Pursuant to the Courts instruction at the hearing on remedies, the United States

provides the following update on the status of the investigation by the Arizona Peace
Officer Standards and Training Board (AZPOST) into CCMO Chief Marshal Jeremiah
H. Darger, Sergeant Samuel E. Johnson, and Officers Hyrum S. Roundy, Daniel N.

25 Musser, Jacob L. Barlow Jr., and Daniel R. Barlow.

As described in the United States Closing Argument Regarding Injunctive Relief,

27 ECF No. 1022, and Attachment C to that filing, ECF No. 1022-3, AZPOST has initiated
28 proceedings to take disciplinary action against the Arizona peace officer certifications of

all of the above-named CCMO officers based on multiple AZPOST rule violations. The
CCMO officers have requested hearings, which have not yet been scheduled, to contest
AZPOSTs findings.
AZPOST has also taken action with respect to the most recently hired CCMO

Officer, Taylor Barlow. The CCMO hired Officer Taylor Barlow after the liability trial in
this case, under new hiring procedures, and with the help of Defendants police practices
consultant, Dan Corsentino. See J. Darger Hrg Tr. at 688-89, 693-94; D. Corsentino Hrg

7 Tr. at 619-21. In December 2016, AZPOST determined that it would not certify CCMO
8 Officer Taylor Barlow as an Arizona peace officer based on AZPOSTs determination that
9 he did not meet minimum qualifications. See Attach. A, Decl. of Mark K. Perkovich.
