MOTION TO RESET THE CONDUCT OF PRELIMINARY

INVESTIGATION
AND MOTION TO ISSUE SUBPOENA
COMES NOW, Complainant and to this Honorable Office of the
Provincial Prosecutor most respectfully states:
1. That the above-entitled case was set for preliminary investigation
on November 11, 2016 at 8:30 oclock in the morning;
2. That, unfortunately, on the same date, the undersigned failed to
appear before this Honorable Office on the ground that he was not able to
receive the subpoena on his given address at Bgy. Tipacla, Ajuy, Iloilo;
3. That considering the abovesaid circumstance undersigned is
compelled to request for the resetting of the preliminary investigation on
February 7, 2017 at 8:30 oclock in the morning;

4. That the undersigned is requesting this Honorable Office to issue

subpoena for himself through the office of Ilarde Penetrante and
Associates, Ground Flr., Lucky Plaza Building, Burgos St., Lapaz,
Iloilo City and to issue subpoena to ERNIE NACIONAL, respondent at his
given address at Bgy. Poblacion, Ajuy, Iloilo;
5. That this motion is filed without intention of delaying the
proceedings of this preliminary investigation but for sole reason aforecited.
WHEREFORE, premises considered it is respectfully prayed that the
preliminary investigation previously set on November 11, 2016 at 8:30
oclock in the morning and the same be reset on February 7, 2017 at 8:30
oclock in the morning and to issue subpoena to the undersigned and
respondent.
