1.0 INTRODUCTION
Upstate NY Power Corp (Upstate Power) proposes to construct the Hounsfield Wind Farm
(Project), a wind-powered electric generating facility on Galloo Island in the Town of
Hounsfield, Jefferson County, New York. The project will consist of the installation and
operation of up to 90 wind turbine generators (WTG) for the purpose of generating 268.8
Megawatts (MW) or less of electricity. The project is located in the Lake Ontario Watershed
(USGS Cataloging Unit: 04150200). The location of the project area is depicted in Figure 1.
The proposed project involves unavoidable impacts to State and federally regulated wetlands
and streams, and as a result compensatory mitigation will be required. Permits, including
compensatory mitigation, for work in and around these resources from the New York State
Department of Environmental Conservation (NYSDEC) and the United States Army Corps
of Engineers (USACE) will be required. This document discusses potential mitigation
options available to Upstate Power including use of credits from a mitigation bank, use of
credits from an in-lieu fee program, permittee-responsible compensatory mitigation
developed using a watershed approach, on-site and/or in-kind permittee-responsible
mitigation, and off-site and/or out-of-kind permittee-responsible mitigation. Of the options
discussed herein and at this time, the preferred alternative is on-site wetlands creation (as
shown in Figure 2), while the second involves the use of an in-lieu-fee arrangement with an
approved third party for the purpose of enhancing, restoring, and/or creating wetlands off-
site. This document shows that the mitigation for the anticipated wetland/stream impacts is
feasible.
x Construction of a closed loop geothermal heating and cooling system for a permanent
facility with the closed loop system placed along the Lake Ontario/Galloo Island
Shoreline.
Additionally, the transmission lines, substations, and related facilities will include
construction and operation of an approximately 51.5-mile transmission line (9 miles under
Lake Ontario, 42.5 miles across the mainland), two substations (one on Galloo Island and
one in Parish, New York), together with interconnection facilities and other related facilities.
The submarine portion of the transmission line will consist of a single 230 kV cable that will
be installed using a combination of methods, including water jet blasting and/or hydro-
plowing. It is anticipated that the cable will have three cores and will be buried at a depth of
up to 6 feet. A sea bed survey will be conducted to determine the appropriate methods of
cable installation and cable depth. The cable route has been planned to avoid New York
Department of State designated Significant Coastal Fish and Wildlife Habitats.
This Conceptual Wetlands/Stream Mitigation Plan has been created to address wetland and
stream impacts specific to Galloo Island. The final project mitigation plan will account for
impacts to Galloo Island as well as impacts associated with the transmission line portion of
the project. The proposed project will result in both temporary and permanent impacts to
wetland and stream resources at Galloo Island. The following is an estimate of
wetland/stream impacts based on preliminary design efforts:
1.) Total temporary impacts from ECS underground installation: 0.058 acres
2.) Total PFO tree clearing from ECS (above and underground): 0.694 acres
3.) Total permanent impacts to wetlands and streams (cut/fill): 0.097 acres
a.) Total NYSDEC/USACE wetland permanent impacts: 0.037 acres
b.) Total USACE wetland permanent impacts: 0.039acres
c.) Total USACE stream impact: 0.021 acres
d.) Total Palustrine Forested (PFO) permanent impacts: 0.037 acres
e.) Total Palustrine Scrub/Shrub (PSS) permanent impacts: 0 acres
f.) Total Palustrine Emergent (PEM) permanent impacts: 0.039 acres
4.) Total permanent impacts to NYSDEC 100' buffer (roads, cut/fill): 0.697 acres
5.) Total temporary impacts to NYSDEC 100' buffer (underground ECS): 0.706 acres
6.) Total tree clearing within NYSDEC 100' buffer (overhead ECS): 4.278 acres
The Descriptive Approach recognizes eight functions and five values that are essential for the
representation of wetland resources associated with a proposed project. These 13 functions
and values are presented below:
FLOODFLOW ALTERATION
The ability of the existing wetlands to serve in attenuating floodwaters is limited given the
acreage of upgradient land resources and their proximity to Lake Ontario. However given
the size of the wetlands in relationship to the local watershed, and the high percentage of
upgradient impervious surfaces and presence of overland flow due to exposed bedrock and
shallow soil conditions, the wetlands can be considered to be locally significant in floodflow
alteration.
PRODUCTION EXPORT
The ability of the wetlands to produce food or usable products for humans or other living
organisms is supported by the presence of wildlife food resources and evidence of wildlife
utilizing the wetlands. In addition, the potential for fish and/ or shellfish habitat within
certain portions of Wetlands D, F and Q, and direct outlet of Wetland A to Lake Ontario
serve to further support the rational that these specific wetlands provide the function of
production export.
WILDLIFE HABITAT
Based on the general lack of a significant human presence and development on Galloo
Island, coupled with the sizes, types and characteristics of the wetlands, the wetlands on
Galloo Island can be considered to provide habitat for a variety of resident and migratory
wildlife that are typically associated with wetlands or wetland edge. Wildlife studies for this
project are ongoing and a more detailed list of observed species will be presented along with
the detailed wetland functions and values assessments once the exact wetlands impacts and
locations are known.
UNIQUENESS/ HERITAGE
Based on the sizes, types and characteristics of the wetlands, and their local functional
values, the wetlands present on Galloo Island can be considered to have a level of local
uniqueness.
C&S has initially reviewed several different options for potential wetlands mitigation prior to
choosing the preferred alternatives. These options, presented in general order of regulatory
preference, are further elaborated on below:
There are no approved commercial wetland mitigation banks with geographic service areas
that cover the project location. As such, this mitigation alternative is not feasible.
Further consultation with these respective groups would be needed in order to assess the
applicability of this type of mitigation option for this project. Given that this alternative is
feasible, pending further inquiry, this alternative is one of Upstate Power’s preferred
alternatives.
4.3 PERMITTEE-RESPONSIBLE
ON-SITE MITIGATION
On-site mitigation involves the enhancement, restoration, and/or creation of wetlands in same
general vicinity of the proposed wetland impacts. On-site mitigation can been in the form of
in-kind or out-of-kind mitigation. In-kind mitigation replaces the structure and function of
the impacted wetland, while out-of-kind may replace either structure or function, or neither.
Opportunities for wetland enhancement, restoration, and/or creation are limited within Galloo
Island, as it is dominated by thin soil and shallow bedrock conditions. Due to soil and
bedrock conditions, the potential for wetland mitigation only exists within certain portions of
the island that are not currently wetlands or are forested. On-site mitigation would generally
involve excavation to match elevations of existing adjacent wetlands. Figure 2 provides the
locations of three potential areas suitable to create wetlands based on field reconnaissance.
This mitigation option would likely involve a combination of in-kind and out-of-kind
mitigation. The USACE and NYSDEC typically requires a 2:1 or greater (wetland creation:
wetland impacts) ratio for impacts to palustrine emergent wetlands, and a 4:1 or greater ratio
for impacts to palustrine forested wetlands. Stream impacts would most likely be mitigated
by creating wetlands at a 2:1 ratio as well. The functions and values of the Island’s
wetland/stream resources as described above should not require mitigation ratios that exceed
these.
Given that this alternative is feasible and cost effective, it is one of Upstate Power’s preferred
alternatives.
OFF-SITE MITIGATION
This type of mitigation involves the permittee undertaking the task of enhancing, restoring,
and/or creating wetlands at an off-site location, preferably within the same watershed Off-
site mitigation can also been in the form of in-kind or out-of-kind mitigation.
Given the nature of the project site, this mitigation effort would require the purchasing of
lands on the mainland by the permittee for the purpose of enhancing, restoring, and/or
creating wetlands. Given the need to acquire additional lands, this mitigation option has not
been explored further at this time.
5.0 CONCLUSION
The proposed project involves unavoidable impacts to federally regulated wetlands, and as a
result compensatory wetlands mitigation is proposed. Based on a cursory review of the
functions and values of the wetlands located on Galloo Island, the primary functions of these
wetlands are floodflow alteration, sediment/ toxicant retention, nutrient removal, and wildlife
habitat. C&S has conducted a cursory review of the mitigation options available and
concluded that two alternatives are feasible at this time. The first alternative is on-site
wetlands creation, while the second involves the use of an in-lieu-fee arrangement with an
approved third party for the purpose of enhancing, restoring, and/or creating wetlands off-
site. It is the opinion of C&S that impacts to existing wetlands can be mitigated through
either alternative in a manor that would meet or exceed the functions and values of the
existing wetlands. Since the project is currently within the project planning stage, this plan
has been prepared to show that wetland mitigation is feasible. The actual wetlands
mitigation plan (including location and acreage) used during the permitting process may
vary.
