ORDER:
Considering the totality of circumstances presented with the respondent's motion, which has
not been opposed by the Department of Homeland Security, the proceedings are reopened under
the provisions of 8 C.F.R 1003.2(a) and will be terminated without prejudice to allow the
respondent to further pursue the acquisition of lawful permanent resident status in this country in
conjunction with a Form 601-A provisional unlawful presence waiver.
