JUDICIAL AFFIDAVIT OF PLAINTIFF KRIS DE LAS ALAS

I, Kris de las Alas, of legal age, married, and living at 14 Joey Street, Sta. Rita, Batangas
City, plaintiff in this case, state under oath as follows:
PRELIMINARY STATEMENT
The person examining me is Atty. Noli Sanchez with address at 304 MVL Bldg.,
P.Burgos Street, Batangas City. The examination is being held at the same address. I am
answering his questions fully conscious that I do so under oath and may face criminal
liability for false testimony and perjury.
PURPOSE: This judicial affidavit is being offered to prove all the allegations in my
complaint including all annexes appended thereto and all other matters, facts and
circumstances relevant and material to this case.
1. Q. Please state your name and other personal circumstances for the record.
A. I am Kris de las Alas, 37 years old, single, and presently resides at 14 Joey Street,
Sta. Rita, Batangas City.

Q. Are you the same Kris de las Alas, the petitioner in this case?
A. Yes.

3. Q. Do you know the defendant in this case, Ms. Bea Gonzaga?

A. Yes. She is one of my clients, particularly a borrower, in my personal loan
business.
4. Q. How did you meet her?
A. She came to my office in Bauan, Batangas sometime in October of 2011,
accompanied by her brother, Felipe Gonzaga, my former classmate in college, and
inquired as to how she can avail of a personal loan.
5. Q. Did she apply for a loan on that same day?
A. No. She merely asked for a copy of the requirements.

Q. When did she apply for the loan then?

A. On 3 October 2011.

7. Q. How much did she apply for?

A. Two million pesos.
8. Q. Was her application approved?
A. Yes, but only the amount of P800,000.00 based from the recommendation of the
credit investigator.
9. Q. When was her loan released?
A. On 12 December 2011.
10. Q. Was there any document which she submitted or executed in relation to the said
loan?
A. Yes, a promissory note which embodies the terms of the said loan.
11. Q. What are the terms surrounding the said loan?
A. The said loan is payable in 12 equal monthly installments with stipulated monthly
interest of 5% per month.
12. Q. What is the current status of her loan?
A. The same remains unpaid to this date.
13. Q. What happened to the monthly installments?
A. She did not pay the same despite the notices I sent and despite several demands.
14. Q. Did defendant offer any other means to pay her loan or at least any reason for her
default?
A. No. My collector even reports of being asked by her helper to wait outside her
house but defendant would not show up.
