PETITION FOR DOMESTIC ADOPTION OF A MINOR
The petitioners, through the undersigned counsels, and unto this Honorable
Court, respectfully avers that:
1. The petitioners Tommy and Miho Esguerra are husband and wife, Filipinos, 43
and 42 years old, respectively, and residents of Banao, Guinobatan, Albay, as
evidenced by their Marriage Contract and Birth Certificates, attached herein as
Annex A and B;
2. They have an adopted child, Aimee Esguerra, female, eleven (11) years old, and
said petitioners desire to jointly adopt a foundling named as Sumo, male and
about two (2) years old, whose filiation is unknown, as evidenced by Certificate
of Foundling, herein attached as Annex C;
3. That the petitioners are the finders of said male child on January 15, 2016 in SM
City Naga. Afterwhich, petitioners immediately reported the incident to the Naga
City Police Headquarters where it was recorded. Then, they committed said
child to the DSWD Region V, Legazpi City;
4. That Aimee Esguerra has manifested her consent to this adoption as evidenced
by her Affidavit of Consent, a copy of which is attached herein as Annex D;
5. That the subject minor possesses all the qualifications and none of the
disqualifications for her to be adopted by the herein petitioners;
6. That the subject minor is physically fit to be adopted by the petitioners. This fact
is evidenced by medical certificate, a copy of which is attached herein as
Annex E;
7. That the herein petitioners possess all the qualifications and none of the
disqualifications to adopt the subject minor;
8. That the petitioners are, likewise, physically fit to adopt This fact is evidenced
by medical certificate, a copy of which is attached herein as Annex F;

9. That the herein petitioners are in possession of full civil capacity and legal rights
to adopt the subject minor;
10. That the petitioners have not been convicted of any crime involving moral
turpitude. This fact is evidenced by their NBI Clearances, copies of which is
attached herein as Annex G.
11. That the herein petitioners are physically, mentally, psychologically,
emotionally, and financially qualified to adopt the said minor, this fact is
evidenced by the medical certificates issued to the petitioners, Certficates of
Employment as government employees, and SALN, copies of which are
attached herein as Annexes H, I and J, respectively;
12. That prior to the filing of the instant petition, a social worker has been
assigned to the subject adoption and he has prepared the Child and Home
Study Report which are attached herein as Annex K;
13. That herein petitioners have complied with the requirements under the Domestic
Adoption Act of 1998 (R.A 8552) and will be able to financially and morally bring
up and educate said minor properly and adequately.
14. This petition will serve the best interest and well-being of the subject minor.
WHEREFORE, it is most respectfully prayed to this Honorable Court that after
publication and hearing, judgment be rendered allowing the adoption of the minor child,
Sumo, by the petitioners, and ordering that the minor childs surname changed to that of
the petitioners.
