PRELIMINARY
L Short title, extent and commencenent._{l)
This Act may
be called the Jammu and Kashmir Reservation
act, ZOO+.
(2) It extends to the whore of the state
of Jammu and
Kashmir.
(3) It shall come into force from the date
of its pubricationin
the GovernmentGazette.

2. De/initions.-rn this Act, unless the c6ntert


otherwise
requires,(a) "Act" meansthe Jammuand KashmirReservation
Act, 2004;
"Appellate
Authorit5r"meansthe authoritiesprescribedunder

Provided that the Government may, on the
recommendationsof the State Backward Classes
Commission,makeinclusionsin, and exclusionfrom' the
said categoryfrom time to time :
Providedfurtherthat the personsspecifiedbelorvand
their children shall be excluded from the category of
'socially and educationallybackwardsl433s5'(i) Governor (serving or retired) ;
(ii) Chief Justice and Judges(serving or retired) of High
Court or the SuPremeCourt of India ;
(iii) Chief Minister and Ex-Chief Minister ;
(iv) Ministers and Ex-Ministers of Cabinet rank ;
(v) Ministersof StateandDeputyMinistershavingmorethan
one term ;
(vi) Chairmanand membersof Jammuand Kashmir Public
Service Commission or the Union Public Service
Commission;
(vii) Membersof the StateLegislature(electedand nominated
both) havingmorethanoneterm irrespectiveof the period
under the secondterm ;
(viii) Members of All India Services;
(ix) any person whose annual income from all sources'
determinedin the prescribedmanner' exceedsrupees
three lacs or such amount as may be notified by the
Governmentfrom time to time in accordancewith the
prescribednorms ; and
(x) such other personsas the Governmentmay notifr from
time to time ;

(p) "selection agency" means the agency, authority, Board or


official committee, as the case may be, prescribed for
recommendingappointmentsorpromotionsorforselecting
candidatesfor admission to professional institutions and
includesthe appointingauthoritywhereverselectionsaremade
directlY bY such authoritY;
(q) "weak and under-privilegedclasses"meanthe classesdeclared
assuchundernotificationSRo.3g4dated5-9.l98lread
with notification SRO-272 dated 3-7-1982 and notification
SRo-316dated18-7-lgS4asamendedfromtimetotime.

CHAPTER II
RESERVATION IN APPOINTMENT BY DIRECT
RECRUITMENT
3. Reservationin appointment'-Exceptas otherwiseprovided

4. Reservationnot to bar appointmentin open merit.-Nothing


containedin section 3 shall preventthe appointmentof any person
belongingto any reservedcategoryagainstunreservedvacancyon the
basisof his merit and suchappointmentshall not result in reduction
in the number of posts reservedfor that category.

the posts shall remainvacantand shall be canied forward to the next
recruitment process :
Providedthat nothinghereincontainedshall preventlaunchingof
a specialdrive by a selectionagencyto fill the carriedforwardvacancies
by inviting applicationsexclusivelyfrom personsbelongingto such
category.
(2) If in the first attemptof recruitment,suitablecandidatesare
not available, secondattemptmay be made in the same recruitment
yearand if eventhen suitablecandidatesarenot available,the vacancies
shall be treated as backlog vacancies.
(3) In subsequentyear, when recruitmentis made for reserved
vacancies,the backlogvacanciesshall also be notified :
Provided that the total number of reservedvacanciesincluding
backlog vacanciesshall not exceedthe percentagereservedfor such
categories.
(a) The reservedvacanciesremaining unfilled for a period
exceedingthree years shall be treated as dereserved.
CHAPTER III
RESERVATION IN GOVERNMENT SERVICE

6. Reservationin promotions.-Except as otherwise provided
in the Act, available vacanciesto the extent as may be notified by
the Governmentfrom time to time, shall be reservedin any service,
class,categoryor gradecarrying a pay scalethe maximumof which
does not exceedthe pay scale of the post of Deputy Secretaryto
Government,for promotionfrom amongstthe personsbelongingto the

any reserved category.

may,by notification in theGovernmentGazette,invest anyrevenueofficer,
not belowthe rankof Tehsildar,with'powersto issuecertificatesin favour
of membersof the reservedcategories:
Providedthat in respectof remoteand inaccessibleareas,the

14. Presentationof application.-A personclaiming benefit
undertheAct shallapplyinthe prescribedmannertotheCompetentAuthority
for grant of a certificate.
