SECTION 1. SHORT TITLE.

This Act may be cited as the Drain the Swamp Act

5 of 2017.

SEC. 2. RELOCATION OF AGENCY HEADQUARTERS.

(a) REPEAL

QUIREMENT.Section

72 of title 4, United States Code,

4 is repealed.

(b) HEADQUARTERS RELOCATION PLAN.

(1) IN

later than September

30, 2018, the head of each executive agency shall

develop and submit to Congress a plan for the relo-

cation of the headquarters of that agency outside of

the Washington metropolitan area.

(2) REQUIREMENTS.The plan described in


paragraph (1) shall

13

(A) identify a location for a new head-

14

quarters outside of the Washington metropoli-

15

tan area;

16

(B) maximize any potential cost savings

17

associated with the relocation;

18

(C) provide that, upon implementation of

19

the plan, no more than 10 percent of the em-

20

ployees of the agency are based in the Wash-

21

ington metropolitan area; and

22

(D) consider any potential national secu-

23

rity implications of the relocation.

(3) CERTIFICATION.Prior to the submission

25

of a plan under paragraph (1), the Director of the

26

Office of Management and Budget and the Adminis-

trator of General Services shall certify the compli-

ance of the plan with the provisions of this section

if the plan meets the requirements described in

paragraph (2).

(4) IMPLEMENTATION.Not later than Sep-

tember 30, 2023, the head of each executive agency

shall implement the plan for such agency submitted

under paragraph (1).

(c) DEFINITIONS.For purposes of this section:

(1) EXECUTIVE

term executive

agency has the meaning given the term Executive

agency in section 105 of title 5, United States

13

Code, except that the term does not include the Ex-

14

ecutive Office of the President.

(2) WASHINGTON

METROPOLITAN AREA.The

16

term Washington metropolitan area means the ge-

17

ographic area located within the boundaries of

18

(A) the District of Columbia;

19

(B) Montgomery and Prince Georges

20

Counties in the State of Maryland; and

21

(C)

Arlington,

Fairfax,

Loudon,

and

22

Prince William Counties and the City of Alex-

23

andria in the Commonwealth of Virginia.
