TERMS & CONDITIONS
SALES CONTRACT
The sales contract will be valid if an order received from the Customer is confirmed in
writing by the supplier.
PRICES
The Prices mentioned in quotation are ex-our works, Ahmedabad excluding Packing,
Forwarding, Freight, Insurance and all othe taxes applicable.
DELIVERY
2.5 to 3 Months after the date of confirmation at your orders.The delivery period
mentioned is only an indication and subject to dealy due to the cases mentioned under the
head FORCE MAJEURE.
TAXES & DUTIES
All the taxes and duties applicable will be charged extra at the rate of prevalling at the
time of supply is effected.
VALIDITY
Eight weeks from the date of our quotation.
MODE OF PAYMENTS
40% advance at the time of placing the order and 60% against Proforma Invoice before
dispatch.
CANCELLATION OF ORDER
Subsequenty once the order placed will not be cancelled for any reason. In case of the
order being cancelled for any reason or failure from your side to lift the machine after
fifteen days of our intimation the entire amount of the advance will be forefeited.

PROPRIETORY RIGHTS
The supplier reserves his proprietory rights to the goods untill he receives full payment in
connection with this contract.
REPAIRS / ALTERATION
If alteration or repairs have been carried out incorrectely by the customer or third pary
without the suppliers prior consent, no guarantee will be accepted by the supplier for the
resulting consequences. The supplier can refuse to repair the defects so long as the
customer has not fullfilled his commitments.
JURISDICTION
Subject to the Ahmedabad jurisdction (GS) India.
FORCE MAJEURE
All delivery dates shall be subject to delay directly or indirectly casused by or contributed
to in any manner by fires, floods, accidents, riots, war , government interference priorities
or embargoes strikes, shortage of labour, fuel , material or supplier, indequate
transportation facilities or any other cause (whether or not simillar in nature to any of
those heretofore specified) beyond our control. No liability shall attach to us for non
performance or delayed execution of any contract (or any part there of) as a result of any
of the aforesaid causes beyond our control.
LOSS OR DAMAGE IN TRANSIT
The suppliers responsibility ceases on delivering the goods to the carries and the supplier
undertake no liability for any damage or loss in transit whatsoever.
WARRANTY
The machine/equipment offered is covered under warranty for a period of 12 months from
the date of Dispatch. Warranty is for manufacturing defects only and is non applicable in
the case of excessive service condition, natural wear and tear, damages due to negligence
in handling, improper use or operation, inadequate or improper maintenance etc. You shall
not permit semiskilled or unskilled and or unqualified person to effect any operation of the
machine/equipment or any replacement of the parts, maintenance, lubrication, adjustment
or repairs of the machine/ equipment. This warranty does not apply to Electric/
Electronics items, bearing and heaters. We will not replace the complete assembly/
equipment where only a part of assembly/equipment is found to be defective. The
defective part/parts shall be returned to our works. The responsibility or liability of the firm
shall be limited only to replacement or repairing of the defective part/parts free of charge
at our option within the warranty period. No monetary claims of any kind resulting from
defective part/parts or equipments will be entertained by us. In case of already purchased
items, the warranty as provided by the sellers suppliers will be directly passed on to the
buyers. Any tampering with the machine/equipment including obliteration or alteration of
the name plate or any place bearing specifications or serial number shall cancel this
warranty. No guarantee is provided for quality of the product manufactured out of the
attachments supplied with the main Plant.

LIMITATION OF LIABILITY
Not withstanding the breace of such warranty as is contained here in above, the supplier
shall not be liable in any circumstance to any greater extent than herein above specifically
specified and the supplier shall, in no event be liable for any special, indirect
consequental or other loss of damages of any mature whatsever arising output of or
connected with this contract in any buyer or any third party in connection with
replacement adjustment or repair or article of part of the installation operation or
maintence thereof by the supplier. If it is expressly understood that this warrant will be
invalid if the terms of payment agreed are not paid dully and punctually with.
ERECTION
We will send our Engineer for erection of the plant at your place. However customer has
to pay To and Fro Ticket for Engineer along with the Lodging and boarding up to his
complete stay at their place. All Raw material, skilled and unskilled labour required for
erection will have to be provided by the customer. For Commissioning the plant, customer
has to provide necessary supply of water, power, Air Conditions, etc. to the line at his
own expenses.

changes and alteration without notice as modification in designs are being effected
frequently.
