Sec.2.ItisthepolicyoftheStatetoensurepublicsafetyandpromoteeconomicdevelopmentthroughthepreventionandsuppressionofallkindsof
destructive fires and promote the professionalization of the fire service as a profession. Towards this end, the State shall enforce all laws, rules and
regulationstoensureadherencetostandardfirepreventionandsafetymeasures,andpromoteaccountabilityforfiresafetyinthefireprotectionservice
andpreventionservice.

protectionsystemsuchassprinklersandotherautomaticextinguishingsystem,detectorsforheat,smokeandcombustionproductsandother
warningsystemcomponents,personalprotectiveequipmentsuchasfireblankets,helmets,firesuits,glovesandothergarmentsthatmaybeput
onorwornbypersonstoprotectthemselvesduringfire.

FireSafetyConstructions Refers to design and installation of walls, barriers, doors, windows, vents, means of egress, etc. integral to and
incorporatedintoabuildingorstructureinordertominimizedangertolifefromfire,smoke,fumesorpanicbeforethebuildingisevacuated.
Thesefeaturesarealsodesignedtoachieve,amongothers,safeandrapidevacuationofpeoplethroughmeansofegresssealedfromsmokeor
fire,theconfinementoffireorsmokeintheroomorflooroforiginanddelaytheirspreadtootherpartsofthebuildingbymeansofsmoke
sealed and fire resistant doors, walls and floors. It shall also mean to include the treatment of buildings components or contents with flame
retardantchemicals.

Sec.4.ApplicabilityofTheCode.TheprovisionsoftheFireCodeshallapplytoallpersonsandallprivateandpublicbuildings,facilitiesorstructures
erectedorconstructedbeforeandafteritseffectivity.

Sec.5.ResponsibilityfortheEnforcementofthisCode.ThisCodeshallbeadministeredandenforcedbytheBureauofFireProtection(BFP),under
thedirectsupervisionandcontroloftheChiefoftheBureauofFireProtection,throughthehierarchyoforganizationasprovidedforinChapterVIof
Republic Act No. 6975. with the approval of the Secretary of the Department of the Interior and Local Government (DILG), the BFP, is hereby
authorizedto:

a. Issue implementing rules and regulations, and prescribe standards, schedules of fees/fire service charges and administrative penalties
thereforeasprovidedinthepertinentprovisionsofthisCode
c ra la w

b.ReorganizetheBFPasmaybenecessaryandappropriate

c ra la w

c.Supportandassistfirevolunteers,practitionersandfirevolunteerorganizationsinthecountrywhoshallundergomandatoryfiresuppression,
inspection,rescue,emergencymedicalservicesandrelatedemergencyresponsetrainingsandcompetencyevaluationstobeconductedbythe
BFP.InthecaseoftheFirepractitiones,theyshallundergomandatorycontinuousprofessionaleducationandcompetencyevaluationoftheir
expertise,knowledgeandskillsintheareaoffirescience,engineeringandtechnologytobeconductedbytheBFP

TheBFPmayenterintoexternalpartyagreementsfortheconductoftraining,educationandevaluationoffirevolunteers,practitionersandfire
volunteer organizations, which shall be under the full control and supervision of the BFP: Provided, however, That during firefighting
operations,firevolunteerorganizationsshallbeunderthedirectoperationalcontrolofthefiregroundcommandersoftheBFP

d.Enterintolongtermagreement,eitherthroughpublicbiddingsornegotiationsinaccordancewiththeprovisionsofRepublicActNo.9184,
otherwiseknownastheGovernmentProcurementReformActof2003,fortheacquisitionoffireprevention,fireprotectionandfirefighting
investigation,rescue,paramedics,hazardousmaterialhandlingequipment,supplies,materialsandrelatedtechnicalservicesnecessaryforthefire
services

e. Enter into Memoranda of Agreement with other departments, bureaus, agencies, offices and corporations of the government, as well as
privateinstitutions,inordertodefineareasofcooperationandcoordinationanddelineateresponsibilityonfirepreventioneducation,firesafety,
fireprevention,firesuppressionandothermattersofcommonconcern

f.Callonthepolice,otherlawenforcementagencies,andlocalgovernmentassistancetorendernecessaryassistanceintheenforcementofthis
Code

g. Designate a fire safety inspector through his/her duly authorized representative, who shall conduct an inspection of every building or
structurewithinhisareaofresponsibilityatleastonceayearandeverytimetheowner,administratororoccupantshallrenewhis/herbusiness
permitorpermittooperate

No occupancy permit, business or permit to operate shall be issued without securing a Fire Safety Inspection Certification (FSIC) from the
Chief,BFP,orhis/herdulyauthorizedrepresentative
c ra la w

h.Inspectatreasonabletime,anybuilding,structure,installationorpremisesfordangerousorhazardousconditionsormaterialsassetforthin
thisCode,providedthatincaseofsinglefamilydwelling,aninspectionmustbeupontheconsentoftheoccupantoruponlawfulorderfromthe
propercourt.TheChief,BFPorhis/herdulyauthorizedrepresentativeshallordertheowner/occupanttoremovehazardousmaterialsand/or
stophazardousoperation/processinaccordancewiththestandardssetbythisCodeoritsimplementingrulesorregulationsorotherpertinent
laws

i.Whereconditionsexistandaredeemedhazardoustolifeandproperty,toordertheowner/occupantofanybuildingorstructuretosummarily
abatesuchhazardousconditions
c ra la w

j.Requirethebuildingowner/occupanttosubmitplansandspecifications,andotherpertinentdocumentsofsaidbuildingtoensurecompliance
withapplicablecodesandstandardsand
c ra la w

k.Issueawrittennoticetotheownerand/orcontractortostopworkonportionofanyworkduetoabsence,orinviolationofapprovedplans
andspecifications,permitand/orclearanceorcertificationasapprovedbytheChief,BFPorhis/herdulyauthorizedrepresentative.Thenotice
shallstatethenatureoftheviolationandnoworkshallbecontinuedonthatportionuntiltheviolationhasbeencorrected.
Sec.6.TechnicalStaff.TheChief,BFPshallconstituteatechnicalstaffofhighlyqualifiedpersonswhoareknowledgeableonfireprevention,fire
safety,andfiresuppression.TheymaybedrawnnotonlyfromtheorganicmembersoftheBFPandothergovernmentofficesandagencies,butalso
fromothersources.Inthelattercase,theywilleitherbeappointedintotheserviceorhiredasconsultantsinaccordancewithlaw.Thetechnicalstaff
shallstudy,reviewandevaluatelatestdevelopmentsandstandardsonfiretechnologyprepareplans/programsonfiresafety,preventionandsuppression

andevaluateimplementationthereofdevelopprogramsontheprofessionalizationofthefireservicecoordinatewithappropriategovernmentandprivate
institutions for the offering of college courses on fire technology and fire protection engineering propose amendments to the Fire Code advise the
Chief,BFPonanymatterbroughttohisattentionandperformsuchotherfunctionsasdirectedonanymatterbroughttohisattentionandperformsuch
otherfunctionsasdirectedbyhigherauthorities.

Sec.7.Inspections,SafetyMeasures,FireSafety,Constructions,andProtectiveand/orWarningSystems.Asmaybedefinedandprovidedinthe
RulesandRegulations,owners,administratorsoroccupantsofbuildings,structuresandtheirpremisesorfacilitiesandotherresponsiblepersonsshall
berequiredtocomplywiththefollowing,asmaybeappropriate:

Sec.9.Violation,PenaltiesandAbatementofFireHazard. Fire hazards shall be abated immediately. The Chief, BFP or his/her duly authorized
representative,uponthereportthataviolationofthisCodeorotherpertinentlaws,rulesandregulationsisbeingcommitted,shallissuenotice/orderto
complytotheowner,administrator,occupantorotherpersonresponsiblefortheconditionofthebuildingorstructure,indicatingamongotherthings,
theperiodwithinwhichcomplianceshallbeeffected,whichshallbewithinten(10)tofifteen(15)daysafterthereceiptofthenotice/order,depending
onthereasonablenesstoadequatelycomplywiththesame.

If,afterthelapseoftheaforesaidperiod,theowner,administrator,occupantorotherresponsiblepersonfailedtocomply,theChief,BFPorhis/her
authorized representative shall put up a sign in front of the building or structure that it is fire hazard. Specifically, the notice shall bear the words

"WARNING: THIS BUILDING/STRUCTURE IS A FIRE HAZARD", which shall remain posted until such time that the owner, administrator,
occupantorotherpersonresponsiblefortheconditionofthebuilding,structureandtheirpremisesorfacilitiesabatethesame,butsuchperiodshallnot
exceedfifteen(15)daysfromthelapseoftheinitialperiodgiveninthenotice/ordertocomply.

Finally,withthefailureoftheowner,administrator,occupantorotherpersonresponsiblefortheconditionofthebuilding,structureandtheirpremises
orfacilitiestocomplywithintheperiodspecifiedabove,theChief,BFPmayissueorderforsuchabatement.Iftheowner,administratororoccupantof
buildings, structure and their premises or facilities does not abate the same within the period fixed in said order, the building, structure, premises or
facilitiesshallbeorderedclosedbytheChief,BFPorhis/herdulyauthorizedrepresentativenotwithstandinganypermitclearanceorcertificateearlier
issuedbythelocalauthorities.

Anybuildingorstructureassessedanddeclaredbythechief,BFPorhis/herdulyauthorizedrepresentativeasafiretraponaccountofthegravityor
palpabilityoftheviolationoriscausingclearandpresentimminentfiredangertoadjoiningestablishmentsandhabitationsshallbedeclaredapublic
nuisance,asdefinedintheCivilCodeofthePhilippinesinanoticetobeissuedtotheowner,administrator,occupantorotherpersonresponsibleforthe
conditionofthebuilding,structureandtheirpremisesorfacilities.Iftheassessedvalueofthenuisanceortheamounttobespentinabatingthesameis
notmorethanOnehundredthousandpesos(P100,000.00),theowner,administratororoccupantthereofshallabatethehazardwithinfifteen(15)days,
or if the assessed value is more than One hundred thousand pesos (P100,000.00), within thirty (30) days from receipt of the order declaring said
buildingorstructureapublicnuisanceotherwise,theChief,BFPorhis/herdulyauthorizedrepresentativeshallforthwithcauseitssummaryabatement.
failuretocomplywithinfive(5)daysfromthereceiptofthenoticeshallcausetheChief,BFPorhis/herdulyauthorizedrepresentativetoputupasign
infrontofthebuildingorstructure,atorneartheentranceofsuchpremises,notifyingthepublicthatsuchbuildingorstructureisa"FIRETRAP",
whichshallremainuntiltheowner,administrator,occupantorotherpersonresponsiblefortheconditionofthebuilding,structureandtheirpremisesor
facilitiesabatethesamewithinthespecifiedperiod.

Summaryabatementasusedhereinshallmeanallcorrectivemeasuresundertakentoabatehazardswhichshallinclude,butnotlimitedtoremodeling,
repairing, strengthening, reconstructing, removal and demolition, either partial or total, of the building or structure. The expenses incurred by the
governmentforsuchsummaryabatementshallbebornebytheowner,administratororoccupant.Theseexpensesshallconstituteapriorlienuponsuch
property.

Sec.10.EnforcementofTheLien.Iftheowner,administratororoccupantfailstoreimbursethegovernmentoftheexpensesincurredinthesummary
abatementwithinninety(90)daysfromthecompletionofsuchabatement,thebuildingorstructureshallbesoldatpublicauctioninaccordancewith
existing laws and rules. No property subject of lien under Sec. 9 hereof, may be sold at a price lower than the abatement expenses incurred by the
government.Thepropertyshallbeforfeitedinfavorofthegovernmentifthehighestbidisnotatleastequaltotheabatementexpenses.

Sec.11.Penalties.

1.Againsttheprivateindividual:

a)AdministrativefineAnypersonwhoviolatesanyprovisionoftheFireCodeoranyoftherulesandregulationspromulgatedunder
this Act shall be penalized by an administrative fine of not exceeding Fifty thousand (P50,000.00) pesos or in the proper case, by
stoppage of operations or by closure of such buildings, structures and their premises or facilities which do not comply with the
requirementsorbybothsuchadministrativefineandclosure/stoppageofoperationtobeimposedbytheChief,BFP.Provided,That
thepaymentofthefine,stoppageofoperationsand/orclosureofsuchbuildings,structures,andtheirpremisesorfacilitiesshallnot
absolvetheviolatorfromcorrectingthedeficiencyorabatingthefirehazard.ThedecisionoftheChief,BFP,underthissubsection,
may be appealed to the Secretary of the Interior and Local Government. Unless ordered by the Secretary of the Interior and Local
GovernmenttheappealshallnotstaytheexecutionoftheorderoftheChief,BFP.ThedecisionoftheSecretaryoftheInteriorand
LocalGovernmentshallbefinalandexecutory.

(b)PunitiveIncaseofwillfulfailuretocorrectthedeficiencyorabatethefirehazardasprovidedintheprecedingsubsection,the
violatorshall,uponconviction,bepunishedbyimprisonmentofnotlessthansix(6)monthsnormorethansix(6)years,orbyafine
ofnotmorethanOnehundredthousand(P100,000.00)pesosorbothsuchfineandimprisonmentProvided,however,thatincaseofa
corporation, firm, partnership or association, the fine and/or imprisonment shall be imposed upon its officials responsible for such
violation, and in case the guilty party is an alien, in addition to the penalties herein prescribed, he shall immediately be deported
Provided,finally,thatweretheviolationisattendedbyinjury,lossoflifeand/ordamagetoproperty,theviolatorshallbeproceeded
againstundertheapplicableprovisionsoftheRevisedPenalCode.

Any person who, without authority, maliciously removes the sign that a building or structure is a fire hazard/firetrap placed by the
authorized person in this Code shall be liable for imprisonment for thirty (30) days or a fine not exceeding One hundred thousand
pesos(P100,000.00)orbothinthediscretionofthecourt.

Any person, who disobeys the lawful order of the fire ground commander during a firefighting operation shall be penalized with
imprisonmentofone(1)daytothirty(30)daysandafineoffivethousandpesos(P5,000.00).
2.Againstthepublicofficer/employee

a)AdministrativeThefollowingactsoromissionsshallrenderthepublicofficer/employeeinchargeoftheenforcementofthisCode,
itsimplementingrulesandregulationandotherpertinentlaws,administrativelyliable,andshallbepunishedbyreprimand,suspension
orremovalinthediscretionofthediscipliningauthority,dependingonthegravityoftheoffenseandwithoutprejudicetotheprovisions
ofotherapplicablelaws:

Sec.12.AppropriationandSourcesofIncome.

(a)Tosupportthemanpower,infrastructureandequipmentneedsofthefireserviceoftheBFP,suchamountasmaybenecessarytoattainthe
objectivesoftheFireCodeshallbeappropriatedandincludedintheannualappropriationoftheBFP.

(b)TopartiallyprovideforthefundingofthefireservicethefollowingtaxesandfeeswhichshallaccruetotheGeneralFundoftheNational
Government,areherebyimposed:

(6)Twopercentum(2%)oftheservicefeesreceivedfromfire,earthquake,andexplosionhazardreinsurancesurveysandpostloss
serviceofinsuranceadjustmentcompaniesdoingbusinessinthePhilippinesdirectlythroughagents.
Sec.13.CollectionofTaxes,FeesandFines.Alltaxes,feesandfinesprovidedinthisCode,shallbecollectedbytheBFP.Provided,Thattwenty
percent(20%)ofsuchcollectionshallbesetasideandretainedforusebythecityormunicipalgovernmentconcerned,whichshallappropriatethesame
exclusivefortheuseoftheoperationandmaintenanceofitslocalfirestation,includingtheconstructionandrepairoffirestation:Provided,further,That
theremainingeighty(80%)shallberemittedtotheNationalTreasuryunderatrustfundassignedforthemodernizationoftheBFP.

"Sec.13A.AssessmentofFireCodeTaxes,FeesandFines.Theassessmentoffirecodetaxes,feesandfinesisvestedupontheBFP.TheBFPshall,
subjecttotheapprovaloftheDILG,prescribetheproceduralrulesforsuchpurpose.

Sec.13B.CollectionandAssessmentofLocalTaxes,FeesandFines.Thecollectionandassessmentoftaxes,feesandfinesasprescribedintheLocal
GovernmentCode,exceptthosecontainedinthisCode,shallbefunctionoftheconcernedlocalgovernmentunits.

Sec.13C.UseofIncomeGeneratedfromtheEnforcementoftheFireCode.TheChief,BFPisauthorized,subjecttotheapprovaloftheSecretaryof
theInteriorandLocalGovernment,tousetheincomegeneratedundertheFireCodeforprocurementoffireprotectionandfirefightinginvestigation,
rescue,paramedics,suppliesandmaterials,andrelatedtechnicalservicesnecessaryforthefireserviceandtheimprovementoffacilitesoftheBureauof
FireProtectionandabatementoffirehazards.

The BFP shall determine the optimal number of equipment, including, but not limited to, fire trucks and fire hydrants, required by every local
governmentunitfortheproperdeliveryoffireprotectionservicesinitsjurisdiction.

Intheprocurementoffirefightingandinvestigationsuppliesandmaterials,theBureauofProductStandardsoftheDepartmentofTradeandIndustry

shall evaluate, determine and certify if the supply to procured conforms to the product standards fixed by the BFP. For this purpose, the BFP shall
submit to the Bureau of Product Standards a detailed set of product standards that must be complied with in the procurement of fire fighting and
investigationsuppliesandmaterialswithinsix(6)monthsfromtheeffectivityofthisact.

Sec.13D.MonitoringtheImplementationoftheFireCodeandtheAmountoftheFeesCollected.TheChief,BFPshall,withinsix(6)monthfrom
theeffectivityofthisCode,submittotheSecretaryoftheInteriorandLocalGovernmentforhis/herapproval,amanagementtoolormechanismthat
wouldensureeffectivemonitoringoftheenforcementoftheFireCodetoincludetheamountofFireCodefeescollected.

Sec.14.Withinsixty(60)daysfromtheeffectivityofthisAct,theSecretaryoftheInteriorandLocalGovernmentshallissuetherulesandregulations
foritseffectiveimplementation.

Sec.15.PresidentialDecreeNo1185isherebyrepealed.Alllaws,presidentialdecrees,lettersofinstructions,executiveorders,rulesandregulations
insofarastheyareinconsistentwiththisAct,areherebyrepealedoramendedasthecasemaybe.

Sec.16.IncaseanyprovisionofthisActoranyportionthereofisdeclaredunconstitutionalbyacompetentcourt,otherprovisionsshallnotbeaffected
thereby.

Sec.17.ThisActshalltakeeffectfifteen(15)daysafteritspublicationintheOfficialGazetteorintwo(2)nationalnewspapersofgeneralcirculation.
