REQUIRED POLICIES AND AGREEMENTS

Assumption of Risk
I am the legal guardian of the child/ren listed above who is/are also listed on the enrollment form for this event or series
of events (Event). I hereby give permission for my child or children to participate in the Event held at Premises. My
child/children are voluntarily participating in the Event. I agree that if I participate in the Event and/or allow my minor child
or children to participate, I do so at my own risk. I expressly assume all risks involved in or arising from my participation
or my child or children's participation in the Event, including without limitation, risk of death, bodily injury, slips, falls,
improper or negligent maintenance, instruction, supervision, or other conduct, property damage, equipment defects,
equipment failure, the unavailability of emergency medical care, loss or theft of personal property, and the negligent or
deliberate acts of other person(s) or equipment failure, the unavailability of emergency medical care, loss or theft of
personal property, and the negligent or deliberate acts of other person(s).

Release of Liability
I agree on behalf of myself, my minor child or children, my spouse, and my dependents, employees, agents, partners,
affiliates, successors and assigns, to RELEASE AND DISCHARGE AND AGREE NOT TO SUE Antony Smith, Tanya Espino,
The Smith Family, The Espino Family, and/or the Premises where lessons are held and their respective spouses,
dependents, directors, officers, employees, agents, partners, affiliates, subsidiaries, franchisees, successors, and
assigns, and each of them, from any and all liabilities, claims, debts, demands, damages, causes of action, controversies,
and rights (accrued, contingent, inchoate, known, unknown or otherwise) whether at law or in equity, which I, or my
successors and assigns, have or may have, jointly or individually, against Antony Smith & Tanya Espino, Premises and
any or all of their respective above mentioned successors, including without limitation, any matter, claim, or cause of
action in connection with or in any way related to the Event.
I hereby waive all protection afforded to my by California Civil Code Section 1542 which states that A GENERAL RELEASE
DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE
TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT
WITH THE DEBTOR.
I acknowledge that I have carefully read this Release of Liability and Assumption of Risk and Policies and I understand
that I am fully releasing Antony Smith, Tanya Espino,The Smith Family, The Espino Family, Premises, and their above
mentioned successors of all liability and that I am waiving my right to bring any legal action against them. This Release of
Liability and Assumption of Risk shall be governed by the laws of the State of California.

Payment and Attendance Policies

Payment is due on Monday for the current week, or on your 1st swimming day of the month if you are enrolled in monthly
classes. Late fees of $20 will be charged if payment is not received by Thursday of that week.
You are paying for your child's time slot regardless of the number of times you are able to attend.
Please place check or cash payments in the poolside binder. If you are paying by cash PLEASE PLACE IT IN AN
ENVELOPE WITH YOUR CHILD'S NAME ON IT so I can credit the proper person for the payment.
Initial registration fees are $50.00 for the 1st and 2nd children, then $25 for the 3rd sibling. Returning registration fee is
$25. All registration and tuition fees (new and returning) are paid to Smith Swim School. There is a $30 fee for returned
checks.
Exact address of lessons will be emailed to you upon completion of registration.
Attendance: if you are unable to make your lesson please call 24 hours ahead. Consistent participation is essential for
your child to progress through lessons. Excessive absences may result in the loss of your time slot.
Promptness: please be on time for your lesson. If you need time to change your child, please arrive early enough to do so
before your lesson time. If you are late, your child's lesson for that day will be the remaining minutes of his/her scheduled
in-water time. There will be no refund or payment adjustments for compromised lesson times.
Weather: unless you receive a call from me for cancellation, assume lessons will continue. If we do not see lightning or
hail or hear thunder, we will still be in the water.

Cancellations: You will be responsible for payment for lessons that YOU cancel, for whatever reason. If we cancel, you
will not be responsible for payment for that day's lesson.

Medical Emergencies
All of Smith Swim Schools Instructors are Red Cross CPR and First Aid Certified. While it is very rare that we will have an
emergency, please be aware that anything can happen at any time, just as it could outside of swim time. In case of
emergency, first aid will be administered to the best of our abilities while we wait for professional emergency personnel to
arrive.

Additional Swim Policies

SWIMWEAR is required if your child is not 100% toilet trained he/she MUST wear a swim diaper, one with snug elastic
around both legs and around the waist. These are available at your local retailer. NO DISPOSABLE DIAPERS!
SUNBLOCK must NOT be applied poolside! Sunblock takes 20-30 minutes to become effective. This means it will start
working when you are on your way home, and it will make your child slippery and difficult to handle in the meantime.
Apply it at home or 30 minutes before lessons.
Please take your trash out with you.
All siblings must stay at parent's side. NO running around the pool deck, playing on the steps, or swimming in the pool.

Media Release
I agree than any pictures or videos taken of my child while in Smith Swim School classes may be used for future Smith
Swim School promotions, including internet/website promotions.
If you do not wish to have your child's photos taken, please include this information when you register and we will not
take photographs or videos of your child.
