
both worlds. As such, if one desires to live according to the rules of many centuries ago then do
not expect to rely for example on Centrelink payments as that didnt exist centuries ago. Neither
us a car as they too didnt exist then.
For a council to accept a Mosque to be built without knowing what kind of religious doctrine will
be used I view is totally irresponsible. After all those using the Mosque may view that council
has accepted that their kind of (religious) law is permitted and as such council would have a hard
time to afterwards objecting because it should have dealt with that before allowing a Mosque to
be build, if at all.

In todays society to expect someone to be put to death for working on the 7th day would be
an absurdity. One also then has to ask if the sabbath is on the Saturday or on the Sunday,
pending a persons religious views.
For many the first day of the week is Monday when one commences to work whereas for others
it is Sunday, just that it is not the first day of work.
What however is important is to understand that what may have been acceptable many centuries
ago would now be absurd.

It is clear that what may have been deemed suitable many centuries ago simply is so to say
totally out of whack in todays society. This also because religious laws were not so much
subject to statute laws. Many countries still apply as they interpret religious laws, but for
example in turkey the Burka/Hijab is not enforced whereas in another country it might be held an
enforceable religious law.
It is the irresponsible conduct of councilors/politicians who blatantly disregard to deal with
issues appropriately and fail to so to say integrate new comers coming from a different culture
that those then moving in simply are so to say under a delusion that their own kind of religious
laws override not just council by-laws but any statute law.
Those who are attending to a Mosque may then end up being indoctrinated that the Mosque is a
sovereign entity on its own and beyond the rule of law, etc.
Doesnt the Mosque show that the western society equality of men and women do simply not
apply to a Mosque? As such why would a person entering this kind of world not accept that
indeed a Mosque is more than just some religious place but is a sovereign entity.
As this gender equality is wiped away by allowing a Mosque to be built. It is where we made
clear that those who follow religious teachings can blatantly disregard our western society rule of
law!
In my view any building, for whomever and wherever, should be under the strict condition that it
must operate within the provisions of Australian common law and Statute law.
Do keep in mind that you as councilors may end up with blood on your hands if it turns out
that the Mosque will be a source of extremism and locals may die as result of this.

In this book I created a fictional terrorist attack where it included people putting mail in a
refrigerator to refrigerator to kill the germs. My wife as editor held it was absurd. Yet, September
11 eventuated a mere few months later and people were doing so in real life.
I wrote how terrorist were using a place to store weapons and the same could be applied
anywhere in Australia, including Bendigo and no one would know the better of it.
If I as an author had to write a crime movie regarding a Mosque then I could device incidents
you never even would dream about.
As I reported to the Federal Government I often purchase 15 or more sim cards, mobile phones,
etc, without any business keeping records that I have them. Yet, I do so in a lawful manner.
It underlines that all those so called anti-terrorism laws are useless and only robbing law abiding
citizens of their rights, while real criminals can escalate their violent programs.
If I can without any problems purchases sim cards and mobile phones without any records of
such purchases then surely those contemplating terrorism can likely do so also.
For sure by the time I use a simcard or mobile they become registered, but do you really think
that any terrorist would worry about this when perhaps within minutes going to use it?
There appears to be no system in place to have so to say warning bells ringing if someone
purchase 10 or more simcards/mobile phones in one purchase without any being then recorded to
whom it was sold.
And when it comes to any Mosque, do you really think the police can just drop in to check what
is going on and what is stored? More than likely they will be criticized for racism, regardless
they may just do their job. Where a Mosque is also serving for military purposes (religious
Muslims) then forget having someone standing at the entrance checking what may or may not be
driven in by vehicles. There are other ways to get it in.
But for now just consider the quotations below and you may get the message that the decision to
allow a Mosque to be built may just have been not just the dumbest but the most irresponsible
thing that could have been done.

Delving into Muslim law (aka Sharia or Islamic law) is not a pleasant experience for fans of human rights,
a scary time machine trip to medieval times.
The classic law of Islam is chock full of jaw-dropping, medieval and theocratic stipulations as if the Old

Testament of the Bible were applied in our modern world as law. For a student of modern common law or
civil law, to delve into Muslim law is to occasionally pause and rub one's eyes to remind oneself that this is
not fiction: this is the law that governs millions of Muslims worldwide.
Now You See It, Now You Don't
Not surprisingly, many modern Muslims take great pains to distance themselves from their historical, core

law, or they state it and then quickly follow with an apologetic but polite criticism or a generic statement that
it is "misunderstood" or that "myths" are harboured.

Many, if not most, Muslim jurisdictions have simply repealed the edge off their historic legal code, the
Koran, by gradually introducing modern law by statute. Turkey, for example.
But not all.
Some, such as Saudi Arabia, Sudan, Nigeria, Iran and Mauritania, proudly trumpet a full or almost complete
adherence to Muhummads 652 A.D. Koran. Parts of Nigeria, Sudan, Mauritania, Libya, Tajikistan,
Afghanistan ..... millions of Muslims fall under the rule of classic Muslim law.
Some Muslim states adopt international or domestic laws to appease Western friendlies but which are not
worth the paper they are written on. No steps are taken to promote or enforce those laws in the rural
communities, which continue their traditional Sharia ways unabated. When a Muslim father interdicts his

daughter from attending school in some rural Iraqi village claiming the Divine Way, there are no truant
officers intervening citing the Universal Declaration of Human Rights.
One of the most astonishing features of Muslim law is that Sharia courts, where they exist, claim personal
jurisdiction over Muslims everywhere. Thus, a Muslim transgressing Muslim law in Canada is exposed to
Muslim law punishment if he makes himself available to Saudi Arabia authorities.

Secondly, Muslim law requires Muslims to obey its authority in preference to national authorities, no matter
where they live. Every law that is incompatible with the word or spirit of Islam is unlawful for Muslims. So
much for a citizenship oath.
Women, Second Class
The ancient legal text Fatawa-i-Alamgiri uses chilling words to describe the legal impact of marriage in

Muslim law:
"[M]arriage ... subjects the wife to the power of restraint (by the
husband) and on her it imposes submission to him when summoned to the
couch and confers upon him the power of correction when she is
disobedient or rebellious...."

That is not just an extract from Muslim legal history.

That is still the law of Islam circa 2010.
In 2007, a female Muslim lawyer, Nadjma Yassari wrote of present-day family law in Iran, that the husband
within a Muslim marriage can control his wife's employment and:
".. has the last word in all affairs concerning the outside world and in

internal family disputes....

"The wife (has) to submit to his will."
In his An Introduction to Islam Law, Oxford and Columbia University professor Joseph Schacht wrote, quite
seriously:
"The legal position of women is not unfavorable. The woman is, it is

true, considered inferior to the man.... As regards inheritance ... she

is counted as half a man. On certain grounds, the husband has the right
of correction."
These are not the words of a sheik; these are the 1964 words of an English law professor.
Nothing has changed. In his 2007 book, Professor Francois-Paul Blanc of Perpignan University (France),

wrote that in Muslim law:

"The wife must obey all reasonable requests from the husband and ... must
not refuse him.
"The wife must ... follow her husband to be family home and she must not
leave it without the authorization of her husband or of a judge."
According to the Koran (IV-34), the obligation of marital faithfulness is applicable only upon the wife.
Fyzee articulates this legal effect of a valid marriage to a Muslim man in a Muslim jurisdiction:
"The husband is entitled to restrain the wifes movements in a reasonable
manner and to exercise marital authority."

Verma writes:
"It is unlawful for a Mohammedan to have more wives than four at one and
the same time. It is unlawful for a Mohammedan woman to have more
husbands than one at one and the same time."
Verma also points out that among the rights belonging to a Muslim husband is:

"Corporal punishment of the wife (and) control her movements. The husband
is ... entitled to exercise a reasonable control on the movements of the
wife."
The witness requirements for a nikah (marriage): 2 male witnesses or 1 male and 2 females!
There is no minimum age for Muslim girls to enter marriage, as long as they have attained puberty.

Of Bondage and Crime

In Muslim criminal law where it remains untouched by statute, if a woman is the victim of a murder or any
other type of physical harm (quesas), she, or her surviving family, is not allowed to invoke the eye for an
eye, tooth for a tooth retaliatory punishment upon the aggressor. She can only obtain financial compensation
(diyya).

A Muslim father has considerable rights in regards to his children including that of djabr, or a forcing the
child into an arranged marriage. He also has the right to rent out the services of his male children.
Muslim children, on the other hand, are not allowed to dine at the same table as their parents.
Slavery and human trafficking is not illegal in classic Sharia law although most Muslim law jurisdictions
have moved to prohibit slavery by way of statute. Indeed, as recently as 1964, Schacht nonchalantly writes of
the:
"... legal position of slaves ... the slave is considered a person, but
being subject to his master he is not fully responsible.... Slavery can
originate only through birth or through captivity...."

In an 1860 law book, MacNaughten wrote:

"There are only two descriptions of persons recognized as slaves under
Moohummudan law. First, the infidels made captive during war; and
secondly, their descendants."
In 2003, Saudi Arabia Muslim law professor Sheikh Saleh Al-Fawzan wrote that:

"Slavery is a part of Islam. Slavery is part of jihad, and jihad will

remain as long there is Islam."
One of the worst crimes is renouncing the Muslim faith. Once a Muslim, always a Muslim .... or else.
Apostacy is not just a quaint historic legal term in Muslim law. It is a capital offence and one which makes a
mockery of freedom of religion.

The deadly consequences of apostasy is effective in discouraging any criticism of Muslim law among
Muslims.
Some courageous Muslims are defying death threats and are speaking out, such as Muslims Against Sharia
and the anonymous Stop Sharia Now website.
Muslim criminal law favours the rich. For intermediary crimes, known as quesas, the aggressor may be able

to pay-off the victim (diyya) and thus avoid conviction and sentencing. Of course, the option is the victim's or
the victim's survivors in the event of a fatal crime. However, this often becomes a simple matter of "how
much", an option not available any but the rich, male Muslim defendant.
Quesas is simply the Muslim variant of an eye for an eye, a tooth for a tooth. If, in a criminal act, a victim
loses an arm, the aggressor stands to be sentenced to the surgical amputation of his arm, quite the job

description for a sheriff.

But the real barbarity of Muslim criminal law can be found in the news reports that from time to time seep
out from Muslim jurisdictions: stonings, beheadings, public flogging and amputations. Indeed, Muslim law
still provides for a biblical punishment of highway robbery (hiraba): death by crucifixion.
Reform! Reform!

Clearly, Muslim law is in dire need of global reform. Muhammad was a great man and the Koran continues to
espouse timeless legal ideas and concepts; a veritable gift to mankind. One could argue that five minutes of
Muslim law in Las Vegas, for example, might do more good than harm.
However, the Koran was written in 652 AD as a guide to conduct at the time, much like the 17 Article
Constitution of Japan (604 AD).

As a statute, it does not fit amidst URLs, space travel, satellite radio, the iPad and the United Nations.
The responsive but piecemeal statutory band-aid solution of some well-intentioned Muslim jurisdictions,
combined with the well-intentioned desire among free and democratic states to not interfere with the internal

laws of other independent states, especially those rich in oil, has artificially sustained classic Muslim law past
its Best Before date.
As the international game of money and politics plays itself out, oil reserves slowly deplete and enrich the
male-dominated Muslim societies.
A religion enforced by theocracy which governs by intimidation and encourages the faithful to suffer in life
and expect reward after death, serves the rich perfectly well. That is no coincidence and one that was outed as
soon as the populace could read and write in all present free and democratic societies of the world.
At the bottom of the legal totem pole blinks the young Muslim girl who, in those jurisdictions that boast of
pure or classic Sharia law, can only look forward to a controlled life where her very features are hidden

behind a Niqab to be forever hidden but to her owner, caught in the doldrums of Muslim law.

the same principles we can remove the incentive to commit such acts. All terrorist believe in

The main criterion clearly is how to simply cancel the 'ticket' to this paradise?

be given a religious burial, the state will retain the body with a disgraced unmarked burial in in pig faeces.

Losing your rights of free activity and choice is part of the incarceration penalty.
Should any religious/political groups, social engineers, Greens or do-gooders bellow objections; as

example, incitement is:
(1) Subject to this Act, where a person in Victoria or elsewhere incites any other person to pursue a course
of conduct which will involve the commission of an offence by-

(2) For a person to be guilty under subsection (1) of incitement the person(a) must intend that the offence the subject of the incitement be committed; and
(b) must intend or believe that any fact or circumstance the existence of which is an element of the offence in
question will exist at the time when the conduct constituting the offence is to take place.
(3) A person may be guilty under subsection (1) of incitement notwithstanding the existence of facts of which
the person is unaware which make commission of the offence in question by the course of conduct incited
impossible.

A person does not have to act on the incitement

One of the interesting aspects of incitement, is that the substantive offence does not require a person to act
upon the incitement, but rather, an attempt to incite is sufficient, as was noted in the Victorian Court of
Appeal in R v Dimozantis, with the Court approving the ruling of the trial judge:

The learned trial judge ruled that it was not necessary, as an element of the offence, to prove that the person
incited acted upon the incitement, although it was necessary to prove that the course of conduct urged would,
if it had been acted upon as the inciter intended it to be, amount to the commission of the offence.
Generally speaking, there is no requirement that a person incited to commit an act, but rather, the inciting
behaviour must be within the knowledge of the other person.
How is the offence proven?

In order for incitement to be proven, the onus is on the prosecution to show that there was incitement to
commit an offence as stated by Isaacs J in Walsh v Sainsbury:
The mere fact that A incites to or urges the commission of an offence or offences against a
Commonwealth law is enough to constitute A an offender. He may incite or urge a particular
person or generally, but, the incitement or the urging once proved, the offence is complete.
Withdrawal does not obliterate it, though no doubt it may affect the measure of punishment. But to be
itself an offence the incitement or the urging must be to the commission of some offence.
The Racial and Religious Tolerance Act 2001 (Vic) also provide offences motivated by religion, as does the
Commonwealth Crimes Act Amendment (Incitement to Violence) Bill 2005

Islamic extremists are stepping up the creation of "no-go" areas in European cities that are off-limits to nonMuslims.
Many of the "no-go" zones function as microstates governed by Islamic Sharia law. Host-country authorities
effectively have lost control in these areas and in many instances are unable to provide even basic public aid
such as police, fire fighting and ambulance services.

The "no-go" areas are the by-product of decades of multicultural policies that have encouraged Muslim
immigrants to create parallel societies and remain segregated rather than become integrated into their
European host nations.
In Britain, for example, a Muslim group called Muslims Against the Crusades has launched a campaign to
turn twelve British cities including what it calls "Londonistan" into independent Islamic states. The socalled Islamic Emirates would function as autonomous enclaves ruled by Islamic Sharia law and operate
entirely outside British jurisprudence. [The same situation exists in France, Belgium, Germany, Italy, the
Netherlands and Sweden]
In Sweden, which has some of the most liberal immigration laws in Europe, large swaths of the southern city
of Malm which is more than 25% Muslim are "no-go" zones for non-Muslims. Fire and emergency
workers, for example, refuse to enter Malm's mostly Muslim Rosengaard district without police escorts. The
male unemployment rate in Rosengaard is estimated to be above 80%. When fire fighters attempted to put out
a fire at Malm's main mosque, they were attacked by stone throwers.
In the Swedish city of Gothenburg, Muslim youth have been hurling petrol bombs at police cars. In the city's
Angered district more than 15 police cars have been destroyed

With the above it must be clear that having prayer rooms may not be an issue but to have
Mosque doted around the country, not just Bendigo, can become a major problem. This, as they
are effectively an alternative (religious) place of governance, military compound, court, etc. and
one may just hope not to be near one of them when so to say hell brakes lose!
