theMinistredel'ducationetdel'EnseignementsuprieuronJanuary22nd.Aresponsefrom
theministrystatedthatTheMinistrydoesntpossessdocumentsaboutthedisciplinarydecisions,
becausetheyarehandledbythedifferenceschoolboards.
Asecondrequest,askingfordecisionsbytheministerorthedepartmenttotakeactiononthe
certificatesofteachersintheprovince,includingthereasontheactionwastakenwasnotreturned
intimeforpublication.

TheDepartmentiscurrentlyreviewingitspracticesincommunicatingrevocations,keepingin
mindthebalancebetweenpersonalinformationandthepublic'srighttoknow.
Asforyouremailedquestions:
1.Forthefivearbitrationsyousentusafewweeksago:
Howmanyoftheseendedwithcertificatesbeingrevoked?Oneisbeingconsideredfor
revocation.
Wereallfiveofthecomplaintsthatstartedthesearbitrationsfoundedintheend?
Ofthefiveadjudications,threestemmedfromfoundedcomplaintsunderPolicy701.
Ofthesethree,oneteacherwassuspendedandtwoteacherswereterminated.Ofthese
twoterminations,onewasupheldbytheadjudicatorhearingthecase,andthiscaseisbeing
consideredforrevocation,andtheotherwasreinstatedintohisformerposition,however,a
suspensionwasimposed.
Therefore,ofthese5adjudications,theonlyteachercertificatebeingconsideredfor
revocationistheonewheretheterminationwasupheld.Theprocessisongoing.
Theothertwoadjudicationhearingsdidnotoriginatefromcomplaintsbutratherfrom
insubordinationandapersonnelmatter.Oneteacherwassuspended,theotherwasdismissed
andsubsequentlyreinstatedintoadifferentpositionfollowingtheadjudicationhearing.
Inaddition,sinceJanuary2005,nine(9)teacherscertificateshavebeenrevokedasper
theMinisterialprocess.Asthesedismissalswerenotgrieved,therewasnoadjudication
hearingheldforthesecases.

Suesentmeyourrequest.Schoolboardsarethemainemployerandareresponsibleforteacher
performanceandregulardiscipline.Thedepartmentonlytakesactionrelatedtoteachingcertificates(ex.
suspensions,cancellationsofcertificates)inregardstoseriousincidents.
Overthelast10years(20052015inclusive)theMinisterhastakenactionon46teacherscertificates.The
followingreasonsforactionbeingtakenare(alsoattachedinspreadsheetformat):
15casesrelatedtothefollowingtypesofmisconduct:SexualAssault,SexualImpropriety,Sexual
Exploitation,SexualRelationshipswithaStudentandSexualMisconduct.
12casesrelatedtothefollowingtypesofmisconduct:InappropriateRelationships,Inappropriate
Communications,ChildLuring.
5casesrelatedtoChildPornographyorPossessionofPornography.
Theremaining14caseshaveinvolvedadiverserangeofmisconductnotrelatedtothose
mentionedabove.TheDepartmentisunabletoprovideadditionalinformationwithoutpotentiallyidentifying
anindividual,prohibitedintheFOIPOPlegislation.
