EDITORIAL
Con el propsito de mantener el enfoque cientfico, jurdico y literario
que caracteriza esta segunda poca de la revista Judicatus, en su nmero
dos, publica artculos que analizan de manera profunda y actual, diversos
temas selectos del Derecho. El contenido de estos invitar a los
lectores a estudiar y conocer ms sobre ellos.
En la primera seccin Estudios jurdicos generales, se encuentran
escritos de cuatro especialistas nacionales del Derecho, de reconocida
trayectoria: Jorge Witker, Catarino Garca Herrera, Pedro Rubn Torres
y Gerardo Garca Silva.
El Mtro. Jorge Witker permite reflexionar sobre la necesidad de
un cambio de cultura jurdica en Mxico, ante la implementacin de
los juicios orales en la normatividad procesal-penal. Vinculante a esta
temtica que aborda el autor, el Mtro. Catarino Garca Herrera explica
la importancia y justificacin de la figura de los medios alternos y
procedimientos simplificados en la reforma penal; ambos, necesarios
para la aplicacin eficiente del sistema acusatorio y procedimiento oral.
En esta seccin, adems del estudio de la reforma penal, tambin
se analiza la doctrina constitucional, con el escrito del Dr. Pedro Rubn
Torres. El escritor expone el debate que existe con relacin a la naturaleza
jurdica del Estado federal, de una manera clara y precisa, tocando
aspectos histricos e internacionales relevantes para nuestro pas.
Por ltimo, y retomando la lnea de investigacin del contenido de
los dos primeros artculos de esta seccin, el Dr. Gerardo Garca Silva
se centra en las principales interrogantes que surgen en la comunidad
jurdica mexicana, con la reforma constitucional en materia penal,
publicada en junio de 2008.
La segunda seccin Estudios jurdicos especializados, contiene obras
de tres juristas internacionales y uno nacional, todos, profesionales
destacados en el rea en que son expertos: Jos Luis Arjona, Jos Luis
Ramrez, Mara Luisa Maqueda e Hilda Marchiori.

5. CONCLUSIONES
Un cambio en la cultura jurdica mexicana supone una ardua labor de
convencimiento de docentes y directivos en las escuelas y facultades de
derecho, junto a las barras y colegios de abogados, sin omitir el trabajo al
interior de los institutos judiciales de capacitacin existentes en nuestro
medio. Una nueva capacitacin bajo el prisma de entrenamiento es
fundamental para las nuevas generaciones de abogados y de estudiantes,
orientando dicha labor con dinmicas de cambio y progreso que apunten
a que estas capacitaciones y entrenamientos podrn depararles en el
futuro, ascensos, ingresos y prestigio. As abogados y sociedad pueden
encontrarse en lo que Andrs BAYTELMAN y Mauricio DUCE afirman
textualmente: la publicidad en los procedimientos judiciales instala la
vida de los tribunales dentro de la convivencia social6.

disolviendo el conflicto concreto, y con ello que se disminuya el nivel general de violencia
y conflicto.
Pero es importante comprender que los mecanismos alternos en
materia penal, propiamente dichos, que son la mediacin y conciliacin,
presentan notables diferencias en su naturaleza y finalidad con las
salidas alternas sui generis que se configuran a travs de facultades
discrecionales o procedimientos simplificados, en las que el principal
objetivo es el ahorro de recursos. Y si bien es cierto que, en ese punto
puede coincidir con la mediacin y conciliacin, ambos mundos no
deben ser confundidos. En estas salidas alternas, el hecho de que ellas
representen un ahorro es slo una cuestin exterior positiva, un efecto
adicional, aunque no su principal objetivo, que es llegar a la solucin del
fondo de los conflictos y de acuerdo con ese objetivo debe ser concebido
su diseo y evaluada su aplicacin. Cuando las salidas alternas se utilizan
slo como formas de descongestionar el sistema, se incurre en error
porque se fomenta la impunidad.
4. El alto sitial constitucional de los Mecanismos
alternos de Solucin de Conflictos en Mxico
El panorama de los mtodos alternos de solucin de controversias en el
sistema legal de nuestro pas, se ha modificado notablemente, su inclusin
en la Ley Suprema que los ubica en el rango de garanta constitucional,
origina su expansin normativa obligatoria en la legislacin federal y en
la de los Estados de la Repblica.
La coronacin constitucional de los mecanismos alternos de
solucin de controversias no es ocasional ni fortuita. Por el contrario,
la reforma constitucional federal al art. 17, que autoriza el empleo de
los mecanismos alternos de solucin de controversias, con acentuacin
especfica en materia penal, es precedido de un movimiento mundial
que se ubica a mediados del siglo pasado en Europa, y que trasciende
a los distintos continentes y se desarrolla en pases de Amrica Latina.
Al concluir la dcada de los noventa, Mxico se une a ese vigoroso
movimiento en la bsqueda de otras alternativas para la solucin de los
conflictos entre los individuos, distintos al proceso judicial.

10. Conclusiones
- Los mecanismos alternos de solucin de controversias son los
procedimientos que, salvaguardo las garantas constitucionales, generan
los espacios y condiciones necesarias para que sean los protagonistas
del conflicto quienes, auxiliados por terceros profesionales, encuentren
la solucin consensuada a su controversia, privilegiando el dilogo,
la interaccin emptica, la colaboracin y el reconocimiento de las
diferencias.
- En este contexto, las salidas alternativas correctamente utilizadas
representan soluciones de alta calidad, verdaderos equivalentes
funcionales de una sentencia: atienden a las necesidades especficas del
conflicto, apuntando a las posibilidades de rehabilitacin del imputado, a
la prevencin de que los hechos vuelvan a repetirse, al inters o temores
concretos de la vctima o de terceros, o bien a alguna combinacin de
stas; evitndose al mismo tiempo, el contagio criminal que representa
la crcel para el imputado y la violencia secundaria que las penas
inevitablemente conllevan.
- En la reciente reforma constitucional penal el constituyente permanente
da importancia a la aplicacin de los mtodos alternos de solucin de
controversias, buscando la proteccin de la vctima u ofendido en el
tema de la reparacin del dao. Asimismo, demanda supervisin judicial
y transfiere a las legislaturas federal y local la determinacin de los casos
que as lo requieran. Introduciendo, por lo tanto, al tema de justicia
restaurativa.
- La legislacin procesal penal de Nuevo Len, adelantndose a la
reforma constitucional reciente, desde el ao 2004 y partiendo de la idea
de que si bien no estaban reguladas, tampoco se encontraban prohibidas,
ha implementado un novedoso esquema de medidas alternas, facultades
discrecionales y procedimientos simplificados en miras al juicio oral,
buscando por una parte, la descongestin del sistema y, por la otra,
salidas de fondo a los asuntos penales.

1. INTRODUCCIN
La doctrina constitucional an debate sobre la naturaleza jurdica del
Estado federal. Algunos autores, como CALHOUN o SEY, niegan a
ste el carcter de Estado, reconducindole, a una especie particular
de confederacin. Por el contrario, ZORN y LE FUR le atribuyen tal
naturaleza tan slo al federal. No obstante, gran parte de la doctrina se
inclina por la naturaleza estatal, tanto de los Estados-miembros como
del Estado federal.
Las posturas dominantes en nuestros das son dos. La sostenida
por autores como DONATI, DURAND y KUNZ, quienes afirman
que el Estado federal es la nica organizacin estatal y no los Estadosmiembros; y la otra postura, encabezada por ROSSI, CARR DE
MALBERG, SANTI ROMANO y BISCARETI DI RUFFA, que
aseguran que el federal es un Estado compuesto, una unin regulada por
el derecho estatal1. Se considera ms acertada esta ltima.
Bajo la anterior premisa, es la reforma constitucional el
procedimiento por el cual los Estados pueden actualizar su marco
normativo, de acuerdo con sus necesidades polticas, sociales y
econmicas y, con esto, no atar una generacin a otra. No obstante, este
procedimiento tambin puede utilizarse con fines polticos de partido o
de persona en perjuicio del prestigio de la norma constitucional local.
Lo descrito, hace referencia a que, ciertos lugares de la Repblica
han reformado su Constitucin, pero no sus prcticas polticas, por
lo que stas pierden legitimidad (la cual an es muy endeble) ante la
ciudadana, ya que sta percibe que la reforma en su Carta Magna no se
tradujo en una mejora de la vida institucional de su Estado, ni en una
mejora en la calidad y vigencia de sus derechos fundamentales. Es decir,
la reforma se ha realizado como una forma de crear el sentimiento de
cambio democrtico, modificando slo la letra del texto, pero no las
prcticas ni la infraestructura jurdica secundaria, ni las instituciones
pblicas estatales.

1. INTRODUCCIN
La reforma constitucional en materia de seguridad y justicia penal1, es la
ms importante en esta rea del derecho, en nuestra historia moderna.
En el contexto econmico, poltico y social en el que actualmente vive
nuestro pas, se trata de una de las llamadas reformas estructurales
junto a las reformas fiscal, electoral, energtica y laboral que
Mxico necesita para poder enfrentar los retos que le depara un mundo
globalizado.
Por ende, su importancia no es menor ni coyuntural, sino que
trata de responder a los retos que representa la delincuencia, sobre
todo la organizada, al estado mexicano en su conjunto. Sin embargo, se
debe reconocer que emprender una reforma de este calibre no resulta
nada fcil, sta an antes de nacer, de manera formal, ya haba sido
bautizada como Guantnamo, o como el vaso de agua con las gotitas
de veneno, entre otras. Si bien es cierto, no es la reforma perfecta que
todos quisieran, se encuentra entre lo deseable y lo posible.
Antes de su aprobacin, ya algunas entidades federativas Nuevo
Len, Chihuahua, Estado de Mxico y Oaxaca haban iniciado reformas
a su sistema procedimental penal para ajustarlo a uno de corte acusatorio,
adversarial y oral. Otras entidades como Veracruz, Morelos y Zacatecas
se encuentran en proceso de implementacin de este nuevo sistema. La
reforma constitucional obligar a todas ellas a adecuar sus respectivas
legislaciones sustantiva y procesal al contenido de la misma.
Sin embargo, surgen muchos cuestionamientos respecto de la
implementacin de este nuevo sistema de justicia penal en nuestro pas, se
encuentran los que se han denominado mitos y realidades con relacin
al enjuiciamiento penal. Se abordar, por tanto, en el presente trabajo,

El planteamiento metodolgico del sistema acusatorio, supone
que desde el inicio de la investigacin hasta la ltima actuacin estas sean
sometidas a reglas rigurosas y claras para las partes, en que no debern
existir las sorpresas ni preferencias, lo que redundar en un mayor nivel
de exigencia de la autoridad en la investigacin y una actitud proactiva de
la defensa para intervenir durante el procedimiento.
10. LOS JUECES SALEN PERJUDICADOS POR EL JUICIO
ORAL
En un sistema de reglas claras jueces, ministerio pblico, defensores,
imputado y vctima , todos salen ganando puesto que se est en
presencia de un sistema ms ordenado, transparente y respetuoso de las
garantas de vctimas e inculpados.
El sistema no es mejor por que facilite las cosas para unos
y las siga complicando para otros, es mejor en la medida que ofrece
condiciones adecuadas para que todos los que se ven relacionados con
ste, encuentren condiciones dignas para desarrollar el rol que les toca.
11. LOS JUICIOS ORALES REQUIEREN UNA GRAN
INVERSIN EN RECURSOS MATERIALES Y HUMANOS
PARA PODER IMPLEMENTARLOS EN MXICO
Cierto es que requiere realizar una fuerte inversin para adecuar la
infraestructura para el nuevo sistema. Los juzgados en Mxico no estn
diseados para celebrar juicios en los que se desarrollen plenamente los
principios informadores de un sistema penal acusatorio. Definitivamente,
se deber realizar una importante inversin para la adecuacin de
instalaciones, capacitacin de personal, difusin del contenido de
la reforma, etc. Sin embargo, es un costo inicial que se espera se vea

1. INTRODUCCIN
El propsito en esta colaboracin consiste en dar noticia de algunas
de las novedades introducidas en los ltimos tiempos en materia de
hipotecas en el derecho espaol, por ser novedades que, aparte de su
relevancia social, han supuesto un cambio importante al menos en
parte en el panorama jurdico hasta entonces existente.
Tales novedades son obra de la ley referida en el ttulo de este
trabajo, cuya rbrica completa es la siguiente: Ley 41/2007, de 7
de diciembre, por la que se modifica la Ley 2/1981, de 25 de marzo,
de Regulacin del Mercado Hipotecario y otras normas del sistema
hipotecario y financiero, de regulacin de las hipotecas inversas y el
seguro de dependencia, y por la que se establece determinada norma
tributaria1.
Aqu se va a tratar sobre dos tipos singulares de hipoteca que en
dicha ley se regulan: las hoy ya habitualmente denominadas hipotecas
flotantes e hipotecas inversas.

Frente a esa lnea, ahora bien, se alzaron autores alegando que las
exigencias pretendidas por la lnea tradicional respondan a un modo
de vida y a un sistema econmico que hoy ya no existe, y que por tanto
deban ser reemplazadas por otras ms acordes con la realidad actual.
Aunque haba tambin entre estos autores pluralidad de opiniones, no
pudindose hablar de un planteamiento comn porque existan posturas
varias, susceptibles de graduacin en funcin de su mayor o menor
exigencia. As, por un lado estaban quienes entendan que el principio
de especialidad quedaba cumplido con la fijacin de una cifra mxima de
responsabilidad hipotecaria y el sealamiento de las lneas fundamentales
de las obligaciones que hubieran de quedar cubiertas8. Despus quienes,
partiendo de lo anterior, daban un paso ms y estimaban suficiente con
aportar una indicacin remotsima de la deuda que se fuera a garantizar9.
Y finalmente, dando un ltimo paso en este sentido lgico, una vez
empezado el camino , quienes entendan debera ser perfectamente
admisible la garanta que se constituyera para cubrir todas las deudas
de una persona, ya que sta o cualquier otra expresin equivalente no
deja lugar a dudas sobre lo que constituye el objeto de la garanta, por lo
que no puede cuestionarse que la misma est determinada10. El abanico
de posibilidades, como se puede ver, era variadsimo.
Pues bien, en ese punto las cosas, el art. 153 bis L. H., introducido
por la Ley 41/2007, resuelve la cuestin relativa al espectro obligacional
susceptible de ser cubierto mediante hipoteca (flotante) diciendo que
sta podr constituirse en garanta de una o diversas obligaciones, de cualquier
clase, presentes y/o futuras, sin necesidad de pacto novatorio de las mismas.
A la vista del cual, y sin prejuzgar su acierto o desacierto, es
indudable que se ha producido en Espaa un cambio radical en la forma

3. LA HIPOTECA INVERSA
La regulacin positiva de esta figura se contiene bsicamente en la
disposicin adicional primera de la Ley 41/2007. Por razones de espacio,
se transcribe a continuacin slo los apartados de la misma de calado
hipotecario y sustantivo:
1.- A los efectos de esta Ley, se entender por hipoteca inversa
el prstamo o crdito garantizado mediante hipoteca sobre un
bien inmueble que constituya la vivienda habitual del solicitante y
espaol vigente a fecha de hoy. Ahora bien, aunque sea en nota, no queremos dejar
de apuntar que nuestra valoracin de esta figura, tal como ya expusimos antes de la
promulgacin de la Ley 41/2007 (nuestro trabajo sobre La hipoteca global se public
en el ao 2004), sigue siendo negativa. La razn es que el resultado de esta hipoteca,
cuando las obligaciones garantizadas sean varias y de cuanta indeterminada, afecta de
forma directa al crdito territorial, perjudicndolo gravemente. Esto es as en tanto
que la cifra de responsabilidad que por obra de esta hipoteca grave la finca se habr
fijado en estos casos teniendo en cuenta la pluralidad de obligaciones que aqulla pueda
cubrir y, teniendo en cuenta que pueden ser de cuanta indeterminada, su intrnseca
variabilidad. Por lo que la cifra que se fije que naturalmente se calcular al alza, y
siempre dejando un margen de seguridad amplio , tendr por lo comn poco o nada
que ver (sobre todo cuando haya transcurrido algn tiempo desde la constitucin de la
hipoteca) con la suma de los importes efectivos de las distintas obligaciones aseguradas
por aqullas, que habrn variado, y normalmente a la baja (por pago de algunas). Este
resultado nos parece difcil de conciliar con uno de los grandes principios inspiradores
de la ley que en 1861 vino a configurar el actual sistema hipotecario espaol: liberar
a la propiedad inmueble de cargas y gravmenes excesivos y carentes de justificacin,
para as fomentar el crdito territorial. Pues estas hipotecas flotantes, por las razones
dichas, normalmente supondrn una amortizacin desproporcionada de los bienes
hipotecados, y por consecuencia un perjuicio injustificado para el hipotecante. Por
lo que concluimos que tales figuras, o no responden a un inters legtimo, o en
todo caso el que las motive debe ceder a favor del antes expresado, por ser en este
sentido preferente: liberar a la propiedad inmueble de cargas y gravmenes que la
amortizan injustificadamente. Este es el principio que a nuestro modo de ver resulta
aqu determinante, y el que verdaderamente subyace en el tradicional apotegma una
hipoteca, una sola obligacin garantizada, y no el principio de especialidad, ni la nota
de la accesoriedad. Y que, por lo dicho, fuerza a rechazar la posibilidad de que una sola
y nica hipoteca pueda cobijar una pluralidad (aunque sea limitada) de obligaciones
independientes, cuando alguna o algunas de ellas (a fortiori, si son todas) sean de cuanta
inicialmente indeterminada.

Electoral y que por tanto es imperativo que se corrija para encuadrarlo a la normatividad
de nuestra Ley Suprema en materia de derechos pblicos subjetivos y especficamente
en el entorno de las garantas sociales consagradas en beneficio de los servidores del
Instituto Federal Electoral por su art. 123. En el contexto amplio de la declaracin del
prrafo inicial de dicho numeral as como en lo que hace al contenido de su apartado
B, en razn de que el sistema de derechos y condiciones de trabajo previsto en sus
frs. VII, VIII, IX y X, no pueden disfrutarse por una parte del personal del Instituto,
por impedirlo el precepto secundario cuya reforma se promueve. En efecto, la fr. XIV
del apartado B del art. 123 constitucional dispone que La ley determinar los cargos
que sern considerados de confianza. Las personas que los desempeen disfrutarn
de las medidas de proteccin al salario y gozarn de los beneficios de la seguridad
social. De la interpretacin gramatical del dispositivo, se desprende la facultad que
en ley secundaria se determine cules de los cargos de la dependencia u organismo
pblico sujeto a los preceptos del apartado B del 123 constitucional, se consideren
de confianza, pero de ningn modo faculta al legislador secundario a considerar a
todos los cargos de la dependencia u organismo en cuestin, como de confianza, como
indebidamente se consider as por el legislador secundario, conculcando los principios
de la fraccin citada al establecer el texto del art. 172 del COFIPE.

2.5. Las Siete Leyes Constitucionales de la Repblica Mexicana (1836)
En las Leyes Constitucionales de 1836 se estableci la distincin entre
delitos comunes y oficiales, en estos trminos, cabe indicar que:
En los delitos comunes no se podr intentar acusacin en contra
del presidente de la Repblica, ni contra los senadores, Sino ante
la Cmara de diputados. Si el acusado fuese diputado, ante el
Senado. En los delitos oficiales, la Cmara de Diputados, ante
quien debe hacerse la acusacin, declarar si ha o no ha lugar
a sta; en caso de ser delitos oficiales, dos de sus miembros

con el mero favorecimiento lucrativo de una entrada ilegal19. Por fin, trata
(trafficking of human beings) y trfico (smuggling of migrants) iban a aparecer
identificados con dos realidades migratorias distintas: coercitiva, una;
consentida, la otra. Por ello, afirmaba en su informe de 2004 el Grupo de
Expertos sobre el trfico de seres humanos, que el elemento diferenciador
entre ellas resida en la existencia de una vctima: mientras que en la trata
(trafficking) hay una persona cuyos derechos individuales han sido violados,
en el trfico (smuggling) slo quedan comprometidos los intereses polticos
del estado cuyas fronteras han sido traspasadas20.
Fue el segundo de los Protocolos de 2000 para prevenir, reprimir
y sancionar la trata de personas el que se ocup de crear confusin en
este esquema clarificador. Con la pretensin declarada de convertirse en
el primer instrumento universal que abordara el problema de las personas
vulnerables a la trata21 y supuestamente preocupado por la pobreza y la
injusticia econmica22, introdujo como uno de sus elementos definitorios,
junto a los que ya estaban, el abuso de una situacin de vulnerabilidad23. La
idea no era del todo nueva. El Parlamento Europeo en su Resolucin de
18 de enero de 1996 haba ya incluido, en su concepto de trata, el abuso

por la trata de migrantes. Pese a reconocer que las definiciones que se dan
de ella no son nunca neutrales sino siempre funcionales a los objetivos
reguladores del sujeto decisorio, entiende que la misma condicin de
irregularidad de los inmigrantes los vuelve vulnerables a la explotacin
y, por tanto, vctimas de la trata (trafficking). Su propuesta es reservar la
expresin trfico de migrantes (smuggling) para cuando se trata de personas
que solicitan de manera voluntaria a las organizaciones criminales servicio
para emigrar de forma clandestina, disponiendo de un capital propio
para los gastos. En su formulacin, la trata aparece identificada con una
situacin de vulnerabilidad econmica: Habr que entender como vctima
de la trata de seres humanos y consecuentemente de alguna forma de
esclavitud, afirma STORINI,
las personas que, aunque acudan libremente a la criminalidad
organizada para emigrar, no poseen suficiente dinero y son obligadas
a pagar los servicios ofrecidos, poniendo a disposicin su propio
cuerpo (smuggling-trafficking), as como las personas que aceptan ser
objeto de lucro de las organizaciones criminales para poder salir
de una situacin de extrema pobreza en la que viven en su pas de
origen (trafficking-smuggling), y, por ltimo, las personas secuestradas
o vendidas y luego traficadas por las organizaciones criminales, en
funcin de un sucesivo y sistemtico lucro (trafficking)36.

por el anteproyecto de reforma que se comenta, en su prembulo, es el de corregir
el tratamiento penal unificado de los delitos de trata de seres humanos e inmigracin

3. CONCLUSIONES
La esclavitud ha sido eternamente comparada con el trfico de trata, e
inclusive con lo que en ocasiones se ha considerado como el trfico de
migrantes, aspectos que a travs del tiempo, se han vinculado con los
diferentes paradigmas que conllevan a entender la explotacin voluntaria
o coercitiva de las personas.
La evolucin de los tiempos, ha propiciado que se encuentren a
estos estereotipos desde varias perspectivas de victimizacin, siempre
partiendo de la supresin de los derechos fundamentales de la vctima.
De manera errnea, al hablar de trata de personas, se toman
en consideracin nicamente, las condiciones de carcter sexual,
desvinculando aspectos trascendentales que hacen al individuo
vulnerable a ella, tales como, la idiosincrasia, la pobreza, la migracin,
los aspectos raciales que convergen en una globalizacin cultural, etc.
Todos estos aspectos han sido relegados del problema de la trata, y no
deben perderse de vista, pues pueden ser un factor preponderante para
su atinada canalizacin legal.
Adems de los supuestos propicios a la condicin de trata, es
importante tener presente a las personas que guan y facilitan que sta
la prostitucin tanto libre como forzada como esclavitud sexual (pg. 19): a los
efectos de la intervencin del Estado, seala el Informe, nada aporta la distincin entre
prostitucin libre y forzada que olvida que el ejercicio de la prostitucin atenta contra
la dignidad de las personas que la ejercen (pg. 18). Con ello, no se hace sino asumir las
declaraciones que en 2005 hizo la plataforma estatal de organizaciones de mujeres por
la abolicin de la prostitucin, cuando afirmaba que la prostitucin en todos los casos
o circunstancias, representa una forma extrema de explotacin y de violencia contra
las mujeres y significa nuestra reduccin a la condicin de mercancas al servicio de
los hombres. Valgan aqu, las indicativas palabras de LAGARDE, M. Claves feministas
para, pg. 55, en apoyo de esa representacin simblica prostitucin/esclavitud :
por definicin las mujeres que ejercen la prostitucin no son autnomas. Por definicin
son cuerpo objeto para el placer de otros. Su cuerpo subjetivo, su persona, est cosificada y
no hay un yo en el centro. En esta situacin no hay posibilidad de construir una persona
que se autodefine, que se autolimita, que se protege y desarrolla a s misma.

8. CONCLUSIONES
Los derechos humanos para el tratamiento de personas vctimas del
crimen organizado, implica que los gobiernos deben implementar
acciones y programas en beneficio de las vctimas de las organizaciones
criminales. Erradicar la violencia, la tortura, el tratamiento cruel y
degradante; y luchar por el derecho de los ciudadanos a ser libres de la
violencia fsica, violacin, ataque sexual, prostitucin, trata de personas
y esclavitud. Es decir, el derecho a la autonoma personal, el derecho
al trabajo, el derecho a gozar de salud fsica, emocional y social ,
derecho a la educacin, al respeto a su dignidad y valor como persona.

I. INTRODUCCIN
Es de cuestionarse la fortuna o desfortunio de continuar viviendo en
el siglo XXI. Esto es porque a pesar de ser prometedor tiene muchos
riesgos y peligros sin precedentes. No es una exageracin el decir que a
no ser que se haga algo drstico, y pronto, el siglo XXI podra atestiguar
el final de la civilizacin, an ms atemorizante, es que podra traer
consigo la extincin de la especie humana, la cual sera borrada tal como
lo fueron algunas de las especies animales hace millones de aos. Esas
terribles predicciones no son profecas de fatalidad ni abatimiento, slo
son advertencias basadas en muchas cosas que estn sucediendo hoy en
da.
Los logros tecnolgicos posteriores a la segunda guerra mundial,
fueron nada menos que espectaculares, transformaron totalmente a la
humanidad. Sin embargo, la tecnologa es una espada de doble filo. Puede
ser una bendicin o una maldicin, puede tener la llave para la salvacin
o causar aniquilacin. sta es precisamente la razn por la cual el siglo
XXI ser un perodo crucial en la historia y quizs ser el ms decisivo
para la raza humana. Toda la sabidura ganada por los seres humanos
durante su existencia, ser necesaria para evitar el desastre y salvar al
planeta de los peligros visibles y ocultos que se presenten. La sabidura
no es de ninguna manera el monopolio de las personas mayores, pero es
probablemente la nica rea en la cual, quienes lo son, poseen una ventaja

los Estados Unidos, las cuales evitan que organizaciones con base en
dicho pas, hagan negocios con pases como Cuba, Irn, Libia y Sudn6.
Si las listas de observacin, listas de no-vuelo, perfiles raciales,
detenciones prolongadas sin juicio, tortura y degradacin para extraer
informacin, intercepcin de comunicaciones privadas, monitoreo
de telfonos y comunicaciones inalmbricas, vigilancia electrnica sin
autorizacin, escrutinio de transacciones financieras, prstamo de libros
en bibliotecas pblicas y renta de video en tiendas, no son caractersticas
de Estado polica, entonces que son?
En su fervor por detener la liberacin y secularizacin de la ley
penal y la humanizacin del sistema de justicia, para poner un alto al
movimiento que lleva a una sociedad permisiva, la criminalizacin se
ha convertido en el orden del da, nada era seguro ya, ni siquiera los
principios bsicos de la ley penal clsica dejaron de ser inmunes. Con el
argumento de la preocupacin sobre la explotacin sexual de muchachos
y muchachas jvenes en Tailandia, las Filipinas, Costa Rica, y otros pases
del Sur de Asia y Amrica Central, el principio perenne de territorialidad
de la ley penal fue eliminado, se hicieron leyes para hacer posible el acusar
y castigar a ciudadanos por crmenes sexuales cometidos en otros pases,
los cuales tienen diferentes jurisdicciones. Sorprende y con asombro,
la efusiva condolencia por la integridad sexual de nios, sta nunca se
extendi hacia la abismal pobreza en la cual vivieron y la cual los forz a
vender su nica materia prima: sus cuerpos.
Los conceptos tradicionales de responsabilidad y culpa moral
han tenido que estirarse para adecuarse a la naturaleza de las nuevas
conductas criminalizadas. P. e., las mujeres adictas a las drogas que no
consiguieron dejar de usar stas despus de quedar embarazadas, fueron
acusadas y castigadas por un delito de reciente creacin que habla de
poner en peligro al feto. En ste slo se les puede acusar si usan crack,
herona, o cocana, no tabaco ni alcohol.

Hoy surge la pregunta, cmo pudo esto haber pasado, acaso no haba
salvaguardas en ambos pases democrticos para evitar que ocurrieran esas
injusticias y abusos evidentes? La era MCCARTHY en Estados Unidos fue
una poca de cacera de brujas contra comunistas, exista el aislamiento,
poner a personas en listas negras, estigmatizacin, persecucin, arrestos,
detenciones, juicios, y castigos contra aqullos de los que se sospechaba
eran comunistas. Hasta hace poco, era comnmente conocido que
ello constituy un capitulo oscuro, una mancha negra, un episodio
vergonzoso de la historia de Estados Unidos, que no debera repetirse.
Y an as, posterior a los eventos del 11 de septiembre de 2001, todo
sucede de nuevo, en esta ocasin, los objetivos no son los comunistas
sino los sospechosos de terrorismo, durante la era de MCCARTHY,
los comunistas fueron objeto de caceras, fueron arrestados, perseguidos
y procesados por sus creencias polticas, hoy en da los sospechosos
de terrorismo, se vuelven vctimas por sus creencias religiosas. Las
prcticas actuales son ms siniestras porque la represin neta tiene un
matiz mucho ms amplio que, incluye a cualquiera que tenga nombre
rabe, apariencia del Medio Oriente, o incluso piel obscura, lo que hace
dichas prcticas peores que lo que sucedi en la era MCCARTHY, ya
que las medidas represivas frecuentemente estn basadas en nada ms
que el principio reprensible de culpable por asociacin, y porque el
nico delito de muchos de los actuales objetivos es pertenecer a una
determinada etnia o grupo religioso.
Hay una pregunta irrefrenable que busca respuesta, cmo es que,
quienes han sido y fuimos extremadamente orgullosos y afortunados de
vivir en sociedades democrticas, de pronto se encuentran en un ambiente
en donde escuchar a hurtadillas se ha vuelto algo comn, la vigilancia
electrnica predomina, la censura es rampante, donde las libertades son
restringidas, donde los derechos democrticos bsicos, como el derecho
a la privacidad, son violados con frecuencia creciente en el nombre de la
guerra en contra del delito, la guerra contra las drogas, la guerra contra
el crimen organizado, y ahora la guerra contra el terrorismo?, y quin
levant un dedo?, quin alz la voz?, quin objet?, quin protest?,
quin exigi que se detuviera la intrusin?, quin pidi que cesara la
invasin?

a un pas en el cual sera torturado. Cul fue el crimen del que era
sospechoso?, de acuerdo con el Globe and Mail El Sr. Arar tena relacin
con un hombre quien tal vez conoca al hermano de un sospechoso de
terrorismo buscado por la Oficina Federal de Investigacin14.
El caso de Maher Arar no es para nada un caso aislado o un
incidente infortunado, es de acuerdo con Morton Sklar, slo el primer
caso donde uno de los supuestos terroristas fue objeto de mtodos de
investigacin brutales por nada. Esto permite confirmar la existencia
de una prctica que viola brutalmente los principios bsicos de los
derechos humanos y la letra de la ley15. El seor SKLAR llama a esa
prctica extraccin de la tortura, sta se refiere a enviar a sospechosos
de terrorismo aprehendidos en Estados Unidos a otros pases en donde
puedan ser interrogados, utilizando tcticas extremas no permitidas
dentro de las fronteras de dicho pas. Sklar cita un artculo publicado
en el Washington Post , en el cual coment que ms de 100 sospechosos
de terrorismo fueron enviados a pases como Siria, Afganistn, Pakistn,
Egipto, Jordania y Marruecos para ser interrogados utilizando mtodos
de estrs y coercin16. El artculo expresa que funcionarios de Estados
Unidos confirmaron que miles ms fueron arrestados y llevados con
asistencia de E.E.U.U. a pases conocidos por su trato brutal hacia los
prisioneros17.
Un gobierno que invoca la palabra guerra o estado de
guerra en casi todos los pronunciamientos pblicos, relacionados con
terrorismo o seguridad, decide de manera unilateral, llamar a quienes tiene
detenidos de forma ilegal en la Baha de Guantnamo, no prisioneros de
guerra, sino enemigos combatientes, como si el hacer malabarismos
semnticos liberara de la obligacin de tratarlos de acuerdo con las reglas
de la Convencin de Ginebra.

sistema de justicia, los criminlogos han dejado a los polticos y a otros
patrocinadores de investigacin establecer la agenda de su rea. Son los
polticos quienes definen el crimen en las calles, el temor al crimen, las
drogas ilegales, los delitos menores y sus similares, como los asuntos
ms apremiantes que necesitan ser estudiados, analizados y tratados por
expertos. Como se puede observar, la investigacin de la criminologa
tiene una definicin estrecha y su campo de visin ha sido severamente
circunscrito.
S, lo ms triste sobre la criminologa es su continua obsesin con las
infracciones de orden criminal y violaciones menores del Cdigo Penal,
as como el descuido persistente del crimen corporativo, medioambiental,
los actos de abuso de poder y el terrorismo institucional. Y lo que es peor,
todo esto a un tiempo en el cual la sociedad ha entendido con dolor que,
vive en un mundo dominado por polticos hambrientos de poder, por
corporaciones avariciosas que carecen de toda responsabilidad social y
dirigentes sin moral alguna, ni conciencia social quienes creen estar ms
all del alcance de sta y de la ley. Es de extraar que, la criminologa se
est volviendo ms y ms insignificante con el paso de cada da? Si no
cambia, corre el riesgo de volverse irrelevante.

elderly hold a distinct advantage over the young. Having the honor of
belonging to the supposedly wise group, I would like to share with the
readers of this article some personal thoughts and views based on the
knowledge and the experience I have accumulated over several decades.
The world is changing and is changing fast. The climate is
changing, the environment is changing and society is changing. Social
change is not a new phenomenon. Industrial and post-industrial
societies, in particular, are in constant mutation. But the pace of
change has accelerated dramatically in recent years. What is troubling
and worrisome is that many of the changes are not in the direction of
progress but are of a regressive and retrograde nature. They are moving
our societies backward rather than forward. They are reversing many of
the positive reforms that were introduced in the second half of the 20th
century. This is particularly true in the vital areas of social justice, human
rights and civil liberties. In fact, many of the changes that have occurred
in the aftermath of 9/11 are outright frightening and should give us
serious cause for concern. And yet they do not seem to have sent alarm
bells ringing among criminologists and other social scientists. I find it
surprising, or shall I say shocking, that in criminology, the discipline and
the profession that should be the most concerned about the erosion of
human rights and civil liberties, the vast expansion in the powers of the
police and security agencies, and the continued intrusion of the State in
the most private spheres of our lives, business seems to be going on as
usual! Its priorities have not shifted, its preoccupations have not been
refocused, and its research has not undergone any fundamental change.
If there has been any upheaval, I for one, have not noticed it. Nor am
I aware of any organized effort or concerted action to denounce what
has been going on for five years now. To my knowledge, there has been
no rush to defend the cherished rights and liberties that were obtained
after hard struggles at a heavy cost in blood and sweat. There has been
no attempt to protect what took centuries to become entrenched in the
Constitutions, the Charters of Rights and Freedoms, in International
Covenants and Conventions etc. I am sorry to say that the silence has
been deafening. Sadly complacency has become the norm and outrage
is in short supply while a dark age is threatening to engulf us. And I

am truly disturbed and baffled by the apparent apathy. How can we sit
back and passively watch our fundamental rights being violated, our civil
liberties being curtailed by a group of individuals bent on executing a
long-held plan and conducting an orchestrated attack on human rights?
In addition to the technological revolution of the last three or
four decades, another trend has changed the world that we used to
know. It is globalization. We live in an age of computerization, of mass
information, of wireless communication, of speedy transportation. We
live in an era of globalization and multinational corporations. Never
before has the world experienced such heightened mobility and such
massive migration. With the creation of the European Union and the
addition of several new members from Eastern Europe, countries that
used to be closed tight behind the iron curtain opened their doors to a
population eager to move. In Europe, national barriers came down and
the borders were opened wide to an unprecedented influx of visitors and
migrant workers. Unfortunately, those guest workers (or Gastarbeiter, as
they are called in German) are not usually greeted with open arms. More
often than not, they encounter hostility or outright rejection. They are
viewed with suspicion, especially if they belong to a different ethnic
group, if they speak a different language, or belong to another religion. It
is all part of the natural distrust of anyone who looks or acts different.
If they are Sicilian, they may be part of the Sicilian mafia. If they
are east European they may be members of the Russian mafia. If they
are Muslims they may belong to Al-Qaeda. Their cultural customs are
frowned upon. Their habits are laughed at. Their religious practices are
ridiculed.
Almost every aspect of their existence is intolerated. We had a
case in Vancouver where a lady sued her neighbors because she could
not stand the smell of their Indian cuisine.

for the new sweeping powers that were now being given to the police
and other control agencies.
And as if all this was not enough, other issues had to be found,
issues that could be used against civil libertarians and human rights
activists, to discredit criminologists traditionally seen and labeled as
bleeding heart liberals. It did not take long for conservatives to realize
that victims of crime, neglected and disenfranchised by society and
the criminal justice system for far too long, could be used (or shall we
say exploited) as pawns in the so-called fight for law and order. Claims
were made that the pendulum of justice has swung too far in favor of
criminals and that a rebalancing of the scales of justice was urgently
called for. Many of the rights of the accused, won in hardly fought
battles aimed at reducing judicial errors and ensuring a fair and equitable
justice system, were curbed or abolished by laws sold to an unsuspecting
public as necessary to protect the rights of the victim and to redress the
imbalance in justice.
Unwritten alliances were forged between various groups united
in their determination to crack down on human rights, to halt the
move towards the dreaded permissive society, and to stop the ongoing
humanization of the Criminal Justice System. Prominent among those
groups were religious fundamentalists, always advocates of harsh
punishments and the Talion Law: an eye for an eye, a tooth for a tooth,
and a life for life. There were also conservative and right-wing politicians
who realized that crime and punishment could be powerful weapons in
electoral battles and who were intent on exploiting the growing public
concern about crime. Both found strong allies in law-enforcement and
other control agencies, ever anxious to expand their powers and enlarge
their empires. Once they joined forces they constituted a formidable front
and were registering spectacular victories against a dwindling number of
human rights activists, civil libertarians, liberal criminologists, and other
like-minded social scientists. Human rights advocates were forced on the
defensive and were increasingly unable to break new grounds or to gain
favor with a skeptical public, brain-washed by the incessant barrage of
religious and right-wing rhetoric and propaganda.

Then came the coup de grace, the fatal blow to those who were
fighting on the side of freedom and justice. The sword opponents of
human rights have been looking for was handed to them on a silver
platter by the tragic events of 9/11. Conspiracy theories about 9/112
became popular for a reason. Many analysts found it difficult to believe
that terrorists (unless they were without an atom of intelligence) would
willingly provide George W. Bush and the religious fundamentalists with
a license, a carte blanche, allowing them to crack down on human rights
and civil liberties with a ferocity unmatched in recent history, and to
transform within a short period of a few months the democratic United
States into a police state.
If it is true, as George W. Bush claims, that the perpetrators of
9/11 were bent on destroying freedom and democracy in the United
States, then one has to admit that they have succeeded beyond their
wildest dreams! And it is surely sad to see a country that used to be a
bastion of democracy, a country that used to lecture others, such as
China, Cuba, Cambodia, Iran, Myanmar, etc, on human rights, has lost
its moral authority and is no longer able to take the moral high ground as
it used to do. This is because its human rights record in the aftermath of
9/11 is dismal. Is it any wonder that it has become a favorable target of
every respectable human rights organization? It is true that before 9/11
the USA used to be criticized for being the sole country in the Western
world to retain and practice the death penalty and to even execute
mentally handicapped and juvenile offenders (that is those who were
younger than 18 when they committed their crime). And it was only
in 2005 that The Supreme Court ruled that such executions violated the
American Constitution.3 It is also true that prior to 9/11the USA used

consequence of 9/11 is that a new era of witch hunt has begun, that
a new wave of McCarthyism is sweeping the US and many other
countries in the Western world. We now look back in horror at the mass
internment and confiscation of property of Canadians and Americans
of Japanese origin during the Second World War and wonder how this
could have happened. We ask ourselves: were there no safeguards in
both democratic countries to prevent these blatant injustices and abuses
from being committed? The McCarthy era in the USA, was an era of
witch-hunt for communists. It saw the ostracizing, the blacklisting, the
stigmatization, the persecution, the arrests, the detainment, the trials,
and the punishments of suspected communists. Until recently, it was
commonly acknowledged that it was a dark chapter, a black stain, a
shameful episode in American history, not to be repeated. And yet,
following the events of Sept. 11, 2001, it happened all over again. The
targets this time were not communists but suspected terrorists. During
the McCarthy era, communists were hounded, arrested, persecuted and
prosecuted for their political beliefs. Nowadays suspected terrorists are
being victimized because of their religious beliefs. Todays practices are
more sinister because the net of repression is cast much wider to include
anyone with an Arab name, Middle-Eastern appearance, or even a dark
skin. What makes the practices worse than during the McCarthy era is
that quite often the repressive measures are based on nothing other than
the reprehensible principle of guilt by association and because the only
crime of many of the current targets is to happen to belong to a specific
ethnic or religious group.
There is a burning question begging for an answer. How is it that we,
who were extremely proud and fortunate to live in democratic societies,
all of a sudden found ourselves in an environment where eavesdropping
is common, electronic surveillance is prevalent, censorship is rampant,
where freedoms are curtailed, where basic democratic rights (such as
the right to privacy) are being violated with increasing frequency in the
name of the war against crime, the war against drugs, the war against
organized crime, and now the war on terrorism? And who lifted a finger?
Who raised their voice? Who objected, who protested? Who called for
the intrusion to stop, for the invasion to cease?

Has the rule of law become obsolete? Is this the new world order that
we were promised a decade ago?
And the most frightening thing about all this is the apparent
complacency about what is taking place not covertly, not secretly, not
clandestinely, but in broad daylight, under our eyes. The scary thing is
the willingness of many to accept the sacrifice of basic fundamental
values, such as privacy, for a chimerical and illusory security.
Following the startling revelation that the National Security Agency
(NSA) aimed to create a database of every (telephone) call ever made
within the US, a Washington Post ABC News Poll found that 63% of
those asked said they found the NSA program to be an acceptable way
to fight terrorism, and 44% said they strongly approved of it (TIME
Magazine, May 22, 2006, p.17).
There was hardly outrage or outcry from the American public
when it was revealed in December 2005 by The New York Times that
President Bush had authorized the super secret NSA to conduct nowarrant wiretaps of hundreds and perhaps thousands of phone calls
and e-mail messages between people inside the US and parties overseas
(Time Magazine, May 22, 2005, p.18).
It seems that in the post 9/11 era many Americans are willing
to put security above all other traditionally American values. As Time
Magazine (May 22, 2006, p.18) put it:
Maybe Americans figure that if Verizon and Ma Belle
can keep track of whom they call and that, in exchange for a
discount card, Safeway gets to compile a database of what they eat
and Barnes & Noble of what they read theres not much harm
if the Government knows as well.
As a society we have to decide what price we are willing to pay for
the freedoms we cherish, the liberties we enjoy, and the human rights
enshrined in The Canadian Charter of Rights and Freedoms. Are we willing to

sacrifice all this in the quest for some elusive security that will supposedly
protect us from a vague and unpredictable threat? And if we do so what
will remain of our democratic and free society? What will be left to
enjoy? Are we willing to convert a country that is the envy of the world
into a police state? Surely internal security was not a problem in the
Soviet Union, in the countries of the communist block or in Saddam
Iraq. Is Canada willing to trade its proud achievements in the area of
human rights for a false sense of security or the kind of safety that
people enjoyed behind the iron curtain?
THE CREATION OF A NEW CLASS OF INTERNATIONAL
OUTCASTS
One of the tragic consequences of the events of 9/11 and the antiterrorism laws that were passed in many countries in the aftermath has
been the creation of a new class of international outcasts, they are the
new wretched of the earth to use the words of Franz Fanon.
In police language there is a group they call the usual suspects.
Those are the petty criminals, the marginals, the deviants, who are
rounded up and checked whenever a serious crime is committed. The
new usual suspects are now people of Middle Eastern origin and
those who belong to the Islamic faith. They can be arrested and detained
even when no crime has been committed. Traditional legal safeguards
do not apply to them, nor do the rules of The Geneva Convention. In the
past, democratic societies used to brag that nobody is above the law
although we always knew that there were those who were unreachable
and those who were untouchable. The new outcasts are not above the
law; they are truly below the law.
Nowadays, people are put on watch lists, no-fly lists, they are placed
under surveillance, and they have their correspondence intercepted, their
telephone calls monitored, for the sole reason that they have an Islamic
or a middle-eastern sounding name. On a visit to Norway in 2006, I came
across a rather disturbing news item that appeared inconspicuously in a
local newspaper called Oppland Arbeiderblad, (Gjvik, Norway, Monday

July 3, 2006). The heading read: Money transfers stopped for people
with names such as Mohammed and Ahmed.
What was reported is that Money transfer companies like Western
Union have blocked several thousands of money transfers by Muslims.
The companies blocked the transfers solely on ground of the sender
or receivers name, like Mohammed and Ahmed. One example of this
was when an Indian driver tried to transfer the modest amount of 750
Norwegian crowns (less than a hundred US dollars) to a friend and it
was stopped because of the receivers name. According to the sender,
Western Union stated that if money is sent to Sahir Mohammed, the
transfer would be stopped because of his name.
Old prejudices die hard. Those that were swept under the carpet
in the age of political correctness have resurfaced with a vengeance. The
stereotypes that were frowned upon in the previous era of increased
tolerance and harmonious co-existence are now being reinforced and
nurtured by none other than the State and by biased media reporting.
Together they are deliberately or inadvertently promoting hate against
those suspected of being potential terrorists.
What is truly tragic is that the new outcasts seem to be excluded
from the hate crime provisions introduced to protect and reassure the
victims of the holocaust and are therefore helpless to invoke the protection
of the Criminal Justice System. When they were ostracized, when their
religion was reviled and their prophet ridiculed in cartoons all over the
world, they were told that it was all part of the democratic right to free
speech and to freedom of expression. It all proved, if any proof was
needed, that the criminal code cannot be used to legislate love or to
outlaw hate.
I do not want to use this article to relate the prejudices and the
countless problems I personally encountered over the years because of
my terrorist-sounding name, but it may help to quote to a couple of
recent studies to illustrate what I mean when talking about international
outcasts because they reveal negative societal judgments against ethnic
names.

justice those who have committed the worst acts of abuse of power,
including genocide?
Who would have imagined that a country that has signed and
ratified the International Treaty referred to as the Convention Against
Torture would practice torture by proxy and contract out its dirty
security business to torturers in Jordan, Pakistan, Afghanistan, Egypt and
Syria, as was revealed in the now notorious case of Canadian computer
engineer, Maher Arar, and of many others suspected of being members
of Al-Qaeda?
Who would have thought that in a democratic, progressive and
just country like Canada, fundamental freedoms would be trashed in the
name of security and that people would be imprisoned for years under
a so-called security certificate issued by CSIS and rubber stamped by the
government, without the detainees being told what they are suspected to
have done or what exactly the nature of the threat they supposedly pose
for national or international security, is.
Not in my worst nightmares did I ever imagine that I will live to
see the day when a Canadian citizen, not accused or proven guilty of
any crime, would be arrested while in transit at an airport in a friendly
country, detained for days/weeks, and then shipped, not to Canada, the
country whose passport he holds, but to a country where he could be
tortured! And what was Mr. Arars suspected crime? According to the
Globe and Mail (Nov. 8, 2003, p.A6) Mr. Arar was acquainted with a man
who may have known the brother of a terror suspect wanted by the Federal Bureau
of Investigation (my emphasis).
The case of Maher Arar is by no means an isolated case or an
unfortunate incident. It is, according to Morton Sklar, (Globe and Mail,
Nov. 10, 2003:p. A11), only the first case where one of the alleged
terrorists subjected to brutal methods of interrogation has been freed,
and is in a position to confirm the existence of a practice that so brutally
violates basic principles of human rights and the rule of law. Mr. Sklar
calls the practice rendition to torture and it involves sending suspected

features of how we exist as a society - features like whether we respect the rule of
law, for instance.
CRIMINOLOGYS LACK OF IMPACT
Whenever one tries to assess the progress, the development, the
achievements of criminology, say in the last 30 years, one cannot help
being struck by the lack of impact criminology has had on social and
criminal policies. Who is to blame for this sad state of affairs? Does the
problem lie in the nature of criminology or in the way criminologists
have conducted their study and their research? Whatever happened
to those glorious days in the 1960s when the School of Criminology in
Berkeley, California, was the hotbed of protest and a thorn in the side
of a Government sending young Americans to fight and die in Vietnam?
Yes, the world has surely changed! Instead of guiding politicians and
helping shape public policy, many criminologists have been co-opted by
the government. Government officials do not hesitate to use academics
thirst for research funds to induce them to do research projects whose
findings can be used to buttress and support politically motivated policies
and decisions.
Instead of pursuing the goals that guided the pioneers in
criminology, instead of gearing their efforts to achieving a just society
and a humane justice system, criminologists have let the politicians
(many of whom are in the pockets of corporations) and other research
sponsors set the criminological agenda. It is the politicians who defined
street crime, fear of crime, illegal drugs, petty offences and the like, as the
most pressing issues that needed to be studied, analyzed and dealt with
by criminology. As a result, criminologys research fields were narrowly
defined and its scope was severely circumscribed.
Yes! The saddest thing about criminology is its continued
obsession with criminal offences and petty violations of the criminal
code and its persistent neglect of corporate crime, environmental crime,
acts of abuse of power, incumbent terrorism, and so forth. All of this
at a time when we have become painfully aware that we live in a world

large are not those who are arrested in city slums and downtown alleys,
but those who sit comfortably in the corporate offices and those who
the uninitiated and uninformed cherish as their revered leaders.
If the contradictions are not obvious, the readers should ask
themselves who is more dangerous to humanity, who poses a greater
threat to the world: the farmers who plant opium, the ones who harvest
coke, the drug traffickers, or those who mass produce arms and sell
them to feuding tribes, to antagonistic governments in Africa, Asia, the
Middle-East, or Latin America?
No one has yet found weapons of mass destruction in Iraq or
Afghanistan, whose civil populations were killed (and are being killed)
by the thousands. But everyone knows that such weapons are piled up in
the U.S.A., in Russia, in England, in France, in Israel, in India and even
in Pakistan. Unfortunately, the loud voices of protest and the calls for
nuclear disarmament that were vociferous during the late 60s and early
70s have been silenced. And the silence is deafening.
THE NEED FOR A RE-ORDERING OF PRIORITIES IN
CRIMINOLOGY
The rapid changes that are taking place in North American society and
around the world dictate a re-ordering of priorities in criminology. In
order for this re-ordering of priorities to take place, criminologists need
to realize that the priorities of their discipline and their profession do
not always coincide with those of the government and politicians; that
they may be even at odds with administrative priorities. Unfortunately,
criminologists have always let politicians and government officials
determine the priorities and set the agenda for criminological research
and endeavors. For example, for so many years, the war on drugs has
been a popular theme with politicians, particularly south of the border.
Billions of dollars are being spent annually in a futile attempt to stem
the flow of drugs and to reduce their use. By what criterion should
drugs be a priority for criminology? If loss of life is the criterion, then
we have to admit that more people die by criminal homicide than by the

use of illegal drugs; that more people die from AIDS than drug abuse;
that environmental pollution is more hazardous to our health than illicit
drugs.
How much criminological research and how many criminological
studies have been carried out on the lives lost, on the deaths by lethal
weapons sold to third world countries by governments that champion
the wars on drugs?
I was quite impressed by an article published in The Globe and Mail
on Oct. 10, 2003 (p. A17) by Helen Mirren. For one thing, Mirren is
not a criminologist, but a well-known figure for her TV series Prime
Suspect and she is also an ambassador for Oxfam on conflict. The title
of this chilling article is Say no to Murder Inc. Dame Mirren laments the
fact that violence is not always controlled by law, and that justice is not
always done. She is shocked that in any given year about half a million
people die from armed violence - one per minute. She writes: They are
victims of a dangerous unregulated global trade in arms. An incredible 88 per cent of
the worlds arms are supplied by the permanent members of the UN Security Council
- The United States, Britain, Russia, France and China. More than two-thirds of
the value of all arms are sold to Africa, Asia, the Middle East and Latin America.
With the value of global, authorized arms exports estimated at 21 billion (US) per
year, Britain and other arms exporters are making massive amounts of money out of
this deadly trade. These rich governments are constantly urging developing countries
to become less reliant on aid, and to become accountable for improving their own
regional security, economies, education and health. Yet, in what can only be seen as
enormous hypocrisy, the very countries that are urging self-reliance are helping to fuel
the conflicts that destroy peoples livelihoods, and trap countries in a cycle of violence
and poverty.
A LOOK INTO THE FUTURE
When in 1974, more than a decade before the proclamation of The
Canadian Charter of Rights and Freedoms, I included in the criminology
curriculum that I developed at Simon Fraser University in Vancouver a
course on Human Rights and Civil Liberties I never imagined that

thirty years later it will become the most important, most relevant and
most timely course in the whole criminology curriculum. And when in
1974 I included a course on terrorism little did I know that 30 years
later it would become the theme of the day and the topic of the century.
Some may call it foresight. But foresight is sometimes a mixed blessing,
because gazing into the future can be outright frightening. Sadly, a couple
of predictions I made in my book Criminology: Past, Present and Future,
published four years prior to the events of Sept. 11, 2001, are becoming
more and more true with the passing of every single day. On page 288 I
said:
The relative seriousness of property offenses, which constitute about 70 percent of all
crime, will undoubtedly decline. Other things that are now taken for granted, privacy
and freedom, for example, will become more fragile and hence much more precious
commodities than material goods, which will be abundant. The primary function of
the criminal code will be to protect these valuable and vulnerable commodities. More
so because the same technological advances that will make it easier to protect whatever
material possessions one has will pose greater and greater threats to human rights and
freedoms. This is not to say that property crime will disappear, but only that it will
cease to be the dominant mode of criminality that it is today.
IN THE SAME BOOK I ALSO TRIED TO SPECULATE ON THE
AIMS OF CRIMINAL CODES OF THE FUTURE. ON PAGE 289
I WROTE:
It might be true that present criminal codes, whose origins can be traced to an era
when class differences were much more pronounced, do reflect the moral values of the
elites and do protect the material interests of the upper social strata. But criminal
codes of the future will likely be different. The values they will be designed to protect
will not be those of any given social class but will be the values and norms of a
higher order, of a more universal nature. In a society obsessed with a never-ending
pursuit of wealth and material goods, protection of property becomes one of the
most important functions of the criminal code. The major threat to the society of the
future will not be, as it is now, the violation of property rights. This threat will pale
in comparison to the threats posed by nuclear and other technologies. Peoples fears in
the future will not be that their property will be stolen or their houses broken into;

sophisticated security systems and comprehensive public insurance schemes will take
care of that. Their major fear will be of major environmental catastrophes, nuclear
or biological terrorism, or genetic technologies that could wipe out the human race.
There will be other, lesser fears than those created by the advances in genetic technology,
genetic engineering, and the manipulation of the human embryo. A major part
of the future criminal codes will have to be devoted to the regulation of previously
unregulated areas, such as organ transplants, organ sales, artificial insemination, test
tube fertilization, gene and sperm banks, uterus rental, and many other issues related
to the technical manipulations of human reproduction. And it is easy to imagine how
difficult it will be to try to explain the new forms of criminality by using obsolete
and antiquated criminological theories developed during the 20th century. What is
important to mention here is that the material interests, which are currently the focus
of the criminal code, will surrender their place to superior moral values. The interests
of humanity at large, not the interests of any particular class, will provide the guiding
principle for the criminal code of the future.
Such a conclusion lead me to reiterate a prediction made by Wollan
(1980) that criminology in the future will become somewhat more
concerned for values and, hence, will shift from the empirical scientific
end of the spectrum toward the normative, philosophical end.
A FEW QUESTIONS
We are witnessing a crucial moment in the history of criminology and a
critical phase in its evolution. Today, criminology stands at a crossroads
and what it does now will determine and shape its future for decades
to come. It would take much too long to list many of the questions
that criminologists have to ask about the future of their discipline
and their profession. But here are a few offered for consideration and
contemplation:
- In a society where concern about crime is ceding the stage to
concern about insurgent terrorism, where the emphasis is no
longer on the well being of the citizens but on national security,
where basic democratic rights and freedoms are sacrificed to
supposedly combat terrorism, has criminology lost its relevance?

who are somewhat older will still remember the tragic end of the fascist
regimes in Germany, in Italy, in Spain, in Portugal, and the list goes on
and on. In Western democracies, governments practice their oppressive
and intrusive policies until they are thrown out of office at the next,
or after the next election. So there is no reason to lose hope or to give
up the fight. One need only to think of the McCarthy era and the antiCommunist witch hunt in the United States or to remember the sexual
hysteria that swept many Western countries, including Canada, in the
1980s and 1990s and led to the destruction of dozens of communities
and of hundreds of families whose members were erroneously charged
and wrongly convicted. Finally, the sexual persecution of the innocent
had to come, and did ultimately come, to an end.
And the same is bound to happen once the hysteria over 9/11
has died down. The current obsession with terrorism that led, and still
leads, to the arrest, the detention, the torture, the stigmatization, the
ostracism of thousands of our brothers because of their ethnic origin,
their religious affiliation, their different beliefs, their associations, or
because of their names or where they were born, this obsession will
also subside sooner or later. Many years from now this new McCarthyist
episode will be remembered as an aberration, as a blot in the history of
a democratic and just society.
Yes, there is hope! And now and then, a decision here and a
decision there create reasons for optimism. A couple of years ago, in
the Netherlands, there was an attempt to have The Brotherly love, Freedom
and Diversity Party (PNVD) banned. But a court in The Hague rejected
the bid stating unequivocally that: The freedom of expression, the freedom
of assembly and freedom of association.......should be seen as the foundations of the
democratic rule of law and the PNVD is also entitled to these freedoms
(The Vancouver Sun, Tuesday, July 18, 2006, p.A4)
And a few weeks earlier, on the 29th of June, 2006, came a glimmer
of hope from the US when the Supreme Court, as conservative as it
is, ruled that president George W. Bush overstepped his authority in
ordering military trials for a handful of Guantanamo Bay detainees.
