TERMS

OF REFERENCE
FOR A NATIONAL INDIVIDUAL CONSULTANT TO DEVELOP A CITIZEN AGENCY, GRASS-ROOTS
CIVIC EDUCATION CURRICULUM OF THE 2010 CONSTITUTION.

Inuka Kenya Ni Sisi! Ltd, a Civil Society Organization in Kenya, is the umbrella body of the Ni Sisi!
Nationwide Social movement that pursues a peaceful, united, well governed Kenya with equal
economic and social opportunities for all citizens. The nationwide social movement seeks to
unite Kenyans to forge a collective identity to drive transformation in leadership and maisha
(livelihoods). Ni Sisi is connected to a wide variety of grassroots organizations and individuals to
bring positive social change through participation in decision making.

In line with its program work of enhancing public participation in governance, Inuka Kenya Ni
Sisi! Ltd is in the process of coming up with a civic education messaging curriculum; that is
citizen friendly-specifically tailored to empower grass roots populations in the devolved units of
governance that will enhance their ownership of the constitution while sustainably promoting
their agency to act and participate in governance. The overall objective of this project is to
remind citizens of their unstoppable power when they act in concert, and of the bright future
they can build together when they use the constitution as their shield and defender.

Against this backdrop, Inuka Kenya Ni Sisi! Ltd, seeks the services of an experienced Consultant
to design a civic education curriculum of the constitution of Kenya adaptable enough to meet
the training needs of the grassroots population in selected counties within the auspices of the
devolved system of governance. The consultant is to provide leadership and guidance to Inuka
Kenya Ni Sisi! Ltd in identifying and producing a set of concepts and/or texts well-suited to the
education of the Kenyan public about the constitution under a unifying umbrella.

1.0 Introduction and Background

In 2010 the Kenyan people voted overwhelmingly to adopt a new constitution. The referendum
process provided a much-needed opportunity for Kenyans to come together, reaffirm their
commitment to democratic rule, and describe their aspirations and ideals for their collective
society. There was urgency to the undertaking as the country continued to reel from the
deadly and dramatic breakdown of order that accompanied the 2007 elections.

The document that over 80% of the electorate supported reorganized the country in order to
capitalize on the growth of post-independence decades and orient the country for better
competition in global markets as well as robust, invigorated participation in regional and global
political life. The promulgation of the Constitution of Kenya 2010 ushered in changes in how the
state and citizen relate. In particular, with the establishment of the counties, their local
government structures, and the upper house of the legislature, the new framework created
entities that provided more direct structures for citizen driven governance. Further,
participation of people is one of the national values and principles of governance as provided in

Article 10 of the constitution and all state organs and officers are bound to apply it. Every
person has right to freedom of expression including freedom to seek, receive and impart
information and ideas. These constitutional provisions put the citizens at the centre of
government programmes and governance.

The provided structures of governance in the constitution would therefore need significant
support and much in the way of educating both the people and the new office-holders if they
were to function effectively. In the past, civic education anchored towards promoting
constitutionalism and informed citizenry has largely relied on materials that are hard to digest
by the very citizens the interventions have targeted resulting to very little impact at the end. It
is therefore imperative that a comprehensive and citizen-friendly framework for civic education
on constitutionalism is developed and rolled out to remind citizens of their agency and
vigilance.

2.0 Rationale informing the clamor for a refined constitutional curriculum for civic education
After the promulgation of the 2010 constitution, many organizations took on the task of
attempting to simplify the concepts underlying the new constitutions impact on how Kenya
and its communities would be governed. These efforts were largely undertaken independently,
and their outputs were limited to small segments of their programs and population in their
reach often with negligible impact. The accompanying reason behind the stunted impact: little
attention to the content and language used to drive the message of constitutionalism home; to
the average citizen.

The refined curriculum endeavors to learn from these preceding shortcomings; embrace a
digestible content by the average citizen with focus on empowering them to own the
constitution and its principles; awakening and engendering grassroots vibrancy and vigilance in
governance. The ultimate goal of the curriculum thus is to build the capacity of the citizen to
take action in defending their constitutional rights, be able to hold their duty bearers
accountable and seek redress.

3.0 The objectives of the refined curriculum for civic education on constitutionalism
Under the County Government Act 2012, Section 99, the objectives of civic education are as
follows:
I.
Sustained citizens engagement in the implementation of the constitution;
II.
Improved understanding, appreciation and engagement of the public in the
operationalization of the county system of government;
III.
Institutionalizing culture of constitutionalism; knowledge of Kenyas transformed
political system, context and implications;
IV.
Enhanced knowledge and understanding of electoral system and procedures;
V.
Enhanced awareness and mainstreaming of the bills of rights and national values
VI.
Heightened demand by citizens for service delivery by institutions of governance at the
county level;
VII.
Ownership and knowledge on principal economic, social and political issues facing
county administrators and their form, structures and procedures; and
VIII.
Appreciating for the diversity of Kenyas communities as building blocks for national
cohesion and integration

These objectives form the basis of the curriculum; to come up with a framework that is
grassroots-oriented and focused towards bottom-up empowerment.


4.0 Objectives and scope of the assignment
The overall objective of the assignment is to develop civic education framework that is citizen-
friendly and drives the process of developing a common understanding of the constitution in
the devolved governments with enhanced understanding of citizens of their importance to take
part in decision making. From a practical standpoint, the proper text will give the people a
framework for advocating for their issues and engaging governmental institutions; vesting real
power in them.
The scope of the assignment includes:
I.
Review of civic education existing materials that have been produced by Kenyan civic
actors since the promulgation of the 2010 constitution and key stakeholders
undertaking civic education initiatives in the country: Collect, collate and desk review of
the materials with the aim of identifying key challenges, lessons learned in coordinating
and delivering civic education in Kenya within the devolved governance framework and
emerging good practices.
Document local and international best practices; methodologies, designs and guidelines
for a participatory and empowering civic education curriculum in a devolved system of
governance
Propose an institutional framework for coordinating and delivering civic education in the
realm of the devolved system of governance.
II.
Develop an appropriate and feasible text from information gathered above that will
form the foundation and subsequent product of the curriculum;
Provide leadership in understanding the text during the Initial Focus Group Discussion
on the draft curriculum with select citizens [includes creative teams] to test
completeness of the curriculum developed.
Incorporate the views and recommendations from the FDG into the final draft of the
curriculum
III.
Prepare and submit reports to Inuka Kenya Ni Sisi! Ltd on the progress of the assigned
task, key milestones and deliverables.
5.0 Expected outputs
Inception Report detailing the understanding of the task at hand, findings from the desk
review and clear-cutting recommendations to inform the work on the new
constitutional civic education curriculum
A text that will serve as the engine for a cross-cutting continuing education process to
realize the pent up potential of the 2010 constitution; informed by a comprehensive
analysis of:
o Ongoing civic education initiatives.
o Success factors, challenges, threats and opportunities for delivery of a bottom-
up, grassroots tailored civic education on constitutionalism.
o Proposed civic education interventions within the devolved system of
governance.
o Proposed institutional framework for civic education delivery.
FGD Report on the findings, recommendations and quality control framework of the
draft curriculum.

7.0 Duration of the consultancy
This is a short-term consultancy and duration shall be negotiated at the initial meeting or based
on the proposal from the Consultant.

8.0 Qualifications, Skills & Experience
The Consultant selected will have the following expertise:

Education:
I.
At least a degree in public administration, communications, Strategic management,
public policy, business administration or any other relevant social sciences from a
recognized University.
Experience
I.
At least 6 years experience of leading good governance and /or civic education process
in Kenya or within the region. Experience with devolved system civic education
curriculum on constitutionalism from other countries shall be an added advantage.
II.
Familiarity with the Constitution of Kenya 2010;
III.
Good understanding of Kenyas governance and civic education context.
IV.
Good knowledge of mandates of National and County Governments.
V.
At least five years of experience in development, assessment and evaluation of
curriculum, teaching and civic learning resources required.
VI.
Excellent research and documentation skills

9.0 Management of the assignment
The Consultant shall report to the Programs Operations Manager, Inuka Kenya Ni Sisi! Ltd.
he/she will also work closely with the Programs Support Assistant, Inuka Kenya Ni Sisi! Ltd for
provision of technical support, reports and any data required during the consultancy. All
stakeholder workshops will be funded outside the consultants budget. Inuka Kenya Ni Sisi Ltd
will provide the necessary support.
