EMPLOYEE BENEFITS AND SERVICES

Before I start my assigned topic I have listed important things to fonder regarding working
conditions of the employees:
1. The normal hours of work of any employee shall not to exceed 8 hours a day. Works may
be performed beyond 8 hours a day provided that the employee is paid for the overtime
work.
2. Every employer shall give his employees a rest period of not less than 24 consecutive
hours after every 6 consecutive normal work days.
3. Under time work of any particular day shall not be offset by overtime work on any other
day.
COMPANY BENEFITS AND SERVICES
As my co-reporter said a while ago, business firms, companies, government agencies and
entities provide their employees benefits and services in addition to wages or salaries in order to
improve the economic conditions of their employees, to provide them with facilities and
assistance for their welfare and convenience. For private firm it may granted either:
1. Voluntarily granted by the company
2. CBA
3. Required by law
But for the government employees there should be a law enacted. There are so many employee
benefits and services enforce nowadays. The sole purpose of these, is for the convenience of the
employer and of the employees, to promote better relations among the both, to reduce
absenteeism, fatigue and greater production:
1. Transportation and housing services if the firm is located in an isolated place where
there are no regular vehicular facilities, to attract and keep workers, the company often
provides bus services for its employees or construct a low-cost housing to be sold or
rented by the employees.
2. Company store and cafeteria some firms operate a store where there products are
sold at discounted price for the employees.
3. Library and reading room to provide employees with technical books, research and
reference materials and magazines related to the business of the firm. This is to widen
the ideas of the worker about the assigned work.
The following are some employee benefits and services that most companies and firms observe
and practice:
1. VACATION LEAVE WITH PAY an employee gets paid while away from work with the
authorization and consent of the employer. A few days of rest and relaxation, change of
activity and change of atmosphere to revitalize all aspects of life of the employee
(Physical, mental, spiritual and emotional). The granting of vacation leave with pay to
employees is based on 3 concepts:
a. It is the employers investment on the health of the workers which benefits production
as a result of improve efficiency of his employees.
b. It is the employers means of recognizing employee loyalty and length of service.
c. It is a good employer-employee relations policy in promoting sound employee morale.
2. SICK LEAVE WITH PAY an employee gets paid who is suffering from an ailment which
prevent him from reporting for work. It enable the employees to get the rest and
treatment he needs so he can get well and return to work soon.
The Labor Code requires private firms to grant paid vacation leaves of at least 5 days each
year which is called the incentive leave. Every employee who has rendered at least 1 year
of service shall be entitled to a yearly service incentive leave of five days with pay.
However sick leave are still granted only upon management initiative and discretion or
under the CBA.
3. SOLO PARENT LEAVE (RA 8972) Woman who gives birth as a result of rape, a widow or
widower, spouse separated legally or de facto for at least 1 year. Any employee who is a
solo parent is entitled to parental leave of not more than 7 working days for every year.
Provided, he/she has rendered service of at least 1 year. The intention of the said law so
that the parent and the child can have time for themselves.
4. LEAVE UNDER RA 9262 (BATTERED WOMAN) the victim woman of violence, if she is an
employee she is entitled to a leave with pay up to 10 days in addition to other paid leaves.
This is to allow the victim to recover from trauma she undergo. The employee has to
submit the certification from Punong Barangay or Kagawad or Prosecutor or Clerk of Court
that an action under 9262 has been filed and is pending.
5. PATERNITY LEAVE (RA 8187) - Any married male employee in the private and public sector
is entitled to 7 working days Paternity Leave with full pay in case his lawful wife has given
birth or suffered miscarriage.

6. MATERNITY LEAVE (RA 1161) Every employer shall grant to any pregnant woman, who
has rendered an aggregate service of at least 6 months for the last 12 months a maternity
leave. Employee need not legally married, and has given birth or suffered miscarriage for:
60 days normal delivery
78 days caesarian delivery
But, benefits shall be paid only for the FIRST 4 deliveries or miscarriages
7. HOLIDAY PAY Every worker shall be paid his regular wage during regular holidays, except
establishments regularly employing less than 10 workers. However the employer may
require an employee to work on any holiday but such employee shall be paid a
compensation equivalent to twice his regular rate.
8. REST PERIOD OR COFFEE BREAK It has now become a recognized practice. It runs from
5-20 minutes and considered a compensable working time. Survey among firms revealed
that it reduces fatigue, increase efficiency and improves morale of workers.
9. MEAL PERIODS Employer should give his employees not less than 60 minutes time-off for
their regular meal. Except, in case of emergencies and work is necessary to prevent loss
the meal period should be not less than 20 minutes. To shorten meal time to less than 20
minutes is not allowed. If the so-called meal time is less than 20 minutes, it becomes only
a rest period
10.13th MONTH PAY(PD 851) All employers are required to pay all their employees a 13 th
month pay not later than December 24 of every year equivalent 1/12 th of the basic salary
of an employee within a calendar year. Provided he have worked for at least 1 month
during a calendar year. Except, household, commission basis workers.
11.RETIREMENT BENEFITS Depends upon the retirement plan of the company, the most
common of which is one that gives to the retiring employees, the sums of money is
equivalent to month or 1 month pay for every year of service with the company. This is
in addition to the retirement benefits under the SSS or GSIS. In the absence of a
retirement plan or CBA concerning the terms and conditions which provides for retirement
at an older age, an employee may retired upon reaching the age of 60, but this is optional,
the mandatory age is 65 years old.
12.SERVICE AWARDS a recognition to employees who have rendered a certain number of
years of service to the company. Awards are generally given at the end of every 5 th years
of service or 10, 15, 20, 25, 30, etc. years of service. Then usually a special recognition
award is given upon completion of 25, 30, or 40 years of service. In the government
service we the so-called longevity sum of money.
13.MEDICAL BENEFITS it is covered under the NATIONAL HEALTH INSURANCE ACT OF 1995
(RA 7875). It includes all citizens of the Philippines but the beneficiaries shall first be
enrolled in order for them to be placed under coverage that entitles them to avail of
benefits. SSS and GSIS members, retirees, pensioners and their dependents, shall immediately and
automatically be made members of the National Health Insurance Program. How to avail the program? To
be entitled of the said benefits:

A. Requisites:
1. A member whose premium contributions for at least 3 months have been paid
within the 6 months prior to the first day of his or his dependents' availment;
2. He can show that he contributes with sufficient regularity; and
3. He is not currently subject to legal penalties
B. Monthly contributions need not be paid by the following to be entitled to benefits:
1. Retirees and pensioners of the SSS and GSIS prior to the effectivity of this Act
2. Members who reach the age of retirement and have paid at least 120 monthly
contributions; and
3. Enrolled indigents
Benefit Package
1. Inpatient hospital care:
a. room and board;
b. services of health care professionals;
c. diagnostic, laboratory, and other medical examination services;
d. use of surgical or medical equipment and facilities;
e. prescription drugs and biologicals; subject to the limitations stated in Section 37
of this act
f. inpatient education packages
2. Outpatient care:
a. services of health care professionals;
b. diagnostic, laboratory and other medical examination services;
c. personal preventive services; and
d. prescription drugs and biologicals subject to the limitations described in Section
37 of this Act

3. Emergency and transfer services


4. Other health care services
Excluded Personal Health Service
1. Non-prescription drugs and devices;
2. Outpatient psychotherapy and counseling for mental disorders;
3. Drug and alcohol abuse or dependency treatment;
4. Cosmetic surgery;
5. Home and rehabilitation services;
6. Optometric services;
7. Normal obstetrical delivery; and
8. cost-ineffective procedures which shall be defined by the Corporation.
