REGULATION OF THE METROPOLITAN TRANSIT

Mr. Enrique Pena Nieto, Governor of the STATE OF MEXICO, IN exercise of the powe
rs conferred upon me by Article 77 FRACTIONS II, IV, XXVIII, XXXVIII XLII OF THE
CONSTITUTION AND POLICY OF THE FREE AND SOVEREIGN STATE OF MEXICO AND THE PROVI
SIONS IN BACKGROUND by Articles 2, 7 AND 8 OF THE ORGANIC LAW OF THE PUBLIC THE
STATE OF MEXICO, AND
WHEREAS
That arising from social transformation of our time, is necessary for the Govern
ment as a component of State, to promote public policies that guarantee adequate
development of the population.
That the State Development Plan of Mexico, published in the Government Gazette d
ated March 2, 2006, sums up the hopes and aspirations of society, as it is the g
uiding document for public policies to be implemented in the current administrat
ion .
That the Development Plan 2005-2011 State of Mexico, states that each State of M
exico must have Comprehensive Security, ie that it must ensure Social Security,
Economic and, in particular, Public.
It is imperative to promote regional projects to facilitate the amount of effort
s and promote greater intergovernmental coordination by the creation and operati
on of programs.

That should encourage the creation and renewal of agreements or contracts with t
he states that border the state of Mexico, for the approval of policies, methods
and actions at all three levels of government.
That the State of Mexico, leading to modernize the legal framework in Mexico, to
gether with the Federal District, by "Government Gazette" dated January 23, 2006
, issued the Declaration of the Metropolitan Area of Mexico as an instrument of
unification,
conceptualization, integration of plans, programs, actions and coordinated joint
attention and common benefit issues in the metropolitan area.
That within the 59 municipalities of Mexico State and 16 delegations of the Fede
ral District that make up the Metropolitan Area of Mexico, is embodied a social
reality in which both the customs and economic activities, political and cultura
l, are similar.
That the Metropolitan Area of Mexico, it is necessary to unify the regulation of
transit, since both the inhabitants of 59 neighboring municipalities, such as t
he 16 delegations of the Federal District, without forgetting those who are move
d by that territory, they face the problem of crossing a federal entity to anoth
er, their obligations in terms of transit and, where appropriate, the penalty fo
r change, leading to ignorance, confusion and ambiguity ruled by the demerit the
principle of legal certainty.

compulsory
for
the
Government
of
State
create
mechanisms
facilitate inter-agency coordination between the municipalities comprising the M
etropolitan Area of Mexico and the Federal District Government, which address ti
mely and effective large metropolitan problems.
That one of the ways to create mechanisms to modernize the agency and establish
a special traffic regulations of the Metropolitan Area of Mexico, both the State
of Mexico, as the Federal District, to prevail in these offenses the same for t
he same conduct.
In virtue of the foregoing, I hereby issue the following:
METROPOLITAN TRANSIT REGULATION CHAPTER I GENERAL PROVISIONS
Article 1 This Regulation aims to establish the rules for state and municipal tr
ansit vehicles and road safety of children, elderly people, people with disabili
ties and pedestrians in general, primary roads and local communication ,, locate
d at the neighboring municipalities of Mexico State. This regulation applies in
the suburbs to the Valley of Mexico in the materials that it regulates. The Stat
e Transit Regulation, regulates the provisions of this ordinance is not necessar
y in general. Article 2 The scope of its powers and jurisdictions are competent
authorities for the implementation of this Regulation the following:

I. The General Secretariat of Government, through the State Security Agency and
II. The councils, through the Department of Public Safety and Municipal Transit.

lace where two or more roads; VII. Deposit: Physical Space authorized by the Dep
artment of Transport in the area where the offense for which the arrest or vehic
le insurance, is the act by which a vehicle is entrusted for safekeeping and cus
tody, for it is under warranty or available to the competent authority; VIII. Mi
nimum Wage Days: Minimum Wage General Journal in the geographical area in which
a violation occurs, in accordance with the provisions of the National Minimum Wa
ge; IX. Directorate, The Directorate of Public Safety and Municipal Transit or s
imilar approved by the City Council; X. Violation: Conduct which violates any pr

and generally any area of public domain and common usage, that disposal of the
authorities or because the service is intended for transit of persons, vehicles
or goods.

CHAPTER II GENERAL RULES OF MOVEMENT Article 5 The driver must: I. Porting exist
ing license or permit; II. Carry the original registration certificate or legal
document that authorizes the vehicle; III. Obey the stop sign at a traffic light

roads, according to the following: a) In case of no signaling in primary routes

The violation of the prohibitions set forth in this Article shall be punished ba

Article 13 on public roads is prohibited: I. Repairs to vehicles, except local r

The Agency and local councils in their respective territorial jurisdiction, can

Article 16 Motor vehicles can only move in: I. License plates or temporary permi
ts in force or if the certified copy of the complaint of the loss to the Deputy

the visibility or registration; c) Match permanent decal circulation, the circu

Article 17 cars that have adapted coupling devices for pulling trailers, must ha

Failure to comply with the obligations outlined in this article, is punishable b

Article 18 You may not install or use in private vehicles: I. Elements of the sa
me or similar identification to the public transport of passengers enrolled in t
he state, emergency vehicles or patrols; II. Devices similar to those used by po
lice or emergency vehicles; III. Headlights of a different color than white or a
mber; IV. Dazzling headlights jeopardize the safety of drivers or pedestrians, V
. Neon lights around license plates; VI. Unauthorized advertising; VII. Projecti
on screen TV or any kind of images on the inside front of the vehicle VIII. Tint
ed glass, obscured or attachments which obstruct the visibility of the driver or
the vehicle interior, except when they come factory installed,€according to the
norms issued by the appropriate federal authority, or when required for medical
reasons, duly accredited by the Ministry of Transportation and any of these cir
cumstances should be reported on the circulation card. The violation of the proh
ibitions set forth in this Article shall be punished according to the following

Article 19 can only travel on counterflow lanes or vehicles for the provision of
emergency medical services, the civil protection assistance in providing emerge

, should be reprimanded verbally-oriented agents to act in accordance with the p
rovisions of the applicable provisions. Article 21 The relevant authorities shou
ld take appropriate measures to ensure the physical integrity and the safe passa
ge of pedestrians on the sidewalk. Also, take the necessary action to ensure tha
t sidewalks are free of obstacles to pedestrian traffic and the movement of peop
le with disabilities.

CHAPTER IV OF THE PROTECTION OF SCHOOLS Article 22 Schools can have road safety
volunteer promoters, who must be authorized and supervised by the Agency and the
Department, after complying with the requirements and training courses establis
hed for that purpose. Article 23 drivers are required to: I. Reduce the speed of
your vehicle and take appropriate precautions when they encounter a school bus
stopped on the road, performing up and down maneuvers of school, and II. Obey si
gns and indications of protection agents, support staff or the promoters road ro
ad safety volunteers. Failure to comply with the obligations provided in this Ar
ticle shall be punished based on the following table: Fraction I and II fined th

Article 24 Schools must have special places for school transportation vehicles m
ade the ascent and descent of the students, without affecting or impeding the mo
vement on public roads. These locations should be located in the vicinity of pro
posed sites to schools and after approval by the Secretary of Transportation, en
suring the safety of schoolchildren. Article 25 The drivers of school transport
vehicles are stopped on the street for maneuvering up and down, must operate fla
shing warning lights. It is the responsibility of the driver of the school trans
port vehicle to take precautions to make the ascent and descent maneuvers of sch
ool safely.

CHAPTER V OF THE MOVEMENT OF PUBLIC PASSENGER TRANSPORT Article 26 The drivers o
f vehicles and equipment earmarked for the public transport service have the fol

Article 27 is prohibited for drivers of passenger vehicles group: I. Circular: a
) For the central lanes of the primary road network and access controlled by the
second side of the tracks, except to use it to pass, and b) The primary routes
in the second lane, except to use it to pass if no movement is prevented. c) Cir
cular confined outside the rails, where they exist, except when they are prevent
ed from doing so by reason of construction or maintenance thereof. d) Driving wi
thout identifying the elements required by the state government of Mexico. II. P
assing another by the counterflow lane main roads unless the vehicle is stopped
for any breakdown. In this case, the driver must exceed cautiously with headligh
ts on and turn signals working; III. Maneuvers of ascent or descent of passenger
s on the second or third lane of traffic, numbered from right to left; IV. Wear
tinted windows obscured or attachments or objects other than the decals regulati
ons, V. Carry objects that obstruct visibility or distract the driver; VI. Insta
ll or use televisions or projection screens of any image on the front of the veh
icle; VII. The immoderate use of radios, tape recorders and audio equipment in g
eneral; VIII. Installing or using dazzling lights that could jeopardize the safe
ty of drivers or pedestrians, as well as neon lights around license plates; IX.
Fueling taking passengers on board, and X. Provide public transportation service
without concession, authorization or permit, in which case proceed in accordanc
e with Article 43 of these Regulations. Failure to comply with the provisions of
this Article shall be punished based on the following table: Fraction I, II, IV

CHAPTER VI OF THE MOVEMENT OF FREIGHT TRANSPORTATION AND TOXIC SUBSTANCES AND HA
ZARDOUS Article 28 freight vehicles can not move: I. For middle lanes and II. Wh

from the Secretary of Transportation; b) Stand out from the back by over a meter
and do not wear red or reflective flags indicating danger; c) obstruct the driv

Article 29 The drivers of freight vehicles should: I. Riding on the extreme righ
t lane and use the left only for passing or turning left; II. Subject to the sch
edules and roads established by notice from the Agency and local councils in the

lace of confinement. IV. Driving without throwing objects or substances that blo
ck shedding traffic or endanger the physical integrity of persons V. Driving lic

Article 30 In addition to the obligations contained in the preceding article, dr
ivers of vehicles carrying toxic or hazardous substances must: I. Strictly subje
ct to the routes and loading and unloading schedules authorized by the Secretary
of Transportation and II. Abstain from stops that are not identified in the ope
ration of the service.€In case of traffic congestion to stop the movement, the d
river should apply to staff priority to continue their march, showing the docume
ntation that covers the risk carrying on the product. Failure of any of the obli

Article 31 prohibits drivers of vehicles carrying toxic or hazardous substances:
I. Taking on board people outside its operation; II. Throwing to the ground or
the roads unnecessarily download any toxic or hazardous substances; III. Park ve
hicles on public roads or near a source of risk, regardless of compliance with t
he conditions and restrictions imposed by federal authorities on environmental a
nd transportation, and IV. Maneuvering for loading and unloading in unsafe place
s, and not intended to do so. 23

Article 32 When an emergency circumstance be required to park the vehicle carryi
ng toxic or hazardous substances on public roads or other source of risk, the dr
iver must ensure that cargo is properly protected and clearly marked in order to
prevent outsiders to handle the transportation equipment or load. When this hap
pen at night, the driver must place warning triangles in both the front and rear
of the unit, at a distance that allows other drivers to take the necessary prec
autions.
Failure to comply with the obligation imposed in this Article, is punished based

CHAPTER VII OF THE MOVEMENT OF BICYCLES AND MOTORCYCLES. Article 33 The drivers
of bicycles and motorcycles have the following duties: I. Respect traffic signal

Carry on board only the number of people for which there is a seat available; I
V. Wearing a helmet. Accompanying persons should also wear, V. Use of a single t

t forth in this Article by motorcyclists, is punished based on the following tab

Article 34 prohibits drivers of bicycles and motorcycles: I. Circular by the cen
tral or inner lanes of the primary routes and where so indicated in the marking
of the access roads controlled, except by notice published in the Official Newsp
aper "Government Gazette", the Secretariat, the Agency and local councils determ
ined hours and days allowed in these roads; II. Circular between lanes; III. Cir
cular two or more such vehicles in parallel position within a lane; IV. Carrying
a passenger somewhere between the person driving and the handlebars of the moto
rcycle V. In case of motorcycles carry passengers under 12 years of age; VI. Han
ging or fastening to other moving vehicles; VII. Travel on sidewalks and areas r
eserved for the exclusive use of pedestrians, and VIII. You can not carry a load
that prevents keep both hands on the handlebars, and a proper control of the ve
hicle or its necessary stability.

Cyclists who do not meet the obligations outlined, will be verbally reprimanded

Article 35 The non-mechanically propelled vehicles authorized by the Secretary o
f Transportation,€only be driven on roads and in compliance with the approved te
chnical standard issued for that purpose.
CHAPTER VIII OF THE DRIVING UNDER THE EFFECTS OF ALCOHOL AND NARCOTICS Article 3
6 No person may drive on public roads, if you have a quantity of blood alcohol e
xceeding 0.8 grams per liter or alcohol in expired air over 0.4 milligrams per l
iter or under the influence of narcotics. Operators of vehicles for passenger se
rvice, freight or transport of toxic or dangerous substances should not show any
amount of alcohol in blood or in expired air or breath alcohol simple symptoms
or be under the effects of narcotics. Failure to comply with this obligation res
ults in the suspension of the license for three years.

Article 37 All drivers who are found committing acts that violate the provisions
of this Regulation and show signs of driving while intoxicated, will be present
ed to the judge called or Municipal Authority competent for the case be under in
fluence of narcotics, are obliged to submit to testing for the degree of intoxic
ation by the competent Public Prosecutor's doctor. Agents can stop the march of
a vehicle when the Agency and local councils through the Department establish an
d implement preventive programs and control of intake of alcohol or narcotics, f
or drivers of vehicles. These programs must be published in the Official Newspap
er "of the Government Gazette and in two of the major newspapers in the state. A
rticle 38 When the agents have alcohol detection devices or narcotics, should pr
oceed as follows: I. Drivers should be tested to detect the degree of intoxicati
on established by the Agency and local councils II. The agent must submit a copy
of the receipt of test results to the driver immediately to implement them; III
. If the driver exceeded the permissible limit of alcohol in the blood should be
sent to the competent Public Prosecutor, and IV. The agent must submit a copy o
f the receipt of test results to the Public Ministry to which the driver is pres
ented, a document which constitutes proof of the amount of alcohol or narcotics
were found and provides the basis for the opinion of forensic experts to determi
ne recovery time may also have to give immediate notice to the Secretary of Tran
sportation to proceed with the cancellation of driver's license under the terms
of the Code. If present, the operator will be forwarded to the Institute of Expe
rt Services of the Attorney General of the State of Mexico, the Social Security
Institute of Mexico State and Municipalities, Ministry of Health of the State of
Mexico or any other Medical Institution Official so that the assistance of the
Agency determines the consumption of alcohol and / or substances referred to, su
bject to necessary sanctions, they shall immediately notify the Secretary of Tra
nsportation to proceed with the suspension of driver's license.

CHAPTER IX OF TRAFFIC ACCIDENTS AND LIABILITY ARISING Article 39 Any vehicle use
d in primary and local roads situated in the suburbs, you must have insurance po
licy in force liability, that covers, at least, responsibility against civil lia
bility when their people in terms of the law of public service vehicles carried
in addition must necessarily need travel insurance. Vehicles of public transport
service must have a current liability insurance. Article 40 If, as a result of
a traffic accident is causing damage to property owned by Public Service of the
State of Mexico or the Municipal Civil those involved are liable to pay the same
regardless of what other legal setting. When the cause of the accident is the l
ack of maintenance of roads, inadequate signage or any other cause attributable
to the authorities of Public Administration of the State of Mexico, those involv
ed are not responsible for any damage caused and may make complaint appropriate
authority for it, through agencies, or agencies and relevant legal procedures, r
epair damage to his person and / or its heritage. If in the traffic of vehicles
are causing damage to property of the Federation, the authorities of the State o
f Mexico or the municipalities,€must give notice to the competent federal author
ities, in order to proceed in accordance with applicable laws. Article 41 Where
an accident has only material damage to private property and those involved are
in agreement on how to repair them, no agent can refer them to the authorities.
The agent should only fill the ballot noting the lack of punishment that caused
the accident.

If the parties disagree on how to repair the damage, should be referred to the a
ppropriate authorities. The exception does not operate if any of the drivers und
er the influence of alcohol or narcotics. However, vehicles must leave the area
so as not to obstruct traffic.
Article 42 The drivers of vehicles involved in a traffic accident which causes s
evere injury or death of any person, provided they are in physical conditions th
at do not require immediate medical attention, should proceed as follows: I. Sta
y on the scene to provide or facilitate assistance to the injured person, trying
to give notice to the competent authority and emergency services, to take posse
ssion of the facts and act accordingly; II. Move or moving the injured from the
place where they are, only where there is no immediate medical care, and if it d
oes not represent a danger or you may worsen your health condition; III. In case
of death, the body and or vehicles should not be removed from the crash site un
til the competent authority so determines; IV. Put away the signs that are requi
red to avoid another possible accident, and V. Remove or accident vehicles to cl
ear the track, once the competent authorities so determine.
CHAPTER X OF THE DUTIES OF AGENTS
Article 43 The penalties on transit forth in these regulations and other legal p
rovisions should be imposed by the agent who has knowledge of its commission, an
d entered on the parking tickets would be approved by the Agency and local counc
ils, which for contain valid:

I. Legal basis: a) Articles that provide for the infringement of the Code or thi
s Regulation, and b) Articles which set the sanction of the Code or these Regula
tions. II. Motivation: a) Date, time, location and brief description of the offe
nding conduct; b) Name and address of the offender, except that is not present o
r not provided them; c) number plates, and if so, permit number of vehicle to mo
ve, and d) Where applicable, number and type of license or driving license. III.
Name, badge number, assignment and signed by the official imposing the sanction
. The Agency and local councils must contribute to the Secretary of Transportati
on for the enforcement of penalties for noncompliance with the provisions of the
matter, when there is flagrant. Article 44 When drivers infringe the provisions
of this Regulation and other applicable provisions, officers should proceed as
follows: I. Indicate to the driver to stop the progress of your vehicle; II. Be
identified with your name and badge number; III. They will point to the driver w
ho committed the offense, showing the article of this Regulation for doing so, a
nd the appropriate penalty for the offense, and IV. Request the driver's license
and the registration certificate, documents to be submitted for review, and ret
urned in the same place immediately after that had been revised, unless a violat
ion has been committed to the regulations, a document may be withheld of these o
r license plate, to ensure payment of the fine, V. For vehicles of public transp
ort service, in its various forms require documentation attesting be authorized
to perform this service. Once the review of documents and the situation in which
the vehicle stands, if in order, the officer must proceed to fill the ballot of
a penalty, from which extend a copy to the applicant. If there are irregulariti
es the agent must submit the vehicle to the bond under this Regulation.

Article 45 In the case of violations of this regulation captured by technologica
l tools, the offense must be notified to the vehicle owner, or whoever, if any,
is jointly liable for the infringement.
CHAPTER XI OF THE PENALTIES Article 46 The fines can be made in: I.€Offices of t
he Ministry of Finance or the Treasury municipalities, depending on the authorit
y which imposed; II. Centers licensed for the purpose, or III. With the actor wh
o won an infringement if it has the necessary technology. The offender has a per
iod of thirty calendar days from the date of issuance of the invoice for payment
penalty, it does not cover the fines established by this regulation within sixt
y calendar days of being imposed , increase the accessories you apply under the
Financial Code of the entity, the expiry of that period without the payment is m
ade, it must cover other tax credits provided for in Financial Code of the entit
y. The infringer to pay the fine within five working days, is entitled to a disc
ount of 50%. Article 47 Without prejudice to the penalties that apply, motorists
who commit an infringement of the rules of this regulation may lead to the defi
nition of a crime, should be made available to prosecutors by officers correspon
ding with knowledge of the case, to resolve it according to law. In the case of
minors, the agent or the Public Prosecutor who has knowledge of the case, you sh
ould call the parents or guardians of minors to the effect that, subject to refe
rral made in accordance with the Law of Justice State Teen Mexico, where appropr
iate, take the necessary steps to cover the liability is incurred.

Article 48 Without prejudice to the penalties provided for in this Regulation, t
he Agency or the Department must provide a copy of the violation to the Secretar
y of Transportation, to impose the appropriate sentence to mention the Eighth Bo
ok of the Code, a person who allows or carries out the interference or impact on
the road or safe passage of pedestrians, or who allows or carries out the reduc
tion of road capacity, during the installation, modification, replacement or mai
ntenance of the constituent elements of an ad and not exhibit at that time the d
ocumentation authorizing them to perform such work. Without prejudice to the Eig
hth Book of the Code, driver's licenses expire by accumulating twelve points pen
alty. The Department of Transport should make the calculation of penalty points
based on copies of parking tickets issued by the Agency. Penalty points are accu
mulated as follows: I. Six points for breach of this Regulation, Articles 5 frac
tion V, 6 fractions I, II, X, 13 fractions V and VI, II. Three points for violat
ing Articles 5 and 6 fraction fraction III XIII; III. One point for infringing o
n any item other than those specified in the two preceding sections. When a tick
et is canceled, the points are deducted based on copies of the respective judici
al or administrative decision. The accumulation of points does not relieve the l
icensee to comply with the sanction that corresponds to the offense. The dispatc
h of a license that expires on penalty comes after three years. Penalty points a
re valid for one year from the date of issuance of the ticket penalty. Article 4
9 Where appropriate referral to the tank vehicle, and before it has begun the pr

Remission should be the vehicle to the tank even when the driver on board. If yo
u are ostensibly person under 16 years, over 65 or disabled, except those who pr
ove to have the permit issued by the Secretary of Transportation, the agent must
raise the appropriate offense and wait until I get the driver or person respons
ible, to proceed immediately to refer the vehicle to the tank. For such vehicles
to the provision of public tranport, in whatever form, submit the documentation
with which proves to be authorized to provide that service. If the driver or th
e person responsible objects to the transfer of the vehicle and refuses to leave
it, should be made available to the competent Public Prosecutor scene in terms
of Article 117 of the Penal Code of the State of Mexico. The officers have order
ed take out reference to the deposit, they must immediately report, via electron
ic means at their disposal,€control center for data warehouse which was sent, ve
hicle type and registration and the location of which was removed. The Agency an
d the Department can assist third parties to the transfer of vehicles to deposit
their own or third party. To return the vehicle in storage, it is essential ver
ification of their legal ownership or possession, the prior payment of the fines
due and rights which they derive, display driver's license, a copy of it and ca
rry the car keys . Also, the test is non-existence of credit for the concept of
Tax Possession or Use of Vehicles and services charges of vehicular control, the
fiscal year preceding the return of the vehicle.
Article 50 vehicles carrying perishable, hazardous or toxic substances, can not
be forwarded to the deposit for violation of the provisions of this Regulation.
In any case, the agent must fill out the citation for allowing the vehicle to co
ntinue their march.

CHAPTER XII THE MEANS OF CHALLENGE AND SPECIAL DEFENSE AGAINST ACTS OF AUTHORITY
Article 51 The individuals affected by the acts and decisions of the authoritie
s, may bring an administrative appeal or grievance administrative trial before t
he Court of Administrative Litigation State, in accordance with the Code of Admi
nistrative Procedures of the State of Mexico. In the case of fines, the proceedi
ngs of grievance or administrative proceeding suspends the said period. Article
52 An official who violate the provisions in this regulation or pursuant to that
sent a vehicle to deposit without cause, they be punished accordingly. Individu
als can appeal to the Deputy Public Bodies Discipline or the Agency or the munic
ipalities, to report suspected illegal acts of an agent.
TRANSITIONAL FIRST .- This Regulation shall enter into force thirty days after p
ublication in the Official Journal Gazette of the Government. " SECOND .- The Ge
neral Secretariat of Government, Transportation and municipalities, will provide
what is necessary for the proper implementation of this Regulation Metropolitan
Transit in the field of competence. THIRD .- administrative provisions are repe
aled in the same or lower rank that are contrary to this Regulation Metropolitan
