Dear Mr. Suresh,
RE: APPOINTMENT AS FINANCIAL CONTROLLER
On behalf of Affordable Homes Sdn Bhd (The Company), we are delighted to offer
you fixed term employment for a period of one (1) year at The Northam All Suites,
Penang (the Hotel) effective 5th October 2015 on the following terms and conditions.
1.0

PROBATION AND CONFIRMATION


You will be put under probation for three (3) months. At the discretion of the
company, the period of probation may be extended.

2.0

POSITION
You will be appointed in the position of Financial Controller, reporting to the
General Manager of The Northam All Suites, Penang or any other superior as
assigned.

3.0

REMUNERATION
3.1 You will be paid a basic salary of Ringgit Malaysia: Seven Thousand and
Five Hundred Only (RM7,500.00) per month.
3.2 Your remuneration (less lawful deductions) will be payable in arrears not
later than the seventh (7th) day of the month in respect of wages earned by
you in the preceding month.
3.3 The Company shall be entitled to at any time during your employment or in
the event of termination, for any reason whatsoever, to deduct from your
remuneration any monies due from you to the Company.

4.0

TERMINATION
4.1 During the period of probation, either party may terminate the employment
by giving 1 month notice in writing or payment of salary in lieu of notice.
4.2 After confirmation, either party may terminate the employment at any time,
by giving 3 months notice in writing or payment in salary in lieu of notice.
4.3 Notwithstanding the above the Company reserves the right to terminate
your appointment without notice or salary in lieu at any time in the following
circumstances:
(a)

If you are found guilty of any misdemeanour, default, misconduct or


negligence;

(b) If you breach or fail to observe any of the terms and conditions of your
employment, both express and implied;
(c) if you convicted of any criminal offence (other than an offence under
road traffic legislation in Malaysia or elsewhere for which a fine or noncustodial penalty is imposed).
4.4 The Company shall be entitled to terminate your employment by one (1)
months notice in writing if you are unable to perform your duties for a
continuous period of forty (40) days or in aggregate a period of sixty (60)
days during the term of this contract, due to incapacity, illness or injury.
4.5 The company has the right to renew or not to renew your contract at its own
discretion.

5.0

WORKING HOURS
Your working hours shall be forty-four (44) hours per week excluding meal
breaks. You may be required to work on straight or split shift. You will be
advised by your Superior or Head of Department as to your actual daily
working hours.
You shall not unreasonably refuse to carry out your duties as and when it may
become necessary in order to meet the needs of the Companys or Hotels
business, whether in excess of or outside the hours of work provided herein. If
required by law, payment of overtime salary in accordance with the applicable
provisions of the Employment Act, 1955 (as amended from time to time) will be
made.

6.0

TRANSFER AND RE-DESIGNATION


The Company may, at its discretion transfer or re-designate you, either on a
temporary or permanent basis, whenever it deems appropriate or necessary, to
any of its outlets, section, department, other properties or companies within the
Hotel.

7.0

CONFIDENTIALITY
You shall not, at anytime during your employment with the Company or
thereafter, make public, use, divulge or disclose to any person any information
as to the business dealings or affairs of the Company, the Hotel or any of its
clients or as to any other matters concerning the Company, the Hotel or clients
which may come to your knowledge in the course of your employment with the
Company.

8.0

MEDICAL EXAMINATION
The Company shall at all times be entitled to require you to be examined at the
Companys expense by a doctor appointed by the Company without assigning
any reason whatsoever and you hereby consent to the result of such
examination being disclosed to the Company.

9.0

EMPLOYMENT INFORMATION
You hereby confirm that all information provided to the Company including but
not limited to the information you have provided in your, application form and
during the recruitment stage to be absolutely true and accurate. The accuracy
and truthfulness of such information shall constitute a fundamental term of your
employment with the Company. If it is discovered at any time prior to the
commencement of your employment or during your employment with the
Company that any pre-employment information that you have provided to the
Company is false, misleading or in breach of this clause, the Company shall
have the right to terminate your employment summarily.

10.0

GENERAL TERMS AND CONDITIONS OF FIXED TERM EMPLOYMENT


Others terms and conditions of employment are as stipulated in the Benefits
Schedule annexed hereto. Any terms and conditions not specified shall be in
accordance with the provisions of the Employment Act 1955 in so far as it is not
contrary to your status as a fixed term employee.

11.0

ENTIRE AGREEMENT
You hereby confirm that save for the terms that have been reduced in writing in
this contract and the Benefits Schedule, you are not relying on any other
representations or assurances, oral or written made to you by the Company, its
directors, officers, employees, agents or representatives.

12.0

OTHERS TERMS & CONDITIONS


The Company reserves the right to amend, add, delete or revise any terms and
conditions as stated above from time to time at its discretion.

Kindly acknowledge your understanding and acceptance to the abovementioned terms


and conditions of employment by signing and returning the duplicate copy of this letter.
