CONSTITUTION AND BY-LAWS
PREAMBLE
We, the Lesbian, Gay, Bisexual and Transgender students of
Bicol University, expressing our faith in the Divine Providence in order
to train ourselves in self-government in order to promote the high
standards for character, scholarship, leadership and service, to foster
closer relationship, and understanding with Bicol University
administration and the community; to maintain effective, cooperative
and fellowship among ourselves; and to contribute to the University of
excellence in higher education in the region; do hereby promulgate
and adopt this constitution.
ARTICLE I
Name
Section 1. This Organization herein established shall be known as the
Bicol University Moving Ahead for Gender Equality, Empowering and
Nurturing Talents (B.U MAGENTA).
ARTICLE II
Declaration of Objectives and Function
Section 1. The Bicol University MAGENTA shall be autonomous in
undertaking program of action complementary to the rights and
Welfare of the Lesbian, Gay, Bisexual, and Transgender (LGBT) student
inside the university.
Section 2. The Bicol University MAGENTA
gives importance to the
promulgation of the rights and welfare of the LGBTs within the
University.
Section 3. The Bicol University MAGENTA adheres to the principle of
equality among allthe students. No discrimination of any sort
shall be encouraged. Also the Bicol University MAGENTA commits
to thedemocratic participation within the context of equalityto all
the decision in the University that will concern the students .
Section 4. TheBicol University MAGENTA commits itself to actively strive to
eradicate student passivity.
Section 5. The Bicol University MAGENTA recognizes the importance of free
discussion and the exchange of ideas to further the Goals of the

Organization and of the University. It recognizes the freedom of


its members to promote various ideas, beliefs and ideologies.
Section 6. The Bicol University MAGENTA devotes itself to creating venues
and providing opportunities for the promotion of student
empowerment and for the development of student leadership.

Membership III
Section 1. All Lesbian, Gay, Bisexual, Transgender and interested
students of Bicol University, irrespective of years and Colleges who are
officially enrolled during the school year can be a member.
Section 2. Each member is required to pay P50.00 per semester as
their membership fee which will immediately be considered as the
organizations standing fund in order to generate programs, projects,
activities and others.
ARTICLE IV
Rights of the Members
Section 1. All members shall have the freedom of the press and
speech, and peaceful assembly not contrary to the Constitution of the
Bicol University MAGENTA and existing laws governing such rights.
Section 2. All the members shall have the right to petition the proper
authorities for redress of grievances, present views and opinions
conducive to broad, sound and healthy thinking of vital issues
concerning the welfare of the LGBTs (Lesbian, Gay, Bisexual and
Transgender)
Section 3. Every member shall have the right to have the grades
speedily recorded, his transcript of records speedily processed and the
confidentiality of his academic records maintained.
Section 4. Every member shall have the right to be informed of the
rules and regulations affecting him.
Section 5. Every member shall have the right to have reasonable
protection, in case of arrest within school premises; coordination shall
be accorded to the school authorities.

Section 6. No member shall be subject to exploitation, involuntary


servitude nor cruel and unusual punishment.
Section 7. All members shall have the right to form, assist and join
school based and non school-based organization, alliances and
federations for their integral development.
Section 8. Every member shall have the free access on records,
reports and other documents kept by the organization
ARTICLE V
Powers and Duties of the Officers of the Bicol University
MAGENTA
Section 1. The President shall be the Chief Executive Officer of the
Organization. He shall:
a. Preside over the general, regular, special and emergency
meetings of the Organization.
b. Carry out and implement resolutions and council laws
passed and approved by the Officers.
c. Represent the organization in his official capacity as
President in occasions and events where the organization
needs his representatives.
d. Authorize and countersign all disbursements to be paid by
the Treasurer.
e. Perform such other acts as may be required of him by the
Council and the organization.
f. Take active supervision over the proper ties, interests,
business and affairs of the organization.
g. In case of suspension and removal of current Bicol
University MAGENTA Officer, the President shall appoint a
student in replacement of the removed one, with the
consent of the other Bicol University MAGENTA Officers.
Section 2. The Vice President shall:
a. Assist the President in all the matters where his assistance
is required.
b. Take over the duties of the President in cases of absence,
disability, resignation or removal for cause of the President.
c. Monitor the activities of the organization.
d. Perform such other acts as may be required of him/her by
the Organization.
e. Propose annual budget to the Assembly.
Section 3. The Secretary shall:
a. Record and keep the minutes of the organization.
b. Prepare and send communications pertaining
activities of the organization.

c. Perform such duties of the President that the organization


may delegate to him/her.
d. Head the Secretariat Committee.
e. Prepare accomplishment report at the end of every
semester.
Section 4. The Treasurer shall:
a. Act as the custodian of the funds and property of the
organization.
b. Disburse the funds of the organization in accordance with
such rules and regulations.
c. Prepare financial statement which shall be supported by the
vouchers and official receipts at the end of the semester.
d. Perform such other duties as may be entrusted to him by
the organization
e. Head the Finance Committee.
Section 5. The Auditor shall:
a. Audit funds and accounts of the organization.
b. Certify the legality of the expenses incurred by the
organization.
c. Perform such other duties as may be entrusted to him by
the organization

Section 6. The Business Manager shall:
a. Supervise all business and fund raising activities of the
organization.
b. Perform such functions as may be designated to him by the
organization.
c. Head the Ways and Means Committee.
Section 7. The Public Information Officer shall:
a. Disseminate information for mass media duly approved by
the President.
b. Head the Public Relations Committee.
c. Pass the minutes, financial statements, and other important
documents prepared by the Secretary and the Treasurer to
the concerned offices.

ARTICLE VI
Impeachment and Suspension from the Office
Section 1. Any officer, who violates the Constitution of the Bicol
University MAGENTA, commits grave misconduct and neglects his
duties shall be liable for impeachment or suspension.

Section 2. For the purpose of impeachment, an affirmative vote of at


least two-thirds of all the officers shall be required.
Section 3. For the purposes of suspension, an affirmative vote of at
least two-thirds of all officers there being a quorum, at the disciplinary
proceedings at which penalty is being determined shall be required;
provided that the period or suspension shall not exceed 60 days.

ARTICLE VII
Meetings
Section 1. The regular meeting of the organization shall be held every
Thursday of the week, the time and place to be designated by the
President. Six members shall constitute a quorum and their acts shall
bind the Council.
Section 4. The President may call for emergency and special meeting.
Section 5. The Secretary shall issue notices of the meetings at least
three (3) before such meeting is to be held.
ARTICLE VIII
Funds
Section 1. The funds of the Bicol University MAGENTA shall come from
the fees paid by the members and from other sources of funds such as
donations, Sponsorship and solicitations.

ARTICLE IX
Bicol University MAGENTA Adviser
Section 1. The Bicol University MAGENTA must be a full time faculty
member of the university whom the majority of the officers shall
choose.
Section 2. The adviser shall be one of the signatories of the given
bank accounts.
Section 3. The term of the office of the adviser shall be co-terminus
with the Bicol University MAGENTA officers.
ARTICLE X
Amendments
Section 1. The Bicol University MAGENTA in a meeting especially for
the purpose of a congress may propose amendments to the
Constitution by three-fourths vote of all the members, subject to the
ratification of the officers in the same manner as the adoption of the
Constitution provided in the next succeeding article.

ARTICLE XII
Effectivity
Section 1. This amended Constitution shall be ratified by a majority
vote of the officers in the plebiscite called for the purpose and shall
take effect upon the approval of the adviser.
