Thank you for your recent conversations with Committee staff regarding Secretary
Hillary Clinton's appearance before the Select Committee on Benghazi.
As we prepare for Secretary Clinton's testimony, we believe there may be documents and
emails from Secretary Clinton relevant to the Committee's inquiry that have not been produced
to the Committee and are likely in her possession. In the most recent document production to .
Congress in August 2014, the State Department, for the first time, produced emails regarding the
Benghazi attack that were sent to and from the address of"hdr22@clintonemail.com." The use
of this email address could explain the relatively small number of emails attributed to Secretary
Clinton produced by the Deparbnent of State relevant to our requests.
The Department was able to identify these newly produced and ostensibly newly
discovered emails because those emails additionally traveled to or from an official State
Department email address. However, the Department has produced only a few of these
documents. The Committee is of course interested in al1 relevant emails related to the state of
Libya before, during, and after the attack on September 11, 2012 regardless of whether those
emails originated from official or non-official accounts. To be clear, the Committee has no
interest in any emails, documents or other tangible things not related to Benghazi. But to the
extent personal email was used to conduct, in any way, official duties we would request those
documents, emails, and other tangible things.
The following summary will aid your understanding of what we have seen in the limited
documents produced thus far.
Examples of Email Usage
In the early morning hours of September 12, 2012, the day after the attack, Sidney
Blumenthal, a longtime friend of Secretary Clinton, sent an email to hdr22@clintonemail.com
regarding Libya. Sent at 12:50 a.m., this email contained the subject "H: Magariaf on attack on

GregAs you are aware, we have been dealing with the turnover of former Secretary Clinton's e-mails. In the first tranche of
e-mails there was one that was subsequently classified. We so advised Mrs. Clinton's lawyer who in turn advised us
that he had received preservation requests from the Select Committee on Benghazi and the IGs from State and the IC
and so needed to keep the e-mail.
The U/S write back (6/19/15) letter asking for a POC with whom Department could work to ensure that the e-mail (and
any subsequently upgraded e-mails were being secured appropriately. The June 22 letter provides the name of the POCo
Please ask the appropriate OS subject matter experts to contact Ms. Turner to arrange for appointment to do a thorough
security review to include physical security of area/safe in which document/electronic versions are being kept, who has
access to the area/safe, do those individuals have appropriate clearances, when the electronic version is uploaded on a
computer is it a stand-alone computer, when the disk/thumb drive is removed is any residual information deleted from
the computer and any other appropriate questions.
This review/Inspection needs to be carried out as soon as possible.
Please keep me in the loop re appointment timing and results of the inspection.

Please be advised that today the above referenced e-mail, which previously was unclassified, has
been classified as "Secret" pursuant to Section 1.7(d) of Executive Order 13526 in connection
with a review and release under the Freedom of Information Act (FOIA). In order to safeguard
and protect the classified infonnation, I ask - consistent with my letter to you dated March 23,
2015 - that you, Secretary Clinton and others assisting her in responding to congressional and
related inquiries coordinate in taking the steps set forth below. A copy ofthe document as
redacted under the FOIA is attached to assist you in your search.
Electronic Records
I) Consistent with my March 23 letter, and to the extent the documents are stored electronically,
please copy onto a digital video disc (DVD) or compact disc (CD) the approximately 55,000
pages. If available, the Department would ask that the documents be provided in native
electronic fonnat with the associated metadata. These steps are in accordance with counsel
we have received from the National Archives and Records Administration.
2) Once the copy has been made place the disc(s) in a brown envelope, seal it, address it to
Richard Visek, Deputy Legal Adviser, U.S. Department of State, Washington, D.C., and
mark the word "SECRET" on the outside of that envelope. Once that is done, please notify
us and we will pick up the envelope from your office.

required in 36 CFR 1230.14 concerning the potential alienation of Federal email records created

continues to be fluid, there are currently two major questions or concerns that the Department
needs to address.
First, in your response you described and forwarded key policy directives issued by the
Department in 2014, on records management in general, including specific guidance related to
the management of email and other electronic records of senior agency officials. Related to these
policies, I am requesting additional infonnation on how the Department implemented these
directives with senior officials. More specifically, we would like to understand the specific
training, procedures, and other controls the Department employed to ensure the key directives
were implemented. This will allow NARA to evaluate whether there are appropriate safeguards
in place to prevent the alienation of records from occuning in the future.
Second, as we have discussed, I would like to reiterate our request that the Department contact
the representatives of fonner Secretary Clinton to secure the native electronic versions with
associated metadata of the approximately 55,000 hard copy pages of emails provided to the

Department. If the Department is unable to obtain the electronic versions of these messages from
Secretary Clinton, I am requesting that the Department inquire with the internet service or email
provider of former Secretary Clinton, and also of former Secretary Powell, with regard to
whether it is still possible to retrieve the email records that may still be present on their servers.
As stated in the OMBINARA M-12-18 Managing Government Records Directive, Federal
agencies are required by the end of 20 16 to maintain all electronic records, including email.in
their native electronic format to facilitate active use and future access.
I am aware that there are multiple ongoing inquiries into the details of this case, including by
Congressional oversight committees and the Department's Inspector General, which may already
be addressing the requests that I have made. I would therefore appreciate continuing updates on
the current status of these activities to the extent possible, particularly where the investigations
may reveal that the collection Secretary Clinton provided to the Department is incomplete. I also
look forward to receiving copies of the final reports of all such investigations, as well as the
Department's plans for corrective action. This documentation will assist us in understanding this
situation and the Department plans to ensure a comparable situation will not happen in the future.
In closing, I would like to convey my appreciation for the Department's efforts in following up
with the representatives of the. former Secretary on the many concerns that have surfaced in the
past several months. We share many of the Department's concerns and stand ready to provide
advice when needed on the records management issues that arise.

The National Archives and Records Administration (NARA) is concerned with the events
outlined in the March 2,2015, New York Times article by Michael S. Schmidt regarding the
potential alienation of Federal email records created or received by fonner Secretary of State
Hillary Rodham Clinton. The article also suggests potential issues with the Federal email records
created or received by fonner Secretaries of State dating back to Secretary Madeleine K.
Albright.
Based on this article and other news reports, NARA is concerned that Federal records may have
been alienated from the Department of State's official recordkeeping systems.
Pursuant to your Department's responsibilities under 44 U.S.C. Chapter 31 and NARA's
authorities in 44 U.S.C. Chapter 29, we request that the Department of State explore this matter
and provide NARA a report of how these records were managed and the current status of these
records.
We request that you provide us with a report as required and described in 36 CFR 1230.14 within
30 days of the date of this letter.
If Federal records have been alienated, please describe all measures the Department has taken, or
expects to take, to retrieve the alienated records. Please also include a description of all
safeguards established to prevent records alienation incidents from happening in the future.
Please also provide NARA all guidance and directives disseminated within the Department that
address the management of email records, including those records created using personal email
accounts.

Dear Messrs linick and McCullough:
This will confirm receipt of your Jetter dated May 26, 2015. As personal counsel to former Secretary Clinton, we will
take reasonable steps to preserve any federal government data or records currently in her possession, generated during
her tenure as Secretary of State and to retain any devices used to store such data or records during this period. As you
note in your letter, the former Secretary produced to the State Department in December 2014 approximately 55,000
pages of such documents. This was the result of a comprehensive review by her personal counsel to identify any workrelated or potentially work-related emails from her personal email account. This process erred on the side of overinclusiveness, as indicated by the fact that a review by the National Archives and Records Administration recently
confirmed the State Department's determination that 1246 of the approximately 30,000 emails the former Secretary
had produced were not federal records but were in fact personal in nature. I am not aware of any further federal
records to be produced, but in the event we identify such records, we will produce them.

I'm happy to show you in person on your computer the following, but here is how you make such editing changes to
have a single editor color and change the User Name:
When in a document, under the Review tab, the "Track Changes" square, click the small black down arrow in the lower
right corner of that square.
Click "Change Tracking Options"
On the pop-up screen Track Changes Options, on the upper right:
o change the Insertions color from "By author" to whatever single color you prefer. (I chose blue.,
o Also, change to the same for the Deletions color. (Again, I chose blue.)
o On that same screen, 2/3 down the screen, unclick the Track Formatting box. This is key to avoiding the
many formatting comments that clutter the document.
Click OK.
Go back to the "Track Changes" square, and again click the small drop down arrow.
Click "Change User Name ... "
Change User name to whatever you want. (I typed in "Legal".)
Change Initials to whatever you want. (I typed in "Legal".)
Click OK.

The U/S write back (6/19/15) letter asking for a POC with whom Department could work to ensure that the e-mail (and
any subsequently upgraded e-mails were being secured appropriately. The June 22 letter provides the name of the POC.
Please ask the appropriate DS subject matter experts to contact Ms. Turner to arrange for appointment to do a thorough
security review to include physical security of area/safe in which document/electronic versions are being kept, who has
access to the area/safe, do those Individuals have appropriate clearances, when the electronic version is uploaded on a
computer is it a stand-alone computer, when the disk/thumb drive is removed is any residual information deleted from
the computer and any other appropriate questions.
This review/inspection needs to be carried out as soon as possible.
Please keep me in the loop re appointment timing and results of the inspection.

from records that she has turned over, raising new questions about whether she deleted work-related emails from the private account

Graham, Republican of South Carolina, who is running for president, said he planned to send a series of questions to the State
Department about the missing emails and about why it allowed her to use the personal account.

Republicans said that the State Department's statement was likely to increase pressure on the House speaker, John A. Boehner of
Ohio, to subpoena the server in Mrs. Clinton's home that housed the account.
Mrs. Clinton has said that she gave the State Department about 50,000 pages of emails that she deemed to be related to her work as
secretary of state and deleted roughly the same number. She said the messages sJle deleted were personal, relating to topics like yoga,
family vacations and her mother's funeral.
Her longtime confidant and adviser Sidney Blumenthal, responding two weeks ago to a su.bpoena from the House cOmmittee
investigating the 2012 attacks in Benghazi, Libya, gave it dozens of cmails he had exchanged with Mrs. Clinton when she was in
otl'ice. Mr. Blumenthal did not work at the State Department at the time, but he routinely provided her with intelligence memos about
Libya, some with dubious information, which Mrs. Clinton circulated to her deputies.
State Department officials then crosschecked the emails from Mr. Blumenthal with the ones Mrs. Clinton had handed over and
discovered that she had not provided nine of them and portions of six others.
Nick Merrill, a spokesman for Mrs. Clinton, who is running for president, said that she had given the State Department "over 55,000
pages of materials," including "all emails in her possession from Mr. Blumentllal."
The chairman of the House committee, Trey Gowdy, Republican of South Carolina, said that many of the em ails that Mrs. Clinton
had not handed over showed that "she was soliciting and regularly corresponding with Sidney Blumenthal, who was passing un vetted
intelligence information about Libya ITom a source with a financial interest in the country."
"It just so happens these emails directly contradict her public statement that the messages froin Blumenthal were unsolicited," he said.
Mr. Blumenthal identified the source of his information as Tyler Drumheller, a former high-ranking C.I.A. official, according to a
person with knowledge of his testimony to the Benghazi panel. Mr. Drumheller was part of a group that sought to do business in
Libya.
Supporters of Mrs. Clinton have argued that the committee's mission has crept far beyond its original scope: to investigate the
Benghazi attacks, which killed fOUT Americans including Ambassador 1. Christopher Stevens. Republican committee members have
said that they are within their right to look into her email use because the resolution that created the panel directed tllem to examine
how the administration complied with previous inquiries into the attacks. Mrs. Clinton'S emails relating to the attacks were not
handed over to any of the panels conducting those inquiries.
Other panels in Congress may consider investigaling the matter. Mr. Graham, who oversees a Senate subcommittee with sway over
the State Department's budget, said that the department "seems to have a system that is not working very well" in regards to its
production of documents to Congress.
"I'm going to ask them whether they think Mrs. Clinton has handed over everything she should and what they are going to do about it,"
he said. "And if they give me runaround responses, we'll drag them up on Capitol Hill and make them answer these questions in
public."
While the State Department acknowledged that it did not have several of Mrs. Clinton's emails, it also told the Benghazi committee
that it had not turned over other messages of hers. The department said that it had not done so because the contents of those messages
fell outside the requests made by the committee.
"The State Department is working diligently to review and publish the 55,000 pages of emails we received from former Secretary
Clinton," it said in a statement.
That statement is unlikely to satisfy the committee, which believes it has been clear in its requests. Members of the panel have

Former Secretary of State Hillary Rodham Clinton didn't turn over all of her work-related emails to the department despite her claims
to have done so, the Benghazi investigative committee charged Thursday in a statement raising new questions about the Democratic
presidential candidate's email practices.
Rep. Trey Gowdy, South Carolina Republican and the Benghazi panel chainnan, said the State Department informed his panel that it
did not have in its possession some emails related to Benghazi and Libya that Mrs. Clinton had exchanged with longtime confidant
Sidney Blumenthal, and which he turned over to the committee.
If true, it suggests that Mrs. Cl'inton either did not perform a fuJI search, intentionally shielded some messages, or had some other
hiccup when she claimed to have belatedly complied with federal law and turned back to the department some 30,000 messages from
her time as secretary.
The Associated Press said there were 15 messages that the State Department said it couldn't find in its own records that Mrs. Clinton
provided.
"This confirms doubts about the completeness of Clinton's self-selected public record and raises serious questions about her decision
to erase her personal server - especially before it could be analyzed by an independent, neutral third-party arbiter," Mr. Gowdy said.
Mrs. Clinton set up her own email server at one of her homes, in New York, and used an account she issued herself, rather than an
account on State Department servers, to conduct business during her four years in office.
She said the arrangement was done out of convenience.
Federal law requires that officials ensure their emails, which are considered potential government records be stored on official servers
for archival purposes. Mrs. Clinton did not comply with that requirement until nearly two years after she left office, and only after the
Benghazi investigative panel discovered her unique email arrangement.
At a dramatic press conference and in follow-up communications from her attorney, she said she had gone through all of her messages
and decided which of the more than 60,000 from that period were personal and which were related to government business.
She said she found 30,000 that she deemed official and turned them over to the State Department in paper fonn. She said another
32,000 were private and she expunged them, then wiped her server clean.

A court has ordered the department to make all of the official messag~s public, and the department had already turned over several
hundred related to Benghazi and Libya more generally, so the committee could complete its probe into the terrorist. attacks of Sept. 11,
2012, which killed Ambassador J. Christopher Stevens and three other Americans.
However, Mr. Gowdy said, the cmails Mr. Blumenthal exchanged with Mrs. Clinton during her time in office were business-related
but weren't part of the set that the State Department sent.
He demanded that the department say whether it had withheld the emails.orwhetherMrs.Clinlon never turned them over in the fITst
place.
The messages Mr. Blumenthal produced also contradict Mrs. Clinton's claim that his advice was "unsolicited."
"This has implications far beyond Libya, Benghazi and our committee's work. This conclusively shows her email arrangement with
herself, which was then vetted by her own lawyers, has resulted in an incomplete public record," Mr. Gowdy said.
The messages in question don't go to the heart of the Benghazi attack, Democrats said.
Mrs. Clinton'S presidential campaign didn't immediately respond to a request for comment Thursday night, nor did a spokesman for
Rep. Elijah E. Cummings of Maryland, the ranking Democrat on the Benghazi committee.
A Clinton campaign spokesman told The Associated Press that they believe she fulfilled her obligations.
"She has turned over 55,000 pages of materials to the State Department, including all emails in her possession from Mr. Blumenthal,"
spokesman Nick Merrill told the wire service.
They also questioned whether some ofthe messages Mr. Blumenthal turned over were really emails, saying they appeared to be
formatted as other types of documents.

If true, it suggests that Mrs. Clinton either did not perform a full search, intentionally shie lded some messages, or had some other
hiccup when she claimed to have belatedly complied with federal law and turned back to the department some 30,000 messages from
her time as secretary.
The Associated Press said there were 15 messages that the State Department said it couldn't find in its own records that Mrs. Clinton
provided.
"This confirms doubts about the completeness of Clinton's self-selected public record and raises serious questions about her decision
to erase her personal server - especially before it could be analyzed by an independent, neutral third-party arbiter," Mr. Gowdy said.
Mrs. Clinton set up her own email server at one of her homes, in New York, and used an account she issued herself, rather than an
account on State Department servers, to conduct business during her four years in office.
She said the arrangement was done out of convenience.
Federal law requires that officials ensure their em ails, which are considered potential government records, be stored on official servers
for archival purposes. Mrs. Clinton did not comply with that requirement until nearly two years after she left office, and only after the
Benghazi investigative panel discovered her unique email arrangement.
At a dramatic press conference and in follow-up communications from her attorney, she said she had gone through all of her messages
and decided which of the more than 60,000 from that period were personal and which were related to government business.
She said she found 30,000 that she deemed official and turned them over to the State Department in paper form. She said another
32,000 were private and she expunged them, then wiped her server clean.
A court has ordered the department to make all of the official messages public, and the department had already turned over several
hundred related to Benghazi and Libya more generally, so the committee cou.ld complete its probe into the terrorist attacks of Sept. II,
2012, which killed Ambassador J. Chfistopher Stevens and three other Americans.
However, Mr. Gowdy said, the cmllils Mr. Blumenthal exchanged with Mrs. Clinton during her time in office were business-related
but weren't part of the set that the State Department sent.
He demanded that the department say whether it had withheld the emails, or whether Mrs. Clinton never turned them over in the first
place.
The messages Mr. Blumenthal produced also contradict Mrs. Clinton's claim that his advice was "unsolicited."
"This has implications far beyond Libya, Benghazi and our committee's work. This conclusively shows her email arrangement with
herself, which was then vetted by her own lawyers, has resulted in an incomplete public record," Mr. Gowdy said.
The messages in question don't go to the heart of the Benghazi attack, Democrats said.

Mrs. Clinton's presidential campaign didn't immediately respond to a request for comment Thursday night, nor did a spokesman for
Rep. Elijah E. Cummings of Maryland, the ranking Democrat on the Benghazi committee.
A Clinton campaign spokesman told The Associated Press that they believe she fulfilled her obligations.
"She has turned over 55,000 pages of materials to the State Department, including all emails in her possession from Mr. Blumenthal,"
spokesman Nick Merrill told the wire service.
They also questioned whether some of the messages Mr. Blumenthal turned over were really em ails, saying they appeared to be
formatted as other types of documents.

As you are aware, we have been dealing with the turnover of former Secretary Clinton's e-mails. In the first tranche of
e-mails there was one that was subsequently classified. We so advised Mrs. Clinton's lawyer who in turn advised us
that he had received preservation requests from the Select Committee on Benghazi and the IGs from State and the Ie
and so needed to keep the e-mail.
The U/S write back (6/19/15) letter asking for a poe with whom Department could work to ensure that the e-mail (and
any subsequently upgraded e-mails were being secured appropriately. The June 22 letter provides the name of the POe.
Please ask the appropriate DS subject matter experts to contact Ms. Turner to arrange for appointment to do a thorough
security review to include physical security of area/safe in which document/electronic versions are being kept, who has
access to the area/safe, do those individuals have appropriate clearances, when the electronic version is uploaded on a
computer is it a stand-alone computer, when the disk/thumb drive is removed is any residual information deleted from
the computer and any other appropriate questions.
This review/inspection needs to be carried out as soon as possible.
Please keep me in the loop re appointment timing and results of the inspection .

HRC Email Coverage
I just had a very cordial 45 minute conversation with Paul Wester regarding the press coverage of the HRC email
personal account 'and State records, focusing on State actions and those NARA will take today.
I explained to Paul the environment in which State operates (and the bifurcated management of recor~s for principals vs
the rest of the Department), as well as steps that M and others have initiated to ensure that we are compliant with laws
and regulations.
In short, we can ex ect a letter from Paul to me later today covering the alienation (a legal term of art) of the former
