Facts 1

Beth and Jennifer are both roommates. Beth is a teacher at the University of
Southern Indiana. Jennifer tells one of Beths students that Beth is addicted to
cocaine. That student goes and tells the dean of the university causing Beth to get
fired. Beth is not a cocaine addict. Beth sues for defamation

Answers:
1.) This is Slander.
2.) Saying that Beth is addicted to cocaine is a verbal defamatory statement.
3.) It is false that Beth is addicted to cocaine
4.) Jennifer told Beths student this and it did cause her injury. So the court will
rule in favor of defamation.
Facts 2
Adrienne and Austen both date. Austen has proposed to Adrienne causing
them to be engaged. Pugh, Austens best buddy decides to send Adrienne a letter
telling her that Austen has cheated on her. Austen did cheat on her. Adrienne then
calls off the wedding and Austen then has to tell his family about what happens.
Austen then sues Pugh for defamation.

Answers:

1.) This would be considered Libel but is not valid


2.) Writing that Austen cheated on Adrienne is a true written statement
3.) Although it was a written libel defamatory statement, since this was a true
statement it is not considered a defamatory statement.
Facts 3
Jennifer Aniston and Sushi both date. Jennifer decides to go cheat on Sushi
with Tom Cruise. Sushi gets interviewed by the cast of E News about this whole
situation. On the live show Sushi says I saw it coming once Jennifer got addicted to
heroin. Jennifer is a heroin addict. Sushi had no intention to harm Jennifer Aniston
and her career. Jennifer sues Sushi for defamation?

Answers:
1.) This would be considered Slander
2.) Sushi stating that Jennifer Aniston is addicted to heroin is a verbal
defamatory statement.
3.) Although sushi told the media that Jennifer Aniston indeed is addicted to
cocaine he had no actual Malice behind this statement. Also the statement
made is a true statement.

Facts 4:
Shannon is lifeguarding at the public pool. Shannon gets a phone call from her
husband causing her to argue with him at the pool. During this conversation, a
swimmer, Sara begins to struggle in the deep end of the pool and begins to drown.
Shannon does not hear or see her during her argument with her husband. Sara then

is pulled out of the water by a nearby swimmer. Sara is then taken to the hospital to
take some excess water out of her lungs causing her to rack up high medical bills.
Sara sues Shannon for negligence.
Questions: Will the court likely find negligence? Why or Why not? Are there any
additional principles involved in this question?
Answers:
1.) Shannon had a duty to watch over the swimmers.
2.) Shannon had breached her duty when she answered the phone and
ignored the swimmers at the pool.
3.) Shannon arguing on the phone is the actual cause for Sara being
underwater for too long.
4.) Sara did have large medical bills.
The court will likely find Shannon negligent because all of the elements of
negligence are present.
Fact 5:
Tom and Jerry live two houses down from each other. Jerry leaves his house to go on
a walk and Tom sees him leaving. Tom decides to rob Jerry of his wallet made of
cheese. Tom walked up behind Jerry and hits him with a shovel and takes his wallet,
leaving Jerry on the ground. Jerry sees Tom run into his house with the wallet. Jerry
calls the cops. Is he charged with burglary, robbery, larceny or none of these?
Answers:
1.) The cheese wallet was taken forcefully
2.) The wallet was the property of Jerrys.
3.) Tom had all intentions to permanently deprive Jerry of his wallet. This
would be considered Robbery due to the fact it was taken by force.
