TERMS OF REFERENCE

CIVIL WORKS FOR THE IMPROVEMENTS, RENOVATIONS AND


REHABILITATION OF BIR ANNEX BUILDING AND BIR-RR-1 COMPOUND
IN CALASIAO, PANGASINAN
I.

DURATION OF CONTRACT
The contract for the CIVIL WORKS FOR THE IMPROVEMENTS,
RENOVATIONS AND REHABILITATION OF BIR ANNEX BUILDING AND
BIR-RR-1 COMPOUND IN CALASIAO, PANGASINAN shall be within
one hundred forty (140) working days from receipt of Notice to Proceed.

II.

SCOPE OF WORKS
The CONTRACTOR shall cover the CIVIL WORKS FOR THE
IMPROVEMENTS, RENOVATIONS AND REHABILITATION OF BIR
ANNEX BUILDING AND BIR-RR-1 COMPOUND IN CALASIAO,
PANGASINAN which shall include but not limited to the following:
II.1

PRE CONSTRUCTION DOCUMENTATIONS


II.1.1 Secure the necessary documents (permits, clearances, etc.)
including payment of assessed fees as may be required by
the Local Government Unit and/or Regulating Agencies
before the implementation of the project. All related
documents shall be submitted to the Regional Director, RR
No. I.

II.2

DEMOLITION / CLEARING WORKS


II.2.1 Remove existing structures, old walls, fences, debris within
the vicinity of the construction site.
II.2.2 Remove and/or relocate water lines, electrical lines, sewer
pipes, etc. as may be affected in the course of the
construction work.
II.2.3 Turn over all surplus materials if any, to the Administrative
Division, RR-1, Calasiao, Pangasinan.
II.2.4 Hauling and disposal of excavated materials to the area
designated by the Administrative Division, RR-1, Calasiao,
Pangasinan.
Disposal of waste materials, debris and other refuses outside
the BIR-RR-1 compound shall be made only after securing the
necessary clearance/approval of the Chief, Administrative
Division, Revenue Region No. 1.

II.3

EXCAVATION, FILLING & BACKFILLING WORKS

II.3.1 Excavation, earth moving and soil poisoning. Excavations


done for the footings and foundations below required depths
shall be filled with concrete and shall be leveled properly.
All concrete pouring to foundations and footings shall only be
made after an inspection was conducted by the
representative of the Project Proponent and/or by the
Inspection and Acceptance Committee created by the BIR.
II.3.2 Soil filling, leveling and tampering. The floor finish shall be
one (1) meter above the ground level or from the level of the
National Highway whichever is higher.
II.3.3 All formworks shall be removed from concrete pouring
(footings, foundations, walls, etc.) before any backfilling of
soil is done.
II.4

CONSTRUCTION WORKS

The whole improvement, renovation and rehabilitation must conform to


the specifications as provided for in the attached set of building/sketch
plans and estimates which include but not limited to the following:
2.4.1. Relocation of wall partition at Ground floor (Office space at main
building, RDO-4, Assessment Section)
2.4.2 Rehabilitation and improvement of BIR Annex Building (Proposed
Seven (7) Units Guestroom and a function room)
2.4.3 Improvement and renovation of main building (E-lounge, clinic
and restrooms for taxpayers and Persons with Disability (PWD))
2.4.4 Extension of existing storeroom and drainage systems of RDC-L1
2.4.5 Relocation and improvement of existing three (3) unit storage
rooms
2.4.6 Renovation of corridors, tiling works at ground floor (Main
building corridors and sidewalk, Annex building corridor and two
(2) office spaces)
2.4.7 Improvement and renovation of conference room (two (2) unit
restrooms at BIR Annex Building)
2.4.8 Renovation of Annex building (Concrete wall partition at
conference room)
2.4.9 Rehabilitation and renovation of existing basketball court.
2.4.10

Electrical & Telephone System

2.4.10.1 Supply and installation of service entrance, feeder lines,


sub-feeders, lightings, controls protective devices, power
panels, power outlets and conduits. All works shall be in
accordance with the Philippine Electrical Code and
National Safety Code.
2.4.10.2 Supply and installation of a panel boards.
2.4.11

Air-conditioning System
2.4.11.1 Supply and installation of eleven (11) 2.0 HP, split type
Air-conditioning Units.
2.4.11.2 Supply and installation of appropriate supply lines,
conduit works including individual circuit breakers.
2.4.11.3 Supply and installation of necessary mechanical parts
(copper pipes, platforms, steel brackets/supports, rubber
insulations, condensate drains, etc.)

2.4.12

Plumbing & Water System


2.4.12.1 Supply and installation of standard plumbing, water
pipe lines, shut off/open valves, control valves and
accessories as per plan.
2.4.12.2 Supply and installation of toilet water closets,
lavatories, counter tops, controls, fitting, accessories as
per plan.

2.4.13Tile & Masonry


2.4.13.1 Supply and installation of floor tiles, tiling materials for
the toilets, baths, lavatories, and other areas as per
plan.
2.4.14

Doors & Windows


2.4.14.1 Supply and installation of new glass windows and

panels as per plan.


2.4.14.2 Supply and installation of new panel and flush doors at
the main entrance of the 2 nd floor of the Annex building
as per plan.
2.4.14.3 Supply and installation of panel/flush doors as per plan.
2.4.15

Cabinets & Shelves


2.4.15.1 Supply and installation of wall partitions, shelves and
cabinets as per plan.

II.5

WATERPROOFING

II.5.1 Application of waterproofing materials on new concrete surfaces


to avoid seepage.
II.5.2 Application of waterproofing materials for roof and gutters.
II.5.3 Flood check for all waterproofing works.
II.6

PAINTING WORKS

II.6.1 Painting/varnishing of all steel and window fixtures where


applicable .
II.6.2 Painting of interior and exterior wall where applicable.
II.6.3 Treatment of anti-termite/pest control chemicals of all woods
and wooden surfaces whether exposed, concealed or in contact
with concrete and masonry.
Painting and surface finishing shall be interpreted to mean and
include all sealing/filling materials, primers, intermediate and
final coats.
II.7

SAFETY ENCLOSURES

II.7.1 The CONTRACTOR shall provide safety barriers, enclosures,


warning signs and other safety nets at the working area to warn
passersby of the ongoing work to avoid untoward incidents in
the course of the construction works.
II.8

POST CONSTRUCTION CLEARING OF SITE

II.8.1 Cleaning the whole area by removing of spots, excesses and


spillage on adjoining areas and shall leave the entire premises
free from rubbish caused by their work to the satisfaction of the
BIR.
II.8.2 Installation of markers and signages of the building to be
provided by the contractor.
2.9 POST CONSTRUCTION DOCUMENTATIONS
The CONTRACTOR shall submit the following documents to the
BIR within five (5) working days after the completion of the
project:
2.9.1 As Built Plans (Structural, Electrical, Sanitary, etc.) scaled
1:100 meter prepared in four (4) blue prints copies for each
plan. Plans shall be in accordance with the standard Engineering
Plans and Specifications.
As Built Plans shall be duly signed and sealed by the
concerned Engineer with his valid registration/professional

license number, date of registration and current PTR Number


affixed/stamped on every page/sheet of the documents.

III.

SERVICE LEVEL AGREEMENT


BIR shall maintain a Service Level Agreement (SLA) with the
CONTRACTOR, with provisions for liquidated damages for their noncompliance.

WARRANTIES OF THE CONTRACTOR


IV.1
The CONTRACTOR warrants that it shall conform strictly with the
terms and conditions of these Terms of Reference.
IV.2
The CONTRACTOR warrants, represents and undertakes
reliability of the service and that their manpower complements are
hardworking, qualified/reliable and dedicated to the service required to
the satisfaction of the BIR. It shall employ well-behaved and honest
employees with ID displayed conspicuously while working within the
compound. It shall not employ BIR employees to work in any category
whatsoever.
IV.3
The CONTRACTOR shall comply with the laws governing
employees compensation, Philhealth, Social Security and / or labor
standard and other laws, rules and regulations applicable to its

personnel employed by the CONTRACTOR on account of contracted


services. The CONTRACTOR shall pay its personnel not less than the
minimum wage and other benefits mandated by law.
IV.4
The CONTRACTOR in performance of its services shall secure,
maintain at its own expense all registration, licenses or permits
required by National or Local Laws and shall comply with the rules and
regulations and directives of Regulatory Authorities and Commissions.
The CONTRACTOR undertakes to pay all fees or charges payable to any
instrumentality of government or to any other duly constituted
authority relating to the construction.
IV.5
The CONTRACTORs personnel shall take all necessary
precautions for the safety of all persons and properties at or near their
area of work and shall always comply with the standard and
established safety regulations, rules and practices.
IV.6
The CONTRACTOR shall coordinate with any authorized and/or
designated BIR personnel in the performance of their jobs.
IV.7
The CONTRACTOR shall be liable for loss, damage, or injury as
may be due directly through the fault or negligence of its personnel. It
shall assume responsibility thereof and the BIR shall be specifically
released from any liability arising therefrom.
IV.8
The CONTRACTOR shall neither assign, transfer, pledge, nor
subcontract any part or interest therein.
V.

TERMS OF PAYMENT
V.1 The CONTRACTOR shall be paid upon completion of the project subject
to the required Expanded Withholding Tax (EWT) of two percent (2%)
and Final Withholding Tax on VAT of five percent (5%).
V.2 Once a month, the contractor may submit a statement of work
accomplished (SWA) or progress billing and corresponding request for
progress payment for work accomplished. The procuring entitys
representative/project engineer shall check the contractors monthly
SWA and certify the amount to be paid to the contractor as progress
payments.
V.3 Progress payments are subject to retention of ten percent (10%)
referred to as the retention money. The total retention money shall
be due for release upon final acceptance.

V.4 The BIR has the right to deduct from the contractors progress billing
such amount as may be necessary to cover third party liabilities. It
must not process any progress payment unless the discovered defects
are corrected.
V.5 Payment shall be made within reasonable time from submission of the
required documents based on existing BIR issuances.
V.6 The method of payment to be followed shall be the unit price
payments which will be based on the unit prices of specific items as
applied to actual quantities accomplished according to the Statement
of Work Accomplished, and duly certified by the designated field
Project Inspector from the Department of Public Works and Highways.
V.7 Advance payment shall be made as provided in item 39 of the
Procurement of Infrastructure Projects of the Government of the
Republic of the Philippines, 4th Edition, as supplemented by COA
Circular No. 2012-001 dated June 14, 2012 upon compliance with the
conditions stated therein.

VI.

PRE-TERMINATION OF CONTRACT
VI.1
The contract for the CIVIL WORKS FOR THE IMPROVEMENTS,
RENOVATIONS AND REHABILITATION OF BIR ANNEX BUILDING AND BIRRR-1 COMPOUND IN CALASIAO, PANGASINAN may be pre-terminated
by the BIR for any violation of the terms of the contract. In case of pretermination, the CONTRACTOR shall be informed by the BIR fifteen (15)
days prior to such termination.
VI.2
In case of pre-termination, the CONTRACTOR shall be liable to an
additional liquidated damages equivalent to one percent (1%) of the
contract price as provided by the Government Accounting and Auditing
Manual (GAAM) and forfeiture of the performance Security.
VI.3
The BIR shall have the right to blacklist the CONTRACTOR in
case of pre-termination.
