1operator. He stated Vilhauer is doing all of the excavating at the site, but will not be back active
'until December. Hector Cueva, a superintendent with Vilhauer was contacted and also confirmed
;this information. The area Vilhauer is excavating can be accessed near the intersection of Elam
& Pemberton Hill.

A majority of the sediment on the roads found during the previous inspection had been
removed. Trucks continued to track sediment onto Pemberton Hill Road but was being scraped
up, and a street sweeper was also being used at the time of inspection.
Specialist spoke with the superintendent who stated he would sweep continuously to minimize
the sediment accumulating on public roads from vehicles exiting the site.
NC #8- Additional BMPs are needed at the construction entrance/exit to keep vehicles from
tracking on to Pemberton Hill Road.

'reduce/prevent sediment from being tracked onto Pemberton Hill Road when vehicles leave the
:construction site. NOV
,#9 All of the dirt that lines both sides of the access road must be removed to prevent the dirt
from spilling into the drainage swale and causing a blockage. The sweeper that was used to
sweep the asphalt road merely pushed the dirt to the side and did not remove it. Sediment
controls may also have to be implemented to protect the drainage swale in the future if heavy
!vehicle traffic is allowed to use the road.
;The specialist spoke with the superintendent about implementing best management practices
:(BMPs) at the entrance to the site. He stated he would place rock down to reduce the amount of
'sediment that leaves the site. He also explained that the project is temporarily shutdown and he
would have to gain permission to remove the dirt from the access road.

This site is basically a large sand pit with water in it, surrounded by on-site sand. The site is
bordered by Elam Road to the south, & Texas Horse Park to the north.
The current operator Vilhauer Enterprises LLC indicated they want to terminate their TPDES
construction permit for this site via transfer operational control to another entity. However,
there needs to be a TPDES-permitted entity to transfer operational control to, & currently our
department SWM is not aware of which entity that will be. Whichever entity Vilhauer will
transfer TPDES control to, needs to be a TPDES-permitted entity. TPDES-permitted entity
means that entity needs to have a NOI & SWPPP for this site. Whether that entity to transfer
operational control to will be a department in City of Dallas, or Trinity Forest Golfers, or a
contractor for the City of Dallas, or another other entity, is not known yet by SWM. The City is
reportedly working on deciding which exact entity will be the next primary operator of this site.

The site is a large area of bare disturbed soil surface. Within this site is a large pit with water in
it, surrounded by on-site loose soils. The site is bordered by Elam Road to the south, & Texas
Horse Park to the north.
The site is inactive.
construction permit for this site via transfer operational control to another entity. The delay
thusfar in doing that was finding or determining which other entity(ies) to transfer operational
control to, because this site is not stabilized. Since the last SWM inspection of this site, TWM
decided/determined an entity to transfer TPDH control to. Therefore anticipate SWM will be
performing a termination inspection to terminate Vilhauer regarding this site, via transfer of
operational control of this site to another operator.

The site includes a large pit within it.
Inaccessible at this time: Rain occurred at the overall area of the site during several days &
'nights within the past week, that rain caused many areas around the site to be very soft. To l
see this site from any of the directions at this time would cause either large ruts & tracking of
mud via tires, or would cause tracking of sediment via walking boots. To avoid creating deep
ruts or tracking clay mud via boots, SWM therefore did not reach the site at this time.

The operator Trinity Forest Golfers {TFG) was verbally informed by SWM on 5/6/2016 that
jTFG is required to stabilize this sandy area. That was relaying a ruling from Trinity Watershed
Management to TFG. That same requirement for TFG to stabilize this site was then documented
in SWM's 5/6/2016 report (SWM file# 3829-3) to this operator TFG. That same requirement

1) The operator Trinity Forest Golfers (TFG) was verbally informed by SWM on 5/6/2016 that
TFG is required to stabilize this sandy area. That was relaying a ruling from Trinity Watershed
Management to TFG. That same requirement for TFG to stabilize this site was written to TFG in
that day's SWM 5/6/2016 inspection report (labeled SWM file# 3829-3).
2) Then that same requirement to comply with TPDES was reported to TFG from SWM in each of
the several subsequent SWM inspection's reports of this site (via reports labeled SWM# 3829-4
since this specific sandy site was assigned SWM file number 3829-4).
3) Then last SWM inspection 7 /20/2016 reported that same. That 7/20/2016 report stated:
#19: Overdue to stabilize the site. No visible indication of initiating permanent
stabilization is at the site. The site is inactive loose soils, & the site has been inactive
since longer than 2 months ago. Need to initiate stabilization of this site. Based on
the quantity of warnings already given as referenced above, if significant stabilization
work is not visibly apparent on-site within the next 10 calendar days from
today, an NOV will be issued.
4) During today's inspection, no visible indication of initiating permanent stabilization is on-site .
.Therefore NOV issued at this time for overdue to stabilize the site.

1) This site is TPDES regulated; this site is regulated by the State's TPDES Construction
regulations (TPDES General Permit).
2) On 5/6/2016, SWM relayed to Trinity Forest Golfers (TFG), from Trinity Watershed
Management (TWM)'s upper management, that TFG is required to achieve compliance of this
isite. SWM on 5/6/2016 verbally informed TFG that TFG is required to achieve compliance & .
'achieving TPDES compliance includes required to stabilize this site. That same requirement for ,
TFG to stabilize this site was written to TFG in that day's SWM 5/6/2016 inspection report
(labeled SWM file# 3829-3).
3) Then that same requirement to comply with TPDES was reported to TFG from SWM in each of
the several subsequent SWM inspection's reports of this site (via reports labeled SWM# 3.829-4
since this specific sandy site was assigned SWM file number 3829-4).
