FederalRuleofCriminalProcedure7(f)providesthattheCourtmaydirectthefilingofabillof
particularsuponthemotionofadefendant.Thepurposeofabillofparticularsistoapprisethe
defendantofthenatureofthecharges,insuchaway,soastoensurethathe:(1)understandsthe
charges,(2)canprepareadefense,(3)canavoidprejudicialsurpriseattrial,and(4)canbepossible

Inthepresentcase,xxxxxxxischargedinCountOneoftheabovecaptionedindictmentwith
ConspiracytoDistribute50GramsorMoreofCocaineBaseinviolationof21U.S.C.846.Count
OneallegesthattheConspiracyexistedfrom"onoraboutSeptember30,1992,toonoraboutJanuary
15,1993."However,CountOnefailstostateanyoftheallegedovertactsnecessarytosupportthe
government'schargethataconspiracyexistedandthatxxxxxxxwasinvolvedinit.Inaddition,other
thanCountOne,Mr.xxxxxxx'sonlyotherchargesstemfromtransactionswhichallegedlyoccurred
betweenJanuary8,1993,andJanuary15,1993(Counts20,23,28and32).Further,inallbutthelast
oftheallegedtransactions,Mr.xxxxxxxischargedalone.Therefore,theinformationsoughtbythis
MotionForBillOfParticularsisabsolutelynecessarytopermitMr.xxxxxxxtoadequatelypreparea
defensetotheconspiracyallegedinCountOne.
