In the Court of Sub-Divisional Executive Magistrate.
Raiganj Sub-Division.Uttar Dinajpur.
Nature of the Case: Promulgation of Order under section 144 Cr.P.C. within the
jurisdiction of Raiganj Police Station, Uttar Dinajpur.
Whereas, this office is on receipt of a report from the SP, Uttar Dinajpur todat ie
in 02/04/2015;
And
Whereas, the report necessitates a deep look into the simmering tension that in
all apprehension has got sufficient input to get flared up any moment;
And

Whereas, certain very disturbing incidents of serious nature causing intolerable

threat to human life abd property in Kanki within the district and adjoining
Kishanganj in Bihar have recently happened;
And
Whereas, Swagata Samity of Uttar Dinajpur under Viswa Hindhu Parishad(VHP)is
to organise a Sanmelan at Merchant Club Maidan or any place within the
jurisdiction of the Raiganj Police Station, on 5 th April,2015;
And
Whereas, there is possibility of large gathering of people in and around the
Sanmelan Maidan from far off areas even from the adjoining states;
And
Whereas, there is sufficient reason to believe that a very aggravated situation
has cropped up which is all likely to scuttle the peace, tranquillity and communal
harmony in the locality;
And
Whereas, there is sufficient reason to apprehend and urgent measures are
warranted for preventing any tension, intimidation or disturbance and the free
hand of which may lead to serious breach of peace , tranquillity and communal
harmony in general and human life and property in particular;
And
Whereas, the continuing of the Sanmelan at Merchant Club Maidan, Raiganj on
5th April 2015 is no longer appears to be held in safe and conducive ambience
and amidst peace and tranquillity and needs to be stopped;

Now, Therefore,
I, Sri Bipul Kumar Biswas, WBCS(Exe.), Sub-Divisional Executive Magistrate,
Raiganj Sub-Division, Uttar Dinajpur, being satisfied and am of the opinion that
there is sufficient resion to proceed Under Section 144 Cr. P.C. for preventing any
breach of peace, tranquillity and communal harmony in the locality, do hereby
promulgate prohibition of any assembly of more than five people at a time in and
around 200 (Two) Hundred) Metres of Merchant Club Maidan, Raiganj, Uttar
Dinajpur.
Order is also issued that
None from the people of any hue and cry shall cause any sorts of prevention,
intimidiation and / or threat to any person and raise any sprots of slogan or
public call which may aggravate the situation.
The Order comes with an immediate effect and shall remain effective for a period
of 60(Sixty days) since promulgation.
