FACTS
Mrs. Inez Moore lives in East Cleveland along with her son, Dale
Moore Sr. and her two grandsons, Dale, Jr., and John Moore, Jr. The
two boys are cousins. John Moore came to live with his
grandmother after his mothers death.
Sometime in 1973, Mrs. Moore received a notice for violating an
ordinance stating that John Moore was an illegal occupant.
Thereafter, Mrs. Moore was criminally charged for failing to remove
him from home. She moved to dismiss claiming that the ordinance
is unconstitutional. However, her motion was overruled and she
was convicted and sentenced to five-day imprisonment and a $25
fine.
ISSUE of the CASE
Whether the ordinance violates the constitutional right of freedom
of personal choice in matters of family.
