Apartment Rules and Regulations

A. GENERAL
1. This Agreement is an Addendum and incorporated by reference into the Rental
Agreement between Landlord and Resident.
2. Landlord may adopt new rules and regulations or amendments to those rules upon
giving thirty (30) days notice in writing. These rules and any changes or amendments
have a legitimate purpose and are not intended to be arbitrary or work as a substantial
modification of Residents rights. They will be equally enforced. Resident is responsible
for the conduct of all guests and the adherence to these rules and regulations at all
times.
3. Rent payments, whether whole or partial, which are five (1) day delinquent cause
administrative expenses to the Landlord. A LATE PAYMENT FEE OF $50.00 WILL
THEREFORE BE CHARGED ON ALL RENT UNPAID AS OF THE 2TH DAY OF THE
MONTH OF DELINQUENCY. CHECKS RETURNED BY YOUR BANK AS "NOT PAID"
FOR ANY REASON WILL BE SUBJECT TO A $50.00 CHARGE. THE RENT SHALL BE
DECLARED OWING FROM THE DATE FIRST DUE AND ALL LATE CHARGES SHALL
BE ENFORCED. NO EXCEPTIONS WILL BE MADE TO THIS RULE.

B. NOISE AND CONDUCT


1. Residents shall not make or allow any disturbing noises in the unit by Resident,
family or guests, nor permit anything by such persons that will interfere with the rights,
comforts or conveniences of other persons.
2. Profane, obscene or loud language is absolutely prohibited on the Premises. Tenant
obligates himself and those under him, not to do or permit to be done anything that will
annoy, harass, embarrass, discommode or inconvenience any of the other tenants or
occupants in adjoining premises.
3. Resident shall ensure that all musical instruments, television sets, stereos, radios,
etc., are played at a volume which will not disturb other persons or residents.
4. Resident is responsible for the activities and conduct of Resident, occupants of their
unit and their guests, including behavior within their unit, outside of the unit, on the
common grounds, parking areas, or any recreation facilities. The activities and conduct
or Resident and Residents guests shall not annoy or disturb other persons or residents.

5. No lounging, visiting or loud talking that may be disturbing to other Residents will be
allowed in the common areas between the hours of 11:00 p.m. and 7:00 a.m.
6. No person shall congregate, lounge, play, sit or obstruct any entrances, stairs or
porches.
7. No Resident or Resident's guests shall consume alcoholic beverages from the front
porches or common areas.
8. Residents shall be responsible for damage done to seeded areas grass, shrubs and
trees around the building, such as digging, uprooting, trampling, etc.
9. Residents shall not throw or sweep any items or debris from any window or door.
11. The rented premises shall be used and occupied only as a private residence and no
business of any kind shall be conducted from them.
12. ONLY OCCUPANTS LISTED ON THE APPLICATION FOR TENANCY AND LEASE
SHALL OCCUPY THE APARTMENT. ANY DEVIATION FROM THIS SHALL
AUTOMATICALLY TERMINATE THIS LEASE/RENTAL AGREEMENT.

C. CLEANLINESS AND TRASH


1. The unit must be kept clean, sanitary and free from objectionable odors at all times.
2. Residents shall assist management in keeping the outside and common areas clean.
3. Resident shall not permit the littering of papers, cigarette butts or trash in and around
the unit.
4. Resident shall ensure that no trash or other materials are accumulated which will
cause a hazard or be in violation of any health, fire or safety ordinance or regulation.
5. Resident shall ensure that garbage is placed inside the containers provided.
Garbage should not be allowed to accumulate and should be placed in the outside
containers on a daily basis. Items too large to fit in the trash containers should not be
placed adjacent to the containers. Resident shall not dispose of any combustible or
hazardous material in the trash containers or bins. Such items will be deemed to be a
nuisance and must be disposed of properly by the Resident in accordance with State
and local laws.
6. Resident may not leave items in the hallways or other common areas. All furniture
must be kept inside the unit. Unsightly items must be kept out of vision.
7. Clothing, curtains, rugs, etc., shall not be shaken or hung outside of any window,
ledge, or balcony.
8. No car repairs are allowed at the property.
9. No signs, notices or advertisements shall be attached or displayed by tenants on or
about the premises.
10. - Furniture must be kept inside the unit. Any items outside the unit (unless approved
in writing) are subject to removal by Landlord/Manager. Tenant may be charged for the
cost of removal.

Articles are not to be left in the hallways or other common areas.


11. Resident shall keep the window glass clean at all times and shall not cover any
window in any manner which, in the opinion of Landlord, detracts from the appearance
of the apartment building.
12. No alteration that will affect the buildings appearance, such as new window
coverings, shall be permitted without.
13. No foil, signs, advertisements, posters or similar displays, shall be affixed to any
door, window, or exterior wall without Owners prior written approval.
14. Garbage cans, brooms, mops, cardboard boxes and similar articles are to be kept
inside the Residents premises and out of view. Care shall be exercised that such
articles are not stored in such a way as to create a fire or safety hazard.

D. PETS
1. Residents shall have no dogs, cats, or other animals on the premises without written
permission of the Landlord.

E. SAFETY
1. Security is the responsibility of each Resident. Landlord assumes no responsibility or
liability, unless otherwise provided by law, for Residents and guests safety, or for injury
or damage caused by the criminal acts of other persons.
2. Resident shall ensure that all doors are locked during Residents absence.
3. Resident shall ensure that all appliances be turned off before leaving the unit.
4. When leaving for an extended period, resident shall notify Landlord how long
Resident will be away.
5. Prior to any planned absence, Resident shall give Landlord authority to allow entry
into unit to any person or provide Landlord with the name of any person or entity
permitted by Resident to enter unit.
6. Smoking in bed is prohibited.
7. The use or storage of gasoline, cleaning solvent or other combustibles in the unit is
prohibited.
8. The use of charcoal and gas grills are allowed only on ground floor apartments and in
their patio designated area. Open fires are prohibited.
9. Resident shall ensure that no personal belongings, including bicycles, play equipment
or other items, are left in the halls, stairways, or about the building unattended.
10. Resident shall not make any changes in electrical wiring nor overload the electrical
systems nor run any exposed wires for electrical appliances or fixtures in violation of the
building code or any ordinance where said premise is located.

11. No additional or replacement locks of any type will be installed on any door without
the written permission of Landlord.
12. If for any reason you get locked out of your apartment and a property manager has
to open the apartment, there will be a $50.00 charge during regular business hours and
$100.00 for after hours and weekends. If you request a complete lock change, the fee is
$25.00 per lock and $35.00 an hour for labor. After hours, charges will double.
13. INVOLVEMENT IN ANY ILLEGAL DRUG USE OR ACTIVITY WILL BE AUTOMATIC
GROUNDS FOR TERMINATION OF THIS LEASE/RENTAL AGREEMENT. THIS RULE
WILL BE STRICTLY ENFORCED, WITH NO EXCEPTIONS.
14. Resident is advised to obtain his own insurance on personal property and to protect
Tenant from losses due to fire, flood, theft, personal injury or injury to others, or other
casualty.
15. Owner, landlord and manager are not responsible for the delivery, acceptance or
receipt of, damage to or loss of, messages, packages, mail or other material left at
entrances to the Building or elsewhere in the Building.
16. Children on the premises must be supervised by a responsible adult at all times.
17. Candles may not be burned in apartment.
18. Water beds are not permitted.

F. MAINTENANCE, REPAIRS AND ALTERATIONS


1. If the unit is supplied with smoke detection device(s) upon occupancy, it shall be the
responsibility of the Resident to regularly test the detector(s) to ensure that the
device(s) is/are in operable condition. The Resident will inform Landlord immediately, in
writing, of any defect, malfunction or failure of such smoke detector(s). Resident is
responsible to replace smoke detector batteries, if any, as needed unless otherwise
provided by law.
2. Resident shall advise Landlord, in writing, of any items requiring repair (dripping
faucets, light switches, etc.).
Notification should be immediate in an emergency or, for normal problems, within
business hours. Repair requests should be made as soon as the defect is noted.
3. Service requests should be made in writing, addressed and delivered to Landlord,
and not directly to maintenance personnel.
4. Costs of repair or clearance of stoppages in waste pipes or drains, water pipes or
plumbing fixtures caused by Residents negligence or improper usage are the
responsibility of the Resident. Payment for corrective action must be paid immediately
by Resident upon demand by Landlord.
5. Resident shall make no alterations or improvements without the consent of Landlord,
including painting or wallpaper, shelving or flooring. Any article attached to the
woodwork, walls, floors or ceilings shall be the sole responsibility of the Resident.

Resident shall be liable for any repairs necessary during or after residency to restore
premises to the original condition. Glue or tape shall not be used to affix pictures or
decorations.
6. The following items shall not be considered as natural wear and tear to the premises,
but shall be considered as damage to the premises and subsequently the cost of repair
will be deducted from any security deposit.
o A. Holes in walls and woodwork.
o B. Careless care of paint in the apartment.
o C. Spray painting or marking on interior/exterior walls.
o D. Damage to carpeting, utility pipes, wiring, plumbing, light fixtures, or
any other fixture or appurtenances, walls floors or ceilings.
o E. Damage done to seeded area and shrubs around apartment such as
digging, uprooting, trampling, etc...
o F. Water damage caused by overflow of kitchen/bathroom sinks, bathtub,
or by failure to close windows or doors during inclement weather, thereby
exposing interior of apartment to elements.
o G. Broken windows/glass: windows, storm windows, storm doors, etc...
o H. Failure of tenant to leave apartment and appliances clean upon
termination of this lease/rental agreement.
7. Tenant shall restore the original paint colors prior to vacating the Premises. Tenant
shall be responsible for all costs involved in such repainting.
8. Adhesive hangers of any kind are prohibited. Picture hangers employing a small nail
or pin are permitted. However, Tenant is responsible for the cost of any repairs or
painting required as a result of the hanging of pictures or other objects.

H. VEHICLES AND PARKING


1. Resident shall only use assigned parking spaces and shall ensure that their guests
park only in your assigned parking at all times, and will not park in another residents
designated parking space. Vehicles parking in unauthorized areas or in another
residents space may be towed away at the expense of the vehicles owner.
2. Inoperable, abandoned, unregistered vehicles or vehicles leaking fluids are subject to
tow pursuant.
3. All vehicles on the premises must be operational, registered, insured and free from
leaking fluids. There shall be no vehicle repairs or maintenance performed on the
premises.

Residents shall observe all rules and regulations, which may be hereafter set forth by the landlord in
reference to the use of the premises leased/rented here, in addition to these rules and regulations set
forth herein. Landlord reserves the right, at their sole option, to amend or revoke any of these rules or
regulations, in and all such amendments, revocations, or new rules and regulations shall become a part of
this lease/rental agreement as of their effective date. Violation of these rules or regulations, or any part of
them, by the resident will be just cause for the landlord to invoke the remedies enumerated in the
lease/rental agreement in regards to these rules and regulations or to declare a forfeiture of the
lease/rental agreement as in any case of forfeiture. Any notice as to amending or revoking any of these
rules or regulations in whole or in part, or to adopt new ones, shall be effective upon notice of same being
sent to the tenant by the landlord in the form as set forth in this lease/rental agreement for serving of
notices by landlord on tenant, or some may in addition there to, become effective, upon the date same
are posted at or near the place set up for the mail boxes in the apartment building in which the demised
premises are a part.
