andindependentcontractors.Theterms"you"and"your"refertotheshipper,itsemployees,principalsandagents.IfyourshipmentoriginatesoutsidetheUnitedStates,yourcontractofcarriageiswiththeFedExsubsidiary,branchor
independentcontractorwhooriginallyacceptstheshipmentfromyou.Theterm"package"meansanycontainerorenvelopethatisacceptedbyusfordelivery,includinganysuchitemstenderedbyyouutilizingourautomatedsystems,
meters,manifestsorwaybills.Theterm"shipment"meansallpackageswhicharetenderedtoandacceptedbyusonasingleAirWaybill.AIRCARRIAGENOTICE.Foranyinternationalshipmentsbyair,theWarsawConvention,as
amended,maybeapplicable.TheWarsawConvention,asamended,willthengovernandinmostcaseslimitFedEx'sliabilityforloss,delayof,ordamagetoyourshipment.TheWarsawConvention,asamended,limitsFedEx'sliability.
ForexampleintheU.S.liabilityislimitedto$9.07perpound(20$perkilogram),unlessahighervalueforcarriageisdeclaredasdescribedbelowandyoupayanyapplicablesupplementarycharges.Theinterpretationandoperationof
theWarsawConvention'sliabilitylimitsmayvaryineachcountry.TherearenospecificstoppingplaceswhichareagreedtoandFedExreservestherighttoroutetheshipmentinanywayFedExdeemsappropriate.ROAD
TRANSPORTNOTICE.ShipmentstransportedsolelybyroadtoorfromacountrywhichisapartytotheWarsawConventionortheContractfortheInternationalCarriageofGoodsbyRoad(the"CMR")aresubjecttothetermsand
conditionsoftheCMR,notwithstandinganyotherprovisionofthisAirWaybilltothecontrary.Forthoseshipmentstransportedsolelybyroad,ifaconflictarisesbetweentheprovisionsoftheCMRandthisAirWaybill,thetermsofthe
CMRshallprevail.LIMITATIONOFLIABILITY.IfnotgovernedbytheWarsawConvention,theCMR,orotherinternationaltreaties,laws,othergovernmentregulations,orders,orrequirements,FedEx'smaximumliabilityfordamage,
loss,delay,shortage,misdelivery,nondelivery,misinformationorfailuretoprovideinformationinconnectionwithyourshipmentislimitedbythisAgreementandassetoutinthetermsandconditionsofthecontractofcarriage.Please
refertothecontractofcarriagesetforthintheapplicableFedExServiceGuideoritsequivalenttodeterminethecontractuallimitation.FedExdoesnotprovidecargoliabilityorallriskinsurance,butyoumaypayanadditionalcharge
foreachadditionalU.S.$100(orequivalentlocalcurrencyforthecountryoforigin)ofdeclaredvalueforcarriage.Ifahighervalueforcarriageisdeclaredandtheadditionalchargeispaid,FedEx'smaximumliabilitywillbethelesserof
thedeclaredvalueforcarriageoryouractualdamages.LIABILITIESNOTASSUMED.INANYEVENT,FEDEXWON'TBELIABLEFORANYDAMAGES,WHETHERDIRECT,INDIRECT,INCIDENTAL,SPECIALOR
CONSEQUENTIALINEXCESSOFTHEDECLAREDVALUEFORCARRIAGE(INCLUDINGBUTNOTLIMITEDTOLOSSOFINCOMEORPROFITS)ORTHEACTUALVALUEOFTHESHIPMENT,IFLOWER,WHETHERORNOT
FEDEXHADANYKNOWLEDGETHATSUCHDAMAGESMIGHTBEINCURRED.FedExwon'tbeliableforyouractsoromissions,includingbutnotlimitedtoincorrectdeclarationofcargo,improperorinsufficientpackaging,
securing,markingoraddressingoftheshipment,orfortheactsoromissionsoftherecipientoranyoneelsewithaninterestintheshipmentorviolationsbyanypartyofthetermsofthisagreement.FedExwon'tbeliablefordamage,
loss,delay,shortage,misdelivery,nondelivery,misinformationorfailuretoprovideinformationinconnectionwithshipmentsofcash,currencyorotherprohibiteditemsorininstancesbeyondourcontrol,suchasactsofGod,perilsof
theair,weatherconditions,mechanicaldelays,actsofpublicenemies,war,strike,civilcommotion,oractsoromissionsofpublicauthorities(includingcustomsandhealthofficials)withactualorapparentauthority.NOWARRANTY.We
makenowarranties,expressorimplied.CLAIMSFORLOSS,DAMAGEORDELAY.ALLCLAIMSMUSTBEMADEINWRITINGANDWITHINSTRICTTIMELIMITS.SEEOURTARIFF,APPLICABLEFEDEXSERVICEGUIDE,OR
STANDARDCONDITIONSOFCARRIAGEFORDETAILS.TheWarsawConventionprovidesspecificwrittenclaimsproceduresfordamage,delayornondeliveryofyourshipment.Moreover,theinterpretationandoperationofthe
WarsawConvention'sclaimsprovisionsmayvaryineachcountry.RefertotheConventiontodeterminetheclaimsperiodforyourshipment.Therighttodamagesagainstusshallbeextinguishedunlessanactionisbroughtwithintwo
years,assetforthintheConvention.FedExisnotobligatedtoactonanyclaimuntilalltransportationchargeshavebeenpaid.Theclaimamountmaynotbedeductedfromthetransportationcharges.Iftherecipientacceptsthe
shipmentwithoutnotinganydamageonthedeliveryrecord,FedExwillassumetheshipmentwasdeliveredingoodcondition.Inorderforustoconsideraclaimfordamage,thecontents,originalshippingcartonandpackingmustbe
madeavailabletousforinspection.MANDATORYLAW.InsofarasanyprovisioncontainedorreferredtointhisAirWaybillmaybecontrarytoanyapplicableinternationaltreaties,laws,governmentregulations,ordersorrequirements
suchprovisionsshallremainineffectasapartofouragreementtotheextentthatitisnotoverridden.TheinvalidityorunenforceabilityofanyprovisionsshallnotaffectanyotherpartofthisAirWaybill.Unlessotherwiseindicated,
