Legal protection of a variety
Rights in a variety may be obtained and enforced on the territory of the
Republic of Moldova by means of a plant variety patent, granted by the State
Agency for Intellectual Property in accordance with this Law and subregulatory normative acts, and likewise with international treaties in this field,
one of the parties to which is the Republic of Moldova.
Authorities responsible for the legal protection of a variety
The authorities implementing state policy in the area of legal protection
of varieties are the State Agency for Intellectual Property (AGEPI), and the
State Commission for the Testing of Plant Varieties
( CSTSP).

State policy in the field of the use of new varieties in breeding shall be
implemented by the State Commission for Testing of Plant Varieties.
